Kaufman, declare under penalty of perjury: 1. I am a Partner of Hogan Lovells US LLP, located at Columbia Square, 555 Thirteenth Street, NW, Washington, D.C. 2004 (“HLUS”). 2. Intelsat S.A. and its affiliates, as debtors and debtors in possession (collectively, the “Debtors”), have requested that HLUS continue to provide legal services to the Debtors as an ordinary course professional pursuant to section 327(e) of the Bankruptcy Code in the Debtors’ chapter 11 cases (collectively, the “Chapter 11 Cases”), and HLUS has agreed to provide such services. Such services may be provided by HLUS directly and/or through its affiliated businesses, including Hogan Lovells International LLP (collectively, the “Firm”), through arrangements with HLUS. 3. The Firm may have performed services in the past, may currently perform services, and may perform services in the future in matters unrelated to the Chapter 11 Cases for persons or entities that are parties in interest in the Chapter 11 Cases. See Schedule A attached 1 Due to the large number of Debtors in these Chapter 11 Cases, for which joint administration has been granted, a complete list of the Debtor entities and the last four digits of their federal tax identification numbers is not provided herein. A complete list may be obtained on the website of the Debtors’ proposed claims and noticing agent at https://cases.stretto.com/intelsat. The Firm does not perform services for any such person in connection with the Chapter 11 Cases. 4. As part of its customary practice, the Firm is retained in cases, proceedings, and transactions involving many different persons and entities, some of whom may represent or be employed by the Debtors, claimants, and parties in interest in the Debtors’ Chapter 11 Cases. 5. Neither I, nor any partner or associate of the Firm, insofar as I have been able to ascertain, holds or represents any interest adverse to the Debtors or their estates with respect to the matters on which HLUS is to be employed by the Debtors as an ordinary course professional. 6. Neither I nor any partner or associate of the Firm has agreed to share or will share any portion of the compensation to be received from the Debtors with any person other than partners and associates of the Firm. 7. The Debtors do not owe the Firm any amounts on account of services rendered and expenses incurred prior to the commencement of the Chapter 11 Cases in connection with HLUS’ employment by the Debtors. 8. As of May 13, 2020, which was the date on which the Debtors commenced their Chapter 11 Cases, the Firm was not party to an agreement for indemnification with any of the Debtors. 9. If at any time during its employment as an ordinary course professional in the Debtors’ Chapter 11 Cases HLUS discovers any facts bearing on the matters described herein, HLUS will supplement the information contained in this declaration.
