  • Dish Hopper Case: a Narrow Reading of Aereo
Reprinted with Permission from Law360 Dish Hopper Case: A Narrow Reading Of Aereo Law360, New York (February 04, 2015, 10:56 AM ET) -- James Dowd U.S. Supreme Court Justice Stephen Breyer promised that the high court’s holding in Aereo was limited. And at least one federal judge seems to agree. In one of the first opinions to apply Aereo, U.S. District Judge Dolly M. Gee of the Central District of California – in the case Fox Broadcasting Company et al. v. Dish Network LLC et al. – rejected Fox’s claim that Aereo applies to the Dish Network’s Hopper technology. The Andrea Weiss Jeffries Jan. 20 decision is one of several that may ultimately confine the impact of Aereo. Last year, after the Supreme Court issued its opinion, legal observers warned that Aereo threatened the legal status of online cloud computing and streaming services. Concerned commentators echoed Justice Antonin Scalia’s dissent, where he signaled frustration with the majority’s apparent disregard for the volitional conduct requirement for direct copyright infringement — a test that had been applied by all of the courts of appeals. He concluded that Elaine Zhong the majority created a “two-tier” version of the Copyright Act, “one part of which applies to ‘cable companies and their equivalents’ while the other governs everyone else.”[1] One commentator wrote that the “uncertainty created by the court seems bound to chill innovation.”[2] While the court’s ruling disrupted Aereo’s business — Aereo filed for Chapter 11 bankruptcy protection just five months after the Supreme Court’s decision — Judge Gee in Fox rejected the notion that Aereo was “gamechanging” with respect to Dish’s Hopper products.

  • Local Information Programming and the Structure of Television Markets
Local Information Programming and the Structure of Television Markets Federal Communications Commission Media Ownership Study #4 Jack Erb* Office of Strategic Planning and Policy Analysis Federal Communications Commission Email: [email protected] May 20, 2011 Abstract: We analyze the relationship between the ownership structure of television markets and the amount of local news and public affairs programming provided in the market (at both the overall market and individual station levels). We find that commercial television stations that are cross-owned with major newspapers in the same market tend to air more local news programming, but that the station-level increase does not translate into more local news programming at the market level. Television-radio cross-ownership has a moderate (but statistically significant) positive impact on local information programming at the station level, and each additional in-market radio station controlled by the television station owner corresponds to additional local news minutes aired by the television station. However, local news programming at the market level is likely to be lower, as the scale economies enjoyed by the cross-owned stations are outweighed by the crowding out of local news programming on other stations. Multiple ownership (i.e., situations in which a single parent controls two or more stations in the same market) does not appear to impact the amount of local information programming at either the market or station level (though this result appears somewhat dependent upon model specification). But we do find that multiple ownership and broadband subscribership have a positive impact on the relative mix of local vs.

  • Preschool Television Viewing and Adolescent Test Scores: Historical Evidence from the Coleman Study
PRESCHOOL TELEVISION VIEWING AND ADOLESCENT TEST SCORES: HISTORICAL EVIDENCE FROM THE COLEMAN STUDY MATTHEW GENTZKOW AND JESSE M. SHAPIRO We use heterogeneity in the timing of television’s introduction to different local markets to identify the effect of preschool television exposure on standardized test scores during adolescence. Our preferred point estimate indicates that an additional year of preschool television exposure raises average adolescent test scores by about 0.02 standard deviations. We are able to reject negative effects larger than about 0.03 standard deviations per year of television exposure. For reading and general knowledge scores, the positive effects we find are marginally statistically significant, and these effects are largest for children from households where English is not the primary language, for children whose mothers have less than a high school education, and for nonwhite children. I. INTRODUCTION Television has attracted young viewers since broadcasting be- gan in the 1940s. Concerns about its effects on the cognitive devel- opment of young children emerged almost immediately and have been fueled by academic research showing a negative association between early-childhood television viewing and later academic achievement.1 These findings have contributed to a belief among the vast majority of pediatricians that television has “negative effects on brain development” of children below age five (Gentile et al. 2004). They have also provided partial motivation for re- cent recommendations that preschool children’s television view- ing time be severely restricted (American Academy of Pediatrics 2001). According to a widely cited report on media use by young * We are grateful to Dominic Brewer, John Collins, Ronald Ehrenberg, Eric Hanushek, and Mary Morris (at ICPSR) for assistance with Coleman study data, and to Christopher Berry for supplying data on school quality.

Turning the Camera on Court TV: Does Televising Trials Teach Us Anything About the Real Law? ANGELIQUE M. PAUL* I. INTRODUCTION What people think about the law is important because ours is a "public opinion" society, "which makes heavy use of referenda, and in which government does not lift a finger or move a muscle without reading the tea leaves of public desire."' The public's perception of justice influences the courts, the laws, the judges, and essentially the democratic process. So what influences the public's perception of justice? Television. For the majority of Americans, television is the most important source of information, and for many it is the only source of information. 2 This is particularly true when it comes to gathering information about the law. Because the majority of Americans have had no personal experience with the legal system,3 and because the majority of Americans get their information about the world solely from television, 4 the portrayal of justice on television is extremely important not only to the continued viability of the legal system, but also to the individual's understanding of that system.
