#299/16 D. LYSENG - That Council direct Administration to construct an AGD - Agricultural Access Road to NW 4-49-21-W4 within RR214 right of 2383 way including 1 1/2" gravel, subject to the suitability of the soil conditions for construction. CARRIED.

New Norway Truckfill Construction Tender

G. Backus reported tenders were sent out for the construction for the Truckfill.

KRAUSE - That Camrose County Council not accept any of the AGD - tenders received for the construction of the New Norway Truckfill 2386 (Project 3-14-15) as the tender prices exceeded the budget and further that County Staff proceed with the construction of the New Norway Truckfill with funding to come from the MSI Capital Fund. ACTION / RECOMMENDATION:

Administration is looking for direction from Council as to how they wish to proceed with this request as per Policy 17.04.

BACKGROUND INFORMATION:

Administration received a letter from the owner of NW4-49-21-W4 requesting Camrose County to construct a road within RR214 Right of Way so that their renter is able to access the quarter section North of Secondary Highway 617. The renter is currently accessing the quarter through their neighbours quarter section (SW4-49-21-W4) either through a old lease road or their neighbors hay field. They state that this access is "becoming increasingly impossible" due to washouts and becoming too narrow for the equipment. At the August 9, 2016 Council meeting Council requested that Administration core the proposed access road RR214 Right of Way North of Secondary Highway 617 to better determine the base and the ability to build and gravel an agricultural access.

Policy, Bylaws, Provincial Acts or Regulations: Policy 17.04

The Road Construction Project aligns with the Camrose County Municipal Operating Principles Plan, Infrastructure Goal 1 - "To develop and implement a sustainable long term plan for maintaining and enhancing the Municipalities road network" Financial Implications: Currently Public Works has no budget for this request for 2016. The road could be budgeted for 2017 should council motion to construct.

Rough estimate for Option 1 (proposed by Landowner) to construct 800m of No. 4 Access to farm land only, as per policy description "No. minimum clay cover, no compaction, 8m. surface width. May be constructed with V type ditches only. May not require any gravel. Generally not a through road. No residences. No snow plowed during the winter months." on the RR214 Alignment North of SH617 would be $14,500.00 (2) graders (2) days, 3 Culverts,.

Should Council wish to upgrade the spec. to include gravel and subgrade compaction the estimated cost would climb to $20,000.00 to $25,000.00. The alignment would need to be very dry, and the fence on the West side of the R/W would need to be removed, this could also be an additional cost. Scheduling of the Shoulder Pulling Crew would need to be adjusted should it be requested that this

road is constructed this year. Alternatives to the Recommendation: Currently RR214 North of SH617 is an undeveloped government road allowance. The Right of Way that the applicants are asking to be built to a No. 4 Access is located within the flood plain of Hay lakes and could be susceptible to flooding at some point in time. Options 1,2, and 3 were proposed by the Land owner in their letter:

1. Option 1: That Camrose County Construct a No. 4 Access to farm land only to the NW4-49- 21-W4 RR214 North of SH617 2. Option 2: That Camrose County Construct a No. 4 Access to farm land and extend existing RR214 South to the NW4-49-21-W4 3. Option 3: That County construct a road on private land located at RR213A N. of SH617 (1/4 section line where there is no Road Allowance)

Administration have added three additional Options for Councils consideration:

1. Option 4: That Camrose County approve the Landowner to Construct a No. 4 Access either from the North or the South to the NW4-49-21-W4 . 2. Option 5: That County and owner may enter into an agreement to each fund a percentage of construction costs, as the road would only be a benefit to the land owner for the 1/4 Section it is accessing. 3. Option 6: Suggest the Land Owner may enter into a Easement discussions with the current owner of the SW4-49-21-W4 to secure future access should their neighbours land sell and improve their current access.

DISCUSSION:

Administration has completed a investigation of the subgrade and has surveyed the right of way (R/W): SUMMARY: Topsoil depth 6" Subgrade: High Plastic Clay Moisture: Over optimum ( Discing and Drying would be required if spec is upgraded from a No. 4 to include gravel ) Survey: An existing Drainage Ditch spans the West Property line of the R/W with a four strand barb wire fence on the East side of the Drainage Ditch both are encroaching onto the County R/W. The fence would have to be removed to accommodate construction. Road Construction Policy 17.04

1. In accordance with the intent of the Municipal Government Act, Council will construct roads whenever required within Camrose County, only when such construction is deemed to be in the interest of the public generally, and

2. Requests received by a resident or ratepayer of the County for the construction of a particular road, within a public right of way, will be considered by Council and dealt with on the basis of the merits of each individual request. The Standard that either the Land owner build the road or the County, should Council motion Administration to, would be No.4 Access to farmland only.

Dear Mr. King

This letter is a request to obtain an access road to our quarter of land at Hay Lakes. We have owned the quarter at NW-4-49-21-4 for 36 years.

Our renter, Ivan Selin, has infonned us that he is having difficulty getting his farming equipment on to the land to farm it and also having difficulty transporting out the grain. He has been using a lease road to obtain access to the quarter when possible and travelling over a neighbour’s field when the road is impassible. Using the lease road is becoming increasingly impossible. Over the years, the road that goes over a hillside has washed away and is very narrow at some points. Also the size of farming equipment has increased and some of the equipment is too wide for the road as the road is bordered by trees on both sides.

Historically, road allowances were surveyed with the intent that each quarter of land would have access. The road allowance leading to our quarter was not developed because of frequent spring flooding .(The road allowance which is now highway 617 was also not developed at that time for the same reason.) In addition, when the oil companies started drilling wells, they build a lease road extending through the quarter at SW-4-49-21-4. This road could be used by my uncle, who owned and lived on our quarter. When the oil company closed the well, my father, who owned the quarter at SW-4-49-21 told them they could leave the road. This is the road we and our renter currently use.

This road is often impassible after rain or in winter. The hillside is dangerous. Several times we have slid sideways and could easily flip over and roll down the hill. It is also frightening to think that medical aid could not reach us when we are staying at the farm. We rely on the goodwill of our neighbour to go over his pasture when we can not use the road. This land was once in our family, but now is owned by Mr. Don Begonyk. Ifthe owner of this land changes, we may not be able to drive through it to access our land.

