1 Attachment 1 Yarmouth Complete Streets Policy As Adopted by Town Council, November 19, 2015

Vision and Adoption: The Town of Yarmouth seeks to provide for all of its residents and visitors a transportation network that is safe, efficient, interconnected, and sustainable for all modes of travel. Doing so will help the Town remain competitive in economic growth and investment, and help appeal to a diverse, healthy, and motivated population and workforce that values transportation options and sustainability. A Complete Street is one that safely accommodates the needs of all street users – pedestrians, wheelchair users, bicyclists, transit users and motor vehicle users. This Complete Streets policy document is adopted pursuant to goals and policies set forth in the Town of Yarmouth’s 2010 Comprehensive Plan, and is hereby incorporated therein by appendix. This policy is aspirational and shall not be construed to have ordinance or rule authority as to public or private development road, bridge, thoroughfare or Complete Streets elements design principles or construction.

All Projects & Phases: In order to further the goals established herein, the Town and the Complete Streets Advisory Committee as herein established shall view every public project and phase related to transportation, from design and planning to construction and maintenance, as an opportunity to improve the street network and make it safer, better connected and more accessible for all users. The Complete Streets Advisory Committee may also comment and recommend Complete Streets design principles and practices for any new private roads or infrastructure proposed and reviewed under the Town’s various land use ordinances, including, but not limited to, roads and other infrastructure proposed to be dedicated as new public facilities. It is important to understand that these goals will likely be achieved over time, and to guarantee success, this policy requires prioritization, phasing, communication, and implementation at all points in the development timeline.

All Agencies & All Roadways: Complete Streets require the cooperation of all departments, agencies, stakeholders, and users involved in the planning, design, construction, maintenance, and utilization of transportation facilities. This Policy shall apply to all streets, roads and ways, including paved and unpaved roadways and connections in Yarmouth, including those in private developments and subdivisions. Privately constructed streets and ways should meet Complete Streets standards for development approval, regardless of whether they will become private or public. All departments, boards, and committees of the Town of Yarmouth shall work together to ensure that the policies and procedures set forth in this policy are clearly communicated, understood, and fully considered.. In order to ensure consistency in the implementation of Complete Streets goals, all relevant ordinances, plans, manuals, and guidelines pertaining to Yarmouth’s streets should be updated as necessary, and shall always be construed and applied to incorporate (and not exclude) Complete Streets goals.

Network: In order to ensure a connected system throughout the Town, Yarmouth shall take a network approach, rather than an individual street approach. Modifications (such as repurposed rights-of-way) that improve the overall network and better connect fragmented portions of the town should take priority over those that affect single thoroughfares. New developments and redevelopment projects shall seek to provide interconnected networks, not just within the development, but with the surrounding existing network, be it street, sidewalk, path or trail, including any transit network.

Context Sensitivity: The development of Complete Streets in Yarmouth must take into consideration the local context, issues, and obstacles unique to the Town. Obstacles include the , Route One, and I-295, which all impede connectivity. Additional factors include the low-density pattern of development that characterizes the more rural areas outside the village with a resulting dependence on automobiles for transportation. Some contextual questions regarding roads, streets and ways include: 1

2 1.2  Proximity to a route with similar facilities to those considered; in low-traffic areas, it may not be necessary to provide multiple nearby routes. In high-traffic areas, it may be advisable to provide alternate routes to the same destination(s).  Access to public transit service; these roadways should be accessible to multiple modes of transportation, as they contribute to the larger network.  Access to neighboring communities; these roadways contribute to the larger network and multi- modal access is desirable.  Character or expected future character of the area it traverses: o Areas expected to remain rural may not require elaborate separate pedestrian/bicycle facilities and could retain their rural character. o Rural areas that are expected to become more urban may require enhanced bicycle- pedestrian facilities. o Different portions of a thoroughfare may have different requirements, e.g., some roads/streets may change in character as they travel through rural areas and in and out of the village.

Design/Principles: Some of the most important elements to provide in the public realm of Complete Streets include:  appropriately sized and located sidewalks,  bike and/or pedestrian pathways,  street trees and landscaping,  street lighting and furniture,  transit lanes and facilities,  bike lanes and facilities,  appropriately scaled vehicle lanes and medians, and  pedestrian safety measures such as crosswalks and signals, refuge areas, and minimum curb radii to shorten crossing distances and reduce motor vehicle speed.

