Conclusion 41 De-mos: A Network for Ideas & Action 5 Preface In the wake of the contested election of 2000, many Americans were shocked to learn that up to 800,000 citizens in Florida were legally barred from voting because of a felony con- viction. These citizens were disproportionately from communities of color, and were among some 4.7 million Americans nationwide who cannot participate in elections because of felony disenfranchisement statutes. Further examination reveals an uneven patchwork quilt of state laws, ranging from some states that do not take away voting rights at all because of a felony conviction, to a number of states that permanently disenfranchise people with felony convictions, resulting in astonishing percentages of citizens deprived of the right to vote. Over the last several years, an energetic movement has sprung up across the United States aimed at restoring voting rights to millions of citizens excluded from our nation’s democratic process. Some states have changed their laws in the past two years to ease the voting rights restoration process. De–mos is proud to be part of this continuing effort. We are currently part of a national collaborative effort of eight organizations, seeking to chal- lenge the constitutionality of felony disenfranchisement laws, repeal or modify these laws through legislative action, and to educate citizens about their voting rights under current statutes. Our partners are the ACLU, the Brennan Center for Justice at NYU School of Law, the Mexican-American Legal Defense and Education Fund, the NAACP, the NAACP Legal Defense Fund, People for the American Way, and The Sentencing Project. This report by political scientist Alec Ewald is an invaluable contribution to those who seek to understand felony disenfranchisement laws. Ewald examines the history of felony disenfranchisement laws, tracing their early development in liberal theory and their explicit racist heritage in the post-Civil War South. He outlines the arguments marshaled in favor of disenfranchisement, and presents a persuasive case that these laws are in con- flict with America’s best ideals and traditions of democracy, and do not further the goals of criminal justice either. De–mos is pleased to present this thoughtful work on a critical challenge for American democracy. We view changing these statutes as one important element of a broader agenda of eliminating barriers to participation in our election process, and, in so doing, helping to achieve a move vibrant and inclusive democracy. Miles Rapoport Steven Carbó President Director, Democracy Program De-mos: A Network for Ideas & Action 7 Executive Summary Almost 4.7 million U.S. adults are now barred from voting because of a criminal convic- tion. The majority of these disenfranchised Americans are no longer incarcerated, and over a million of them have completed their sentences entirely. The United States is the only democracy that indefinitely bars so many ex-offenders from voting. The laws that determine whether citizens with felony convictions can vote — criminal disenfranchisement laws — vary widely across the country. In two states, convicted citi- zens retain their right to vote while incarcerated. In the thirteen harshest states, many crim- inal offenders are denied the vote even after they have completed their terms of incarceration, probation or parole. This report offers a fresh assessment of criminal disenfranchisement law in the United States, based on a comprehensive explanation and analysis of arguments for and against the policy. After describing the state of U.S. disenfranchisement law today and the history of the practice in Western politics, Punishing at the Polls details the claims advanced by advocates and opponents of the policy today. Punishing at the Polls concludes that laws barring criminal offenders from voting should be repealed. Defenders of felony disenfranchisement laws emphasize a few central points. They contend that felons should be deprived of the vote because they have violated the social contract, and so should lose the right to make society’s rules; because they are not trust- worthy, and may commit vote fraud; because they “pollute” the polity; or because barring felons from the polls expresses our respect for the civic process. Arguments for criminal disenfranchisement also have roots in America’s troubling history of racial discrimination. In the late nineteenth century, some state legislatures, espe- cially in the American south, tailored criminal disenfranchisement laws to exclude blacks from the franchise. While the explicitly racist ideology which motivated those policies is almost universally discredited in American public life today, it has played an important role in shaping our country’s disenfranchisement laws. This report systematically critiques the case for felony disenfranchisement laws and exam- ines the negative consequences of these laws. Huntington Library What was the ablest work ever done in America in public relations? An interesting question, to which one historian has already given a succinct answer. The fullest critical biography of Alexander Hamilton thus far written is that by Professor Broadus Mitchell of Rutgers University, which was published in 1957. One chapter is entitled "The Art of Persuasion," and midway it carries one of the most remarkable tributes to Hamilton ever penned. Professor Mitchell discusses in it The Federalist Papers, a majority of which were written by Hamilton and nearly all the others by James Madison. "In parrying blows against and enlisting support for the Constitution," he writes, with his eyes on the year 1788, "the authors of The Federalist did the best job of public relations in history." This statement is substantially endorsed by other historians of the framing and adoption of the American Constitution, our most precious national possession. Supporting the statement are George Bancroft, John Bath McMaster, John Fiske, the two Britons James Bryce and F. S. Oliver and various later writers. When the Constitution was signed in September, 1787, its ultimate fate swayed in the balance. It had to be accepted by the Continental Congress; it then had to be submitted to special conventions in the thirteen states; and it had to be ratified by nine states, or two-thirds of the whole number.