When we first purchased the land in 1980, we intended to build a house and live there. With no reliable road access, we were not able to do so. We would not have been able to travel to work and our children could not have walked such a great distance to the school bus. Our children, and in future years, our grandchildren are in the same situation. This would also apply to any new owner should we

We want to make it clear that we are not asking for access to our yard site, only to our quarter. We understand that we would be required to maintain the road from our quarter to the yard. We pay taxes and don't understand why we can not receive the same services as others. What is the county’s policy on providing and maintaining road allowances?

Several options for an access road exist. The original road allowance which is on flat land beside the drainage ditch could be developed as flooding is no longer an issue. There is also the possibility that an access road could come in from the north. The road that leads up to Mr. Reinke’s property could be extended to our quarter. This would involve building a road on a hillside and putting a culvert in the drainage ditch. The third option would be to cut the steep hil entrance at RFl213A-617HWYand gravel the present lease road up to our quarter. l

ROAD CONSTRUCTION

1) In accordance with the intent of the Municipal Government Act, Council will construct roads whenever required within Camrose County, only when such construction is deemed to be in the interest of the public generally, and

2) Requests received by a resident or ratepayer of the County for the construction of a particular road, within a public right of way, will be considered by Council and dealt with on the basis of the merits of each individual request.

PROCEDURES - LOCAL ROAD CONSTRUCTION PLAN

A five (5) year Local Road Construction Priority list is developed to allow for the orderly development of the local road system. This 5 year plan would allow for the engineering and contract preparation to be prepared 1 year in advance of the actual construction.

The Priority List shall be reviewed and approved by Council each year. The amount of contract local road construction will be determined by the budget funds available each year.

ROAD CONSTRUCTION PROJECTS NOT INCLUDED ON PRIORTY LIST.

SPECIAL GRANT PROGRAMS – RESOURCE ROADS

These are special programs that allow for outside funding for the construction of local roads. The required County contribution for these types of projects would be funded from Reserves at the time of program and the approval. These roads would automatically be considered our highest construction priority at the time the grant is available. These projects have NOT been included on the Priority List.

ACCESS REQUESTS and OTHER REQUESTS

Specific requests from landowners for access and other requests for road reconstruction for industrial / agricultural developments etc. These projects have NOT been included on the Priority List.

The Manager of Public Works will recommend Road Construction Priorities to Council for their consideration and approval.

Named Holidays

In addition to annual vacation leave, Camrose County recognizes the following as paid holidays for permanent staff:

Permanent Part-time and Temporary employees shall receive Holiday Pay at their regular rate of pay after thirty (30) days of employment and if the named holiday falls on a regularly scheduled day of work.

EVENT SPONSORSHIP

POLICY Camrose County is regularly approached to sponsor events within the County and region. Sponsorship is an important part of meeting the County’s obligations to support and encourage initiatives which encourage economic development and tourism to the County and the region. This policy is designed to provide an equitable means for community organizations to access County funds, to establish mutually beneficial partnerships between the County and the community events.

Section 248 of the Municipal Government Act, Revised Statues of Alberta 2000 – Chapter M-26 as amended from time to time describes how a Municipality should administer funds. Section 248 states that a municipality may only make an expenditure that is included in an operating budget, interim operating budget or capital budget or otherwise authorized by the council. This policy aims, therefore, to assist the County to achieve best practice by promoting the establishment of strategies and processes which effectively control the manner in which it provides event sponsorship to the community.

GENERAL PRINCIPLES Eligible Projects: Sponsorship is available to a variety of events including sporting, tourism, cultural and general community events and conferences.

Projects not funded:  Individuals  Private functions  Dances  Political parties, lobby groups or religious groups

ASSESSMENT CRITERIA The following criteria must be addressed and will be taken into account by the Council in assessing the priority of the application. The Camrose Association For Community Living Charity Auction will be held October 15, 2016 at the Camrose Regional Exhibition. This year our focus is on making a difference in our programs for children & teens with special health and developmental concerns, families at risk and adults with disabilities. Our message, "Everyone Has A Story” speaks to the importance of learning about people's situations. Kimberly Ostrem (whom you see in the signature photo above) is in one of our programs and she will tell her story at this year's event.

Last year, with contributions from community members we worked together to make a difference in the lives of:

32 children with special needs attended Kandu Summer Camp where they met other children, made friends, had fun and learned new things.

105 moms were given assistance to learn the skills to have & raise healthy children through the TIPS and PCAP programs in East . 117 children had better moms because of our program.

700 school children received presentations on Body Image & Brain Injury Prevention by individuals’ we hired from our program's

491 people were fed through 32 Community kitchens we offered

ACTION / RECOMMENDATION:

That Camrose County Council direct Administration to proceed with graveling and the application of Clearview dust control to Taylor Street and Molville Street between Railway Avenue and Alberta Avenue as well as gravel and apply Clearview dust control to Railway Avenue and Alberta Avenue between Taylor Street and Molville Street with funding to come from Municipal Reserves.

BACKGROUND INFORMATION:

Initial discussion regarding the need for street improvement came about a result of a number of phone calls from concerned residents regarding the condition of Taylor Street and Railway Avenue. These streets were surfaced with cold mix at some point, and over time have deteriorated to the current situation where Street Improvements are required. Upon further inspection of the neighbourhood, it was determined that Moville Street should be added as well.

Initial budget considerations made in 2015 for the 2016 operational budget were to turn the noted sections of roadway back to gravel, so any costs over and above that will be unbudgeted expenses.

As a result of the June 28, 2016 Regular meeting of Council, in which it was initially recommended that these streets be paved with hot-mix asphalt, it was requested that a formal survey be sent to the residents to be directly affected by this project to allow them to have the appropriate input. The results of that survey were presented to Council August 9, 2016 the response was poor with an overall landowner participation of 43%. Response was as follows, with Parcels in Favor of Hot-Paving: 11 (78.6% of responses received) Parcels in Favor of Gravel with Clearview: 3 (21.4% of responses received)

On the August 9, 2016 Council meeting, Council requested administration to contact each resident who reside on the streets in question personally and request a preference surface treatment they would prefer ie. Hot-Paving or Gravel with Clearview and summarize the results.