The goals of a Complete Streets initiative (multi-modal safety and connectivity) cannot be achieved through the public right-of-way alone. Additional focus must be placed on the areas linked by the transportation network and the overall user experience. Outside the public realm, consideration should be given to neighborhood destinations and amenities, and streetscapes. Pedestrian areas should be appropriately scaled for human comfort. All of these elements determine the quality of the pedestrian, bicyclist, and motorist experience.

When designing new streets, consideration shall be given to the destinations that they are expected to provide access to, any natural or man-made barriers they will cross, and whether they are part of a current or future critical route for non-motorized traffic. It is often necessary to prioritize simple, cost-effective changes to create a multi- modal environment, such as re-striping to reduce vehicular lane width and create bike lanes, wider shoulders, adding crosswalks, or planting trees or incorporating other streetscape improvements.

Exceptions: While it is important to consider bicycle, pedestrian, and transit users and facilities in all transportation projects throughout the Town, exceptions may be made where circumstances dictate. Establishment of bicycle and pedestrian facilities need not be required:  Where their establishment would be contrary to public safety;  When the cost (including foreseeable cost of future maintenance) would be excessively disproportionate to the need or probable use;  Where there is no identified present or reasonably foreseeable future need;  Where the establishment would violate Comprehensive Plan policies; or  The justification and reasoning for such decisions and exceptions should be documented. The aforementioned exceptions do not preclude the consideration and implementation of all other Complete Streets policies within the given travel corridor. The inability to accommodate certain users within a given right-of-way may require an analysis of the local street network and reprioritization of transportation facilities along nearby or parallel routes, to the end that no user is excluded.

Implementation: The implementation of Complete Streets will begin with a series of broad changes to local policies governing streets, and then as physical, measurable changes to those streets. The implementation process can be summarized in four main phases, some of which may overlap in time. 1. Form Committee; Identify Responsible Parties & Develop Implementation Plan: The first step to ensuring the success of a Complete Streets Policy in Yarmouth shall be to identify responsible parties and stakeholders, and develop an implementation plan with clearly defined steps, measurable performance indicators, data reporting procedures, and a process by which projects are prioritized for execution and funding. This work shall be done by or at the direction of an advisory committee (the Complete Streets Advisory Committee) comprised of the Yarmouth Planning Director, Director of Public Works, Fire Chief, Police Chief, Town Engineer, Director of Community Services, and a representative from the Bicycle and Pedestrian Committee (to be appointed by the Town Council for a four year term), or their respective designees. The Committee shall meet at least quarterly and as the need arises to review, and evaluate for compliance with this Policy, any:  Major developments,  Roadway projects,  Capital improvement projects,  Regulatory issues, and/or  Recommendations for policies, constructed improvements, public services and programs, budgets and other measures to advance the Complete Streets goals and design principles.

2. Review and Revise Existing Regulating Documents: The second step shall be to review all existing codes, ordinances, standards, etc. to determine whether they require updating in order to further the Complete Streets goals, and to be sure there are no rules or guidelines that would hinder the development and redevelopment of Complete 3

4 1.4 Streets. Any needed amendments or modifications should be drafted and submitted for adoption as soon as possible. The Committee shall review all future land use and transportation plans to be sure that the Complete Streets goals for connectivity and safe, efficient multi-modal transportation are incorporated - if not, plan amendments and updates should be drafted and recommended..

3. Review Funding and Capital Improvement Procedures: The third step will be to review the procedures for obtaining funding for street projects and any existing or proposed capital improvement plans, to be sure projects will advance the Complete Streets policies and ensure Complete Streets are prioritized and able to receive funding. The Committee shall identify current and potential future sources of funding for street improvements (including possible public/private partnerships).

