18 November 2008 at 10.45Am EAST AYRSHIRE LICENSING BOARD Minute of the meeting of East Ayrshire Licensing Board held on Tuesday 18 November 2008 at 10.45am SEDERUNT : Councillor Buchanan, Councillor Campbell, Councillor H Coffey, Councillor Dinwoodie, Councillor J McGhee, Councillor N McGhee, Councillor Ross and Councillor J Sutherland. ATTENDING : Mr S McCall (Depute Clerk to the Licensing Board), Mr D McDowall (Building Standards), Mr G Mair (Environmental Health), Mrs C McEwan and Mr I Hiles (Licensing Standards Officers), Mrs P Duncan and Ms S Gillies (Licensing Board Administrators). Councillor Cree and Councillor Cuninghame were unable to attend the meeting due to other commitments. The Chair welcomed everyone to the meeting and introduced the first item of business. 1. SEDERUNT Noted. 2. MINUTES OF MEETINGS 2.1 Minute of the Licensing Board meeting held on 23 September 2008 was approved and noted. 3. APPLICATIONS Consider applications received under the Licensing (Scotland) Act 2005, Licensing (Scotland) Act, 1976, as amended and the Gambling Act, 2005 – Appendix I. There being no further business, the meeting ended at 12.10pm. As the offence was a relevant conviction in terms of the Licensing (Scotland) Act, 2005, the matter was brought to the Board’s attention. Mr Cairns appeared before the Board and explained that the conviction was a silly mistake on his part. He advised that the driving ban was to be reduced by three months due to him attending a Drink Driving Awareness Course. Activities/Services to be Provided: Restaurant facilities and bar meals will be available. Social functions including weddings, funerals, birthdays, retirements etc., and club/group meetings will be catered for. Recorded music and live performances will be permitted. Gaming, indoor/outdoor sports and televised sport will also be permitted. Activities such as darts, pool, charity/fund raising events, poker, disco, D.J., quiz nights and bingo will also be available. Outdoor drinking facilities will be available. Children and Young Persons: Children and young persons from 0yrs to 17yrs will be allowed entry to the lounge area, games area and beer garden of the premises for the purpose of a meal, to attend a private function and to view live televised sporting events of local and national interest, including football, athletics, rugby, boxing, horse racing and any other major events which customers wish to be involved. They will be permitted to enter the premises between the hours of 11.00am and 8.00pm unless attending a private function where they shall be permitted to remain on the premises until the termination of the function, but not later than the terminal core hour for that date. The Depute Clerk highlighted that the applicant intended to allow children within the premises to view live televised sporting events of local and national interest, including football, athletics, rugby, boxing, horse racing and any other major events which customers wished to be involved. The Depute Clerk advised that these premises were inspected by Building Standards on 6 November 2008 and found to be satisfactory. Addressing the occupant capacity of the premises,

    OTHER CHURCHES IN CATRINE THE UNITED SECESSION CHURCH (Later: The United Presbyterian Church) he 1891 Census states that in its early days the population of Catrine “…contained a goodly sprinkling of Dissenters…some of whom travelled to Cumnock to the TWhig Kirk at Rigg, near Auchinleck; but a much larger number went to the Secession Church at Mauchline. The saintly Mr Walker, minister there, becoming frail and not able to attend to all his flock, this (ie.1835) was thought to be a suitable time to take steps to have a church in Catrine”. An application for a site near the centre of the village was made to the Catrine Cotton Works Company, but this was refused by the then resident proprietor who said that: “He could not favour dissent.” A meeting of subscribers was held on 16th June 1835 when it was decided to approach Mr Claud Alexander of Ballochmyle with a request for ground. Mr Alexander duly granted them a site at the nominal sum of sixpence per fall. (A fall was equal to one square perch – about 30.25 square yards.) Another meeting of subscribers on 12th April 1836 authorised obtaining a loan of up to £350 to cover the cost of erecting a building on the site at the foot of Cowan Brae (i.e. at the corner where the present day Mauchline Road joins Ballochmyle Street). James Ingram of St.Germain Street, father of the eminent architect Robert Samson Ingram of Kilmarnock, was appointed to draw out plans. A proposal was approved to place a bottle containing the County newspaper in the foundation.