Policy, Bylaws, Provincial Acts or Regulations: The Road Construction Project aligns with the Camrose County Municipal Operating Principles Plan, Infrastructure Goal 1 - "To develop and implement a sustainable long term plan for maintaining and enhancing the Municipality's road network" Financial Implications: The majority of this project would be an unbudgeted expenditure. Proposed additional funding would come from Municipal Reserves and a Local Improvement Tax. Alternatives to the Recommendation:

Based on the Overall Survey, Gravel with Clearview would be the option preferred. The Survey was broken down by Street's/Avenue's which can be seen in the attached Survey Results. Taylor Street shows more people wanting it to be gravel with Clearview, the majority on Moville would like to see Hot paving, 2/3's of the residents on Alberta Ave would like Hot Paving, and 3/5's of the residents on Railway Ave are for Hot Pave. No one wanted to see Cold mix and there were very few that wanted Only Gravel.

ACTION / RECOMMENDATION:

That Camrose County Council award the gravel crushing tender of 100,000 cubic meters at the Dried Meat Lake pit for 2016 to McNabb Construction of Forestburg, AB for the bid price of four- hundred-sixty-eight-thousand dollars ($468,000.00) plus GST with funding to come from the Public Works operations budget.

BACKGROUND INFORMATION:

The Public Works department makes an effort to maintain a stockpile of 3/4" road crush gravel in the Camrose County pits. Currently, the available quantity of gravel in the Dried Meat Lake pit has been reduced to less than 20,000 cubic meters.

It is important that crushed gravel is available as it is used for:  The winter gravel haul program in which it is desirable for all rural roads to receive gravel at least once every three years as identified in Policy 17.21. (90,417 Tonnes of gravel were used from the Dried Meat Lake pit for the 2015 winter gravel haul)  Summer patch gravelling to keep roads in the best shape possible.  Newly constructed and "shoulder pulled" roads.  General maintenance and projects throughout County. The crushing tender package was advertised on the Alberta Purchasing Connection (APC) to allow contractors access to the documents and a mandatory pre-tender meeting was held August 9th at the pit to identify exactly what was required as written in the tender package.

The crushing tender closed on August 16th with a total of 14 submissions. Of those 14, there were 12 qualified bids which are shown in the attached scoring table.

Crushing Contractor Results and Scoring Table DISCUSSION:

For the purposes of time-savings, reference checks were completed for the lowest three bids only.

The initial low tender supplied by JMB Crushing was rejected due to their failure to include the sign and seal portion of the Tender Documents. This was also the reason that Associated Aggregates was rejected.

Considering that this is extremely good value for gravel crushing, and the contract does have a condition for it, there is the possibility that more gravel be crushed at the contracted unit rate in the Dried Meat Lake Pit. This would be subject to council approval for any amount over $20,000.

There are plans to advertise another gravel tender as soon as possible for the Ferintosh gravel pit.

BACKGROUND INFORMATION:

The landowner of the east half of 21-43-18-W4 approached the county about closing the portion of undeveloped road between the two quarters because his driveway and yard are partially on the road plan. In reviewing the file with Public Works we determined it would be better to close the entire road plan rather than only a portion. The landowner spoke with the owners of the west half of 21 and they all agreed to apply for the road closure together.

The road is a forced road, so the intention is that the road will be consolidated back into each quarter where it was removed from. The only exception is that we will maintain a 5m strip along Range Road 184, consistent with the remaining road widening. The road plan design means that the held back 5m strip only impacts the SW parcel.

Public Works has initiated this road closure as part of a road construction project. The intent is to realign the existing road within Plan 1611NY into the government road allowance to the south of SE 29-43-18-W4. This realignment will eliminate existing curves in the roadway and will align the intersection of this road with the preexisting grid network.

The closed road plan will be given to the landowner in exchange for some additional road right of way required for the new road project, shown on the attached drawing.

Re: Notice of Public Hearing – Bylaw 1377

Further to notification received by mail regarding the closure of the road allowance dividing SE 29-43-18W4 and the pending reconstruction of Twp Road 434, I would like to address the matter from a number of perspectives.

1. My personal situation is that my cropland is all located E of Rge Rd 184 and is crop shared with an operator who moves equipment 4 miles E on either Twp Rd 434 or 432 to access my land. While the current road may be considered unsafe when large farm machinery enters Range Road 184 (travelling either East of West from Twp Rd 434), nowadays the only wide equipment travelling that section of road is an air seeder (folded width – 23’), which only travels a maximum of 2 times per year during seeding. All harvesting equipment has detachable tow-behind 39 ft headers.

2. The primary use of Twp Rd 434, West of Rge Rd 184 is regular traffic accessing Hwy 56 from Secondary 609 (or vice versa) to avoid travelling through the steep hills of Battle River Valley

crossing on Hwy 56, therefore providing safer access to Hwy 13 or points North via 609. To move the intersection to the top of the hill and create a crossroad would impede the flow of traffic and make for a less safe right turn for traffic travelling West on Twp Rd 434.

3. While my (and my crop sharer’s) opinion is that the proposed changes are unnecessary and would create a less safe intersection, I would also argue that in today’s challenging fiscal environment, the monies dedicated to this project could be utilized otherwise more effectively. The installation of “CAUTION - Hidden Intersection” signs both North and South of the existing Twp Rd 184 and Range Rd 434 intersection would serve both safety and cost saving issues.

4. Lastly, the current route of Twp Rd 434 down the draw to where it meets Rge Rd 184 is an attractive feature of the Ferry Point district. Destruction of the tree cover to facilitate construction of a new “thru road” would be a detriment to the beauty of the area.

BACKGROUND INFORMATION:

Camrose County has partnered with the City of Camrose and all of the Villages in a Joint Quality Management Plan to regulate the Safety Codes Act in our area since 1995. This document has basically been unchanged since it was initially approved. The City and County have been working on an update for several years. At the same time the province has introduced a Uniform Quality Management Plan.

Our existing Quality Management Plan does not align with the Uniform Quality Management Plan of the province and we've been told we need to get in line with that document or lose our accreditation.

The City has worked with the province, the Safety Codes Council and County Administration to draft a QMP that works and aligns with the Uniform QMP. The City of Camrose Administration report outlines the discussions that they've had with the province and the outcomes and is attached for you.