4. Measure Performance and Report Findings: In order to monitor the implementation and success of the Complete Streets policy, the Police Department and Bike/Pedestrian and/or Complete Streets committees shall regularly monitor several measurable performance indicators, including, without limitation: o User Data – o Number of users (with a goal to increase all bike/pedestrian users). o Age of users (with a goal for a broader range of ages and an increase in older users). o Ability of users (with a goal to accommodate a broader range of abilities and an increase in users with disabilities that can affect mobility).  Sidewalk Data - Linear feet of sidewalk throughout the Town (with a goal to increase overall sidewalks, and a decrease in sidewalks in disrepair).  Vehicular Speed Data (with a goal of calming of motor vehicle speeds).  Crash Data – Number and type of crashes and severity of injuries (with a goal of decreasing crashes of all types, especially those involving bicycles and/or pedestrians, with lower severity of injury)  Completion of bicycle/pedestrian network – The percent of completion of the overall planned network. The Complete Streets Committee shall determine measurement criteria and parties responsible for regular measurements and/or surveys for each item based on clearly identified short- and long-term goals. For example, crash data should be collected throughout the Town, perhaps as a map showing traffic incidents by type (vehicle vs. bicycle, etc) over a set period of time. The data would be provided to the Committee at regular intervals. An annual report of all measured performance indicators shall be provided to the Town Council and any other groups deemed necessary or advisable by the Complete Streets Committee.

I recently met with the Ped/Bike Committee to discuss a wide range of issues- but with the primary focus to hear and respond to concerns that the Complete Streets Advisory Committee is not being formally convened and utilized as a disciplined process for both planning and project review on all road projects, or its global mission of forming recommendations for a Complete Streets Implementation Plan. While I was able to share the very significant work, prioritization, actual and planned investments, and updated regulations and policies that have successfully flowed from the Complete Streets approaches to municipal work in the last several years, I also acknowledged that the formal and disciplined process laid out for the Advisory Committee in the Complete Streets Policy adopted by the Town Council in November 2015 needs to be better attended to. I have pledged your increased efforts and attention to that aspect of the work as well. Please do convene and work out a workplan to that end. Thank you.

I have cc’d Scott on this as much of the funding in the first few years has been and will be from the Development Fund and focused on the Village and Route 1, although the Policy applies and is aspirational town-wide. I would like the Economic Development office to be in the loop in the committee’s conversations—formally or informally. Otherwise, committee make-up is established in the policy as follows:

Planning Director- by office Director of Public Works- by office Fire Chief- by office Police Chief- by office Town Engineer- by office Director of YCS- by office Ped/Bike Representative by Council appointment (4-yr term)

I suggested to the Ped/Bike Committee that an effort should be made to have the Town Council formally establish the Committee (it’s somewhat of an ad hoc, self-appointed, committee without formal Council endorsement or sanction except for the implicit recognition that the Council made by agreeing to appoint one of its members to the Complete Streets Advisory Committee.) I think that formalization would help with the communications and accountability concerns that the Committee expressed. I’m not sure the Council ever formally appointed Dan Ostrye as the Ped/Bike representative (maybe, I can’t recall) , but that certainly that is the defacto posture that applies and we should continue so long as he is willing. If so, a new 4-year term as representative to the Complete Streets Policy ought to be formalized along with the establishment of the Ped/Bike Committee. I recommended that the Ped/Bike Committee work on getting its formal recognition in place for the June organizational meeting for the Town Council so that a Council liaison member can be appointed to the Ped/Bike Committee further improving the accountability and communication

6 2.2 links. The Council may be having a new conversation on the roles and responsibilities of liaisons in the coming months.

Initially, we defaulted to Alex to serve as the Chair since the Complete Streets policy itself arose out of and was championed before the Town Council by that office. However, the Committee is free to choose its own organizing structure, leadership, communication lines, and work processes and schedules as may fit the needs of the Committee- within the general parameters of the formal policy document.

Project Background and Approach Scope of Services: The Town of Yarmouth (Client) is looking to update the “Reconnecting Yarmouth Village to the Working Waterfront” plan recommendations for pedestrian improvements along a portion of Lafayette Road, from the intersection with Marina Road to the Lower Falls Landing access drive. The project involves:  Installation of a new sidewalk extending from the existing sidewalk on Marina Road to the area of the access drive to Lower Falls Landing, along the southwesterly side of Lafayette Street;  The sidewalk and pedestrian crossings will consider road intersection improvements at the intersection of Pleasant Street and Lafayette Street; and  The sidewalk design will be coordinated with site improvements at the Town of Yarmouth’s Harbor Pumping Station. This design effort will be consistent with the recent Phase I project effort by Baker Design Consultants (Consultant) including the following services:  Limited field observations to update prior topographic survey plans;  Preliminary design and cost estimating for town staff review; and  Completion of preliminary design plans and cost estimates for Client use in constructing the project. Client anticipates using local funds for this project. Consultant will support Client coordination with MaineDOT and/or other utility service providers in the project area.