    -1- COLUMBIA AND SLAVERY: A PRELIMINARY REPORT Eric Foner Drawing on papers written by students in a seminar I directed in the spring of 2015 and another directed by Thai Jones in the spring of 2016, all of which will soon be posted in a new website, as well as my own research and relevant secondary sources, this report summarizes Columbia’s connections with slavery and with antislavery movements from the founding of King’s College to the end of the Civil War. Significant gaps remain in our knowledge, and investigations into the subject, as well as into the racial history of the university after 1865, will continue. -2- 1. King’s College and Slavery The fifth college founded in Britain’s North American colonies, King’s College, Columbia’s direct predecessor, opened its doors in July 1754 on a beautiful site in downtown New York City with a view of New York harbor, New Jersey, and Long Island. Not far away, at Wall and Pearl Streets, stood the municipal slave market. But more than geographic proximity linked King’s with slavery. One small indication of the connection appeared in the May 12, 1755 issue of the New-York Post-Boy or Weekly Gazette. The newspaper published an account of the swearing-in ceremony for the college governors, who took oaths of allegiance to the crown administered by Daniel Horsmanden, a justice of the colony’s Supreme Court. The same page carried an advertisement for the sale of “two likely Negro Boys and a Girl,” at a shop opposite Beekman’s Slip, a wharf at present-day Fulton Street.

    Welcome Our joint OAH/NCPH program committee this year faced an unusual set of challenges. It began meeting as controversies over Wisconsin’s budget broke into protest movements against austerity cuts and the rights of Wisconsin’s public employees to bargain collectively. These reactions raised questions about the meaning and practice of democracy in a nation where state and national governments found themselves guided by the principles of free-market capitalism. We had, by then, already selected the overall theme of the meeting, “Frontiers of Capitalism and Democracy,” with a view to reflecting on what our call for papers described as the tensions and complementaries of capitalism and democracy at “frontier” moments in the past. Overall, America’s Frontier Heritage is an excellent work that should be in most libraries and of great interest to all students and general readers who desire to know more about the origins and peculiarities of the American character. Shortly after Lincoln’s tragic assassination a torrent of biographical writing began that has not yet run its course. As of 1939 Jay Monaghan’s standard Lincoln Bibliography listed some four thousand separate titles concerning Lincoln, not including articles. By now five thousand or more such works exist. Although the earliest of the Lincoln biographers were generally the weakest, in 1890 his two former secretaries, John G. Nicolay and John Hay, published their notable ten- volume Abraham Lincoln, A History. It was the result of more than twenty years of personal knowledge and careful note-taking by alert and intimate observers of Lincoln’s role as president. Furthermore, Lincoln had cooperated with his secretaries in gathering relevant manu- script materials. Although Nicolay and Hay had every possible op- portunity to present a biography of the “inner Lincoln,” particularly in times of great national stress, they fashioned instead a conventional history of the United States from Lincoln’s birth until the end of the Civil War, serialized first for Century Magazine.