The City presented the draft QMP to the County and Village administrations on July 26th where they outlined the impact on the municipal partners. No significant concerns were raised by the Villages. County administration had some concerns about the potential negative impacts on the new requirements, particularly related to completion times, but these were addressed. One of the big changes in this document is it doesn't contemplate the partnership administration. For example, what happens if a partner pulls out of the agreement. The Safety Codes Council will not allow this to be added to the document so we will likely need to create a separate management document dealing with those types of issues.

RECOMMENDATION:

THAT the City of Camrose adopt the updated Joint Quality Management Plan (QMP) for safety codes inspections in the building, electrical, plumbing and gas disciplines, and that the City’s signing authorities be authorized to sign the Joint Municipalities Agreement section of the updated Joint QMP.

BACKGROUND:

Since 1995, the City of Camrose has been providing safety codes inspections to all properties within the boundaries of the City of Camrose, Camrose County, and the various municipalities within the County boundaries (with the exception of the Town of Bashaw, who contracts their safety codes inspections through a separate agency). How the City conducts its work is governed by a number of Joint Quality Management Plans (QMPs) for the various disciplines (building, electrical, plumbing, gas, and fire). Each QMP is a separate, standalone document, although there are a number of similarities between the documents both in terms of structure as well as content. Since 1995, there have been no updates to these Joint QMP documents.

Over the past few years, the City has been working with Alberta Municipal Affairs and the Safety Codes Council (SCC) on the development of a new Joint QMP for the various disciplines, trying to consolidate documents where possible in the process. As part of that review, Administration has utilized the Safety Codes Council’s new Uniform QMP as its template.

While the updated Joint QMP document generally meets the requirements of that Uniform QMP, there are a number of issues which Administration wanted to see incorporated in the updated Joint QMP document. While some of Administration’s recommendations did make their way into the updated document, most of these suggestions were ultimately rejected by the SCC as the SCC believes that they would go beyond the allowances of the applicable provincial legislation. Examples of potential changes that were proposed by Administration but not accepted by the SCC are listed as an appendix to this report.

As a result of the fact that some requested changes were not incorporated into the final Joint QMP document, it is likely that future Safety Codes audits will see a number of potential “findings” which outline where our actions are not in line with the requirements of the updated Joint QMP. While Administration will attempt to meet all of the requirements of the Joint QMP (and thus have no “findings” on our future audits), we believe that the majority of the potential

“findings” will be minor in nature, and would be reasonable for each of the member municipalities. Examples of potential findings have also been listed in the appendix of this report.

Separate from this current review, the City’s Fire Department is also working with the various member municipalities to come up with an updated Joint QMP for the fire discipline. City Administration found a number of significant differences between the practices of the fire discipline vs. the practices of the other disciplines. Thus, a separate updated Joint QMP for the fire discipline was developed, and will be brought to the various municipal councils sometime in the near future.

City Administration is recommending that the City adopts the updated Joint Quality Management Plan.

Administration recently met with the administrative staff from each of our municipal partners to review the proposed changes to the Joint QMP. No concerns were raised regarding the updated Joint QMP, and so Administration expects that this document will be presented to the municipal Councils at their respective council meetings in the near future.

One related item that was flagged at the recent joint administrative meeting was the need to reconfirm each municipality’s involvement in the current joint accreditation process. The existing Joint QMP included provisions related to each municipality’s commitment to the process, as well as administrative procedures to be followed if a municipality wished to remove itself from the Joint QMP. Due to changes to the Joint QMP template, it was not feasible to include this in the current Joint QMP document. Administration is currently working on an agreement to reconfirm and re-formalize the relationship between the City and the municipal partners, and plans to present this at an upcoming Council meeting following internal review with the other municipal administrations.

MUNICIPAL DIRECTIVES:

- The activities of the City’s safety codes staff is governed directly by the Joint QMP document. Updating this document will help ensure a high level of service to all clients & businesses residing within the boundaries of the various municipal partners.

IMPLICATIONS OF RECOMMENDATION:

- Adoption of the updated Joint QMP will need to be done by each member municipality. Alternately, a member municipality could decide to pull out of the joint accreditation, at which point they will be responsible for performing their own safety codes inspections or finding an agency to conduct these inspections on their behalf. - Pending execution of the updated Joint QMP, Administration will forward copies of the partially executed document to all partner municipalities, and then to the Safety Codes Council once the document has been fully executed. Safety Codes activities will then follow the new Joint QMP document.

Appendix – Potential issues related to the updated Joint Quality Management Plan

As noted above, there were a number of potential changes that Administration was hoping to see in the updated Joint QMP document, but were ultimately rejected by the Safety Codes Council. The following is a summary of those potential changes.

1. Verification of Compliance (page 17 of the Joint QMP)  Issue o A Verification of Compliance (VOC) is a document issued by a Safety Codes Officer (SCO). While a VOC can be used for a variety of reasons, Camrose SCOs most commonly use a VOC as a follow up to deficiencies or unsafe conditions noted during a site inspection. The permit holder would review and then return a signed copy of the VOC, verifying that the deficiencies have been cleaned up as per the SCOs instructions. This saves the SCO from having to return to site to verify the fix first-hand, while still being able to close out a permit. o In some instances (approximately 20% of the time), VOCs are not returned to the appropriate SCO, despite various follow up requests by the City.  SCC position o When used by an SCO, the City must receive a response on each VOC issued before a permit can be closed.  Administration’s position o Historically, the City has not used a VOC for any major deficiencies which would pose a significant life safety risk. Instead, the SCOs typically complete follow up on-site inspections to ensure that those major deficiencies are cleaned up. o The SCOs typically use a VOC to document deficiencies that are minor in nature (such as the location of an electrical staple or the painting of a gas line). In those instances, the VOC is actually used more as an educational tool to remind homebuilders or contractors of the requirements of the applicable code, but where the lack of remedy of the deficiency does not present a specific life safety risk. Where the City does use a VOC on a more significant issue, the City will also follow up with the permit holder to ensure that we receive the signed VOC back. However, in the opinion of Administration, the return of a VOC on minor issues is of less of a concern. o In other cases, a permit holder may receive a VOC from the SCO but forget or refuse to send it back after numerous requests by the City. Unless there are significant outstanding issues, the SCO believes that it is appropriate to close the permit file without receiving the signed VOC. Historically, this issue has been more of a problem in the rural areas than urban areas, and has also typically been more of a problem on permits issued to homeowners (as opposed to those issued to contractors). o The City was hoping that the updated Joint QMP would require the return of only a portion of VOCs issued by the SCOs.  Resolution o The updated Joint QMP identifies that the City must receive back 100% of VOCs issued.  Potential impacts on future audits o Ethically, the SCO is bound to report any deficiency that they note on an inspection and/or complete a follow up inspection to ensure that the deficiency is fixed. Rather than the SCO simply not advising the permit holder of the issue,

