Ask The Elder Law and Estate Planning Attorney Leaving Assets Outright to Beneficiaries is a Common Mistake By: Robert J. Kurre, Esq. The Question: I have heard different things about how I should leave my estate to my family. Should I provide in my Will that my children receive my estate as long as they are at least 21? Is it better to leave it to them in a trust even if they are older than 21 when I die?

The Strategy: Because we live in a litigious society where divorce and lawsuits are common, your estate plan should be designed to protect your ben- eficiaries so their inheritances will not be lost. Leaving assets outright to benefi- ciaries upon reaching age 21 or even in staggered distributions (e.g., at ages 25, 30 and 35) is usually a mistake. Instead, I generally recommend that clients pass inheritances in a more protective fashion - in a beneficiary controlled trust (BCT).

How It Works: The BCT can be a trust within your Will de- signed to provide the primary beneficiary with all of the rights, benefits and control over the trust property that the beneficiary would have had if he or she owned it outright. However, it provides superior protection against claims from divorce, creditors and other lawsuits that may exist against your beneficiaries. Page 16 Gold Coast Gazette Week of March 13, 2014 Glen Cove HS Comes to the Aid of One of its Own More than 50 students and faculty members volunteered their time to raise money for Glen Cove High School ju- nior Luis Torres, who was involved in a serious car accident two months ago. The GCHS Key Club sponsored a stu- dent vs. faculty basketball game on the gym floor of GCHS on Friday, February 28. Proceeds from the gate will go to the Torres family. Close to 30 students and 15 faculty members laced up the sneak- ers and hit the hardwood for this spirited event. Several other students volunteered their time as referees, announcers and scorekeepers. The GCHS Heroes Club also donated funds to the Torres family raised through a charity bake sale. In total, the collective efforts of students and staff have raised close to $2,000.
