The project is coordinated by the University of Jyväskylä involving six partners from Europe and two from the Horn of Africa and will conduct field research in both Europe and Africa. MAX Security Report [email protected] +44 203 540 0434 Politics Somalia SITUATION UPDATE: Lower House of 14 Parliament passes resolution extending APR President Farmajo’s mandate for two years on 12:03 UTC April 12 Executive Summary: On April 12, the Lower House of Parliament, allied to President Mohamed Abdullahi Farmajo, voted to extend the Federal Government of Somalia (FGS) mandate following months of failed dialogue with Federal Member States (FMS) and opposition leaders in an effort to resolve protracted electoral disputes. Apart from the complete breakdown of FGS-FMS dialogue, that the Lower House extended Farmajo’s term without consensus from all electoral stakeholders and the resolution of protracted electoral disputes, which leaves Somalia increasingly vulnerable to political and security threats. Despite overwhelming international condemnation of the FGS’s action, given that Farmajo has demonstrated resolve to hold on to power despite the immense risks to Somalia’s stability, the political and security situation in Somalia is poised to remain highly volatile over the coming days. Please be advised: On April 12, the Lower House of Parliament voted to extend the Federal Government of Somalia (FGS) and President Mohamed Abdullahi Farmajo’s mandate by an additional two years, with 149 out of 275 deputies voting in favor of the resolution. In a statement, President Farmajo praised the resolution and claimed that the term extension page 1 / 3 will provide the FGS time to implement a universal suffrage electoral model facilitating the participation of all Somali citizens in the next elections. The Upper House of Parliament released a separate communique claiming that the mandate extension is unconstitutional on the grounds that President Farmajo’s term ended on February 8. -

In Eritrea,pre- colonialChristianity, sharp class distinctions,and a strong state promotedinteraction between colonizers andcolonized. Eritrean nationalismemerged against Ethiopia; thus, nosharp breakbetween Eritreans andItalians emerged.Two outgrowths ofcolonialism, the Eritrean nationalmovement andreligious ties,facilitate immigration and integration. CONSTITUTION OF PUNTLAND STATE OF SOMALIA December 2009 National Democratic Institute (NDI) unofficial translation into English of the 2009 Constitution of Puntland State of Somalia. NDI accepts no responsibility for the accuracy of this translation. Any errors or inconsistencies that may exist in the original Somali were translated into English. The Somali version remains authoritative. Puntland State was created in 1998 through a consultative agreement among the different regions that constitute Puntland. The creation of Puntland State emerged from Somalia’s failure to re-establish an inclusive national government for eight years. The people of Puntland realized they could not continue without a government. It was then decided in the constitutional conference of 1998 that Puntland would become a state that would be part of a federal Somalia. A charter was approved in that same 1998 conference and later replaced with a provisional constitution that was approved by members of the House of Representatives in 2001. A referendum on the constitution was to have taken place in 2004, although this was not accomplished. Since it was not possible to hold a referendum on the constitution it was decided that the constitution would continue in force while undergoing review. The constitutional review process began in May 2007 and continued until June 2009. In the review process, meaningful opinions were contributed from different sectors of Puntland society, such as Somali lawyers and foreign lawyers. Therefore, the new constitution was drafted to become the law of the people of Puntland and was based on the Islamic shari’a and, at the same time, the constitution guides the system of governance, and thus brings collaboration and order among the different government institutions of the state. -

CHAPTER SEVEN CLAIMING THE EASTERN BORDERLANDS After the 1997 Hargeysa Conference, the Somaliland state apparatus consolidated. It deepened, as the state realm displaced governance arrangements overseen by clan elders. And it broadened, as central government control extended geographically from the capital into urban centres such as Borama in the west and Bur’o in the east. In the areas east of Bur’o government was far less present or efffective, especially where non-Isaaq clans traditionally lived. Erigavo, the capital of Sanaag Region, which was shared by the Habar Yunis, the Habar Ja’lo, the Warsengeli and the Dhulbahante, was fijinally brought under formal government control in 1997, after Egal sent a delegation of nine govern- ment ministers originating from the area to sort out local government with the elders and political actors on the ground. After fijive months of negotiations, the president was able to appoint a Mayor for Erigavo and a Governor for Sanaag.1 But east of Erigavo, in the area inhabited by the Warsengeli, any claim to governance from Hargeysa was just nominal.2 The same was true for most of Sool Region inhabited by the Dhulbahante. Eastern Sanaag and Sool had not been Egal’s priority. The president did not strictly need these regions to be under his military control in order to preserve and consolidate his position politically or in terms of resources. The port of Berbera was vital for the economic survival of the Somaliland government. Erigavo and Las Anod were not. However, because the Somaliland government claimed the borders of the former British protec- torate as the borders of Somaliland, Sanaag and Sool had to be seen as under government control. -

It officially seceded from Somalia in 1991, but has not been recognized by the international community (MRG 2010, 17; The Guardian 26 Aug. 2011). Government and Administration Somaliland has a directly elected president and a bicameral legislature (US 8 Apr. 2011 Sec. 3; Human Rights Watch July 2009, 16-17) comprised of a house of representatives and a house of elders (ibid.; ACCORD Dec. 2009, 5). Its 2010 presidential elections were deemed to be generally free and fair by international observers (Human Rights Watch 2011; US 8 Apr. 2011, Sec. 3). The United States (US) Department of State notes that while the 2002 Somaliland constitution is based on democratic principles, the region also uses laws enacted prior to 1991, and does not recognize Somalia's Transitional Federal Charter (ibid., Sec.1.e). Somaliland's administrative institutions are considered to be generally functional (ibid., Sec. 3; ACCORD Dec. 2009, 5; The Guardian 26 Aug. 2011). However, sources also note that the government's limited revenue, due in part to its ineligibility for international development assistance as an unrecognized sovereign state, limits its ability to provide basic public services (ibid.; Human Rights Watch July 2009, 12; Freedom House 2011). -