SCOs will continue to issue VOCs. Future audits are likely to have “findings” related to permits being closed without receipt of the signed VOCs. Administration is comfortable with “findings” of this nature.  Relevant Examples where future “findings” may be found during an audit o “Minor” issues such as locations of electrical staples or whether or not a gas line has been painted o Final cleanup of issues on some homeowner permits in remote areas

2. Receipt of required schedules prior to issuance of building permit (page 19)  Issue o According to the AB Building Code, building permits are technically not supposed to be issued by an SCO until after the City obtains all documentation outlined in the Code. This would include 2 complete sets of construction documents & drawings, any letter or schedules as required by the Code, and any other documents as required by the Code to be sealed and signed by a registered architect and/or professional engineer. Schedules and other required documents are typically only required for larger developments such as commercial, industrial or institutional sites, but they may also be required for smaller developments such as large garages which require an engineered concrete slab, or for some pole-supported structures. o In some instances, the individual or company requesting the building permit may be under such time restraints that construction begins before all of the required documentation has been provided to the City or a permit is actually issued. In these instances, the SCOs will sometimes use their judgement and issue the permit so that initial inspections can be done, knowing that the preliminary schedules will come in in due time. This practice is more commonly used with builders or developers which have a long record of compliance. o The City was hoping that the updated Joint QMP would allow for a certain percentage of building permits to be issued without having all of the typical documents submitted up front.  SCC position o The SCC maintains its position that no permits should be issued by the City until all of the typical documents are submitted up front.  Administration’s position o City Administration believes in our current practice to allow the SCOs to use their judgement on this matter. We believe that this helps to maintaining good working relationships with our regular clients, and helps keep construction moving ahead and initial inspections to be completed while schedules are still being prepared and submitted for review.  Resolution o The updated Joint QMP identifies that permits should not be issued by the City until we receive all of the outlined documents.  Potential impacts on future audits o The City intends to be responsive to the needs of the clients throughout the inspection service area. Future audits are likely to have “findings” related to permits being issued prior to receiving all preliminary schedules or other supporting documents. Administration is comfortable with “findings” of this nature.  Relevant Examples where future “findings” may be found during an audit

o Major industrial renovations on properties with long-standing history of compliance o Non-agricultural “pole sheds” or garages with engineered concrete slabs

3. Receipt of required close-out schedules at end of construction (page 19)  Issue o According to the AB Building Code, building permits are to remain “open” until all follow up schedules have been received from the permit holder’s professional engineer and/or registered architect. In some larger projects, the receipt of these follow up schedules can sometimes take a very long time. o While this is a reasonable expectation in most cases, there are some instances where it is not realistic for the City to receive the follow up schedules, or where it is practical to receive these schedules. o One of the more typical examples is the construction of larger garage pad. Once the garage pad reaches a certain size, it must be designed by a professional engineer. In the City’s experience, a homeowner or contractor may agree to pay their engineer to complete the original design of the pad, but is not willing to pay the engineer for a follow up inspection to prove that the pad was installed as designed. While this is one of the more common examples, there would be a variety of similar instances that come up from time to time. o As with the prior issue, the City was hoping that the updated Joint QMP would allow for a certain percentage of building permits to be closed without having all of the typical follow up documents. This would allow the City to follow up on receiving follow up schedules on the more significant developments, while recognizing the potential financial constraints on a portion of smaller developments.  SCC position o The SCC maintains its position that no permits should be closed by the City until all of the follow up schedules are received.  Administration’s position o The City believes that the current practice allows the SCOs to use their judgement in closing off permits for which there is little risk of not having a follow up inspection by the designing engineer.  Resolution o The updated Joint QMP identifies that permits should not be closed by the City until we receive all of the follow up schedules.  Potential impacts on future audits o The City intends to be responsive to the needs of the clients throughout the inspection service area. Future audits are likely to have “findings” related to permits being closed without receiving all follow up schedules. Administration is comfortable with “findings” of this nature.  Relevant Examples where future “findings” may be found during an audit o Smaller projects which still require engineered drawings / schedules may see the initial schedules being submitted, but no follow up schedules being submitted

4. Completing 100% of required inspections on all projects (pages 19 through 26)  Issue o The remaining section of the updated Joint QMP identifies the number of inspections that are to be completed within each discipline and at each stage of a project. These would vary in number and timing depending on a number of

factors (the size of the development, new construction vs. renovation, etc.). However, there are some instances where it is not possible or practical for the SCOs to complete the minimum number of required inspections. o For example, when the economy is very strong and the number of open permits exceeds the City’s internal capacity to complete these permits, there may be times when an SCO is unable to complete all of the required inspections. Rather than bringing in a contract SCO inspector to supplement our existing staff contingent (usually at great expense to the City, assuming that an available inspector can even be found), some inspections simply might not be completed. o In this instance, the SCOs have used their judgement to prioritize inspections based on relative risk, in order to ensure that “riskier” inspections are not missed. Also, the SCOs have typically prioritized the locations of the inspections to ensure that “missed” inspections are not confined to certain geographic areas or to specific builders. o By way of example, for some of the more common home builders in urban areas, it may be possible to inspect only a select number of homes at a certain stage and reasonably expect to see similar issues on the remaining homes that were not inspected. o Another example that comes up from time to time is an inspection at a property where illegal activities are suspected to occur (i.e. “grow ops” or “chop shops”). Following the advice of the applicable police authority, our SCOs have occasionally not performed inspections on properties where their safety may be placed in jeopardy. o As with prior examples, the City was hoping that the updated Joint QMP would allow for a certain percentage of building permits to be closed without having completed all of the required inspections. This option would only be used in extenuating circumstances. o It should be noted that in many cases, the number of inspections being completed may actually exceed the minimum number of inspections. Examples of this would be inspections on a large industrial site in either the rural or urban areas, or follow up inspections on residential or non-residential developments where significant deficiencies were noted on prior inspections.  SCC position o The SCC maintains its position that no permits should be closed by the City until the identified minimum number of completed inspections has been achieved.  Administration’s position o The City believes that the current practice allows the SCOs to use their judgement in closing off permits where there is low risk to the City or property owner in times when the number of inspections exceeds the City’s ability to conduct these inspections, or where SCOs could be in harm’s way should they proceed with the inspections.  Resolution o The updated Joint QMP identifies that permits should not be closed by the City unless all of the required inspections are completed.  Potential impacts on future audits o While the City’s SCOs will continue to strive toward completing all required inspections for all open permits, the City does not believe that it is practical to meet this requirement 100% of the time. o Although the City’s Safety Codes work unit is run as a “fee for service” operation, in many years the City’s expenses related to the provision of safety code

