Water Source (Reservoir) Project. Therefore, the implementation of the project must meet the World Bank's social security policy. The DPs Resettlement Plan complis with thelaws and regulations of People's Republic of , Gansu Province, and

Longnan relevant, as well as the World Bank's social security policy, and became the basis for land acquisition, relocation and resettlement involved in the project.

Chengxian County People's Government hereby confirms that the contents of this report, and ensures that the project land acquisition, demolition, resettlement, compensation, and budget funds will be implementated according to this plan, while ensuring that all the resettlement funds will be paid in a timely manner and in full amount. The resettlement plan is prepared according to the project feasibility study report and preliminary socio-economic survey data. If the project‟s finally implemented engineering contents are inconsistent with engineering contents described in the project feasibility study report, and caused an actual effect on this resettlement plan, the resettlement plan will be amended accordingly. The amended resettlement plan should get World Bank's approval prior to implementation.

The definitions of relevant terms

I. Displaced Persons, DPs

1. From the eligibility criteria for compensation, "Displaced Persons, DPs” are divided into the following three categories:

A. People having formal legal rights to the land (including the usual and traditional rights recognized by national law); B. People who do not have formal legal rights to the land in beginning of the census, but who claim requests for this piece of land or property - such requests are recognized by national law or recognized through process recognized in the resettlement plan; and C. People who don’t have recognized legitimate rights or claims for the land they occupy. 2. People in situation 1 (A) and 1 (B) get compensation and other assistance for the loss of land. People in situation 1 (C) can get access DPs resettlement assistance in lieu of compensation for the land that they occupy, and other necessary helps to achieve the goals set in this policy, provided that their occupation of land on the project area is earlier than a deadline1 provided by the borrower and accepted by the Bank. People occupying this region after this deadline shall not be entitled to compensation or any form of resettlement assistance. Everyone involved in paragraphs 1 (A), 1 (B) and 1 (C) can get the compensation for damage to property other than land.

II. Compensation and resettlement measures

3. In order to resolve or eliminate the impacts or problems resulted from the compulsory acquisition of land, (i) relocation or loss of shelter; (ii) loss of assets or channels of access to assets; or (iii) loss of income sources or means of subsistence (whether the affected person must be moved to other places), we should prepare a DPs resettlement plan or DPs resettlement policy framework covering the following:

A. DPs resettlement plan or DPs resettlement policy framework shall take appropriate measures to ensure that the DPs (i) Be informed of the options and other rights on the resettlement issue; (ii) Understand the technically and economically feasible solution, participate in the consultation, and enjoy the opportunity to choose; (iii) Get prompt and effective compensation at the full replacement cost2, to offset the direct property loss caused by the project. B. If the impacts include relocation, then DPs resettlement plan or resettlement policy framework should take appropriate measures to ensure that DPs (i) Get help in the relocation period (eg, relocation subsidies); (ii) Get housing or homestead, or get agricultural production sites upon request. Agricultural production site‟s production potential, location advantages, and

other comprehensive factors should be at least equivalent with favorable conditions of the original sites. C. To achieve this policy‟s objectives, the GPs resettlement plan or GPs resettlement policy framework should also take appropriate measures when necessary, to ensure that GPs (i) After the removal, according to the time may be required for recovery of livelihoods and living standards, reasonably estimate the transition period, and get help during this transition period; (ii) In addition to the compensatory measures referred to in paragraph 3 (A) (iii), they can also get assistances in land preparation, credit, training or employment. III. Vulnerable group

Vulnerable group of the project refers to project-affected people below the poverty line, the elderly, women, the disabled, ethnic minorities and so on. This project will pay particular attention to such group.

1 Project Overview

1.1 Project background

Gansu Province Chengxian County Urban Area Water Supply Mobaxia Water Source (Reservoir) Project is a World Bank emergency loan project. Chengxian County, the location of Mobaxia Reservoir, is located in the southeast of Gansu Province, part of Longnan City. It is located at north latitude 33°31'-34°02', and east longitude 105°24'-105°57', it is Jialing River System in the upper reaches of the Yangtze River, it is adjacent to Huixian County in the northeast, in the northwest, looks to Kangxian County across the southern boundary of Western Hanshui River, and borders Lueyang, Shaanxi in the southeast.

Chengxian County‟s urban area is Longnan City‟s secondary central city in economy, culture and science and technology fields, and also a new eco-industrial city one being built. According to water supply project planning in “Chengxian County‟s General Urban Planning Framework (2008-2025)”, by long term in 2025, the county will build 3 Water plants of Chengnan, Hedong and Paosha, the total size of the urban water supply will reach 65,000 m3/d. Therefore, from the status quo of city water supply, existing Chengnan Sunjiaba Water plant‟s groundwater well water is affected by the water pollution and deterioration, aging facilities and the Wenchuan earthquake; peak reservoir water is limited by small natural runoff and reservoir storage capacity; combined with that the city‟s facilities of water supply network are badly damaged poor, etc., the existing water supply capacity can not meet urban water demand in the current period, and in short term and long term, with a large gap behind the city‟s estimated the water consumption needs. Chengxian County‟s current water supply infrastructure has become a serious impediment restricting Chengxian County‟s urbanization level and sustainable development of local economy.

Chengxian County CPC Committee and County Government attach great importance to this, county NPC deputies, CPPCC members have repeatedly proposed to build a reservoir in Mobaxia for Chengxian County‟s water supply, the proposal has been supported the county community, and formed motion to submit to the Gansu Province People's Congress. The construction of Mobaxia Reservoir is an important water supply infrastructure related to expanding the scale of urban development of

Chengxian County.

In February 2009, commissioned by Chengxian County Water Resources and Power Authority, all specialities of Luoyang Water Survey and Design Institut started a feasibility study and design of Mobaxia Reservoir.

1.2 Project overview

1.2.1 Project components Mobaxia Reservoir is a canyon water storage reservoir, and a water supply project mainly for urban water supply. Mobaxia Reservoir Project‟s main construction contents include one water source water storage reservoir and hub area works.

 Reservoir area

According to water calculation and reservoir flood calculus, the reservoir total storage capacity is determine as 17.87 million m3, water project capacity is 11.4 million m3, Mobaxia Reservoir‟s maximum annual water supply capacity is 16,659,200 m3 (corresponding peak e reservoir supplements 792,800 m3), the maximum daily water supply capacity is 47,500 m3, Mobaxia Reservoir‟s average annual water supply capacity is 15,053,000 m3, and the average daily water supply capacity is 41,240 m3.

 Hub area

The hub area works are mainly composed of buildings of roller compacted concrete gravity dam, right bank flood discharge tunnel, on-the-dam road and aqueduct. On basis of designed water supply of 43200 m3, according to the “Outdoor Water Supply design Code” (GB50013-2006), designed flow from water source to the water treatment plant should be determined by daily water supply plus water plant‟s water consumption and waterpipeline leakage loss, water plant‟s water consumption and waterpipeline leakage losses are calculated at 10%, then the water source design daily water supply capacity is 47,500 m3, and Mobaxia Reservoir‟s waterpipeline water supply design flow is 0.55m3/s. Water pipelines length is5.04km.

1.2.2 Project land acquisition and resettlement scope and impact brief Chengxian County Mobaxias Reservoir Project land acquisition and demolition scope includes the reservoir inundation area, reservoir affected zone, and hub project construction area (including hub project construction permanently occupied land and hub project temporary construction site). In this stage, the project's land acquisition and resettlement impact is determined on basis of the investigation according to the recommended program determined in the project feasibility study stage. According to the requirements of “Water Resources and Hydropower Project Land Acquisition and Resettlement Design Specification” (S290-2009) and the actual situation of the reservoir area, consider Nanhe‟s hydrology, sediment, and reservoir operation mode, analyze the level of importanve of different submerged objects around the reservoir, crop planting structure and other factors, and develop Mobaxia Reservoir‟s inundation design flood standards as follows:

① Farmland and garden: controlled by once-per-five-year flood standard;

② Rural settlements: controlled by once-per- two-decade flood standard;

③ Woodland: controlled by normal water level of 1092.7m.