The proposed scope of Consultant services, project schedule and fee estimate are outlined below. 1. Background Data Collection and Supplemental Topographic Survey: a. The initial 2012 study provided survey plans with topographic and boundary survey data which is still suitable for development of preliminary design materials. This survey work did not include storm drain pipe sizes and inverts, and there may be other minor site features that have changed since then, which can be obtained by field measurement. 2. Preliminary Design Review Materials a. Preliminary (75%) plans and construction cost estimates will be developed and submitted electronically (PDF file) to Client for review. 3. Staff Review Coordination a. Consultant will attend a meeting (either in person or via teleconference per Client preference) and site visit with town staff representatives to review the preliminary design materials and discuss any review comments and modifications to the plans and cost estimates. 4. Final Preliminary Design Materials a. Consultant will revise preliminary design plans and construction cost estimates per Client review and final materials will be submitted electronically (PDF file) to Client. Work Not Included:  Final design plans and technical specifications for bidding and contracting the constructing work.

The Town of Yarmouth is requesting funding for a culvert and sidewalk project located on Route 1 in Yarmouth, vicinity of 412 Route 1 (Maine Paint Service) and 385-431 Route 1 (Mercy Quick Care/Pratt- Abbott Cleaners). The project entails the following elements: 1. Sliplining of existing concrete box culvert, approximately 100’; 2. Construction of retaining wall and sidewalk on east embankment, approximately 135’; 3. Riprap stabilization of west embankment/culvert invert; 4. Construction of a mid-block crossing with RRFB signal and median pedestrian refuge at 438 Route 1 (Yarmouth Marketplace) and 431 Route 1. Engineered plans and cost estimate for items 1 – 3 have been developed by Baker Design Consultants, totaling $246,016. We have developed an opinion of cost for item 4 at $26,400, for a total project cost estimate of $272,416.

Town of Yarmouth REQUEST FOR PROPOSALS May 22, 2019 Multiuse Trail Assessment, Yarmouth Maine 1. Introduction The Town of Yarmouth in collaboration with the Maine Department of Transportation (MaineDOT) pursuant to a Planning Partnership Initiative (PPI) agreement is soliciting proposals to perform this study. The study’s purpose is to evaluate the feasibility, preferred alignment, cost and impacts of a multiuse trail extension as follows:

This project will create a plan to extend the Beth Condon Path approximately 3,200 feet (.61 miles) along the easterly side of Route 1 from Exit 17 to the Cousins River Bridge. With the Cousins River Bridge replacement under design development, Freeport and Yarmouth have requested inclusion of the shared use path on the new bridge in anticipation of extension of the multi-use trail to the YMCA. In concert with Yarmouth’s extension of the Beth Condon Path to the Cousins River Bridge and the bridge replacement project, the Town of Freeport will take up the task of completing the trail segment from the Cousins River Bridge to the YMCA.

Cousins River Bridge Replacement: The Route 1 Cousins River Bridge is currently in design development for a replacement bridge. As of February 27, 2019, the last Bridge Advisory Committee meeting, three options were under consideration. (update after Thursday’s meeting)

Route One Corridor Plan: In February, 2018, the North of Portland Complete Streets Corridor Plan was completed, showing proposed improvements to Route 1 in Falmouth, Cumberland, Yarmouth and Freeport to make it a complete street. The plan recommended extension of the Beth Condon Path as described in this project.

2. Scope of Work Background and Purpose: In May 2019, the Town of Yarmouth approached the Maine Department of Transportation (MaineDOT) to evaluate the feasibility, cost and impacts of a multi-use trail extension in Yarmouth, ME. The study will recommend the optimal trail location, identify right-of-way impacts, identify any stream or wetland crossings and include public involvement. The study will identify safety concerns including roadway connections, exiting highway crash information, etc. It will consider alternatives that take into consideration cost, right-of-way limitations, and the trail user experience to determine the best alignment for further development. It will include a final report with conceptual plans including cross sections.

