INTRODUCTION In August 1990, commercial fossil hunters from the Black Hills Geologic Institute (“Black Hills”) discovered the remains of an almost-complete Tyrannosaurus Rex skeleton located in the badlands of South Dakota.1 Named “Sue” after her discoverer,2 the fossil immediately became the subject of controversy. Although many of the facts were disputed, the collectors gave the purported owner of the land, a Native American rancher named Maurice Williams, a check for $5,000, which he cashed, and the collectors excavated Sue.3 The fair market value of a T-Rex skeleton with that degree of completeness was over eight million dollars.4 Once the discovery began to garner publicity, Williams began a fierce court battle to rescind the contract with Black Hills, claiming that the $5,000 was merely a payment * Assistant Professor of Law, Cumberland School of Law, Samford University; B.A., 1996, Dartmouth College; J.D., 1999, Harvard Law School. REX (Nova original television broadcast, Feb. 25, 1997). In October of 1997, Sotheby’s auctioned Sue off. In the face of intense bidding, the Chicago field museum purchased Sue for $8,362,500. See McShane, supra note 1, at A10. 4 McShane, supra note 1, at A10. 2 to inspect the property for potential fossils.5 And he was not the only one with a bone to pick. At one point, the parties claiming ownership of Sue included Black Hills, Williams, the Cheyenne River Sioux tribe (Williams’ land was within the boundaries of their reservation), and the federal government (the government had held the land in trust for Williams so it was not subject to tax forfeiture).6 Ultimately, the district court,7 and then the Eighth Circuit Court of Appeals,8 ruled against the Black Hills. The structure of the trust required government permission in order to sell land. Holding that Sue’s bones were part of the “land,” the Eighth Circuit determined that Sue could only be sold if government permission had been granted, and, as Black Hills had never requested permission, it had no claim to the fossil.9 The Eighth Circuit concluded that the federal government held the fossil in trust for Williams.10 In addition to the pages of the federal reporter and in the press, Sue’s story has also been 5 Black Hills Inst. of Geological Research v. While useful, the article is also extremely partisan, as Duffy was Larson’s attorney in the criminal trial. The Black Hills Institute later discovered another T-Rex skeleton that they named “Duffy” in gratitude for their lawyer’s services. 7 Black Hills, 812 F. Sch. of Mines & Tech., 12 F.3d 737, 739 (8th Cir. 1993). 9 Id. at 743-44. 10 Id. 3 told in two books,11 one of which, Rex Appeal, was written by fossil hunter and Black Hills founder Peter Larson.12 An understanding of contract law and contract defenses is essential to understanding and analyzing the question of Sue’s ownership.13 Sue’s case involves the high-stakes world of fossil hunting and collecting, a subject matter that students find appealing. Besides piquing student interest, Sue’s case also allows for a far-ranging discussion of many contract defenses. When discussing the contract between Maurice Williams and the Black Hills Institute, students begin formulating arguments based on the doctrines of unilateral mistake, unequal bargaining power, capacity, unconscionability, and the failure of a condition. I provide this description of the teaching module I use for contract defenses as one possible alternative to the Socratic method. As described in the final portion of this Article, the Socratic method has come under attack in recent years.14 In response to such criticisms, the lesson that I describe provides a constructive alternative to the Socratic method, based on the theory of problem-based learning and the appropriate incorporation of technology in the classroom. However, unlike other problem-based learning approaches, this particular lesson can be adopted without having to change the entire structure of an already-existing course, and does not mean the utter extinction of a traditional casebook.15 Rather, the exercise supplements the typical coverage of contract defenses in the major casebooks. 11 The first book, written by Steve Fiffer, a former journalist and attorney, is a well- written account that provides a multi-faceted and balanced view of the case, including the point of view of many of the participants. LARSON & KRISTIN DONNAN, REX APPEAL: THE AMAZING STORY OF SUE, THE DINOSAUR THAT CHANGED SCIENCE, THE LAW, AND MY LIFE (2002). 13 Property law and Native American law are vital to analyzing Sue’s ownership, and it was on these grounds that the actual case was decided. A recent casenote suggests that Sue’s case could be used to teach property law. See Dana G. Jim, Great Property Case: Johnson v. M’Intosh and the South Dakota Fossil Cases, 46 ST. LOUIS U. L.J. 791 (2002). Therefore, in this Article I concentrate solely on the contracts questions that Sue’s case raises and how law professors can use Sue’s case to teach contracts defenses. 14 See Part IV infra. 15 See Douglas L. TEACHING CONTRACT DEFENSES: REWARDS AND CHALLENGES Teaching contract defenses is one of the more difficult parts of the basic contracts course. During the first portion of the course,16 I spend a great deal of time on basic concepts – the rules of offer and acceptance, consideration, and promissory estoppel – as well as helping students become familiar with basic legal skills, such as how to discern the holding of a case from dicta; how to master the standard arguments about bright line rules versus legal standards; and how to discern the various sources of contract law. Despite the oddity and strange amusement value in the cases of dissolute smoking and drinking nephews,17 sick children at sea who run up medical bills,18 and loyal employees who dive off platforms to save their bosses,19 the first part of the course must necessarily focus on teaching basic legal skills.

