And what a year it was! The year had barely begun when we were already saying goodbye to musical heroes gone far too soon. David Bowie, Leonard Cohen, Glenn Frey, Leon Russell, Maurice White, Prince, George Michael ... the list goes on. And yet, despite the sadness of these losses, there is much for the industry to celebrate. Music consumption is at an all-time high. Overall consumption of album sales, song sales and audio on-demand streaming volume is up 5% over 2015, fueled by an incredible 203% increase in on-demand audio streams, enough to offset declines in sales and return a positive year for the business. 2016 also marked the highest vinyl sales total to date. It was an incredible year for Canadian artists, at home and abroad. Eight different Canadian artists had #1 albums in 2016, led by Drake whose album Views was the biggest album of the year in Canada as well as the U.S. The Tragically Hip had two albums reach the top of the chart as well, their latest release and their 2005 best of album, and their emotional farewell concert in August was something we’ll remember for a long time. Justin Bieber, Billy Talent, Céline Dion, Shawn Mendes, Leonard Cohen and The Weeknd also spent time at #1. Break out artist Alessia Cara as well as accomplished superstar Michael Buble also enjoyed successes this year.

Those of you who have visited our panto over the last two decades may know that Solihull’s ‘Mr Panto’ Malcolm Stent is hanging up his frilled shirt and golden waistcoat and stepping down from his mammoth role after 27 years! He’s built the show into a family favourite and was thrilled to be honoured in Her Majesty’s New Year Honours list for his ’Services to Entertainment’. He enjoyed a fabulous day at Buckingham Palace in the Summer and is rightly proud of his medal. He decided to make Jack & The Beanstalk his last panto but, like any true stage pro he won’t stop working… so he’ll continue to write and perform, here and around the Midlands. We’ll continue to stage professional pantomimes here and the show will be ‘re-booted’ next year or as they say in Dr Who… regenerated! We’ll continue to welcome back our family audiences of all ages continuing our fantastic pantomime tradition here in Solihull. VOICE MISAPPROPRIATION IN CALIFORNIA-BETTE MIDLER, TOM WAITS, AND GRANDMA BURGER BY: EDWIN F. MCPHERSON* On October 4, 2001, the California Court of Appeal, for the first time, acknowledged, defined, explained, and confirmed the common law ofvoice misappropriation in California. Unfortunately, only onejustice on the three justice panel saw fit to tell the legal world the status of the law before the parties had to go through the expense and uncertainty of a trial. The case is PriorityRecords v. SuperiorCourt (Geneva Burger). 1 As it turns out, the case was settled during trial, for an undisclosed sum of money, and the California Court of Appeal still has yet to make its voice officially heard. When Prioritywasdecided, the only common lawvoice misappropriation cases in California were Federal cases, both decided by the Ninth Circuit Court of Appeals, and both involving celebrity recording artists.
