WORK SESSION AGENDA: Vice Chairperson North called the Work Session to order at 6:30 pm. All Planning & Zoning Commissioners were present, with the exception of Chairperson May. 1. PUBLIC HEARING: 1. Consider Zoning Case Z-1309-15; the review of Site Plan, Landscape Plan and Elevations as required in this Planned Development, as well as a request for deviations regarding masonry requirements; an area south of Belt Line Road and just west of Westmoreland Road; on approximately 1.15 acres of land and consisting of one (1) lot. Applicant: Josh Millsap; Owner: Bruce Harbour Mr. Edlyn Vatthauer, Planning Manager, presented the management report. Vice Chairperson North asked the Commissioners if there were any questions of staff. There being no response, he opened the public hearing at 7:05 pm for public discussion and asked the applicant to come forward to address the Commission. Mr. Chuck Bennett, of 4121 Commerce Street, Dallas, representing First Choice came forward to address the Commission. He informed the Commission that the purpose for the metal facade deviation request is to brand First Choice. First Choice would like customers to recognize the name and image of the business, and metal is typically the first masonry option that is selected. Mr. Chad Suitonu, of 2828 Ross Street, Dallas, representing First Choice came forward to address the Commission and provide detail information about the propose metal material for the facade. Vice Chairperson North asked the Commission if there were any additional questions or comments for Mr. Bennett or Mr. Suitonu. Commissioner Lee asked if the applicant could explain the types of services that would be rendered at the proposed medical facility. would be rendered at the proposed medical facility. Mr. Todd Bradbury of 2941 South Lake Vista, Lewisville, representing First Choice came forward to address the Commission. He explained that the proposed First Choice would provide emergency services, similar to what a hospital emergency room would provide. Vice Chairperson North asked the Commissioners if there were any further questions for Mr. Bradbury. Hearing no response, he asked if there was anyone in the audience who wished to address the Commission either in favor of or in opposition to Case Z-1309-15. There being no response, Vice Chairperson North closed the public hearing at 7:11 pm and asked the Commissioners for a motion. Motion by Commissioner Russell Hooper, with second by Commissioner Jacqueline Lee to approve Case Z-1309-15; the review of Site Plan, Landscape Plan and Elevations as required in Planned Development 101 (PD-101). Motion passed 4-2. With the following stipulations: (1) The elevations must meet all masonry requirements as set forth in the Zoning Ordinance. SUMMARY: The applicant wants to build an Advance Auto Parts store on the property in question. In order to proceed, the existing Planned Development (PD) for this tract must be removed and replaced with straight General Retail (GR) zoning, as the existing Site Plan for this Planned Development (PD) does not meet the development requirements of this proposed use. Consequently, the applicant is requesting that this tract be rezoned back to the General Retail (GR) zoning. The property in question is located on the north side of Belt Line Road and approximately 270 feet east of Alpine Drive, as provided on the Vicinity Map. As provided on the Zoning Exhibit, the property in question is currently zoned Planned Development-148 (PD-148). To the east and west is General Retail (GR) zoning. To the north is Planned Development-22 (PD-22), which is a residential Planned Development (PD). To the south, across Belt Line Road, is General Retail (GR) and Single Family-8 (SF-8) zoning. As seen on the aerial photo, the property in question has an old building (formerly a roller skate rink) in the front of the lot with some out buildings to the north of the existing building. To the west is a small retail center and to the east is a fueling station. To the north is vacant land and single family homes. To the south, across Belt Line Road is a church and single family homes. The front portion of this tract where the applicant is proposing to build is not located in the floodplain.