Acta Palaeontologica Polonica 60 (1): 131–139. Isolated teeth from vertebrate microfossil localities often provide unique information on the biodiversity of ancient ecosystems that might otherwise remain unrecognized. Microfossil sampling is a particularly valuable tool for doc- umenting taxa that are poorly represented in macrofossil surveys due to small body size, fragile skeletal structure, or relatively low ecosystem abundance. Because biodiversity patterns in the late Maastrichtian of North American are the primary data for a broad array of studies regarding non-avian dinosaur extinction in the terminal Cretaceous, intensive sampling on multiple scales is critical to understanding the nature of this event. We address theropod biodiversity in the Maastrichtian by examining teeth collected from the Hell Creek Formation locality that yielded FMNH PR 2081 (the Tyrannosaurus rex specimen “Sue”). Eight morphotypes (three previously undocumented) are identified in the sample, representing Tyrannosauridae, Dromaeosauridae, Troodontidae, and Avialae. Noticeably absent are teeth attributed to the morphotypes Richardoestesia and Paronychodon. Morphometric comparison to dromaeosaurid teeth from multiple Hell Creek and Lance formations microsites reveals two unique dromaeosaurid morphotypes bearing finer distal denticles than present on teeth of similar size, and also differences in crown shape in at least one of these. These findings suggest more dromaeosaurid taxa, and a higher Maastrichtian biodiversity, than previously appreciated.

    The Battle for Sue: A Controversy Over Commercial Collecting, Fossil Ownership Rights and its Effects on Museums Adrienne Stroup MUS 503: Intro to Museum Studies 13 December 2011 Should commercial fossil dealing be legal? Many museums rely on dealers for specimens because they do not have the resources to fund professional excavations conducted by paleontologists. On the contrary, many members of the scientific community believe commercial fossil hunting by amateurs hurts the integrity of paleontology, and in turn negatively affects museums. This debate, along with issues surrounding the ownership rights of fossil resources, is not a new one, but it came to the attention of the media when a Tyrannosaurus rex dubbed “Sue” was discovered in South Dakota in 1990. Flashing back 67 million years ago, western South Dakota was once the coast of an inland sea that divided the North American continent in two. The climate was humid and swampy, with dense vegetation, much like the southeastern United States is today (Fiffer 12). The seven-ton Tyrannosaurus dominated the landscape as the top predator of the Cretaceous Period. Standing over thirteen feet tall at the hips, up to twenty feet tall when standing completely upright, and forty-one feet long, Sue would have been a formidable opponent (Reedstrom). Her fossilized remains portray an animal that led a violent and difficult life, with evidence of a healed leg fracture, and other injuries. A tooth fragment embedded in her rib and puncture wounds in her jaw and eye socket suggest fights with other Tyrannosaurs, leading to her possible cause of death, a fatal skull-crushing bite (Monastersky, “Sake of Sue”).

