Israel 2017 International Religious Freedom Report ISRAEL AND THE GOLAN HEIGHTS 2017 INTERNATIONAL RELIGIOUS FREEDOM REPORT Executive Summary A report on the West Bank and Gaza, including areas subject to the jurisdiction of the Palestinian Authority (PA), is appended at the end of this report. This section includes Israel, the Golan Heights, and issues primarily related to Israeli residents of Jerusalem. Issues primarily related to Palestinian residents of Jerusalem are covered in the “West Bank and Gaza” section. On December 6, the United States recognized Jerusalem as the capital of Israel. It is the position of the United States that the specific boundaries of Israeli sovereignty in Jerusalem are subject to final status negotiations between the parties. The Basic Law describes the country as a Jewish state and protects the freedom of conscience, faith, religion, and worship, regardless of an individual’s religious affiliation. Some Members of the Knesset (MKs) and government officials called for reversing the policy of banning non-Muslim prayer and the government’s ban on MKs at the Temple Mount (the foundation of the first and second Jewish temples) and the Haram al-Sharif (containing the Dome of the Rock and the Al- Aqsa Mosque), but Prime Minister Benjamin Netanyahu publicly repeated his support for both bans. The prime minister, however, allowed MKs, including two Jewish MKs, to enter the compound for one day in August, and one Jewish MK entered on October 25. One Muslim MK visited without permission from Prime Minister Netanyahu on July 27. The government permitted persons of all faiths to pray at the main Western Wall plaza in separate gender sections, but continued to enforce a prohibition on mixed gender Jewish prayer services. On June 25, the government suspended a January 2016 compromise agreement with non-Orthodox Jewish movements regarding “egalitarian prayer,” i.e., Reform and Conservative Jewish services, south of the main Western Wall plaza. The government implemented policies based on Orthodox Jewish interpretations of religious law. For example, the only in-country marriages the government recognized for Jews were those performed by the Chief Rabbinate, which refused to wed persons who did not qualify as Jewish under the Chief Rabbinate’s criteria. Three Muslim citizens shot and killed two Israeli police officers, both of whom were Druze, near the entrance to the Temple Mount/Haram al-Sharif on July 14. The attackers escaped to the Temple Mount/Haram al-Sharif, where other Israeli police officers shot and killed them. On June 25, following ultra-Orthodox parties’ objections to elements of a January 2016 agreement with non-Orthodox Jewish groups that offered symbolic recognition to the Conservative and Reform movements, the ISRAEL, GOLAN HEIGHTS, WEST BANK AND GAZA 2 cabinet voted to “freeze” the agreement. Media reported on September 19 that Prime Minister Netanyahu expressed support for greater religious pluralism for Jews in Israel, but stated that he “won’t solve” the disparity between laws based on halacha (Jewish law) and public practice by the non-Orthodox majority. The government maintained its policy not to accept new applications for official recognition from religious groups, while stating that members of nonrecognized religious groups remained free to practice their religion. Government resources available for religious or heritage studies to Arab and non-Orthodox Jewish public schools remained significantly fewer than those available to Orthodox Jewish public schools. Caretakers at a Muslim cemetery in Jaffa discovered several smashed gravestones on April 23. The Jerusalem District prosecutor indicted an ultra-Orthodox man on September 4 for painting graffiti and death threats against Reform Jewish leaders on a reform synagogue in Ra’anana in November 2016. Tension continued between the ultra-Orthodox community and other Israelis, including concerns related to service in the Israel Defense Forces (IDF), housing, public transportation, and participation in the workforce. The media reported attacks and threats by ultra-Orthodox assailants against soldiers and those encouraging ultra- Orthodox men to enlist in the military, including throwing stones at Defense Minister Avigdor Liberman on August 8, posting signs threatening IDF Human Resources Branch Director Major General Moti Almoz in May and June, and burning effigies of IDF soldiers on May 13. According to missionary organizations, societal attitudes toward missionary activities and conversion to other religions continued to be negative. Some Jews continued to oppose missionary activity directed at Jews, saying it amounted to religious harassment, and reacted with hostility toward Jewish converts to Christianity. Jehovah’s Witnesses described violent attacks, such as a July 20 assault by a woman against a Jehovah’s Witness member in Tel Aviv, hitting her face and legs. According to the Latin Patriarchate of Jerusalem, in September vandals shattered stained-glass windows and committed other acts of vandalism in St. Stephen’s Church at the Beit Jimal Monastery near Beit Shemesh for the third time in four years. The U.S. Ambassador and embassy officers