Planning Application Comments: Week Commencing 10th August 2020

The following statement will precede each consultee response to :

“Due to the restrictions placed on the Council as a result of the pandemic Coronavirus, this response represents the opinion of members of St Agnes Parish Council identified through a consultation process, but does not constitute a formal consultee response because the outcome was not reached at a physical meeting at which the public could be present and where Councillors can legally vote.”

Each consultee response to Cornwall Council will be concluded with the following statement:

“This response represents the opinion of members of the Council, but cannot legally constitute a consultee response as the outcome was not reached at a physical meeting at which the public could be present. Therefore a ‘5-day protocol’ email should not be issued to the Council as it cannot legally respond. However, the Parish Council requests that should a Planning Officer decide an application in opposition to the majority response given by (the collated opinions of) the Parish Council, could they advise the Local Member by email, copying in the Parish Council, so as they are kept informed.”

X3 no objection [MAJORITY]

Comment: If necessary, relevant boundary treatment and obscured glass could be used to reduce any overlooking concerns from the closest neighbour.

X2 object. Concern has been expressed about the proximity of the dwellings to the bungalow, Chy Vean. Suggestion that the proposal site should be moved sufficiently South to the extent that Chy Vean's windows will receive daylight in Winter, ideally with an illustration provided to show this has been achieved. Although the area is in the historic settlement boundary, the bus has been re-routed away from the area and the site is 1500m from the nearest shop/other facilities. Access roads are narrow and usually single track due to the need for on street parking and without pavements in areas. Concern was also expressed that the layout could seem to be making provision for further development, giving a density which would add further to access problems for new and existing residents.

X 2 object. Concern has been expressed that the AONB unit has not been consulted for comment. The garage is immediately beside the byway in the AONB and the site protrudes into the lane which is part of a route to the coast path. Raising the height of the garage would create a dominant and overbearing building from the road, which would be out of character with respect to other dwellings at this locality. Therefore, it is suggested that the development would not comply with Local Plan Policy 2, in not demonstrating an aesthetic understanding of its location, and Policy 12, there being an overbearing impact on the narrow lane. It should also be noted that not all the buildings present on this site are shown on the plans or on Cornwall interactive maps. (For example there is structure which has clearly served as an indoor swimming pool in the recent past.)
