1. MINUTES

The Minutes (copies of which had been circulated) of the meeting held on 8 August 2017 were approved as a correct record and signed by the Chair.

2. DECLARATIONS OF INTEREST

Councillors and Officers were invited to declare any interests which they had in any of the items on the agenda for the meeting.

3. PROGRESS ON AREA COMMITTEE DECISIONS

A representative of the Democratic Services Manager submitted a report (copies of which had been circulated) updating the Area Committee on progress since the last meeting on decisions taken by the Area Committee and the current position on Ward Flexibility Funding. The report also included the position on ward delegated budgets.

A Member highlighted the lack of enforcement of the traffic regulation order at the junction of Buckingham Road and Cheadle Road, Cheadle Hulme. Cheadle Area Committee - 26 September 2017

RESOLVED – That the report be noted.

4. URGENT DECISIONS

No urgent decisions were reported.

5. COMMUNITY ENGAGEMENT

(i) Chair's Announcements

The Chair advised the meeting of a McMillan coffee morning to be held at Bethany Church, Gatley on 29 September 2017 and a community litter pick to be held at 10.00am in Heald Green on 21 October 2017.

(ii) Public Question Time

Members of the public were invited to put questions to the Chair of the Area Committee on any matters within the powers and duties of the Area Committee, subject to the exclusions set out in the Code of Practice.

Three .public questions were submitted.

The first public question related to motorcyclists using a pedestrian passageway between Deane Avenue and Donnington Avenue, Cheadle causing a danger to pedestrians and to children who played out in the road.

The second public question related to car parking problems on Ashbourne Avenue in Cheadle. The questioner was advised that Councillors would be visiting the area next week with Council Traffic Officers to assess the car parking situation.

The third public question had been submitted by a member of the public who was not present at the meeting. The Chair advised that, in accordance with the Code of Practice, a written response would be provided to the questioner.

RESOLVED – (1) That, with regard to the first public question, the issue be raised with the Community Safety Unit in the first instance and the questioner requested to keep a diary of the motorcyclists using the passageway and the registration numbers if possible.

(2) That with regard to the second public question, Traffic Officers be requested to investigate the situation further and prepare a report for a future meeting of the Area Committee.

(3) That, with regard to the third public question, a written response be sent to the questioner.

(iii) Public Realm

David Wilson (Public Realm Inspector) attended the meeting to report on current issues and to answer questions from councillors and members of the public in relation to public realm issues within the area represented by the Cheadle Area Committee. He reported Cheadle Area Committee - 26 September 2017 that the following routes would shortly be subject to their annual highway safety inspection:-

 Cheadle and Gatley Ward: Springfield Road – Levens Close and Troutbeck Road, Gatley.  Cheadle Hulme North Ward: Shakespeare Drive and Lavington Avenue, Cheadle.  Heald Green Ward: East Avenue – Sydall Road and Dawson Road, Heald Green.

The following comments were made/issues raised:-

 The accumulation of litter in the passage off Baslow Drive, Heald Green was reported.  Non-illuminated bollards on Finney Lane, Heald Green had been damaged.  Fly tipping and the accumulation of waste by the clothes bank near the railway station in Heald Green was reported.  Smoke had been observed at a local farm in Heald Green for the last three days.  Over growing vegetation on a public right of way off Bolshaw Road, Heald Green was reported.  Further information was requested regarding the policy for the removal of fly posters.  Repeated over flowing waste, including dog fouling, was reported at a litter bin on Queens Road, Cheadle Hulme.  A member of the public requested that stone block paving be returned around the base of a reset bollard in Cheadle District Centre as tarmac had been used instead.

RESOLVED – That David Wilson be thanked for his attendance.

(iv) Petitions

No petitions were submitted.

(v) Open Forum - SEMMM Strategy Refresh - Transport Issues and Options

Amy Beasley (Transport Strategy and Growth Manager, Stockport Council) attended the meeting and provided an update on the public consultation being undertaken regarding transport issues and options in Stockport to inform the updating of the South East Manchester Multi-Modal Strategy to 2040. She advised the Area Committee that a consultation event on the Local Plan and the SEMMM Strategy Refresh would be held on 28 September 2017 at 6.00pm at The Kingsway School, Foxland Campus. All were invited to attend.

RESOLVED – That Amy Beasley be thanked for her attendance.

(vi) Ward Flexibility Funding - 1st Gatley Scouts (St James)

A representative of the 1st Gatley Scouts (St James) attended the Area Committee to answer questions from Members in relation to an application for Ward Flexibility Funding from 1st Gatley Scouts (St James) for a defibrillator. He reported that he had managed to Cheadle Area Committee - 26 September 2017 secure a quote for a defibrillator for £960, as opposed to the £1,248 requested in the application form.