spoke with government officials and Knesset leaders about the importance of maintaining the status quo at the Temple Mount/Haram al-Sharif and not escalating tensions through provocative actions or statements. In meetings with government officials and public speeches, the Ambassador and embassy officers stressed the importance of religious pluralism and respect for all religious groups. Visiting high-level U.S. officials, including the President, the U.S. Ambassador to the United Nations, the Special International Religious Freedom Report for 2017 United States Department of State • Bureau of Democracy, Human Rights, and Labor ISRAEL, GOLAN HEIGHTS, WEST BANK AND GAZA 3 Representative for International Negotiations, and the Special Advisor for Religious Minorities in the Near East and South/Central Asia, met with government officials, religious groups, and civil society leaders to stress tolerance and dialogue and ways to reduce religiously motivated violence. Embassy- supported initiatives focused on interreligious dialogue and community development and advocated for a shared society for Jewish and Arab populations. Embassy officers participated in religious events organized by Jewish, Muslim, Druze, and Christian groups to show U.S. support for religious pluralism. Section I. Religious Demography The U.S. government estimates the population at 8.3 million (July 2017 estimate), which includes residents and citizens living in the Golan Heights, as well as 201,000 Israelis in East Jerusalem (2014 estimate). According to the Central Bureau of Statistics (CBS) classification system, approximately 75 percent of the population is Jewish, 18 percent Muslim, 2 percent Christian, and 1.6 percent Druze. The remaining 4 percent consists of those the CBS classifies as “other” – mostly persons, including many immigrants from the former Soviet Union, who identify themselves as Jewish but do not satisfy the Orthodox Jewish definition of “Jewish” the government uses for civil procedures – as well as relatively small communities of Samaritans, Karaites, Ahmadi Muslims, and Jehovah’s Witnesses. The majority of non-Jewish citizens are of Arab origin. This includes 134,000 out of 170,000 Christians, according to an April 3 report from the Knesset Research and Information Center. In addition, according to the Latin Patriarchate of Jerusalem, there are approximately 65,000 noncitizen Christian laborers in the country, mostly from Asia. There are also approximately 27,500 Christian “irregular” migrants from Eritrea and approximately 79,000 persons who overstayed tourist visas, mostly Christians from Ukraine and Georgia. According to a poll by the local NGO Hiddush published in September, 59 percent of Jewish Israelis do not affiliate with any religious stream, 18 percent are “Zionist Orthodox,” 11 percent “ultra-Orthodox” (including 2 percent who chose “Zionist ultra-Orthodox”), 6 percent chose “Reform,” and 5 percent “Conservative.” There is also a community of approximately 20,000 Messianic Jews, as reported by the Messianic Jewish community. Bedouin Muslim communities are concentrated in the Negev and many majority Druze, Christian, and Muslim communities are located in the Galilee region, some of which are homogenous and others a mix of these groups. According to government statistics, as of September 30, there were 86,870 legal foreign workers in the country, 74,212 Palestinian legal workers, and 18,555 undocumented workers (not including Palestinians). The government did not have information on the number of undocumented Palestinian workers. According to the UN High Commissioner for Refugees, there are approximately 38,000 African migrants and asylum seekers residing in the country. Foreign workers and migrants include Protestants, Roman Catholics, Orthodox Christians, Buddhists, Hindus, and Muslims. Section II. Status of Government Respect for Religious Freedom Legal Framework There is no constitution. The Basic Law describes the country as a “Jewish and democratic state” and references the Declaration of the Establishment of the State of Israel, which promises freedom of religion and

In 1931 William Butler Yeats concluded his short poem, “Remorse for Intemperate Speech,” with a stanza that speaks to me as the person I am, for better or for worse: Out of Ireland have we come. Great hatred, little room, Maimed us at the start. I carry from my mother’s womb A fanatic heart. Ireland is, indeed, a small place, and it has seen great fanaticism and hatred, although the temperature of Ireland as a whole has subsided dramatically since the Good Friday Agreement of 1998, despite Boris Johnson. The whole island of Ireland today occupies 32,599 square miles. British-administered Northern Ireland includes 5,340 of those square miles. Combined Northern Ireland and the Republic of Ireland approximate the size of Indiana. The total population of the island of Ireland is 6.7 million people, about a half a million more than the population of Indiana. There is another place of “great hatred, little room” that I wish to discuss this evening: the Holy Land, made up today of the State of Israel and the Palestinian autonomous regions of the West Bank and the Gaza Strip.