[email protected] 605-210-1275 ABSTRACT: A census of Hell Creek and Lance Formation dinosaur remains was conducted from April, 2017 through February of 2018. Online databases were reviewed and curators and collections managers interviewed in an effort to determine how much material had been collected over the past 130+ years of exploration. The results of this new census has led to numerous observations regarding the quantity, quality, and locations of the total collection, as well as ancillary data on the faunal diversity and density of Late Cretaceous dinosaur populations. By reviewing the available data, it was also possible to make general observations regarding the current state of certain exploration programs, the nature of collection bias present in those collections and the availability of today's online databases. A total of 653 distinct, associated and/or articulated remains (skulls and partial skeletons) were located. Ceratopsid skulls and partial skeletons (mostly identified as Triceratops) were the most numerous, tallying over 335+ specimens. Hadrosaurids (Edmontosaurus) were second with at least 149 associated and/or articulated remains. Tyrannosaurids (Tyrannosaurus and Nanotyrannus) were third with a total of 71 associated and/or articulated specimens currently known to exist. Basal ornithopods (Thescelosaurus) were also well represented by at least 42 known associated and/or articulated remains. The remaining associated and/or articulated specimens, included pachycephalosaurids (18), ankylosaurids (6) nodosaurids (6), ornithomimids (13), oviraptorosaurids (9), dromaeosaurids (1) and troodontids (1).

Ammerman Director: Jennifer Good, Ph.D. After the first successful extraction of ancient DNA from a fossilized Quagga in 1984, the subsequent development of PCR (Polymerase Chain Reaction) technology opened up a plethora of possibilities in the field of molecular paleontology. Supplied with fragmented ancient genomes, some scientists acted as if the days of resurrecting dinosaurs were a few technical difficulties away. Theories surfaced on the possible applications of ancient DNA technology, and some, such as creating tactical dinosaurs for the U.S. military, were outrageous. A less ridiculous idea surfaced in the form of Michael Crichton’s Jurassic Park, published in 1990. Coupled with Steven Spielberg’s 1993 feature film adaption, the Jurassic Park series created a world in which genetically- engineered dinosaurs roamed once again as theme park attractions on a billionaire’s private island, and explored the possible outcomes of a “Jurassic Park” experiment. Jurassic Park ignited scientific debate over the technological feasibility, environmental impact, and ethical questions of a “Jurassic Park” experiment. This thesis continues that conversation by asking, could resurrecting a dinosaur be a productive environmental enterprise, other than a mere display of power over Nature? Focusing on Tyrannosaurus rex, this thesis combines a brief survey the current state of dinosaur genetic research, with analyses of rewilding with large predators, to discuss whether or not scientists should ever attempt to re-create a T. rex in the future.     Tyrannosaurus Sue A letter from Bruce Adolphe Humans, like you, have the amazing ability to think about the past. Not only can we think about what we had for dinner last night or recall a concert or sports event from last year, we can even think about things that happened before we were born — or before anyone was born. Like thinking about dinosaurs. Because paleontologists (scientists who study fossils and remains from millions of years ago) can uncover the past for us, we can look at dinosaur bones and think about what life was like 67 million years ago. That’s way before smart phones. It’s even before umbrellas. In fact, it is before people existed! In the year 2000, the most complete set of dinosaur bones ever discovered was put on display at the Field Museum of Natural History in Chicago. The bones belonged to a Tyrannosaurus rex that weighed about seven tons (when alive), and it had 60 teeth, some as long as 12 inches. Because the T. rex was discovered by a paleontologist named Sue Hendrickson, we call the dinosaur Sue. Its official name is FMNH PR 2081. “Sue” is catchier, I think you will agree. When “Sue” was put on display for the first time, the Chicago Chamber Musicians were invited to play a concert in the museum to celebrate the day, and they asked me to compose them a piece about the dinosaur. That’s why we have the piece Tyrannosaurus Sue. If you were writing a piece of music about a Tyrannosaurus rex, which one of these instruments would you choose to portray the huge dinosaur: flute; trombone; violin; cello; clarinet.