inspections within the entire service area exceeds the amount of revenue that the City realizes through permit fees and charges. As such, the City is reluctant to bring in contracted SCOs to assist with completing inspections during times of higher construction activity, as the additional revenue received during those busier periods does not generally cover the cost of retaining the contracted inspector. Additionally, as there are only a limited number of certified SCOs within the Province, the City may not be able to retain an SCO to assist with these inspections during the busier construction periods due to heavy inspection workloads in other jurisdictions. o Future audits are likely to have “findings” related to permits being closed without completing all of the required inspections. Administration is comfortable with “findings” of this nature.  Relevant Examples where future “findings” may be found during an audit o “Low risk” inspections, such as multiple homes being built by the same contractor at approximately the same time, and at approximately the same stage of construction o Projects that may pose an unusual health & safety concern for SCOs

ADMINISTRATION OF THE CAMROSE JOINT QUALITY MANAGEMENT PLAN

Adherence to the Quality Management Plan

City of Camrose, Camrose County, Village of Bawlf, Village of Bittern Lake, Village of Edberg, Village Ferintosh, Village of Hay Lakes and Village of Rosalind herein referred to as “The Municipality” is responsible for the administration, effectiveness, and compliance with this Quality Management Plan (QMP) that includes Schedule A – Scope and Administration and Schedule B - Service Delivery Standards.

The Municipality will provide services under Schedule B – Service Delivery Standards through their own staff or one or more accredited agencies. When providing services through an agency(s), the Municipality will contract with the agency(s) to provide services in accordance with Schedule B – Service Delivery Standards. The Municipality is responsible for monitoring the contracted agency’s compliance with Schedule B – Service Delivery Standards.

The Municipality recognizes that the Safety Codes Council (SCC) or its representative may review/audit for compliance to this QMP and will give full cooperation to the SCC or its representative in business related to the administration of the SCA including the conduct of reviews/audits. The Municipality will implement the recommendations of the reviewer/auditor.

The Municipality will encourage and maintain an atmosphere that supports objective and unbiased decisions. All Safety Codes Officers (SCOs) working in the Municipality have the ability and opportunity to make decisions relative to compliance monitoring independently, without undue influence of management, appointed or elected officials.

The Municipality, in the event that it ceases to administer the SCA for any new thing, process, or activity under the SCA, retains responsibility for services provided under the SCA while accredited, including the administration and completion of services for permits issued.

The Municipality recognizes that failure to follow this QMP may result in suspension or cancellation of the Municipality's accreditation.

The Municipality has identified a QMP Manager who is responsible for the administration of the QMP.

Policy for Personnel Training

The Municipality will ensure that SCOs of the Municipality attend updating seminars required by the SCC to maintain current SCO certification.

Freedom of Information and Confidentiality The Municipality will ensure that all staff, SCO’s, and contracted personnel preserve confidentiality with respect to all information and documents that come to their knowledge from their involvement with the administration of this QMP. The Canadian Charter of Rights and Freedoms applies to all activities undertaken in the administration of this QMP. The Freedom of Information and Protection of Privacy Act apply to all information and records relating to, created, or collected under this QMP.

Records Retention & Retrieval

The Municipality will retain the files of all projects including those where an accredited agency(s) was involved, for at least three (3) years or in accordance with the Municipality’s record retention policy, whichever is greater. Such files will be available at the Municipality’s office. Files where an accredited agency was involved are the property of the Municipality and will be returned to the Municipality within a reasonable time after completion of the services, or upon request.

Declaration of Status

The SCOs, staff, officers, and accredited agency(s), whether employed, retained or otherwise engaged by the Municipality will not participate in any safety codes administration, inspection, or investigation of properties or fires where they may have pecuniary interest.

Annual Review

Internal reviews will be carried out annually by the QMP Manager or the Manager’s delegate to evaluate whether or not compliance of the Quality Management Plan is being achieved. At the conclusion of the internal review, the QMP Manager will provide, to the Safety Codes Council, a letter of QMP compliance that has been signed off by the municipality’s executive authority. The letter must be comprised of all findings of the review including any successes, areas for improvement and the methodology used to achieve improvement or correction as it relates to the approved Quality Management Plan.

This is a mandatory requirement and failure to comply may result in cancellation or suspension of a municipalities’ accreditation designation. All findings for the annual internal reviews are due to the Safety Codes Council no later than the last day of March of the following year that is being reviewed.

The QMP Manager assigned for the management of the Joint QMP will be responsible for the coordination of annual internal reviews for all municipalities within the Joint QMP.

Revisions

Revisions to this QMP may only be made to the Scope and will only be made by the Chief Administrative Officer responsible for this QMP. A Resolution from the Municipal Council will be included with a revision. The Administrator of Accreditation at the SCC must approve any change in the QMP.

Revision Control System

The Municipality will ensure its SCOs have ongoing access to a copy of this QMP and contracted accredited Agencies are provided with a copy of this QMP and any amendments.

The Municipality will maintain a registry of the SCOs and Agency(s) that have been provided with a copy of this QMP and amendments. The Municipality will immediately distribute copies of approved amendments to all registered holders of this QMP.

Section 1: Scope of Services

The Service Delivery Standards establishes responsibilities and minimum performance criteria for providing compliance monitoring services under the SCA including:  code advice,  permit issuance,  plans examinations,  site inspections,  site investigations,  alternative solutions/variances,  orders,  verification of compliance,  identification and follow-up of deficiencies and unsafe conditions,  collection and remittance of SCC fees,  issuance of Permit Services Reports, and  maintaining files and records.