④ Transportation, power transmission and other special facilities around the reservoir, use the appropriate design flood standard.

Backwater is calculated using the Bernoulli piecewise test algorithm (ignore the water near head and channel storage capacity, channel roughness is calculated at equivalent), in the measured 1/2000 topographic map, cut the 24 cross-sections of

Taking into account the reservoir banks local recycling factor, in the flat water segment of reservoir area, the cultivated land requisition and residents resettlement line is higher than normal water level by 1m, for safety's sake. External line composed of the normal reservoir water level plus security ultra height and back water level of floods of all frequencies is used as the scope of investigation for all kinds of submerged physical objects indicators. Reservoir inundation path water level see Annex 2.

In the process of investigation of displacement-affected physical indicators, the investigation group, on the basis of the results of previous surveys combined with actual situatoin in construction and land acquisition area, holds measured 1:2000 reservoir area terrain diagram, according to the reservoir submerged temporary boundary markers‟ defined scope, conducts a full investigation on the physical indicators in Mobaxia reservoir inundation area and hub construction area involved in reservoir inundation.

The project land acquisition and resettlement involve Chengxian County‟s three townships of Chenyuan, Shaba and Paosha; seven administrative villages, and 13 village groups. Project land acquisition and resettlement directly affect the total population of 280 people, the project needs a permanent occupation of land of 940.664 mu, of which arable land of 150.534 mu; temporary land area of 345 mu, of which arable land of 45.87 mu; project displaced residents housing of 549.33 m2, one industrial and mining enterprise, and non-residential housing of 52m2. Project-impacted DPs are shown in Table 1-2.

1.2.3 Project's social and economic benefits The implementation of Gansu Province Chengxian County Urban Area Water Supply Mobaxia Water Source (Reservoir) Project is a fundamental solution to the water problems in the life of the county district residents and the production of industrial enterprises, also lays the foundation for the development of the western region, creation of an investment environment, and establishment and improvement of market economy, and bears great significance in promoting sustained economic development in Chengxian County as a whole. The maximum annual water supply capacity of Mobaxia Reservoir is 16,659,200 m3, maximum daily water supply capacity is 47,500 m3, Mobaxia Reservoir‟s average annual water supply capacity is 15,053,000 m3, and average daily water supply capacity is 41,240 m3.

1.2.4 Investment estimation and implementation plan According to “Gansu Province Chengxian County Urban Area Water Supply Mobaxia Water Source (Reservoir) Project Feasibility Study Report” prepared by Luoyang Water Survey and Design Institute, the total project investment is 264.4538 million yuan. Displacement and the environment part‟s investment is 44.0144 million yuan, accounting for 16.64% of the total investment.

According to the progress of the project, project preparatory work is arranged in February 2009 to October 2011, feasibility study and project approval will be completed in June 2009, preliminary design will be completed in April 2012, construction drawing design and construction bidding work will be completed in May 2012, construction will commence in June 2012, construction will be completed in December 2013, constuction duration is months, and the project will be delivered in

December 2013.

1.2.5 Resettlement plan preparation and approval According to the progress of the project construction, under the guidance of World Bank Emergency Preferential Loans Longnan Earthquake Reconstruction Project Office (hereinafter referred to as the World Bank Project Leadership Office), Luoyang Water Survey and Design Limited Liability Company has started prepare the project's displacement plan in November 2010. The preparation and modification of the displacement plan will be completed in June 2011, which will be submitted to the World Bank for review. On October 27, 2011, the Department of Water Resources of Gansu Province organized review of “Mobaxia Water Source (Reservoir) Project Resettlement Planning Framework (Draft for Review)” in . According to the comments, the modified “Mobaxia Water Source (Reservoir) Project Resettlement Planning Framework (Draft for Review)”, after being submitted for approval to the higher level unit in charge, will guide the preparation of “”Chengxian County Urban Area Water Supply Mobaxia Water Source (Reservoir) Project Resettlement Planning Report” and resettlement implementation work. And on this basis, prepare “Resettlement Action Plan” and submit to the World Bank for review. After theWorld Bank has reviewed and approved the project, project land acquisition, compensation and resettlement implementation plan will start in June 2012. Project and displacement plan review plan is in Table 1-3.

1.3 Measures to reduce land acquisition and resettlement

1.3.1 Project design and siting principle In the project design phase, taking into account land acquisition and relocation shall be minimized; the main principles are as follows:

 Avoid residential areas restricting the reservoir scale

 Avoid or minimize occupying existing and planned residential areas (rural and urban)

 Avoid or minimize occupation of high quality arable land

 Use existing national and local road to the proposed construction area

 Avoid or minimize the occupation of environmentally sensitive areas

 Choice of resettlement areas should be in line with local development planning

1.3.2 Project plan comparison and selection In project planning and design phase, in order to reduce the impact of projects on the local socio-economic situation, Luoyang Water Survey and Design Limited Liability Company carried out stringent plan comparison, selection and optimization, project land acquisitoin and occupation is one of the most important indicators. Luoyang Water Survey and Design Limited Liability Company conducted rigorous plan demonstration on the dam site, reservoir inundation water level under circumstance of ensuring the water supply capacity and function.

In the feasibility study stage, calculation, statistical work and determination are based on 1/2000 topographic map. In the feasibility study stage, the twodam line plans of upper and lower are compared, dam lines in the two plans are 100 meters apart, with almost no effect on the submerged physical indicators.

In the project feasibility study stage, considering the feasibility study stage‟s normal water level selection results and interested parties‟ views on the normal water level, we developed three options with the normal water level of 1089m, 1092.7m and 1096m for analysis and comparison. Three normal water level plans‟ dead water levels are all 1068m. From the impact of displacemnt and water supply indicators, in order to determine the optimal project submerged line, we compared and analyzed different water levels, see Table 1-4. Through analysis of submerged indicators at all water levels, the higher the normal water level, the larger the submerging effect. Through analyze of the project„s economic efficiency, according to the principle of minimum present value of total cost, through calculation of the sum of each normal water level plan‟s difference in cost of the project and the cost of replacement project, we carried out plan economic comparison.

In summary, with combination of project submerged targets and water supply indicators, we determine recommend normal water level at this stage to be 1092.7m.

1.4 Associated project identification

Associated projects are other projects having direct relation with the project construction features or benefits is in the process of project preparation and implementation, namely projects using non-World Bank loan funds, build at the same

In the project design process, the project unit attaches great importance to the identification of the associated project. The project unit and design unit carried out association analysis of all works. Through analysis, the approved project does not involve the associated projects.

2 Project impact

2.1 Project impact category

According to the analysis of the physical survey, the project impact category mainly includes the following four categories:

(1) Land acquisition/occupation losses impact

(2) Residential housing and appurtenances demolition impact

(3) Non-residential housing demolition impact

(4) Special and infrastructure losses impact

2.2 Project affected areas

Land acquisition and resettlement affected areas include reservoir inundation scope, and reservoir dam area construction scope.

Reservoir inundation scope includes inundation area and areas of reservoir water immersion, bank caving, landslides and other areas affected by the reservoir impoundment. Accordiing to requirements of “Water Resources and Hydropower Project Land Acquisition and Resettlement Design Specification” (S290-2009) and the actual situation of the reservoir area, taking into account Nanhe‟s hydrology, sediment, and reservoir operation modes, we analyzed the level of importance of submerged objects around the reservoir, crop planting structure and other factors, and developed Mobaxia Reservoir‟s inundation design flood standard as:

① Farmland and garden: controlled by once-per-five-year flood standard;

② Rural settlements: controlled by once-per- two-decade flood standard;

③ Woodland: controlled by normal water level of 1092.7m.

④ Transportation, power transmission and other special facilities around the reservoir, use the appropriate design flood standard.

