The first chapter deals with the po litical, social and religious background of ‘ Abd al-M alik, and relates this to his later policy on becoming caliph. Chapter II is devoted to the ‘ Alid opposition of the period, i.e . the revolt of al-Mukhtar ibn Abi ‘ Ubaid al-Thaqafi, and its nature, causes and consequences. The ‘ Asabiyya(tribal feuds), a dominant phenomenon of the Umayyad period, is examined in the third chapter. An attempt is made to throw light on its causes, and on the policies adopted by ‘ Abd al-M alik to contain it. -

It consists of a note on the sources and seven chapters. The first chapter is a biographical review of al-Hakim's person. It introduces a history of his birth, childhood, succession to the Caliphate, his education and private life and it examines the contradiction in the sources concerning his character. Chapter II discusses the problems which al-Hakim inherited from the previous rule and examines their impact on the political life of his State. Chapter III introduces the administration of the internal affairs of the State. -

They demanded from the wazir sahib al-ahkàm Ibn al-Layt that he should be expelled from their market and be detained from acting within it. The document presented by the claimant to Ibn al- Layt as judge attested to the damage caused by the muhtasib and his use of force against them {tasallutuhü 'alayhim), thus deserving expulsion from their market. In consequence, the wazir sahib al-ahkàm Ibn al-Layt consulted the jurists whether this claim should be granted.» This case taken from the/atowâ-collection al-Ahkàm al-kubm by the ^^âçfJ Ibn Sahl (d. 468/1093)^ might, in a broader Islamic context, be interpreted as a complaint against the market inspector {muhtasib) addressed to a higher official, namely the wazïr sahib al-ahkàm. In the Cordobán setting, however, it is quite evident that the shoemakers sued a private person who had caused damage to them by his conduct. In describing this person as muhtasib, i.e. someone acting on behalf of the Koranic formula «demanding good and forbidding evil»,^ the source already alludes to the rightfulness of his action: We learn that both jurists consulted gave a legal response (fatwà) strongly objecting to the shoemakers' claim. According to the famous jurisconsult Muhammad Ibn 'Attâb (d. 462/1070), «anybody opposing him [i.e. the muhtasib] is more apt for expulsion from the market than he is. -

‘Abd Allah Ibn Al-Zubayr and His Career as Caliph Prof. Dr. Mehmet Mehdi Ilhan∗ Abstract ‘Abd Allah b. al-Zubayr was raised by ‘A’isha in the Prophet’s (s.a.s.) house. Safiyyah, the Prophet’s maternal aunt was his paternal grandmother, ‘A’isha’s sister Asma was his mother, and Abu Bakr his maternal grandfather. ‘Abd Allah b. al-Zubayr’s upbringing and lineage played an important role throughout his life and future career as caliph. Although ‘Abd Allah b. al-Zubayr was undeniably close to ‘A’isha, a very reliable source for the sunna and the traditions of the Prophet, his loyalty to the teachings of the Prophet and particular- ly the warning to those who attribute to the Prophet what he had not said that they would be sent to hell determined his choice of only 33 hadith to transmit. His love for the house of the Prophet and his grandfather Abu Bakr made him a staunch defender of the office of caliphate when he saw it abused by Mu‘awiyah and his son Yazid. ‘Abd Allah b. al-Zubayr ruled over Hijaz and the Eastern provinces from Mecca for nine years. The people of Iraq, Hijaz, and a large part of Syria paid him homage as caliph. After his death in 692 A.D., the caliphate of ‘Abd al-Malik b. Marwan was confirmed. In this paper I will deal with the life and career of ‘Abd Allah b. al-Zubayr and show how the Prophet’s teachings were reflected in his character and behaviour. -

Islam and Appeal* Martin Shapirot Appeal is a legal phenomenon that Westerners tend to accept without question. The orthodox view is that appeal serves to correct trial errors and thus protect individual rights. Uniformity of law is also commonly advanced as a purpose of appeal. Yet appeal is encountered even in autocratic and totalitarian regimes that have no particular re- gard for due process or the rights of individuals. Moreover, in such regimes appeal is typically employed to allow the highest political au- thorities to dispense "personal" justice, or, in other words, to give spe- cial and nonuniform treatment to those favored by those in authority. It is the hypothesis of this Article that the basic explanation for the almost universal adoption of appeal by various legal systems lies not in a commitment to individual rights and legal uniformity as general val- ues, but rather in the benefits that appeal mechanisms provide to cen- tralizing regimes engaged in the solicitation of political loyalty and the facilitation of hierarchical control. It is contended that political hierar- chy is the wellspring of appellate processes. This hypothesis will be applied to the legal system of Islam, which stands alone among major legal cultures in its failure to employ appellate mechanisms. After a brief survey of the primary political implications of appel- late processes in general, various explanations for the absence of appeal in Islamic law will be critically examined. It will be argued that the cultural peculiarities of Islam alone do not explain the absence of ap- peal in Islamic legal cultures, since such mechanisms have developed in similar societies. -