Section 2: Performance

The Municipality will:  perform the services in an effective and timely manner,  endeavour to work co-operatively with the owner and/or the owner’s representative(s) to achieve compliance with the SCA and applicable Regulation(s),  perform the services with impartiality and integrity, and  provide services in a professional and ethical manner.

Section 3: Personnel

The Municipality will:  employ persons knowledgeable about the applicable codes, standards and regulations, relative to the services it provides,  employ SCOs who are certified and designated at an appropriate level to provide compliance monitoring and investigations relative to service levels the Municipality provides, and  maintain a registry of all SCOs they employ, their level(s) of Certification, and Designation of Powers.

Section 4: Quality Management Plan Training

The Municipality will:  train its SCOs and other involved staff in the requirements of this QMP, and  maintain the training records on the employee’s file.

Section 5: Records

The Municipality will maintain a file system for all the records associated with performing the services including:  permit applications and permits,  plans, specifications, and other related documents,  plans review reports,  inspection reports,  investigation reports,  verifications of compliance,  Alternative Solutions / Variances,  Orders,  Permit Services Reports, and  related correspondence and/or other relevant information.

Section 6: Safety Codes Council Operating Fees

The Municipality will collect the Council levy for each permit or service provided under the Act, and remits the levy to the Council in the manner and form prescribed by the Council.

Section 7: Orders

Will be issued and served in accordance with the SCA, the Administrative Items Regulation, and SCC policy. Orders will be in the format provided on the SCC web site: www.safetycodes.ab.ca. Upon compliance with an Order, a notice of compliance will be provided to the person(s) to whom the Order was served and to the SCC.

Section 8: Alternative Solutions / Variances

Will be issued in accordance with the SCA and SCC policy. An Alternative Solution / Variance will be in the format directed by the SCC (available on the SCC web site: www.safetycodes.ab.ca. ).

A SCO may issue an Alternative Solution / Variance from a code or referenced standard if the SCO is of the opinion that the Alternative Solution / Variance provides approximately equivalent or greater safety performance than that prescribed by the code or standard.

A request for Alternative Solution / Variance must be made in writing and include support documentation. A SCO will only make a decision respecting an Alternative Solution / Variance after having thoroughly researched the subject matter.

A copy of an Alternative Solution / Variance issued will be provided to the:  owner,  contractor if applicable,  SCC, and  the Municipality’s file.

Section 9: Compliance Monitoring

General

The Municipality will monitor compliance through a program of permit issuance, plans examination (when applicable), site inspection, and follow-up inspections or verification of compliance; using appropriately certified and designated SCOs to provide compliance monitoring in accordance with the SCA and associated codes and standards.

Permits / Permissions

The Municipality will collect all information required by the SCC to be collected as part of each permit application.

Permit Applications

Permit Applications will include the following information:  name of the issuing Municipality,  permit discipline type,  date of application,  applicant’s name, address, and phone number, and email (if known),  contractor’s name, address, and phone number, and email (if known),  owner’s name, address, and phone number, and email (if known),  project location by legal description, civic address, and municipality,  description of the work,  state the use or proposed use of the premises,  a Freedom of Information and Protection of Privacy Act (FOIPP) statement that meets the requirements of FOIPP as per the following example:

“The personal information provided as part of this application is collected under the Safety Codes Act and the Municipal Government Act and in accordance with the Freedom of Information and Protection of Privacy Act. The information is required and will be used for issuing permits, safety codes compliance verification and monitoring and property assessment purposes. The name of the permit holder and the nature of the permit is available to the public upon request. If you have any questions about the collection or use of the personal information provided, please contact the municipality.”

 any other information the SCO or permit issuer considers necessary.

Permits

Permits will include the following information:  a permit number or other unique identifier that has been assigned by the permit issuer to the undertaking,  the date on which the permit is issued,  the name of the owner and the person to whom the permit has been issued,  where the undertaking is to take place,  a description of the undertaking or portion of the undertaking governed by the permit, and  contain any other information that the permit issuer considers necessary  issuer’s name, signature, and designation number,.

Permit Conditions

A permit may contain terms and conditions that include but not limited to:  permission be obtained from the SCO before occupancy or use of the construction, process or activity under the permit,  the date on which the permit expires,  a condition that causes the permit to expire,  the period of time that the undertaking may be occupied, used or operated,  setting the scope of the undertaking being permitted,  setting the qualifications required of the person responsible for the undertaking and/or doing the work,  an identification number or label to be affixed to the undertaking,  requirement to obtain the approval of a safety codes officer before any part of the building or system is covered or concealed.

Site Inspections

An SCO will inspect:  to determine if the use, occupancy, sites or work complies with the SCA and relevant codes and standards, permits, and conditions,  within the time frames noted in the discipline specific sections of this QMP,  in a timely fashion (endeavour to inspect within 2 working days and will not exceed 5 working days, when contacted for a required inspection unless otherwise noted in this QMP),  at the stage(s) indicated in the discipline specific sections of this QMP, and  all work or occupancy(s) in place at the time of the inspection.

The Municipality may, at their discretion, extend the time frame for a required site inspection(s) by documenting in the file:  the reason for the extension, and  the new time frame or date for conducting the inspection(s).

Inspection Reports

A SCO will, for each inspection required by this QMP, complete an inspection report noting:  permit number and file number (if applicable),  discipline,  municipality name and date,  owner name, address, phone number, and email (if known),  contractor name, address, phone number, and email (if known),  legal description, address (if applicable), and municipality,  stage(s) of work being inspected,  a description of the work in place at the time of inspection,  all observed deficiencies (any condition where the work is incomplete, or does not comply with the SCA or an associated code or regulation and in the opinion of the SCO is not an unsafe condition),  all observed unsafe conditions (any condition that, in the opinion of a SCO, could result in property loss, injury, or death, and is not a situation of imminent serious danger),  all observed situations of imminent serious danger and the action taken by the SCO to remove or reduce the danger, and  name, signature, and designation number of the SCO conducting the inspection.