Taking into account the reservoir banks local recycling factor, in the flat water segment of reservoir area, the cultivated land requisition and residents resettlement line is higher than normal water level by 1m, for safety's sake. External line composed of the normal reservoir water level plus security ultra height and back water level of floods of all frequencies is used as the scope of investigation for all kinds of submerged physical objects indicators. Reservoir inundation path water level see Annex 2. According to the requirements of the “Water Resources and Hydropower Project Land Acquisition and Resettlement Design Specification" (S290-2009), we determine the inundation areas as follows:

(1) Land acquisition line: cultivated land and garden's requisition lines consider sediment deposition in 10-30 years, flood back waterline is desitned according to flood once every 2-5 years, in segment in front of the dam where backwater has significant effect, consider the impact of storm climbing, add 1m to above the normal water level of 1092.7m for safety's sake. Woodland, grassland and other types of land‟s requisition line is at normal water level of 1092.7m.

(2) Population migration line: consider sediment deposition in 10-30 years, design flood back waterline according to flood once every 10-20 years, in the section in front of the dam where backwater has no significant effect, consider the impact of the storms climbing, and add 1 m to above the normal water level of 1092.7m for safety's sake.

(3) Specialized project submerged line: determine with reference to the provisions of the specialized norms of the specialized project and the appropriate standard of flood.

(4) Reservoir dam area, and land acquisition range of the supporting pipe network are determined according to hydraulic speciality and construction specialty‟s general layout.

According to the above-mentioned range, the project land acquisition and resettlement involves Longnan City Chengxian County‟s 3 towns, seven villages and 13 villager groups. Project-affected administrative divisions are shown in Table 2-1.

2.3 Project impact (physical indicators) survey methodolog

From November 11, 2010 to November 22, 2010, the report preparation unit, in the assistance of the owner, conducted a full survey on the subjective indicators in Mobaxia Reservoir‟s inundated area and hub construction occupied area. The survey methodology is as follows.

2.3.1 Land survey The investigating officers determine the land class and ownership block by block according to the scope of land requisition and field planted permanent boundary markers measured, with land contracting household and administrative village as unit, collective and state-owned blocks are measured and calculated in block (piece) on 1:2000 scale land class terrain map with computer CAD software, and the personal

The division of the land class shall be subject to the status quo, and comprehensively determined with reference to land status map and forest map of the land and the forestry sectors. The unit of measurement of land is standard mu (1 mu = 666.67m2), to two decimal places. The slopes shall be calculated according to the horizontal projection area.

2.3.2 Census and housing suvey Census, housing and ancillary buildings surveys are carried out at the same time, with township (town), village and group as unit, household registration booklet as the basis, and statistics are got by agricultural and non-agricultural. Survey criteria include the population with household registration and population excceding family planning without household registration, conscripts with household temporarily transferred out, primary and secondary school students, students coming back to the origin after graduation, contract workers, personnel receiving labor education, and workers going out for temporary work. Population whose households have moved out of the construction and land acquisition area are not included in the population of the construction and land acquisition area; workers and military officers born and grew up in construction and land acquisition area, once settled in the construction and land acquisition area, and whose registration for permanent residence is outside the construction and land acquisition area at the time of the survey are not included in the population of construction and land acquisition area; for populatio with only housing but without household in the construction and land acquisition area, only housing and physical objects shall be included.

Various types of housing construction area and appendage number shall be measured and classified with household as unit. They are devided into residents‟ private housing and public housing of village collective ownership according to ownership and affiliation. They are divided into four types of brick and concrete, bricka and tile, brick, clay and tile, and clay and tile according to housing structure, and are actually measured at site; survey on ancillary buildings, collective property, agricultural and sideline facilities, scattered trees and others takes the door-to-door survey method, and register.

2.3.3 Specialized item survey Specialized item survey includes transportation, electricity, telecommunications, mineral resources, heritage and so on within the area affected by land acquisition. Investigate and verify by speciality category, item and unit in the field, and identify economic nature, ownership relations and main technical-economic characteristics. According to Luoyang Water Survey and Design Institute‟s measured 1:2000 topographic map, for roads, electricity, telecommunications and other facilities that water pipelines pass by, we carried out on-site field survey to understand the status quo of special facilities influenced gy the project passing through, visited the relevant administrative departments, understood ownership relations and engineering level of special facilities, and market the location of the crossed building passed through on the map.

2.3.4 Scattered tree survey Comprehensive survey is conducte on scattered trees with household as unit, which are divided into fruit tree, economic tree, and timber tree and so on, and are measured by treee.

The survey data of rural part are kept in record and registered by the investigating officers, and signed (sealed) by investigators and owners (ownership units) for recognization.

2.3.5 Survey results identification (1) Confirmation of investigation process

In the course of the investigation of the physical indicators, scattered trees, arable land (garden), population, housing and ancillary facilities are investigated, for each household‟s survey form, the head of the household, township or village cadres representative Chengxian County Water and Power Bureau and Chengxian County Land Management Bureau‟s representatives publically signed the physical indicators of this household for recognition.

Related professional departments issued the documents for relevant specialized project facilities and signed (sealed) for recognition.

(2) Confirmation of summary results

Mobaxia Reservoir‟s construction and land acquisition physical indicators are technically summarized for statistics by Luoyang Water Survey and Design Institute, and summary results are reported by Chengxian County Water and Power Authority to Chengxian County People's Government.

DPs‟s personal property, such as housing and other ground appendages conduct statistical work with household as unit, statistics of the relevant land indicators shall be to owners; the survey and other basic information has been inventoried and archived, for use in the follow-up resettlement process.

(3) Physical indicators survey and results publicity

After the end of the physical indicators survey, Luoyang Water Survey and Design Limited Liability Company conducted statistical work, survey, data aggregation, sorting, and preparation of physical indicators to publicize the materials. Chengxian County People's Government publicitzed physical indicators, and took combination of oral public notice and posting publicity. Publicity adoptts three-list publicity system, publicity period of the first list and second list is three days, the third list is the ending list, and publicity period is seven days. During the publicity period, if owners (ownership units) have objections to the physical indicators, they should submit a written application to the township government‟s designated contact person, and submit to Chengxian County People's Government for review after sorting and and summerizing, conduct site review on the physical indicators according to the audit opinion on the joint investigation team, for the physical indicators, the results of review shall prevail.

From November 23, 2010 to November 5, 2010, Chengxian County People's Government publicized the survey results on the reviewed physical indicators the Township People's Government, villages and groups, without objection after publicity, the physical quantity publicized in this list shall be finally confirmed results of physical indicators.

(4) Confirmation and review of physical indicators

According to the review results of the physical indicators survey publicized in the ending list, conduct summary and statistical work by village, township, and county level by level, summarized results are signed and sealed after review by all investigated parties for confirmation, and form “Chengxian County Mobaxia

Reservoir (Water Resource) Project Construction and Land Acquisition Physical Indicators Summary Table". The townships‟ signing on the review results for confirmation is detailed in Annex 3.

2.4 Project-affected physical indicators

2.4.1 Project-affected population

(I) Project-affected population Project-affected population contains two meanings: (a) population actually impacted by the project, including the demolition-affected the population and population actually impacted by project land acquisition; (b) in accordance with the theoretical calculations of “Water Conservancy and Hydropower Project Construction and Land Acquisition Resettlement Design Specification (SL 290-2009)", it is placement resettled population. The placement resettled population includes production resettled population and relocation resettled population. Production resettled population refers to rural placement resettled population who need re-allocation of land resources or solution to survival due to that the original land resources outside the land acquisition line cannot be used caused by the original land resources loss or or other causes. Production resettled population is calculated and determined on basis of the degree of people‟s main source of income being impacted by submerging. For those with arable land (garden) as their main source, it shall be calculated with the arable land (garden) affected by submerging in flooded village and group in the reservoir area divided by the per capita share of arable land (garden) village and group before land acquisition, if necessary, we should also consider the land quality differential factor between inside and outside the reservoir; relocation population includes population below the submerged line, population in the flooding affected zone, population that must be relocated with flooded land but no flooded room, and pulation that must be relocated for other reasons; for production resettled population and the relocation resettled population, naturally increased population needs to be calculated according to the proposed design level.