Task 1 – Project Kick-Off The consultant team with meet with the study team including representatives from the Town of Yarmouth and MaineDOT under a collaborative planning process as follows: • Identify and understand local issues • Identify and understand relevant state and federal regulatory requirements • Finalize scope of work • Develop purpose and need • Identify previous related study efforts and available data • Identify transportation data that will need to be collected • Identify baseline environmental data, including potential fatal flaws, which will need to be collected. • Identify criteria for ranking of alternative trail alignments.

The consultant team will review available information provided by the Town of Yarmouth and MaineDOT. Task 3 – Evaluate Potential Multi-Use Path Locations The consultant team will evaluate the existing and recent historic performance of traffic and baseline environmental information in the study area based on traditional forecasting and growth models. Alternative path alignments will be evaluated and assessed according to the ranking criteria identified in Task 1. The assessment will include but not be limited to: • Analysis of current traffic conditions. The analysis will include traffic patterns, capacity, speeds, and crash experience • Identification of bicycle and pedestrian deficiencies • Evaluation of existing right-of-way ownership • Evaluation stream crossings and wetland information • Review analyses with team members and discuss possible recommendations and additional alternatives to be considered. • Identify and assess baseline environmental data including but not limited to the following: o Registered historic properties o Public parks and recreation areas o Wetlands o Endangered species such as bald eagle nests o Etc. • Evaluate the quality of the trail user experience under alternative alignments, including factors such as noise, scenic character, etc.

Task 4 Develop Preliminary Recommendations Based on the analysis of alternatives determined in Task 4, the consultants will develop recommendations. .

• The recommendations will include a discussion of the potential and degree of effort associated with environmental analysis, secondary, cumulative impacts, etc., including anticipated future costs of remaining planning, design and construction phases. Recommendations for on off-street multi-use path should include a matrix comparing alternatives as applicable with particular attention to fatal flaws that could prevent permitting of a path. • Develop cost estimates for recommendations (including construction and potential right- of-way costs).

• Develop a draft report containing the analysis of existing and future conditions, alternatives analysis, and recommendations, including a matrix summarizing recommendations. • Develop basic conceptual renderings of recommended alternatives on aerial photography.

Task 5 Public and Agency Feedback The consultant team should expect to with meet with the study team including representatives from the Town of Yarmouth and MaineDOT up to three times including task 1. The consultant team should expect to attend and present at up two meetings during the study.

Task 6 – Final Report The Tasks discussed above will be combined into a final narrative report documenting the project. At a minimum the report will include a narrative of the study process, a description of the various alternatives considered, documentation of the evaluation criteria, and illustrations of conceptual designs and cross sections for the preferred alternative. The final report will incorporate all applicable technical memorandums.

Please accept this submission of a five-year project implementation plan of the Yarmouth portion of the North of Portland Route One Complete Streets Corridor Plan of February 2018. These project recommendations have been developed in consultation with Dan Ostrye, Chair of the Bike and Pedestrian Committee, a subcommittee of the Parks and Lands Committee. [Please note, at this writing the Opinions of Cost are not verified or reviewed by the Town Engineer or Public Works Director, but are based on consultations with those individuals, Town Tree Warden, and costs of recent projects.]

1. Sidewalk from Mr. Bagel/Pratt-Abbott to Mercy Quick Care, in concert with related stream culvert repair and stabilization. This project will connect existing sidewalks recently installed in front of the Pratt-Abbott/Mr. Bagel facility at 431 Route 1 with the existing sidewalk in front of the Mercy Quick Care facility at 385 Route 1. The sidewalk will connect these businesses with Clayton’s, NYA, and the new sidewalk to Main Street associated with the new Rt. 1 Bridge over Main Street including a pedestrian actuated signalized crosswalk from NYA to Rite-Aid and the Beth Condon Path and the businesses at Yarmouth Marketplace. This project has been engineered by Baker Design Consultants, with a cost estimate pending. The sidewalk portion extends approximately 165’, including 135’ supported by a block retaining wall across the streambed and extended culvert.

22 7.3 Opinion of Cost: We have a cost estimate to repair and slip-line the existing culvert and construct the retaining wall on east side with 6’ sidewalk, for a total cost of $246,016. I have highlighted the items in the cost estimate, Attachment 3, that are associated with the retaining wall and sidewalk, to separate the sidewalk cost from the culvert improvements costs, in an approximate way. This yields a total cost of $135,000 out of the project costs attributable to the sidewalk portion of the project. This is important if the funding is split between stormwater management sources and Rt. 1 TIF sources.

