LOCATION: Wildwood – Southwest corner of C-475 N and CR 246S (Map 1) CASE SUMMARY: The applicant is requesting a minor special use permit to allow the construction of a gymnastics studio to be operated in conjunction with an existing trick riding school. The landowners currently operate a training facility for equestrian circus performers and horse vaulting athletes. The facility lawfully operates as an agribusiness on the family farm. They are asking to expand their business to include classes for non-equestrian students. This special use permit will allow them to provide general gymnastics classes and circus acrobatics training for small classes. The applicant is proposing to construct a building that will house both a sheltered horse ring designed specifically to train equestrian performers, and a studio for general acrobatics training. Classes will be small with less than ten students. General classes may cover a range of acrobatic skills including ropes, gymnastics, trapeze, and yoga. The application site is located in a rural area surrounded by agricultural and rural residential uses. Surrounding properties are zoned A10C and RR5C (Map 2). The property fronts on C- 475N, a major collector road. there are a number of agricultural based businesses in the surrounding area including, a horse breeding/training farm with staff housing, a winery with restaurant, and a pet day care. CASE ANALYSIS: The equestrian training facility is a lawfully existing agritourism business under Chapter 570.85, Florida Statute. This application addresses only the non-equestrian aspects of the proposed project. The proposed improvements, including the sheltered training ring, studio, and student accommodation areas would be allowed as a use by right if clientele were restricted to the equestrian community. The proposed business expansion to general students is a secondary use in conjunction with the existing equestrian facility. The Land Development Code does not address this specific use. The Development Services Director, per Section 13-431(c), determined that the proposed use would be appropriately considered as a Special Use Permit. This is based on Table 13-431A; Schedule of Principal Uses of the Sumter County Land Development Code which allows nursery schools and fraternal organizations as a special use permit within the A10C zoning district. Special use permits are addressed in Section 13-332(a)(2) of the Sumter County Land Development Code. The following requirements must be considered. S2019-0010 Page 2 of 6 Tchalabaev a. The use must not be detrimental to the neighborhood environment or unduly infringe on the rights of surrounding property owners. The proposed studio is not expected to unduly infringe on the rights of surrounding landowners. The property fronts on C-475 N, a busy, major collector road. This will minimize any potential impacts on surrounding neighbors. The studio is not expected to create noise, dust, or other impacts to neighboring properties. b. A vehicular parking or traffic problem must not be created, and the vehicular average daily traffic created on local roads must not be increased in such a manner as to degrade the established function of the roadway or create hazards to public health or safety. The commission and staff may rely on input from the Florida Department of Transportation, the Florida Highway Patrol and the sheriff's office in making this determination. The proposed studio has good access to C-475N and is not expected to create traffic problems. c. Screening and buffering sufficient to minimize interference with the enjoyment of surrounding properties may be required. The proposed project will be required to maintain adequate screening and buffering between the studio and adjacent properties. DEVELOPMENT SERVICES DEPARTMENT STAFF CONCLUSIONS: Proof of ownership is on record. Staff has deemed the requested application in compliance with the minimum requirements of the Sumter County Land Development Code and Comprehensive Plan and recommends approval with the following conditions: 1. The Special Use Permit approval is for the addition of a general acrobatics studio to an existing trick riding facility. The acrobatics studio may serve both the general public and equestrian students. 2. Site development shall be as generally provided in the attached conceptual plan (Attachment). Access to the site shall be as approved by the Sumter County Public Works Department. 3. Class size shall be limited to no more than twelve students per class for non-equestrian training. 4. A site development permit for the studio must be approved within two years of this approval. Site improvements, including buildings used by non-equestrian students shall be complete within three years.