RESOLVED – That approval be given to funding to 1st Gatley Scouts (St James) for £960 for a defibrillator, to be funded from the Cheadle and Gatley Ward Flexibility Funding allocation.

6. DEVELOPMENT APPLICATIONS

Development applications were submitted.

The Corporate Director for Place Management and Regeneration is authorised to determine conditions and reasons and they are not therefore referred to in committee minutes unless the committee makes a specific decision on a condition or reason. The Chair outlined the procedure approved by the Council for public speaking on planning applications.

(i) DC/064779 - Cheadle Muslim Association, 377 Road, Heald Green

In respect of plan no. 64779 for a proposed new mosque and community centre to replace the existing main building, side caretaker’s house and portacabins; including the re-design and improvement of car parking and landscape improvement works at the Cheadle Muslim Association, 377 Wilmslow Road, Heald Green a representative of the applicant spoke in support of the application

RESOLVED – That the Planning and Highways Regulation Committee be recommended to grant planning permission, subject to the conditions contained in the report.

(ii) DC/066326 - Land to the south-west of Cheadle College, Cheadle Road, Cheadle Hulme

In respect of plan no. 66326 for the development of a nursery, primary and secondary school with sports hall, sports pitches and associated boundary treatments, external lighting, landscaping, parking and access on land to the south-west of Cheadle College, Cheadle Road, Cheadle Hulme a member of the public spoke against the application; and Cheadle Area Committee - 26 September 2017 a representative of the applicant spoke in favour of the application.

RESOLVED – (Two for, One against) That the Planning and Highways Regulation Committee be recommended to grant planning permission and consider the following comments in its consideration of the application:-

 concerns were raised as to the scale of the proposal on a constrained site and the likely impact on the local highway network, as well as the amenity of local residents. Furthermore, although the significant benefits of the proposal with its community facilities and the provision of much needed nursery and primary school places were noted, it was queried how the development would improve secondary education, when the need for secondary school facilities was greater in other parts of the borough.  a request was made for Officers from Education Services to attend the meeting of the Bramhall and Cheadle Hulme South Area Committee on 28 September 2017 to provide clarification on the need or otherwise for the proposed secondary school.  the possibility of implementing Traffic Regulation Orders in the area, particularly along North Downs Road, needed to be considered, both prior to development and when the schools would be running at full capacity. If approved, careful consideration would need to be given to conditions, specifically those relating to construction hours, route for the construction traffic, noise levels, the highway improvement works and their completion prior to the opening of the development, a robust Travel Plan, use of the staff car park, hours of use of the Multi-Use Games Areas (MUGAs) and the suitability of cladding materials.  Councillors suggested that it would be beneficial for Members of the Planning and Highways Regulation Committee to visit the site as part of their assessment of the application. Any such site visit was suggested to take place on a week day at 8.30am.

7. PLANNING APPEALS, ENFORCEMENT APPEALS & ENFORCEMENT NOTICES

A representative of the Democratic Services Manager submitted a report of the Deputy Chief Executive (copies of which had been circulated) summarising recent appeal decisions, listing current planning appeals and dates for local enquiries, informal hearings and progress on authorised enforcement action.

RESOLVED – That the report be noted.

8. DEDICATION OF A BRIDLEWAY ON LANDOWNED PRIVATELY AND BY THE COUNCIL, CREATION OF A BRIDLEWAY OVER PRIVATELY OWNED LAND IN THE LADYBROOK VALLEY, CHEADLE HULME, AND THE EXTINGUISHMENT OF A SECTION OF FOOTPATH 75 CHEADLE AND GATLEY

A representative of the Corporate Director for Place Management and Regeneration submitted a report (copies of which had been circulated) regarding a request to dedicate a bridleway over a section of land owned by the Council in the Ladybrook Valley, and on land that was outside its ownership in the Ladybrook Valley, as shown on the plan Cheadle Area Committee - 26 September 2017 attached to the report. The Committee was requested to consider entering into a dedication agreement with the owners of the private land.

If the Area Committee agreed to dedicate the bridleway, the Council would have maintenance responsibility to bridleway standard for the route. The Area Committee was also requested to consider the creation of a bridleway on land which is outside its ownership in the Ladybrook Valley. The paths would be maintainable at public expense.

In addition, the Area Committee was requested to consider the extinguishment of a section of Footpath 75 Cheadle and Gatley.

RESOLVED – (1) That the dedication of a bridleway over the section of the route between Points A – B – C – D - E and K – L - M – N, as shown on the plans at Appendices 5, 6, 7 and 8, be approved.