The Municipality will, for each required inspection:  provide copies of Inspection Reports to the permit applicant, contractor, and Municipality’s file; and if requested to the owner, project consultant, architect, or consulting engineers, and  follow-up on noted deficiencies or unsafe conditions through re-inspection(s) (or at the discretion of the SCO, a verification of compliance may be accepted in lieu of an on-site re-inspection).

Verification of Compliance

A SCO may, at their discretion, accept a verification of compliance (reasonable assurance provided from a third party that work complies):  as follow-up to deficiencies or unsafe conditions noted on a site inspection, or  in lieu of a site inspection when permitted in this QMP (eg. labelled mobile home siting, minor residential improvements).

An SCO, when accepting a verification of compliance, will document the information to the permit file including:  identification of the document as a verification of compliance,  permit number and discipline,  name and title of the person who provided the verification of compliance and how it was provided (i.e. written assurance, verbal assurance, site visit by designate, etc.),  date accepted by the SCO, and  signature and designation number of the SCO.

No-Entry Policy

When a SCO is unable to gain entry to a site for a required inspection, the SCO will leave a notification on- site in a visible location, or forward notification to the Owner or permit applicant (as appropriate), advising of the inspection attempt and requesting that the Municipality be contacted to arrange for the site inspection.

If the Municipality does not receive a response within 30 days of notification, the Municipality will mail the Owner or permit applicant (as appropriate), a second notification requesting that the Municipality be contacted within 30 days to arrange for a site inspection.

If the Municipality is not contacted within 30 days of the second notification, the inspection stage may be considered a “no-entry” and counted as the required interim or final inspection.

Final / Compliance Monitoring Inspection Report (Permit Services Report)

The Municipality will issue a Permit Services Report with inclusion of the final inspection: (combined into one form)  within 30 days of completing the compliance monitoring services as required in this QMP (completion of compliance monitoring services means; after the final or only required inspection, after acceptance of a verification of compliance in lieu of an inspection when permitted, or after compliance with the no-entry policy with respect to the final or only required inspection),  to the Owner (the Owner, for the purposes of this QMP means, in order of preference; the Owner of the project at the time the permit was purchased, at the time the compliance monitoring services were provided, or at the time the Permit Services Report was issued).

The Municipality will not issue a Permit Services Report or close a file if there is an unsafe condition, until such time as the unsafe condition is corrected.

The Municipality will, for administrative purposes, consider the file closed when the Permit Services Report is issued, however:  will reactivate the file if any further activity related to the permit is initiated within 30 days, and  may reactivate the file at any time.

APPENDIX A: BUILDING DISCIPLINE

Building Permits

The Municipality will, prior to permit issuance:

 obtain two complete sets of construction documents as outlined in the Alberta Building Code (ABC),  obtain any letters or schedules required to be provided by the ABC,  conduct a preliminary review of the construction documents to determine if professional involvement is required or if there are any potentially significant code compliance issues, and  obtain documents with the seal and signature of a registered architect and/or professional engineer(s), when required by the ABC.

Construction Document Review

The Municipality will, not more than 15 days after permit issuance:

 complete a review of the construction documents in accordance with the requirements of the ABC,  prepare a Plans Review Report,  provide the Plans Review Report to the permit applicant, contractor, and Municipality’s file; and if requested, to the owner, project consultant, architect, or consulting engineers, and  provide one set of construction documents to the permit applicant for retention and review at the project site, and retain one set on the Municipality’s file.

Compliance Monitoring on Projects requiring Professional Involvement

The Municipality will collect and maintain on file, required schedules and/or a letter(s) of compliance from the professional architect or engineer when a part or parts of the building require a professional architect or engineer.

The Municipality will collect and maintain on file all schedules and letters of compliance required in accordance with the ABC when overall professional architect and/or engineer involvement is required for the work covered under a permit.

Site Inspection of Non-flammable Medical Gas Piping Systems will be at the discretion of the SCO responsible for permit issuance. The SCO will follow up all ABC deficiencies identified by the testing Agency, to ensure compliance.

Permit Issuance for Private Sewage Disposal Systems

The Municipality will, prior to permit issuance require the permit applicant to provide all relevant installation details including:  a site plan,  the expected volume of sewage per day,  the criteria used to determine the expected volume of sewage per day,  description and details of all sewage system treatment and effluent disposal component(s),  details of the method(s) used to determine the soil effluent loading rate, including the results of the method(s) and who they were conducted by, and the depth to the water table if less than 2.4 m from ground surface,

and

 require a Plumbing Group B SCO to complete a review of the information for compliance with the requirements of the Private Sewage Disposal System regulations.

Private Sewage Disposal System Site Inspections

A Plumbing Group B SCO will:

 conduct a minimum of one site inspection during installation, or  if unable to conduct the inspection during installation, note the reason on file and conduct a final inspection within 30 days of permit issuance.

That Administration be authorized to conduct preliminary negotiations with the City of Camrose regarding amending the Water Supply and Wastewater Services Agreement Regarding the Residential Subdivision of Braim, specifically for but not limited to the water and wastewater rates and connection fee structure, with all amendments being brought back to Council for approval prior to any final amendments being made.

BACKGROUND INFORMATION:

On August 15, 2016 Camrose City Council passed a motion that directs City Administration to amend the Water Supply and Wastewater Services Agreement Regarding the Residential Subdivision of Braim. This will allow for two additional residential parcels located within the Braim Subdivision, Lot 2, Plan 8120157, NW 11-47-20-W4 and Lot J, Plan 5675KS to connect to the City's water and wastewater system. Additionally, SE-15-47-20-W4M, a residential parcel located outside the Braim Subdivision, can connect to the City's water system.

The approval for the above mentioned properties to connect are subject to the following:

1) That the water and wastewater connection fee for the two additional residential parcels in Braim shall be $10,000 each ($5,000 Water and $5,000 Wastewater); and the water connection fee for the one residential parcel located outside of Braim shall be $5,000; and

2) That the County agrees to open the "Water Supply and Wastewater Services Agreement Regarding the Residential Subdivision of Braim" specifically for but not limited to the water and wastewater rates and connection fee structure.

Camrose County Administration (Planning) has contacted the residents of the Braim subdivision regarding delaying subdivision approval to allow these negotiations to be completed, the residents involved have agreed to delay subdivision approval until September 27th.