LOEWENBERG* “The 144-dunam al-Aqsa Mosque/al-Haram al-Sharif is a place of wor- ship and prayer for Muslims only,” according to Zaid Lozi, Secretary- General of the Jordanian Ministry of Foreign Affairs.1 This statement that the Temple Mount in Jerusalem is exclusively a Muslim holy site is not new, but merely repeats what has been a basic position of the Arab world for many centuries. Because of this belief non-Muslims were pro- hibited for centuries from going up on the Temple Mount. It is widely believed that no Jew ascended the Temple Mount in the 450 years prior to the Israel army’s capture of East Jerusalem in 1967.2 While there are many reports of Jewish activities on the Temple Mount in the millennium prior to the Ottoman conquest of Jerusalem in ,1517 3 after that date the ascent of Jews and all other non-Muslims was strictly prohibited. An unsubstantiated folktale has it that the Western Wall was awarded to the Jews as a place of Jewish prayer in compensation for any rights they previously had on the Temple Mount. Actually, the prohibition of Jews from going up to the Temple Mount was in effect already prior to the Ottoman conquest.     ISRAEL 2015 HUMAN RIGHTS REPORT EXECUTIVE SUMMARY Israel is a multiparty parliamentary democracy. Although it has no constitution, the parliament, the unicameral 120-member Knesset, has enacted a series of “Basic Laws” that enumerate fundamental rights. Certain fundamental laws, orders, and regulations legally depend on the existence of a “state of emergency,” which has been in effect since 1948. Under the Basic Laws, the Knesset has the power to dissolve the government and mandate elections. The nationwide Knesset elections in March, considered free and fair, resulted in a coalition government led by Prime Minister Benjamin Netanyahu. Civilian authorities maintained effective control over the security services. (An annex to this report covers human rights in the occupied territories. This report deals with human rights in Israel and the Israeli- occupied Golan Heights.) During the year according to Israeli Security Agency (ISA, also known as Shabak) statistics, Palestinians committed 47 terror attacks (including stabbings, assaults, shootings, projectile and rocket attacks, and attacks by improvised explosive devices (IED) within the Green Line that led to the deaths of five Israelis and one Eritrean, and two stabbing terror attacks committed by Jewish Israelis within the Green Line and not including Jerusalem. According to the ISA, Hamas, Hezbollah, and other militant groups fired 22 rockets into Israel and in 11 other incidents either planted IEDs or carried out shooting or projectile attacks into Israel and the Golan Heights.     Undecided Past – National Identities and Politics of Diversity: The Mount Eytan Commemoration Site udi lebel Sapir College and Ariel University Center, Israel zeev drory Kinneret College, Israel in 1982 the israeli government launched a proposal to establish a national commemoration site on Mount Eytan. Despite intensive activity, the project was shelved in 2002. The article presents official discourses regarding memory, commemoration, and setting collective boundaries. It presents the theoretical arguments as well as conflicting processes in politics of memory in Israel, which occurred along a different axis and regarding different variables. Finally we discuss the social and political significance arising from the project’s management and in terms of creating consensus in an age of privati- zation, to the extent that projections can be made from an event of this nature. The museum is a cultural agent acting within national politics to manufacture representation of (subjects of) the past and ‘graft’ them as objects (Katriel 1997b, 147). Museums are sites where links between memory and history are created, in such a way that the sub-group which initiates the memory aspires, using a unique narrative, for its past to be transformed into the individual memory of each visitor (Katriel 1994, 1). Narratives of the past thus become relevant both for understanding the present and for internalizing recommended ways of coping with it (Katriel 1993, 69). If the process unfolds in a manner approved by the establishment, this sites will become state-supported museums that the public is encouraged to visit (Barena 1989, 118). Economic considerations, among others, propel many museums into the heart of consensus.