The 2018/19 programme for Bridge and Culvert Strengthening and Traffic, Transportation and Road Safety were both approved by Cabinet on 21 March 2018. A three year LED street lighting replacement programme commenced in April 2018. This will increase the current number of LED units from around 20% towards 100%. 3. The available budgets for 2018/19 are £5.1 million for carriageways; street lighting £0.250 million; traffic & road safety £0.265 million; bridges £1.0 million; CWSS (Cycling Walking and Safer Streets) £0.166 million; Smarter Choices, Smarter Places £0.112 million; the New Cumnock Flood Works £0.600 million; A70 Glenbuck £1.4 million; SPT £1.215 million; and Sustrans £0.135 million. 4. On 23 June 2020, Network Rail gave notice of its intention to dispose of land at Coal Road, Auchinleck, East Ayrshire (“the land”), in accordance with Condition 17 of its network licence. The land is described in more detail in the notice (copy attached). 2. We have considered the information supplied by Network Rail including the responses received from third parties consulted. For the purposes of Condition 17 of Network Rail’s network licence, ORR consents to the disposal of the land in accordance with the particulars set out in its notice. Reasons for decision 3. We are satisfied that Network Rail has consulted relevant stakeholders with current information and no objections were received. 4. In considering the proposed disposal, we note that: there is no evidence that railway operations would be affected adversely; Network Rail completed the process to remove the land from the strategic freight site list in 2018; and no other reasonably foreseeable railway use for the land was identified. 5. Based on all the evidence we have received and taking into account all the material facts and views relevant to our consideration under Condition 17, we are satisfied that there are no issues for us to address. 6. Prior to 1 April 2014, the Roads Maintenance Units within both authorities had the role of implementing and managing the road works programmes within the geographical areas of both authorities. 3. East Ayrshire Council’s programme for 2016/17 was approved by Cabinet on 10 February 2016. The available budgets for 2016/17 from East Ayrshire Council are £3.305m carriageways; street lighting £250k; traffic & road safety £200k; bridges £1.59m; New Cumnock Flood Work £600k; A71 Moorfield £600k; A70 Glenbuck £1.4m; and A71 Gowanbank £400k. 4. South Ayrshire Council’s programme for 2016/17 was approved by Leadership Panel on 26 April 2016. The available budgets for 2016/17 from South Ayrshire Council are £710k carriageways; street lighting £1.050m; and bridges £325k. 5. The Ayrshire Roads Alliance formally commenced on Tuesday 1 April 2014 and will deliver the programmes across the geographical areas served by East Ayrshire and South Ayrshire Councils through its combined operations unit. 6. Updated progress of programmes 2016-2017 are contained within Appendices One and Two. FINANCIAL IMPLICATIONS 7. The Ayrshire Roads Alliance will deliver the strategic and local services as stated in the Service Plan associated with Roads Operations.

DEVELOPMENT DESCRIPTION 1.1 Full planning permission is now being sought for the demolition of the Cronberry Viaduct and the reconstruction of a new rail overbridge, the demolition and reconstruction of the overbridge at Coal Road in Auchinleck, and the formation of a new underpass access to serve Fore Rogerton Farm. 1.2 The planning application also provides details of the installation of a conveyor system to carry coals won from the existing Gasswater OCCS to the new rail terminus and coal loading facility. The proposed conveyor system will traverse the A70 Road via a new underpass. Details of layout of the proposed rail loading facility have been provided as part of this application. In order to facilitate access, it is proposed to construct a new staggered junction adjacent to the Gasswater OCCS entrance and a new access road to serve the terminus and coal loading facility. 1.3 The coal loading facility will consist of an enclosed loading pad, a rail weighbridge, associated settlement lagoons and a radial stockpile boom at the end of the conveyor system. The conveyor itself will be a low level covered structure to ensure minimal adverse impacts arising from noise and dust.

INTRODUCTION 1.1 Every planning authority must prepare a Development Plan Scheme on at least an annual basis. This sets out the authority’s timetable for preparing and reviewing their Strategic Development Plan or Local Development Plan and outlines how this will be done. The Development Plan Scheme must also contain a Participation Statement which sets out how people can get involved in the plan preparation process. 1.2 East Ayrshire Council does not need to prepare a Strategic Development Plan; instead it is required only to prepare Local Development Plan(s) (LDP). As there is no strategic level development plan for East Ayrshire, the local development plan sets out a strategic vision for the area. 1.3 In April 2017, East Ayrshire Council adopted the East Ayrshire Local Development Plan (2017). This replaced the East Ayrshire Local Plan (2010) for all matters excluding minerals. As stated in previous Development Plan Schemes, the Councils Cabinet decided in August 2013 that a separate Minerals Local Development Plan that would cover all mineral extraction matters should be prepared, in addition to the East Ayrshire Local Development Plan. A separate Minerals Local Development Plan is therefore under preparation. The existing development plan for East Ayrshire now currently comprises the following: East Ayrshire Local Development Plan 2017 Ayrshire Joint Structure Plan – approved November 2007 Minerals East Ayrshire Local Plan 2010 – adopted October 2010 matters only East Ayrshire Opencast Coal Subject Plan – adopted March 2003 In addition to the above mentioned documents, the Council has approved a number of statutory Supplementary Guidance and non-statutory Planning Guidance.