Based on survey results of physical indicators of population, farming land (garden) and others by the village groups in land acquisition area, rural socio-economic statistics annual report by village and group, land resources detailed

15 Relocation plan for ADB-financed Mobaxia water source (reservior) project for urba n water supply of Cheng County, Gansu Province survey results, survey results of the remaining population and farming land (garden) indicators by group of villagers, in accordance with the “People's Republic of China Land Administration Law" and "People's Republic of China Land Contract Law”, use the combination of basic by-group calculation method and field household survey method, analyze and calculate is production and relocation task in the project construction and land acquisition involved region. This project replaced population of 97 people at the design level year (2010), including production resettled population of 83, relocation resettled population of 14; estimated as per natural population growth rate of P = 4‰, in the planning level year (2014), the project will resettle population of 105 people3, including production resettled population of 89, relocation resettled population of 16. Replacement resettled population calculation is detailed in Annex 4.

According to the statistics of the field survey, land acquisition and resettlement of the project directly impacted 66 households and 280 people. Based on the calculation results the resettlement population, 89 persons among people affected by the land acquisition are included in the production resettled population; 16 people affected by project demolition are the relocation resettled population; one industrial and mining enterprise is Mobaxia Quarry. In addition, due to temporary occupation of land by project area (dam area) and water control and water distribution network, population with short-term impact are 78 households and 377 people, project-affected population is shown in Table 2-2. Statistics on population with actual impact, direct impact and short-term impact by the project by village and group are respectively in Annex 5 and Annex 6.

2.4.2 Project permanently expropriated collective land and impact analysis (I) Permanently expropriated collective land Project permanently occupied land is all collective land, 13 villagers group in seven villages in three towns of Chengxian County, Longnan City are involved, rural collective land of 1017.79 mu was acquiired, of which the reservoir inundation area permanently occupied land is 869.96 mu, accounting for 85.48%; hub area ( dam area) permanently occupied land is 147.834 mu, accounting for 14.52%. The hub area project land occupation is caused by the dam construction, management room, aqueduct and dam access road, each sub-project‟s land occupation is as follows: the dam covers an area of 96 mu, accounting for 64.94%; management room covers an area of 13 mu, accounting for 8.79%; the aqueduct covers an area of 18.834 mu, accounting for 12.74%; dam access road covers an area of 20 mu, accounting for 13.53%. From land use and type, agricultural land is 917.534 mu (including dry land of 18.834 mu, sloping land above 25º of 131.7 mu, and woodland of 767 mu), accounting for 90.15% of the total amount of land acquisition, of which arable land is 150.543 mu, accounting for 14.79% of the total amount of land acquisition. In expropriated land, 23.999 mu of arable land and 767 mu of woodland are collectively owned, not contracted to household; construction land is 4.13 mu, accounting for 0.41% of the total number of land acquisition; unused land is 96.13 mu, accounting for 9.44% of the total amount of land acquisition. Project‟s expropriated collective land is shown in Table 2-3. The detailed list of relocated households for land acquisition which involved in the highway on dam and waterline of the project will verify, show to the public and confirm again before the implementation of immigration programme, and the detailed list will be submitted to the World Bank after the final confirmation. After the providing of detailed list which has done the final verification, public notification and confirmation, can analyse the number of land acquisition of every household, the

change of cultivated land per capita before and after land acquisition, and the loss of income, especially the seriously affected households, and submit to the World Bank. Farmland that the project plans to acquire is shown in Figure 2-1. Woodland that the project plans to acquire is shown in Figure 2-2.

(II) Project expropriated collective land impact analysis

Project permanently occupied land is collective land, involving 13 village groups in 7 villages in 3 townships of Chengxian County, Longnan City, which are all villages affected by project land acquisition. Project resettlement village is Chengxian County Chenyuan Town Baimasi Village (resettlement village does not involve land acquisition and demolition). The project has expropriated 1017.79 mu of rural collective land, of which 150.534 mu is arable land, accounting for 14.79% of the total amount of land acquisition. According to the socio-economic survey, we compared and analyzed the arable land and other conditions in affected villages and groups before and after the land acquisition, in 13 group in 7 villages affected, except Moba Village Ma‟er Group (13.23%) and Niurao Village Mazhuang Group (10.57%), whose land loss rate exceeds 10%, the rest of the village groups‟ land loss rate is less than 10%, up to 7.19%; from the loss of income, except 2 households (9 people) in Niurao Village Mazhuang Group, whose per capita loss of annual income is 7,100 yuan, 1 household (5 people) in Longmen Village 3rd Group, whose per capita loss of annual income is 5,700 yuan, the rest of the village groups‟ loss of income is between 0 and 1,200 yuan, of which, nine villages‟ per capita loss of annual income is 100 yuan. Analysis of village groups affected by project land acquisition see in Table 2-4.

For 66 households impacted by land acquisition, 3 households‟ land loss rate is 100%, accounting for 4.55%; 2 households‟ land loss rate is between 21% and 30%, accounting for 3.03%; 5 households‟ land loss rate is between 11% and 20%, accounting for 7.58%; 56 households‟ land acquisition impact rate is less than 10%, accounting for 84.84%. Among them, affected households with land loss rate of 100% are mainly 2 households (9 people) in Niuyao Village Mazhuang Group and 1 household (5 persons) in Longmen Village 3rd Group. Land acquisition affected household analysis table is shown in Table 2-5.

To sum up, except 2 households (9 people) in Niuyao Village Mazhuang Group and 1 household (5 persons) in Longmen Village 3rd Group, land acquisition has extremely small influence on farmers.

2.4.3 Temporarily occupied collective land The project‟s temporarily occupied land involves 10 groups of 3 villages of 1 township in Chengxian County, Longnan City, with total temporary occupation of land of 345 mu, of which temporary occupation by the hub project, temporary buildings, yard, and abandoned ballast field is 258.45 mu; temporary land occupation by water pipelines is 86.55 mu.

From land use and type, agricultural land is 54.53 mu (including 45.87 mu of dry land, 8.66 mu of woodland, which are all shrub land), accounting for 15.81% of the total temporarily occupied land, 45.87 mu of arable land, accounting for 13.3%; 290.47 mu of unused land, accounting for 84.19% of the total. Project‟s temporarily occupied land detals are shown in Table 2-6.

2.4.4 Residential housing demolition Project residential housing demolition involves Niuyao Village Mazhuang Group and Longmen Village 3rd Group. Project total residential housing demolition area is 549.33m2, in which formal house is 369.82m2 (all clay and wood structure), accounting for 67.32%, being for the living; miscellaneous rooms are 179.51m2, accounting for 32.68%, mainly used to put things

In the residential housing demolition, demolition is located Niuyao Village Mazhuang Group and Longmen Village 3rd Group; demolition affects 3 households and 14 people. From housing type, three households are all cottage; from the housing structure, the impacted residential housing are clay and wood structures; from housing area, three affected families‟ per-household housing area is 123.27 m2, per capita housing area is 26.41 m2; from the completion year of the housing, the houses were built in the 1970s. Project residential housing demolition details are shown in Table 2-7. Affected housing is shown in Figure 2-4.

2.4.5 Non-residential housing demolition Project‟s demolition of non-residential housing is 52m2, mainly impacting Mobaxia Quarry. Project demolition of Mobaxia Quarry‟s housing is 52m2; from the housing structure, brick and concrete structure is 16m2, accounting for 30.77% of the demolition area, clay and wood structure is 36m2, accounting for 69.23%. Project non-residential housing demolition impact is shown in Table 2-8.

2.4.6 Minority According to the survey, the affected population in the project does not involve the ethnic minority population.

2.4.7 Vulnerabl groups In accordance with the tenet of this project, the vulnerable group means the disabled household, household enjoying five-guarantee1, female-headed household, household enjoying the minimum living guarantee2, the elderly family which lives alone and national minority. According to the survey, amont those affected within the scope of project land requisition, there is no vulnerable group.

