The Administrator, Union Territory, Chandigarh, is pleased to frame the following bye-Laws in exercise of the powers conferred by Section 399 of Punjab

Municipal Corporation Act, 1976 as extended to the Union Territory, Chandigarh by the

Punjab Municipal Corporation Law (Extension to Chandigarh) Act, 1994, read with sub section (1.) of section 401 of the said Act ibid after the objections from general public are called and settled.

Short Title, Extent and Commencement:- (a) These Bye-Larvs may be callcd the Chandigarh Cycle/Ricksharvs/Load ing Rehri/Animal porvered cart ( Rcgularion and Control) Bye-Larvs. 20 I 9.

(b) These Bye-l-aws shall extend to the wholc o1- U.T., Chandigarh.

Definitions :-

ln these Bye-l-arvs, unless the context othenvise rcquires.

(a) "Animal Powered Cart" means a cart driven b1,one or more animals

e.g. horse or mule or bullock. camel or such Iike anirnals. (b) "Drive" means the pulling/push in-q o1' a C1,cle/Ricksharvs/Loading Rehri/Anirnal porvered carl.

(d) "License" means a license granted under these Bye-l.aws and includes both owner's and driver's Iicense. (e) "Licensing Officer" rreans the ofllcer appointed by the Commissioner, Municipal Corporation, Chandigarh tbr granting Iicence or imposing fine for ricksharv/load ing rehri license/Anirnal Powered Cart.

(f) "Rickshaw and Loading Rehri" rneans a two-wheeled. threc-

rvheeled and tbur-rvheeled carriage attached to a cyclc. which is

driven and propelled by a person and is designed to carry loads and passengcrs. L

(a)No person shall keep a ricksharv/loading rchri/ othcr person on his behall within the plying on hire cither b.v-. hirnself or by any registered *'ith an ottrcer lirr-rits oi Chandigarh' rvithout getting thc same Municipal corporation' authorized in this behall by the commissioner. Chandigarh and rvithout obtaining a driving license' time shall I)rovitled that thc nutnber o1- licctrscs to bc issucd al an)' not exceecl the limit that lna)' bc pre'scribcd hy thc C onrrnissioner' Municipal Corporation. 4.Eligibility:Thelbllorvingconditionsshallbet'ulfrlledbyapersontobecomc cligibleforgrantofregistrationcertiflcateanddril'inglicensefor rickshaw/loading rehri license/Anirnal Porvered Cart:- (a) He/She should be a bonatldc residcnt ol'Chandigarh'

(b) Hc/She should be abovc l8 years ofage' . Procedure to obtain Rcgistration Cerlificate and Driving Liccnse:- 5. ,fhe (a) orvncr o1. cvery ricksharv/load iltg relrri licensc/Anirlal Polvered Cart dcsirous ol obtaining a Registration Certiflcate shall apply in writine in Irorm "C" appended to these B1--c-Larvs to thc Licensinll Officer and produce the rickshaw /loading rehri fbr inspection at

such placc and tirne as the said olficer ua1'appoint. (b) A pcrson desirotts ol' obtaining a driving liccnsc shall apply' in rvriting in Forrn "D" appendcd to these I31c-Larvs to thc L'icensinS Authority alongs'ith three passport size photographs and thc doctll)lents in stlpport of his/her agc and residence like voter card or

Aadhar card or as dircctcd b1' the [.icensing Ol1iccr. (c) The Licensing Officer may either Erant or refuse to grant the

registration certificate or driving license, as the case may be. ln the

case of refusal, the grounds of rejection shall be recorded'

(d) The registration certificate and the driving license will be issued

(e) 'lhe Licensing Olllcer shall delivcr or cause to be delivered to thc owncr. a plate shorving the registratiorr numbcr allottcd to the ricksharv/loading rehri Iiccnse/Aninral Porvered Cart. 3

(l) 'l'he platc shall bc displal'cd at the back ol'thc rickshaw/loading rchri or at a place as speciticd on the rickshau /loading rehri license/Animal Powered Cart. (g) In case the license or the nutnbcr plate issucd or rcnewed under thesc Byc-Larvs is mutilated or destroyed. the Licensing Officcr nray. il'so desire, issue duplicatc liccnse on paYmcnt o1'a f'cc ol'Rs' l00/- onlY. (h) No license or the number plate trndcr these B1"e-[.arvs shall bc

transf-erable. (i) Ilvery licensed driver shall produce his/her liccnse whenevcr requircd to do so by:- (i) Any Magistrate (ii) 1'he Liccnsing Of ficer. the Medical Otficcr ol Hcalth or any Of llcers of Municipal Corporation' Chandigarh. (iii) Any member ol'the Police on duty (iv) Any person hiring the ricksharv and loading rehri.

6. Liccnse ['ce :

(b) In case an application for the rcnewal of registration certiticate or driving liccnse in respect of a rickshaw and loading rehri is made after the expiry of the period, an additional lee shall be charged at thc ratcs.

(f)Drivershallensurethatthcmaximurnrvcightolthcloadshouldnotexceed 150 Kg on a rickshaw and loading rchri'