(2) That the appropriate dedication agreements be entered into between the Council and the landowners of the land over which the sections of path marked A-B-C and D-E run.

(3) That the making of a bridleway creation order in respect of the sections of the route between points E-F-G-H-I and G-J, as shown on the plans at Appendix 6, be approved.

(4) That the making of a footpath extinguishment order under Section 118 of the Highways Act 1980 to extinguish that section of Footpath 75 Cheadle and Gatley between X-Y, as shown on the plan at Appendix 2, be approved.

(5) That, in the event that objections are received to the creation and/or extinguishment orders, authority to send the orders to the Secretary of State for confirmation, or not proceed with the orders, be delegated to the Corporate Director for Place Management and Regeneration.

9. ANTI-SOCIAL BEHAVIOUR AT CHEADLE MILL DEVELOPMENT

A representative of the Corporate Director for Place Management and Regeneration submitted a report (copies of which had been circulated) setting out an action plan to be put in place following reports of anti-social behaviour at the Cheadle Mill development.

With the agreement of the Committee, the primary landowner of the site was permitted to address the Committee. He expressed concern about the level of anti-social behaviour at the site and requested that the police address the problem.

RESOLVED – (1) That the Corporate Director for Place Management and Regeneration be requested to arrange a meeting between representatives of the Police, Council Officers, Members of this Area Committee and the landowners of the site with regard to the incidents of anti-social behaviour at the Cheadle Mill development.

(2) That the outcome of the meeting referred to in (1) above be reported back to Members of the Area Committee. Cheadle Area Committee - 26 September 2017

10. SECURITY AROUND MILL LANE CEMETERY, CHEADLE

A representative of the Corporate Director for Place Management and Regeneration submitted a report (copies of which had been circulated) regarding options for security at Mill Lane Cemetery. The cemetery was not a fully secure site. It had a wall along Manchester Road but this would not deter access, and it was partially fenced around the perimeter. The main gate to the cemetery had been left open at evenings and weekends and had been for a number of years.

There had been a few reports of anti-social behaviour or concerns about security at Mill Lane Cemetery over the years. Following the most recent report this year a security patrol had been introduced and there had been no subsequent reports of incidents. The costs of effectively securing the site were prohibitive and were also likely to restrict access to some visitors who currently visited the site at weekends and evenings.

As part of improvement works at the cemetery, bushes would be planted between the footpath (which is a public right of way) and the cemetery.

RESOLVED – That the site continue to be monitored and action taken with Police, if necessary.

11. THE METROPOLITAN BOROUGH OF STOCKPORT (CHURCH ROAD, GATLEY) (PROHIBITION OF WAITING) ORDER 2017 - OBJECTION REPORT

A representative of the Democratic Services Manager submitted a report of the Corporate Director for Place Management and Regeneration (copies of which had been circulated) setting out an objection received to a proposed Prohibition of Waiting Traffic Regulation Order on Church Road, Gatley.

RESOLVED – That, notwithstanding the objection received, the Prohibition of Waiting Traffic Regulation Order on Church Road, Gatley, be made as advertised.

12. WHITEGATES ROAD / ASHFIELD ROAD , CHEADLE - TRAFFIC REGULATION ORDER OBJECTION REPORT

A representative of the Democratic Services Manager submitted a report of the Corporate Director for Place Management and Regeneration (copies of which had been circulated) setting out an objection received to a proposed Prohibition of Waiting Traffic Regulation Order at the junction of Whitegate Road and Ashfield Road, Cheadle.

RESOLVED - That, notwithstanding the objection received, the Prohibition of Waiting Traffic Regulation Order at the junction of Whitegate Road and Ashfield Road, Cheadle, be made as advertised.

13. APPOINTMENT OF COUNCILLORS TO LAY WREATHS AT REMEMBRANCE DAY SERVICES (CHEADLE AREA)

A representative of the Democratic Services Manager submitted a report (copies of which had been circulated) requesting the Area Committee to appoint Councillors to lay wreaths Cheadle Area Committee - 26 September 2017 at Remembrance Day Services at Cheadle, Gatley and Heald Green War Memorials on Sunday, 12 November 2017.

RESOLVED – (1) That approval be given to the appointment of the following Councillors to lay wreaths on Sunday, 12 November 2017:-

Cheadle War Memorial – Councillor June Somekh Gatley War Memorial – Councillor Iain Roberts Heald Green War Memorial – Councillor Adrian Nottingham

(2) That the Bramhall and Cheadle Hulme South Area Committee be requested to agree to a Councillor from the Cheadle Hulme North Ward laying a wreath at the Cheadle Hulme War Memorial this year.