2.4.8 Special facilities and ground attachments According to the survey, special facilities affected by the project are mainly power transmission facilities of 10kv line of 1.2km. The project impacted ground fixtures are mainly floors, stoves, burial grounds, cellars, drying yards, etc.. The impact of special facilities and ground attachments is shown in Table 2-9.

2.4.9 Cultural relics Through survey and understanding of the relevant land and resources department, there is no important mineral in the project area, there is no pressure overlying mineral resources, and there is no need for special attention.

1. Agricultural Production Cooperatives help and care for the elderly, weak, orphaned, widowed, and disabled who lack of or have no labor force or have nothing to live on, by providing them with food, clothes and firewood, educating the young and burying the elderly when died, so they have guarantees of human needs from the birth to the death. 2. The per capita net income is less than 1067 Yuan / year.

3 Project area’s socio-economic profile

3.1 Affected city, county/district’s socio-economic status This project involves one county under the jurisdiction of Longnan City, Chengxian County. Affected city and county‟s social and economic development profiles are as described below.

Longnan City Gansu Province Longnan City is located in south frontier of Gansu Province, connectd to Shaanxi Province in the east, Sichuan Province in the south, Gannan Tibetan Autonomous Prefecture in the west, and City and City in the north, it is the hub of Gansu, Shaanxi and Sichuan provinces, referred to as "key to Qin and Long, and throat of Sichuan", with great strategic importance. 9 districts and counties of Wudu, Dangchang, Wenxian County, Chengxian County, Kangxian County, Huixian County, Xihe and Lixian County are under jurisdiction of Longnan City, it has a total of 242 towns, 3423 villagers' committees the city has about 2.5 million population. Longnan City has 21 ethnic groups including Han, Hui, Tibetan, seven ethnic townships; ethnic minority population is more than 50,000 people. Longnan City‟s natural resources, water resources, mineral resources, tourism resources are very rich, it is rich in traditional Chinese medicine, tea, fruit, etc..

It is expected Longnan City‟s GDP in 2010 will complete 16 billion yuan, an increase of 10.2%; per capita GDP reach 5982 yuan; three industrial structure will be adjusted from 32:29:39 at the end of the "10th 5-Year-Plan" period to 25:24:51. Total fixed assets investment will be 24.3 billion yuan, an increase of 20%; above-scale industrial added value will be 2.35 billion yuan, an increase of 21%; complete large-caliber financial income of 2.065 billion yuan, up 20.9 percent; complete the total retail sales of social consumer goods of 4.15 billion yuan, up 17%; per capita disposable income of urban residents will be 10,570 yuan, up 11.5 percent; farmers' per capita income will be 2236 yuan, an increase of 12.2%. The registered urban unemployment rate wil be 3.8%. The urbanization rate will reach 22.6%.

Longnan City completed the training of 350.470 migrant workers in 2010, transmitted and transferred rural labor force of 690.650 people, created labor income of 5.669 billion yuan, an increase of 23.8%. The rural poor people reduced from

897,000 people at the end of the "10th 5-Year-Plan" period to 690,000 people, the incidence of poverty dropped by 10%.

Chengxian County is located in Longnan Mountainous Area in the southern part of Gansu Province, bordering Huixian County in the northeast, adjacent to Xihe in the west, Kangxian County across west Han River in the south, and Shaanxi Lueyang County in the southeast. The territory features mountains and canyons, terrain is high in northwest and low in southeast, between 750-2377 m above sea level. Geomorphological features are mountains in north and south, entral hills, with valleys formed by cutting of Qingni River and its tributaries. The county has 13 towns and 9 townships under the jurisdiction, including the County Town, Paosha Town, Huangzhu Town, Wangmo Town, Hongchuan Town, Diancun Town, Songping Township, Xiaochuan Town, Zhifang Town, Tanhe Township, Tanba Township, Daping Township, Zhiqi Town, Chenyuan Town, Shuiquan Township, Erlang Township, Nankang Township, Shaba Town, Suochi Township, Suyuan Township, Huaya Town, and Huangchen Town, with a total of 245 villagers committees, 1472 co-operatives, the total number of households of 62,500, the total population of 259,500. The county‟s total land area is 1676.54 square kilometers, of which 411,900 mu is arable land, 1.1865 million mu is forest land, 155,000 mu is natural grassland. Chengxian County is rich in mineral resources, mineral resources has been initially identified are more than 20 kinds, including lead, zinc, gold, silver, copper, iron, mercury and other major metal ores, of which lead and zinc reserves rank second in China. Characteristic main agricultural products are walnut, persimmon, chestnut, jujube, pine, and silk.

In 2010, the county realized a GDP of 2.703 billion yuan, a large-caliber financial income of 321 million yuan, fixed assets investment of 1.82 billion yuan, total retail sales of social consumer goods reached 490 million yuan, the urban residents per capita disposable income reached 10,685 yuan. The three major industries ratio is adjusted from 23.3:46:30.7 at the end of "10th 5-Year-Plan" peroid to 21.8:39.6:38.6. County farmers' per capita net income reached 3227.6 yuan. The participation rate in corporatives in rural areas reached 96.87% in 2010; the county's birth rate is controlled below 10.33 ‰.

3.2 Impacted township’s socio-economic situation This project involves three towns under the jurisdiction of Chengxian County, including Chenyuan, Shaba and Paosha. Affected cities and counties‟ social and economic development profiles are described below.

Chenyuan Town Gansu Province Longnan City Chenyuan Town is 5 km away from Gansu Province Chenxian County seat, the administrative area is 8995 hectares, 24,200 mu is arable land. The average elevation is 1027.6 meters, the annual average temperature is 12.6 ℃, annual average rainfall is 650 mm, and annual frost-free period is 190 days. The town has jurisdiction over 14 villagers' committees and 72 village groups, the total population is 10,794 people, 2479 households, males are 6319. The town is a shallow mountainous hilly area, with fertile land, rich resources, abundant rainfall, and appropriate climate, it is Chengxian County's major grain production bases, known as Chengxian County‟s “North back granary". Characteristic agricultural products include walnuts, tobacco, plum, peach, etc., of which the flue-cured industry is a pillar industry of the town, which is the first tobacco planting

In 2010, the town‟s total revenue is 97.96 million yuan and rural per capita net income is 2800 yuan. Shaba Town Shaba Town is located in Gansu Province Chenxian County, the 30th of Top 50 Towns in Longnan. Nanba Town is 15 kilometers sand from the county seat, the administrative area is 6912 hectares, 22,951 mu is arable land. The average altitude is 1432.32 meters, the average annual temperature is 11.9 ℃, annual average rainfall is 645 mm, and the annual frost-free period is 207 days. The town has jurisdiction over 12 villagers' committees, the total number of households is 2804, total population is 11,842 people, including 6169 men. The town abounds in walnut, pepper, red bean, in 2010, the town‟s total revenue is 73.67 million yuan, and per capita net income of farmers is 2300 yuan. Paosha Town Paosha Town is located in Huicheng Basin, Longnan, Gansu Province, five kilometers west of Chengxian County town, at the foot of national forest park Jifeng Mountain. The town has jurisdiction over 15 villages, 100 village groups, 5965 households and 23451 people, including 12429 male, it has 32446 mu of arable land, and is one of the county‟s large agricultural towns. The town has superioir location, and very convenient transportation. It has full coverage of communications network, adequate water resources, rich limestone, marble and other mineral resources, long history and culture, and has always been Longyou cultural center, in the territorym there is the rare treasures of Han Dynasty cliff sculpture “Xi Xia Song”, Ma Rong‟s General Conquering Table, Red Army revolutionary site Wulong Mountain Site and other cultural attractions. Paosha Town has prominent feature in the industrial structure, vegetables, walnuts have become the pillar industries of the farmers' income, and it is listed as a pollution-free vegetable production base in the province. Ir has rapid development of industrial economy based on non-ferrous metal processing, building materials, and is identified by the state as Longnan Xicheng Development Zone Chengxian County Industrial Park. In 2009, the town's GDP reached 140.197 million yuan, the per capita net income of farmers reached 3562 yuan.

