1. This notice may be cited as the Revocation of Taking of Land Notice (No. 2102) 2010.

TAKING OF EASEMENT NOTICE (No. 2103) 2010

Short title

1. This notice may be cited as the Taking of Easement Notice (No. 2103) 2010. Easement to be taken [s.9(7) of the Acquisition of Land Act 1967]

2. An easement is taken through the land described in Schedule 2, by the Chief Executive, Department of Transport and Main Roads, as constructing authority for the State of Queensland, for a purpose incidental to the purpose of transport (rail and rail transport infrastructure), namely, soil nailing purposes, as from 3 December 2010, and vests in the Chief Executive, Department of Transport and Main Roads, as constructing authority for the State of Queensland.

Terms and Conditions of Easement

3. The terms and the conditions of the easement are set out in Schedule 1.

SCHEDULE 1

Terms of Easement 1. EASEMENT

1.1 The State and its Licensees has the use of an easement through the Land for a right of subjacent and lateral support, for the purpose of Soil Nailing to support, uphold and maintain the Railway Works.

1.2 For and incidental to the purpose mentioned in clause 1.1, the State may do all or any of the following:

(a) enter, go, return, pass, repass and remain on the Land with or without tools, implements, machinery and vehicles;

(b) clear and remove any obstruction, timber, trees, undergrowth, crops and fences on the Land;

(c) lay down, erect or construct the Soil Nailing Infrastructure;

(d) demolish, destroy and remove the Soil Nailing Infrastructure;

(e) inspect, patrol, alter, renew, reconstruct, add to, replace, repair, cleanse, maintain and change the size and/or location of the Soil Nailing Infrastructure; and

(f) do all things necessary or convenient to be done in connection with or incidental to the exercise of the rights conferred by clauses 1.1 and 1.2 including, without limitation, entry on to and accessing other adjoining land of the Landowner .

1.3 The State and its Licensees must (in exercising the rights conferred by this Easement):

(a) carry out all operations in a proper and workmanlike manner and so as to cause as little injury and disturbance as practicable to any other use made of the Land or to property of the Landowner or any other person, having regard to the nature of such operations;

(b) repair any damage to the Land caused by its activities on the Land as soon as practicable and reinstate it as near as practicable to its condition prior to the damage;

(c) refrain from destroying, removing or clearing trees, timber and scrub to an extent greater than is necessary for the purpose of exercising the rights under this Easement;

(d) refrain from taking timber, soil and water from the Land to an extent greater than is necessary for the purpose of exercising the rights under this Easement; and

(e) comply with all Statutory Provisions and all Requirements.

2. TITLE TO SOIL NAILING INFRASTRUCTURE

All Soil Nailing Infrastructure installed or supplied by the State does not become the property of the Landowner even if it is annexed or affixed to the Land. The State may remove any such Soil Nailing Infrastructure wholly or partially at any time.

3. LANDOWNER'S COVENANTS

3.1 The Landowner will not:

(a) prevent or restrict the State or a Licensee of the State in the exercise of the rights under this Easement;

(b) obstruct access to the Land by the State or a Licensee of the State;

(c) interrupt or disturb the right to enjoy the Land or other rights conferred under this Easement on the State and the Licensees of the State; or

(d) do any act or make any omission upon the Land likely to jeopardise or prejudicially affect the safety or reliable working of the Soil Nailing Infrastructure. 3 December 2010] QUEENSLAND GOVERNMENT GAZETTE No. 100 981

4. BREACH

The State may serve a written notice on the Landowner of any failure by the Landowner to carry out any of its obligations under this Easement. Such written notice may require the Landowner to comply with its obligations under this Easement within a reasonable time. In default of the Landowner’s doing so, the State may, without prejudice to any other rights or remedies, and without any further notice to the Landowner, enter upon the Landowner’s land and carry out such works as may be necessary to facilitate compliance with such obligations. The Landowner must pay to the State the costs and expenses incurred in such exercise, and such costs and expenses will constitute a liquidated debt owing by the Landowner to the State payable on demand.

5. GOVERNING LAW AND JURISDICTION

5.1 The law of Queensland governs this Easement.

5.2 The parties submit to the non-exclusive jurisdiction of the courts of Queensland.

6. DEFINITIONS

Unless the context otherwise requires:

“Land” means part of Lot 1 on RP24048, County of Stanley, Parish of Ipswich, shown as Easement D on SP211220.

“Easement” means the rights through the Land obtained by the State from the Landowner, including but not limited to the terms and conditions set out in Schedule 1.

“Landowner” means the registered owner or lessee of the whole or part of the Land and includes its successors in title.

“Licensees, of the State”, means the State’s surveyors, engineers, servants, agents, licensees, contractors and subcontractors authorised by the State for the purposes of this easement.

“Railway Works” means the retaining wall and associated works constructed or to be constructed on the rail corridor.

“Requirement” means any requirement, notice, order or direction lawfully given by any statutory, public or other competent authority, present or future.

“Soil Nailing” means the installation, construction, operation, repair, replacement and maintenance of the Soil Nailing Infrastructure.

“Soil Nailing Infrastructure” means steel rods or cables secured in a hole drilled in rock or soil, held in position by grout or mechanical means or both as a way of stabilising and supporting the State’s Works constructed or to be constructed on the rail corridor and/or other land.

“State” means the Chief Executive, Department of Transport and Main Roads for and on behalf of the State of Queensland.

“Statutory Provision” means a statute or a regulation or provision of a statute or regulation.
