THE CHALLENGE: No less than 5 applicants have submitted applications to the DEPARTMENT OF MINING for the right to build an open-cast tungsten and molybdenum mine, one of these 50 hectares in extent and 200 metres deep, in the Moutonshoek Valley, between Piketberg and Elands Bay in the Western Cape. The Moutonshoek is a narrow valley, approximately 17 kilometres long and 3-4 kilometres wide, on the slopes of the Piketberg-mountain. THE VERLORENVLEI COALITION will oppose the proposed mining because: 1. It will destroy productive and profitable farms and detrimentally affect the food security of the Western Cape.

AND 86 OTHER PARTIES Respondents JUDGMENT DELIVERED: 25 AUGUST 2011 ______________________________________________________________ BINNS-WARD J: [1] The applicant, which is a municipality established in terms of the Local Government: Municipal Structures Act 117 of 1998 (‘the Structures Act’), has applied for eight declaratory orders. If granted, the declarators sought would be to the effect that the ‘rural levies’ imposed by it in respect of properties in its area in the 2001/2 and 2002/3 financial years were lawfully and validly imposed, as were the rates levied by it on rural property within its area in the 2003/4, 2004/5, 2005/6, 2006/7, 2007/8 and 2008/9 financial years. (In terms of the applicable statutory provisions, a municipality’s financial year has, during the entire period concerned, run between 2 1 July in each year and 30 June of the succeeding year.1) The orders are sought because it has been contended by the respondents, who make up a significant number of the owners of rural property within the municipal area, that the aforementioned imposts are invalid. [2] The respondents have declined to make payment of the assessed rural levies and rates and have defended enforcement proceedings instituted against them by the municipality in various magistrates’ courts in the municipal area. Both sides in the disputes have agreed that the current proceedings might afford a convenient means of cutting the Gordian knot; in particular, because they are also agreed that a determination of the alleged invalidity of the imposts is a matter beyond the jurisdiction of a magistrate’s court.

The proposed activity is the construction of a powerline to evacuate electricity from the Boulders Wind farm (NID and HIA completed by Kathryn Smuts 2018) to the Eskom distribution network. Some 5 routes have been proposed of which route 3 is considered the most favorable by the proponent. Given that the entire landscape incorporating all the 5 routes has been surveyed and heritage sites recorded, it is with confidence that the impacts on heritage are assessed. Impacts Paleontology All the proposed activity is confined to the granite hills terrain which is considered not very palaeontologically sensitive. This fact combined with the small footprint of the proposed activity means that the chances of encountering any paleontological material are extremely low. As a precaution, a fossil finds protocol is included in Appendix 1. Mitigation • No specific mitigation is recommended • In the unlikely event of a find, the matter must be reported to Heritage Western Cape and a Palaeontologist. • The fossil finds protocol must be implemented. Archaeology The impact on archaeology and historic sites is very low, with only one archaeological site previously identified in the corridor of Route 3.

    WARD PLAN: WARD 1: FOURTH INTEGRATED DEVELOPMENT PLAN 2017 - 2022 BERGRIVIER MUNICIPALITY WARD PLAN WARD 3 2017 – 2022 1 | P a g e WARD PLAN: WARD 1: FOURTH INTEGRATED DEVELOPMENT PLAN 2017 - 2022 7.3.1 PURPOSE OF WARD PLANS The Fourth Generation IDP (Chapter 4) has significant updated information on the demographic profile of the Bergrivier municipal area. This information forms the baseline to make informed decisions on the future of Bergrivier and therefore defining the vision. One of the most serious constraints currently in the drafting of an IDP is the lack of detailed information on a ward level. Most of the new information obtained, is only available on a municipal level. The problem is further exacerbated by the fact that ward boundaries are political boundaries and could potentially (and did, in preparation for the 2016 elections) change every 5 years. For these reasons, the baseline information of ward plans will be the baseline information of the relevant local communities and rural areas. This information may at the time of approving the Fourth Generation IDP not be complete and will be updated continuously during the term of the IDP. A survey is currently in the final phase of completion and will enable the municipality to determine the estimated number of people and households in each ward. This will contribute to the development of a more reliable demographic profile for each ward. However, to ensure a comparative analysis, the 2011-statistics (StatsSA) will form the base of an exercise to determine an estimated, projected demographic profile. The study undertaken by the Department of Agriculture in 2016 on households in the rural areas, will also be incorporated into a complete profile.

This SWOT analysis informs the Economic Development Strategic Framework outlined in Chapter Three. 2.2 FOREIGN DIRECT AND DOMESTIC INVESTMENT AND INTERNATIONAL TRADE International economic linkages account for an increasing share of economic activity and constitute an important potential area for economic growth and job creation. This section identifies key trends in the following areas: • Foreign Direct Investment • Domestic Investment • International Trade • Tourism As a result of these global trends, an estimated 50% of South Africa's future economic growth is dependent on its ability to position itself strategically on a global scale: • Exports of goods are expected to be a driving force for economic growth, contributing 25% of new growth in GDP over the next five years, and projected to grow at an annual average of 3% p.a. • Exports of services will dramatically grow in importance, contributing over 10% of GDP growth and growing at over 10% p.a. 2.2.1. Foreign Direct Investment The West Coast District has attracted very little foreign direct investment over the past five years, with the recent exception of the MAN Ferrostaal investment in Saldanha. It also affords an opportunity to undertake oversight visits and interact with communities in order to get first-hand information on the needs and challenges that are confronting the people. The committees also visit projects that are implemented by various government departments in the province. The Social Cluster Visit Week afforded the standing committees an opportunity to visit areas outside the Cape Town metropolitan area.
