The rates of pay for additional positions established shall be in conformity with the rates of pay for comparable positions of the same class shown in this Agreement and currently occupied. Such rates shall be subject to immediate review by the proper officer of the Company on request of the Union. Changes shall be made in agreed basic rates of pay for individual positions only when warranted by changed conditions. When changes in basic rates of pay are proposed, the positions affected will be reviewed and compared with the duties and responsibilities of comparable positions by the proper officer of the Company and the Union, with the object of reaching an agreement of revised rates to maintain uniformity for positions on which the duties and responsibilities are relatively the same. Reduction in the basic rate of pay for any position will be made only when a permanent vacancy occurs In such position, and the amount of such reduction shall be applied to increase the basic rates of pay of other existing positions where an increase is required to bring the basic rates of pay of such positions in conformity with those of positions of which the duties and responsibilities are relatively the same. DEFINITIONS AND INTERPRETATIONS "Company'' shall mean Ontera. "Management'' shall be understood to mean the Senior Company Official of Ontera or Corporate Labour Relations Department. as applicable. "Union" shall mean the Local Steward or other such authority of tha Union. INTERPRETATION Any question of interpretation which may arise will be adjusted

The Commission denies Rogers Wireless Inc.'s request to apply the revised line-side WAS rates retroactively to 1 January 2002. Introduction 1. The Commission received a Part VII application by Rogers Wireless Inc. (RWI), dated 17 December 2001, seeking a review of the line-side wireless access service (WAS) interconnection rates in the territories of the companies that were, at that time, referred to as the independent telephone companies operating in Ontario and Quebec, which included Société en commandite Télébec (Télébec) and the former TELUS Communications (Quebec) Inc., now TELUS Communications Company (TCC).1 These companies, excluding Télébec and TCC, are now considered to be small incumbent local exchange carriers (SILECs) operating in Ontario and Quebec. 2. Specifically, RWI requested that the Commission reduce the line-side WAS rates of Télébec, TCC and the SILECs operating in Ontario and Quebec, effective 1 January 2002, by removing the implicit subsidy from these rates. RWI requested that if the Commission were unable to remove the implicit subsidy by 1 January 2002, the Commission should make these rates interim on 1 January 2002, with the final subsidy-free rates retroactive to 1 January 2002.

An interexchange carrier (“IXC”) that wishes to interconnect with the Company must also enter into an interconnection agreement with the Company in the form of the CLEC-IXC Agreement. Terms and Conditions Applicable to Interconnection with IXSPs 1. The Company will provide at least one suitably equipped point of interconnection in each exchange in which it operates as a CLEC. An IXC may also enter into a transiting arrangement to interconnect with the Company via the ILEC where suitable ILEC facilities exist. 2. Equal Access 1. Equal Access is available to IXSPs in the Company’s serving areas. 2. Equal Access is available from any local reseller that is an affiliate of the Company to IXSPs that subscribe to interconnection services from the Company. 3. The provision of interconnection services is further subject to the terms and conditions specified in the CLEC-IXC Agreement, including the Appendices and Schedules, and in the PIC/CARE Access Customer Handbook described in Item 302.4.3. As an exception to Item 102.8, the CLEC-IXC Agreement defines and determines the procedures for handling confidential information provided by the IXSP to the Company and specifies procedures with respect to the receipt and processing of orders from the IXSP, interchange carrier billing, network planning requirements and PIC information processing, all in relation to interconnection services.

The Commission also approves the continued use of the rates for direct connect, equal access and toll trunks established in Direct toll and network access costing methodology for small incumbent local exchange carriers - Follow-up to Decision 2001-756, Telecom Decision CRTC 2005-3, 31 January 2005, but directs that these rates be applied to actual minutes and toll trunks. In addition, the Commission permits local competition in the territories of all SILECs, effective immediately. Background 1. There are currently 38 small incumbent local exchange carriers (SILECs) in Canada, which are listed in Attachment 1 to this Decision. Most are dispersed throughout Ontario and Quebec, with one located in British Columbia. These SILECs serve less than 2 percent of the Canadian population in generally rural areas, and almost all have less than 25,000 subscribers. 2. In Regulatory framework for the small incumbent telephone companies, Decision CRTC 2001-756, 14 December 2001 (Decision 2001-756), the Commission established a simplified price regulation framework applicable to the SILECs. This framework came into effect in 2002 for a period of four years. 3. Local exchange services were grouped into four baskets of services.