3.3 Affected village’s socio-economic situation Project affects three towns and seven villages. In the seven affected villages, per-household population is about 4.3 people/household, per capita arable land is between 0.6 and 2.58 mu /person, per capita income gap is not big, Niuyao Village has the lowest per capita income of 3100 yuan/person, Moba Village has the highest per capita income of 4300 yuan/person. The affected villages has basically no industrial enterprise, mainly for agricultural production, planted crops are mainly wheat, corn, soybeans and others; it plants economic crops also, including walnut, winter oilseed rape, tobacco, persimmon and so on. The project affected village and group‟s socio-economic situation is shown in Table 3-3.

3.4 Socio-economic characteristics of affected households In October to December, 2010, Luoyang Water Survey and Design Limited Liability Company organized professionals and unit owners to conduct a survey of

Survey of displaced families‟ basic situation adopts a comprehensive survey, we conducted a survey of the displaced families of the project impacted area; at the same time, we conducted a sample survey on displaced households, the sampling rate is 33%.

3.4.1 Basic family situation In 22 affected households surveyed, total population is 93, per-household population is 4.23 people, including 45 women, accounting for 48.39% of the total population, labor of 54 persons, accounting for 58.06% of the total population. The affected population is rural households, and men are mostly migrant workers, women engaged in farming at home, in farming spare time, a small number of them are migrant workers.

(1) Age composition and gender analysis

Among 93 people of 22 households surveyed, the population age distribution is population under 18 years of age is 21, accounting for 22.58% of the total population; including 12 males, accounting for 25.00% of the male population, and 9 females, accounting for 20.00% of female population; population of 16 to 60-year-old is 54, accounting for 58.06% of the total population; of which 27 are males, accounting for 56.25% of the male population, 27 are females, accounting for 60.00% of the female population; people aged over 18 are 60 , accounting for 19.36% of the total population; including 9 males, accounting for 18.75% of the total population of males, 9 females, accounting for 19.36% of the female population. (2) Education

Education is, primary and below 51 people, 24.16% of the total population; 28 males, accounting for 58.33% of the total male population; 23 female, accounting for 51.11% of the total number of females; 33 junior middle school education level, 35.48% of the total number; of which 14 men, accounting for 29.17% of the total number of men; 19 females, accounting for 42.22% of the total female population; nine people have high school and higher cultural level, 9.68% of the total population; of which 6 men, accounting for 12.50% of the total number of men, 3 women, accounting for 6.67% of the total number of females. See Table 3-4.

3.4.2 The land use survey Among 93 people in 22 households surveyed, the cultivated land area is 255.17 mu, per-household arable land is 11.59 mu, per capita arable land is approximately 2.74 mu, per capita grain production is 59.4 kg; growing crop is mainly wheat.

3.4.3 The family assets From household asset survey, in 22 households surveyed, per-household color TV possession is 0.95, per-household mobile phones possession is 1.09, per-household motorcycle possession is 0.5, per-household tractors possession is 0.23, per-household bicycles possession is 0.27, per-household VCD possession is 0.41, per-household refrigerators and audio possession is 0.05.

3.4.4 Annual household income and expenditure According to the survey, among 93 people in 22 households surveyed, in terms of revenue, the per capita annual family income is 3597.9 yuan, of which migrant income is 1890.3 yuan, accounting for 52.54%, agricultural income is 1234.4 yuan, accounting for 34.31%, other income is 473.2 yuan, accounting for 13.15%;

3.5 Socio-economic characteristics of the affected enterprise This project affects a total of one industrial and mining enterprise, Niuyao Village‟s collective enterprise. The affected site area has been abandoned at the project survey, the site area has been relocated to another place for production, the new site area‟s production running is in good condition. The affected enterprise‟s basic economic survey is shown in Table 3. The survey found that the surveyed enteprise supported the construction of this project, understood the construction of the project and considered the project had a favorable impact on the local economy, tourism and living. For resettlement, Niuyao Village Villagers Committee selected monetary compensation, and compensation is based on the consensus of both sides, with 200,000 yuan (including premium) for a one-time compensation and resettlement. In the implementation of the project, the final amount of compensation will be determined by the method of asset evaluation

4.2 World Bank policy 10. In order to ensure that relocation or restrict the use of resources and assets will not occur before the implementation of necessary resettlement measures, displacement implementation needs to be linked with the implementation of project investment link. For the impact referred to in paragraph 3 (a) of the policy, its measures include providing compensation and help needed in relocation before the relocation, if necessary, prepare and provide resettlement places with complete facilities. It should be noted that land acquisition and property can only be carried out only after the payment of compensation, and if necessary, the provision of resettlement sites and relocation subsidies. For impact referred to in paragraph 3 (b) of this policy, the measures should be as part of the project, and implemented according to the requirements of the project plan of action.

11. For displaced person living on the land, priority should be given to strateg of resettlement based on land. These strategies include resettlement on public land or private land expropriated for resettlement. Whenever replacement land is provided, the productive potential, location advantage and other factors of land provided to the DPs should at least equal to the favorable conditions before land acquisition. If the DPs failed to acquire land as a priority program, if the land provided will adversely affect the sustainability of a park or protected area, or can not get enough land at a reasonable price, in addition to land and other property losses cash compensation, they should also be provided separately with land-leaving placement program based on employment or the opportunity of seeking a life by themselves. In case of lack of adequate land, it should be described and written to a file in accordance with the requirements of the World Bank.

15. Compensation eligibility criteria. DPs can be divided into the following three categories:

People having formal legal rights on the land (including the usual and traditional rights recognized by national law);

People who do not have formal legal rights on the land in the beginning of the census, but who claim for this piece of land or property - such requests are recognized by national law, or recognized in the resettlement planning process; and people who

4.3 Chinese laws and policies The “People's Republic of China Land Administration Law" is the main policy basis for this project. Meanwhile, in order to further clarify the principle of land expropriation compensation and resettlement compensation, compensation standards, land acquisition procedures and oversight mechanisms, in October 2004, the State Council promulgated the "State Council‟s Decision on Deepening Reforms for Tightening Land Management (Guo Fa [2004] No. 28). Accompanying with it, the Ministry of Land and Resources promulgated “Guidance on Improving Land Compensation and Resettlement System” (Guo Tu Zi Fa [2004] No.238) in November 2004. At the same time, Gansu Provincial People's Government issued “Gansu Province‟s Approach on Implementing Land Administration Law" (March 30, 2002) and Gansu Provincial People's Government promulgated "Gansu Province‟s Notice on the Issuance of Land Requisition Compensation Area Integrated Land Price and Gansu Land Compensation Unified Annual Output Value Standard" (Gan Zheng Fa [2009] No. 88 file) and other policy documents, such as those listed in 4.1 of this chapter, these policy documents provide important guidelines on the resettlement of the project. In addition, in order to strengthen the management of large and medium-sized water conservancy and hydropower project construction land acquisition and resettlement, for reasonable land acquisition and proper resettlement, according to the “People's Republic of China Land Administration Law”, the State Council specifically enacted "Large and Medium-Sized Water Conservancy and Hydropower Project Construction land Compensation and Resettlement Ordiance” on July 1, 2006, and “State Council‟s Views on Perfecting Large and Medium-Sized Reservoir Resettlement Policy" (Guo Fa [2006] No. 17) on May 17, 2006. 4.4 Projects compensation principle and qualifications

4.4.1 The compensation principle According to the Chinese government and the World Bank's regulatory and policy requirements, this project‟s compensation and interest principle is developed, whose goal is to ensure that DPs' access to adequate compensation and assistance measures, at least back to the standard of living at the start of the project. The project resettlement principle is shown in Table 4-2.

The compensated people in this project are affected persons who lost their homes and land in scope of land requisition within the reservoir.

5 Compensation Standard

In accordance with the provisions of the above legal framework, combined with the actual situation of all project-affected areas, develop various types of compensation standards of this project.