We have applied to the PACTS Municipal Partnership Initiative program (MPI) for $133,333, which is 1/3 of the $400,000 Northern Sub-Region allocation. The project description includes this project and project #2, below. (The Northern Subregion has agreed to split the $400,000 equally, which is very likely to be approved by the PACTS Policy Committee.)

2. Mid-Block Pedestrian Crossing, Mr. Bagel to Beth Condon Path and Yarmouth Marketplace. This project provides a mid-block crossing between the existing Rite-Aid/NYA signalized crossing and the signalized crossing at Portland Street. The distance between the existing pedestrian crossings of Route 1 is approximately 2,000’, effectively preventing convenient access to and from businesses along Route 1 and resulting in unsafe crossings at unprotected and unmarked locations. The crossing proposed at 431 Route 1 includes a small landscaped refuge island with two Armstrong Maple trees, and a pedestrian actuated Rapid Rectangular Flashing Beacon (RRFB).

3. Sidewalk from Bayview Street (spur) to Maples Entry Drive (881 Route 1) with Crosswalk to East Main Street Ramp. This sidewalk will connect Bayview Street with a spur to Route 1 adjacent to the East Main Street Bridge, extending northerly approximately 370’ to the signalized intersection at Maples at 881 Route 1 and the East Main Street Ramp. A crosswalk will be provided across Route 1 to the East Main Ramp, southerly side, and the Beth Condon Path. The median will provide a pedestrian refuge, with four Armstrong Maple trees.

4. Beth Condon Memorial Path Extension, 940 route 1 (O’Brien Auto Parts) to Exit 17. This project extends the BCMP northerly from its existing terminus at 940 Route 1 to Exit 17, (a distance of approximately 1,800’), along the west side of Route 1 to the newly signalized intersection at Exit 17, there crossing to the easterly side of Route 1. The project also includes a 5’ sidewalk extending from Exit 17 on the westerly side of Route 1 to the MaineDOT Visitors Center, (a distance of approximately 780’). This project also includes the reconfiguration of the southbound off ramp from I-295 onto Route 1 to eliminate the “sling-shot” ramp/slip lane onto Route 1, with a stop sign controlled intersection. A pedestrian activated RRFB will be provided at this intersection crossing. This project is PACTS funded for a Preliminary Design Report, which will position the project for capital funding in the 2020-2021 biennial budget.

In future projects, the BCMP will ultimately be extended northerly along the east side or Route 1 across the Cousins River Bridge, which will be replaced with a new bridge including the BCMP crossing, and into Freeport to the Casco Bay YMCA.

Concept Plan for Extension of Beth Condon Memorial Pathway to Exit 17

Opinion of Cost: $580,000, of which 80% will be federally funded, and 20%, or $116,000 is the local match. Please see Attachment 2 for detailed cost estimate documentation.

5. Sidewalk from Patriot Insurance to Willow Street with Crosswalk Across Willow, East Side. When Patriot Insurance was constructed in 2017, a sidewalk was constructed along their property line, connecting via signalized crosswalk to the Beth Condon Path at Forest Falls Drive. This project extends the sidewalk from Patriot’s northerly property line to Willow Street, across the Tire Warehouse property at 731 Route 1. A crosswalk is included on the easterly side of Route 1 across Willow Street, joining the existing signalized crosswalk across Route 1 to the Hannaford Shopping Center and the Beth Condon Path. The existing Route 1 center paved median is proposed to be landscaped with three Armstrong Maple trees.

6. Beth Condon Path Extension from School Street to Forest Falls Drive. This project extends the Beth Condon Memorial Path along Route 1 from School Street to Forest Falls Drive, a distance of approximately 1,000’, with a RRFB protected crosswalk across the School Street intersection. The plan calls for the BCMP to occupy the westerly travel lane over the bridge and to the connection to the existing BCMP at Forest Falls Drive, which necessitates a crash tested barrier to the travel lane. On the south end of the bridge, the BCMP shifts off of Rt. 1 onto the adjacent land area. The Route 1 Complete Street Plan shows how the School Street southbound off ramp is accommodated south of the bridge.
