Ghostbusters: West Coast “The Next Generation of Ghostbusters” A web series consisting of 12 hourlong episodes. Treatment by Carey Martell [email protected] Goal: Help to enhance the Ghostbuster franchise by continuing the story of the Ghostbusters movies and Ghostbusters: The Video Game (the game’s script was written with Dan Aykroyd and Harold Ramis as cowriters; it’s essentially the third movie) with a new team of Ghostbusters who open a franchise in Los Angeles. Novel Ideas: ● Use ghost designs based on those featured in The Real Ghostbusters 198691 cartoon series and toyline (huge merchandising potential with collectors and youth). This makes it a show adult fans will want to watch with their kids. Some of the ghosts will be Samhain, the Boogieman, and the Sandman. ● A male and female Ghostbuster team; the cast will be selected from very popular YouTube comedians who have millions of subscribers. ● Show the negative consequences of the Ghostbusters’ celebritism and discovery of scientific ways to harness the occult (reemergence of a new Cult of Gozer). ● Story is focused on a Ghostbusters franchise based in Los Angeles rather than New York; new opportunities for well known locations to be haunted. Series Synopsis: PILOT Shortly after the events of Ghostbusters II, in the early 90s and at the height of the Ghostbusters popularity after saving the world, a group of kids who are members of the Junior Ghostbusters Fan Club enter a haunted house. They are equipped with homemade PKE meters and a “ghost trap” made from Radio Shack parts and modified household items like a toaster oven, and a Ghostbuster fan club version of Tobin’s Spirit Guide (similar to a Boy Scout Handbook). -

Introduction As marketing techniques and the means of communication expand in anticipa- tion of the next millennium, the law struggles to keep rein of commercial practices. In Australia, the tort of passing off has evolved at a great pace, to deal with the practice of exploiting the reputation and goodwill of both real and fictional characters. In Twentieth Century Fox Film Corporation & Anor v South Australian Brewing Co Ltd & Anor,l Tamberlin J considered the applica- bility of character merchandising principles to the more remote, though related, auspices of fictional products. The decision is indicative of the increasing scope of the tort of passing off, and is also a shining example of a successfbl claim under section 52 of the Trade Practices Act 1974 (Cth). As the protec- tion afforded by the tort of passing off in character merchandising cases be- comes increasingly broad, the need to re-assess the purpose of that protection becomes imminent. Both this issue, and the appropriateness of developing a general tort of misappropriating valuable intangibles, will be considered in the light of Tamberlin J's judgment. 2. The Facts and Legal Context The first applicant in this case ("Fox") was the maker and producer of the animated television series, "The Simpsons", and the second applicant ("Greening") was the creator of the characters, stories and titles of that series. Since February 1991, "The Simpsons" has been regularly broadcast across Australia during prime time, and has thereby "achieved wide coverage, deep market penetration, and broad recognition."2 "Homer Simpson", one of the leading characters in the series, is the "inept and bumbling but good natur- ed"3 father of the Simpson family, and a drinker of "Duff Beer". -

NEW YORK PUBLIC LIBRARY -- DAY The sun shines brightly on the classic facade of the main library at Fifth Avenue and 42nd Street. LIBRARIAN A slightly stout, studious looking girl in her late twenties circulates quietly among the tables picking up books and putting them on her cart. Everything seems completely normal and peaceful. POV A single eerie musical note signals the presence of something strange looking down on the Librarian from a vantage point high above the room. It follows the Librarian as she pushes her cart around the corner. INT. WORK AREA The Librarian is alone in a back room sorting books for reshelving. Behind her is the card catalogue. One of the books attracts her interest and she starts leafing through it. THE CARD CATALOGUE Another eerie note is heard as one of the drawers silently slides open behind the Librarian and hundreds of index cards start popping out. The Librarian continues reading completely oblivious to this strange phenomenon. She gets up and moves past another row of cabinets. -

Product Description and Product Segments Cyberpunk 2077 is a video game produced by the Poland-based video game company CD Projekt Red (“CDPR”) that is slated for release on 19 November 2020.1 Cyberpunk 2077 is an interactive entertainment product – a video game. As such, it is a complex work from an intellectual property perspective, not only embedding a wide range of often overlapping intellectual property rights (“IPRs”), but also incorporating some content which may fall beyond the scope of intellectual property in at least some juristictions. In this paper, we analyse the intellectual property assets associated with this game, explore their lifecycle and highlight challenges and opportunities in managing IPRs with properties of this nature. Cyberpunk 2077 falls within specific genres of interactive entertainment. Specifically, it is a: (1) first-person perspective, (2) open world, (3) role-playing game, (4) that is set within the cyberpunk sub-genre of science fiction.2 Cyberpunk 2077 represents a significant investment for CDPR, one which is made possible by the success of CDPR’s prior video game franchise. The Witcher, CDPR’s first project, experienced significant growth from the company’s release of the first video game in the franchise to their most recent release, the critically acclaimed Witcher 3: Wild Hunt. As a product, a video game is a complex work of authorship implementing a wide set of IP rights.