5.1 Compensation standard for imposing the rural collective land According to Land Administration Law of the People's Republic of China , Guidance on Improving the System of Land Compensation and Resettlement, Land Administration Law of the People's Republic of China implemented by Gansu Province, Notice on Issuance of Standard of Integrated Land Price and Unified Annual Output Value of Compensation for Land Acquisition of Area of Compensation for Land Acquisition in Cheng County issued by Land and Resources Bureau of Cheng County (Cheng, Land, Resource, Notice, No. [2010] 1 Document), the standard of compensation for occupation of forest land is implemented in accordance with relevant provisions of Measures for Implementation of the Forestry Law of the People's Republic of China by Gansu Province and relevant regulations and policies of all affected counties in Longnan City, the standard of unified annual output value applies to measure and calculate the collective agricultural land in the region, and the standard of compensation for construction land and state-owned agricultural land will be implemented with it as reference, and 2 times of unified annual output value will be compensated for acquisition of collective unused land. After consultation with the affected people, combined with the actual situation of standard of compensation of land acquisition of other projects in the project-affected area implemented in 2011, details of standard of compensation of land acquisition proposed for this project is shown in Table 5-1.

In comparasion with the standard of compensation in the Ordinance of Compensation for Land Acquisition and Resettlement for Migrants for Construction of Large and Medium-Sized Water Conservancy and Hydropower Project issued by the State Council on July 1, 2006 (under the provisions: for acquisition of arable land for the large and medium-sized water conservancy and hydropower project, total of the land compensation fee and resettlement fee is 16 times of average annual output value of three years before acquisition of arable land), the standard of compensation for land acquisition in Cheng County of the project is little higher than that of the large and medium-sized water conservancy and hydropower project, which is beneficial to the affected people for better recovery of production and living. The comparasion and analysis of the standard of compensation for land acquisition and that of the Ordinance of Compensation for Land Acquisition and Resettlement for

Migrants for Construction of Large and Medium-Sized Water Conservancy and Hydropower Project issued by the State Council is shown in Table 5-2.

5.2 Compensation standard of temporary occupation of land

In accordance with the provisions of the State and the Gansu Province for temporary occupation of land, payment of young crops compensation fee should be carried out for temporary occupation of land. During temporary occupation of land, the standard of compensation for arable land each year is two times of the average output value per mu of previous three years of 1580. After the expiration of occupancy, according to the wishes of the affected people, select the construction unit to organize recovery or village, or the affected people for recovery, the period of project‟s temporary land is three years, and the period of compensation is 4 years, and the compensation for temporary occupation of arable land is 7820 yuan/mu for Paoshao Town, 4988 yuan/mu for Chenyuan Town and Shaba Town; the compensation for temporary acquisition of shrubbery is 2580 yuan/mu for Paosha Town, and 1872 yuan/mu for Chenyuan Town and Shaba Town; in the standard of compensation for land reclamation, it is 1500 yuan/mu for paddy field considered as dryland, and the restoration fee for shrubbery vegetation is paid according to 1000 yuan/mu. In order to reduce the impact of land acquisition on young crops, the project will begin after the harvest, or before sowing for new crops, and it will constructed with the actual situation, engineering in general after. The standard of compensation for temporary occupation of land is shown in Table 5-3.

5.3 Compensation standard of demolition of residential housing According to the Land Administration Law of the People's Republic of China, the Implementation Regulations on Land Administration, as well as related policies and regulations of Gansu Province, Longnan City and all project-related counties, the principle of full replacement cost, and combined with the actual situation of Cheng County, prepare the compensation standard of demolition of residential housing for this project. Analysis, survey and calculation carried out in accordance with construction cost of brick and concrete, and civil structure housing in the project region is shown in Appendix 7. According to the results of survey, take calculation, the compensation standard of civil structure housing in the project region of 1560 yuan/m2 is higher the resetting cost of the housing with this structure of 971.25 yuan/ m2 (in which, structure resetting cost of 307.25 yuan/ m2. In addition of demolition compensation, the project-affected relocated households can also obtain relocation subsidy and incentive fee for relocation in advance. Details of compensation standard of demolition of residential housing are shown in Table 5-4.

5.4 Compensation standard of demolition of non-residential housing

This project affects one non-residential industrial and mining unit, and it is the Mobaxia stone processing plant as the village collective enterprise of Niuyao Village, and caused by the project of Cheng County Reservoir. According to the compensation policy of non-residential housing in Cheng County, the industrial and mining unit‟s housing to be removed will be based on the principle of resetting price of market, and compensation and resettlement amount will be determined after consultation with the industrial and mining unit.

5.5 Compensation standards of special facilities and ground attachments

The project-affected appendage includes the drying dam, stove, cellars, etc.; special facilities will affect the transmission line. The compensation standard of project-affected appendages and special facilities is shown in Table 5-5. In various sub-tables of this table, there are standards actually implemented in the process of land acquisition and demolition, and they have been smoothly implemented in other projects, and the affected villages and groups and the population have acknowledged and accepted these standards in the process of public participation at the stage of preparation of plan of migrant resettlement.

5.6 Supporting in later stage of resettlement

According to the Suggestion on Improvement of Policy of Late Support for Large and Medium-Sized Reservoir Resettlement Issued by the State Council (State Issuance [2006] No. 17), the project will achieve late support for the migrants. The supported object is the population of resettlement. The project has the relocation and placement population of 97 persons in the design level (2010), including the production and placement population of 83 persons, population of relocation of 14 to 83 persons; the supporting standard is 600 yuan/person, and the supporting time is 20 years.

5.7 Cost for clearance of bottom of reservoir

The cost for clearance of bottom of reservoir includes the building clean-up fee of 15 yuan/ m2, health clean-up fee of 10 yuan/person, grave clean-up fee of 150 yuan/block, forest land clearance fee of 500 yuan/mu, and other clean-up fee of 10,000 yuan/ km2.

5.8 Other fees and taxation

Details of other costs of the standard of the project‟s land acquisition and demolition is shown in Table 5-6.

6 Program of migrant production and living recovery

6.1 Resettlement target

Achieve reasonable compensation and proper arrangements for affecting of the project to ensure that the affected people after resettlement will recover or exceed the original production level, income level and living level. According to the actual living standard of migrants in the project area in 2007, combined into "12th Five-Year Plan" for National Economic and Social Development of Cheng County and long-term objectives of 2015, and the resettlement objectives are analyzed and determined as follows:

(1) Basically ensure food self-sufficiency, fully tap the potential of land and improve land productivity through adjustment of agricultural structure in the area with few arable land resources;

(2) Take measures to ensure that the production and living standard of migrants can be restored to the level before settlement;

(3) The public infrastructure, schooling, medical treatment, level of social welfare, natural environment and traffic conditions and so on can remains changed or be improved.

6.2 Principles of plan of resettlement

According to the aim to migration program, develop a series of settlement and recovery principles:

(1) Respect of the wishes of the affected people, and maintain their existing production and living tradition;

(2) The migration recovery plan is based on impact of land acquisition and demolition, and with the compensation for land acquisition and demolition and subsidy standard as the basis;

(3) The migration recovery plan must be combined with the village team construction, resource development, economic development and environmental protection in order to ensure the sustainable development of the affected villages and migrants;

(4) Ensure that the groups under adverse effects of the project can be improved in the living standard.

(5) The resettlement area should be the area with better geographic conditions, economic conditions, agricultural production conditions and infrastructure conditions;

(6) The new home homestead for reconstruction of housing should be provided for relocation of families free of charge, and relocation and transportation fee should be provided;

(7) Compensation fee for demolition must be paid to the farmers before the relocation;

6.3 Production and resettlement program

The project‟s permanently occupied land is the collective land, and it involves 13 villager groups, 7 villages and 3 towns of Cheng County of Longnan City, and there is a total of rural collective land of 1017.79 mu, including 150.543 mu of arable land, accounting for 14.79% of the total amount of land. In the land of acquisition, there are 23.999 mu of arable land under collective ownership, not contracted to households. According to the estimation by the Design Institute, there are 89 persons to be resettled per year for land acquisition for Mobaxia Water Resource Project.