    Chapter 4 St Francis and the Holy Land in the Fifteenth Century From around the turn of the sixteenth century onwards, when the Francis- cans had been established in the Holy Land for almost two hundred years, they began to articulate increasingly sophisticated ideas about their own role within this region. Not only did the (by this time) Observant friars come to view receiving and conducting all Western European pilgrims as their preroga- tive, as was discussed in the previous chapter, but they also began to claim the Holy Land as an essentially Observant Franciscan territory (see chapter five). In order to substantiate this claim to the Holy Land, the friars looked to the past. By constructing their own particular narrative of the history of the Holy Land, they were able to create a cultural memory to support their identity as divinely appointed keepers and possessors of (or even heirs to) the Holy Land. By studying and reinterpreting the past they aimed to give substance to their ideological relationship with the Holy Land. This chapter examines the first, late fifteenth-century, example of a text by an Observant Franciscan that analyses the past in order to point out the present significance of the custodia Terrae Sanctae: book vii of friar Paul Wal- ther von Guglingen’s Treatise on the Holy Land. Book vii is firmly grounded in the then existing tradition at the Franciscan convent in Jerusalem of com- piling manuscripts with historical texts relating to the Holy Land. Nonethe- less, Guglingen’s text is also innovative. It synthesizes a new and coherent history of Jerusalem and the Holy Land, based on the sources present in the convent library in Jerusalem, something that had not previously been at- tempted by a friar of the Franciscan custody of the Holy Land.

    Chapter 3 Politics in the Planning of the Western Wall Plaza The question of how to design and construct the Western Wall plaza arose immediately with the end of the Six-Day War. The total destruction of the Mughrabi Quarter, the empty space created as a result, and the transfer of the Western Wall to the authority of the State of Israel and the Ministry of Religions afforded an unparalleled opportunity to plan and construct the plaza as a site bearing both national and religious meaning. There was general agree- ment that the nondescript, newly created plaza required a process of archi- tectural development. But how was the state to design such an important and significant site to meet the needs of the many worshippers and visitors, one befitting its status as a Jewish holy place and an Israeli symbol? How should the site be rebuilt in order to serve as a place of worship and religious com- munion and simultaneously as a historical and national emblem? The answers to these questions, as we will see below, turned out to be exceedingly complex and sensitive. The indecision regarding the architectural design of the Western Wall became the subject of an incisive and prolonged public and political de- bate in Israel; in it, Israeli and Jewish values, religion and nationality, and past and present all came into conflict. The present chapter focuses on the struggle surrounding the issue of the design and renovation of the Western Wall plaza in the first decades follow- ing the Six-Day War, and analyzes the political forces that put this process in motion.

    CUSTODY OF THE HOLY LAND Order of Friars Minor Report Summary 2010/2011 The Custody of the Holy Land tirelessly continues its mission, begun several centuries ago, to conserve and protect the holy places in the Land of Jesus. This includes celebrating the liturgy, assisting Pilgrims, and carrying out multiple apostolic works, especially for the benefit of the Christian communities. In the year 2010/2011, particular attention has been paid to the planning and execution of projects in the following areas: HOLY PLACES I) PILGRIMS 1. Bethlehem • Parish Church of St. Catherine ¾ Completion of work on the lighting system inside the Church of St. Catherine. 2. Jerusalem • Convent of St. Saviour ¾ Renovation of the “Studio Teologico” and restoration of the Convent of St. Saviour. ¾ Work started on the Custodial Library. ¾ Magnificat – School of Music: renovation of bathrooms and entrance stairway. ¾ Renovation of bathrooms in the Sisters’ Convent. • Sanctuary of Dominus Flevit ¾ Completion of restructuring at the Convent of Dominus Flevit, including the sanctuary, gardens and areas reserved for the reception of pilgrims. • Gethsemane ¾ Initial procurement needed for reconstruction of the exterior stone wall, supplies for and installation of steel fence, as required by the Environmental Authorities of Israel. ¾ Beginning restoration and maintenance of the roof of the Basilica of Gethsemane, in order to prevent water seepage. • Sanctuary of the Flagellation Studium Biblicum Francescanum 1 ¾ Concluding restoration of the “Hall of Crusaders” at the Convent of the Flagellation. ¾ Completing the Library expansion of the Studium Biblicum Francescanum. The project includes the installation of an elevator for greater accessibility to the premises, as well as renovation of mobile and fixed shelving.