According to analysis on effect of acquisition of collective land of Chapter 2, the village group‟s farmers of the land under acquisition is less affected (land loss rate does not exceed 10%, accounting for 85.32%), there are 5 households with the rate of land loss in 11% -21%, accounting for 7.58%; there are 2 households with rate of land loss of 21% -30%, accounting for 3.03%; and the greater influence occurs in Niuyao Village involving one household and Longmen Village involving two villages (the one with rate of land loss of 100% accounts for 2.75%). In accordance with the Ordinance of Compensation for Land Acquisition and Resettlement for Migrants for Construction of Large and Medium-Sized Water Conservancy and Hydropower Project, the World Bank Office and unit of owner implement the earlier compensation for the project, the principle of late supporting and the World Bank Office‟s policies and procedure requirements on involuntary relocation is determined on the basis of analysis of quality of arable land for resettlement, per capita possession of land resources in resettlement area (per capita farmland of 1.22mu after land acquisition)

The resettlement program is shown in Table 6-1.

The production and resettlement program developed in this project are described as follows:

(1) Monetary compensation According to a survey on land acquisition and resettlement conducted for the affected households, 100% of the affected households require cash compensation. Through consultation with the rural collective economic organizations and the farmers receiving land acquisition, this will pay full of land compensation and resettlement subsidy to the farmers, and the village collective will not retain.

The compensation standard for farmland is Paosha Town is 16 times of annual output value, and for Chenyuan Town and Shaba Town, it is 20 times of annual output value, therefore, the land revenue will be calculated with the compensation standard of Paosha Town as example. The annual output value per mu of Paosha Town is 1580 yuan/mu, and net income per mu is 1000 yuan/mu, the annual net income of arable land increases by 1.5%. At present, the benchmark interest rate of deposit of the People's Bank of China is 4.20% (the deposit period of five years or more)1, the average future opportunity cost2 of the land is calculated with the method of net present value, so the net income of the affected land within the remaining 18 years is RMB 14533.8 (according to the survey, the second round of collective land contracting had been started from 1996-1999 in Longnan City, until March 31, 2011, the contracting period had lasted for 12 years, that is, the remaining contracting term of 18 years), the standard of compensation for land acquisition is 75,000 yuan/mu for Paosha Town and 41,400 yuan/mu for Shaba Town. This shows that the project's compensation fee for land acquisition is sufficient to cover the proceeds of the farmers in the remaining contracting period.1

It has been carried out on 20th October 2010.1

Calculation formula of land average opportunity cost in the future: NPV stands for Net present value, A stands for Net Output Value, and i stands for Discount Rate.1

After investigation, we can learn that after the project‟s land acquisition, the per capita arable land is still 1.22mu, which can still ensure that the affected people may continue to engage in agricultural activities. The five households with land loss rate of 11% -21% and two households with land loss rate of 21% -30% are located in group two of Wushan Village, the per capita arable land of this group is more, before land acquisition, there is still land of 1.91mu/person, after land acquisition, per capita arable land of part of affected people may reach 0.8-1.7mu, which can ensure that some of the affected people here continue to engage in agricultural activities. In addition, through interviews with migrant families, majority of farmers have strong confidence in income-generating activities after getting compensation and they expect to purchase vehicles, carry out farming or adjust planting structure to plant cash crops and operate shops and others through the compensation in order to develop production and improve income level. For acquisition of the land not contracted to the household in the collective land, the affected collective requires to take cash compensation, for allocation of fund benefit, the village collective economic organization will decide it by the villager congress. The affected people will be equal to enjoyment of the benefits of village‟s development plan. (2) Unpaid renting and farming

The farmers with rate of land loss of 100% are mainly involved in the Niuyao Village, Mazhuang group and Longmen Village, and it will affect 14 persons of 3 households. This part of affected people also requires cash compensation, and the full amount of compensation will be paid to the affected persons. Because these three households are affected by demolition of residential housing in the project, the Longnan City‟s World Bank Office, unit of owners and the People's Government of Cheng County has held the meeting to the plan of resettlement for this part of population: after implementation of monetary compensation, provide unpaid state-owned farmland for this part of population in the new settlement region. The settlement region is located in the agricultural vocational secondary school of Baimasi Village of Chenyuan Town, Cheng County with the existing school experimental field of 76 mu and perfect irrigation facilities which can be used for production and resettlement land. The government of resettlement region makes the commitment that

63 Relocation plan for ADB-financed Mobaxia water source (reservior) project for urba n water supply of Cheng County, Gansu Province the contracted land it provides will not be less than per capita arable land of Baimasi Village in resettlement region of 1.75 mu, the White Horse Village, the minutes of meetings and the commitment letter of the People's Government of Cheng County are shown in Appendix 8.

(3) Skill training

The county-level and township people's government of the region where the project is located have established corresponding human resources and social security institution which is specifically responsible for organization and management of vocational and skill training, and in Cheng County, some training bases, including vocational and technical schools have been established, and detailed annual training plan has been developed. The population affected by land acquisition within the project area can participate in these institutions and will be provided with free technical and employment training. The training will be arranged according to the training needs of the affected population. The training generally includes various agricultural technical training, and non-agricultural occupations and skills, see details in Table 6-2.

In addition, due to implementation of the project, the agricultural industry structure of the project area will be adjusted to provide technical guidance of agricultural industry adjustment for the affected people, the project is also prepared with special funds for the affected people, and agricultural technology training for the

(4) Provide working and employment service

At the stage of the project‟s construction and operation, it will produce over 1080 temporary employment opportunities (of which about 1000 are in the project‟s construction phase, about 80 in the project‟s operational phase, and 60% of employment opportunities requires only unskilled labor). During implementation and operation of the project, the Project Office will require the construction contractor and operation and management unit to give priority to the affected people to receive the opportunity under the same conditions.

At the phase of construction of the project, the total amount of the main project: excavation of earth and stone of 431,600 m3, hole excavation of earth and stone of 23,100 m3, filling of earth and stone of 55,400 m3, concrete of 252,800 m3, curtain grouting of 8580m, consolidation grouting of 3100m, installation of metal structure of 186.5t. There is need for the project design, contract management, contract supervision and other positions and management, engineering and other staff, including the skilled worker (machine operator, electrician, welder, etc.) and unskilled worker (mining worker, porter, greening worker). According to estimation made by the design unit, there will be an average workforce of 800 people during construction

At the phase of operation of project, the work mainly comes from the administrative, technical management, financial and asset management and water administration and monitoring position, the Mobaxia Water Resource Project‟s management position has 35 people for the project‟s supervision and control (skilled labor), and maintenance of engineering facilities (electrician, plumber, etc.) and other works (hourly worker, security guard, cleaner, etc.) need 15 people.

Situation of labor of the project during construction and operation is shown in Table 6-4

In addition, during the construction of project, a large number of foreign engineering personnel may bring development space for the local tertiary industry such as canteen, shops and other service industry markets, which can be effective in stimulating the affected people in the project area to develop the canteen, shop and other service industries. Due to larger stream of construction workers, the economic benefits of this type of industry shop will be good during the construction period.

6.4 Program of relocation and resettlement

The demolition of residential housing involves Niuyao Village, Mazhuang group and Groups three of Longmen Village. The resident housing with area of 549.33m2 is supplied by the project, in which the primary room has 369.82 m2 in the area (civil structure), accounting for 67.32% for residential use; miscellaneous room has 179.51 m2 in the area, accounting for 32.68%, is mainly used to place their things, etc., the total number of affected households is 14 persons of 3 households.

According to the survey, the relocatees agree the Design Institute‟s planning in agricultural vocational secondary school in Baimasi Village, Chenyuan Town, Cheng County, and the account will be transferred into the Baimasi Village, Chenyuan Town, Cheng County. In the resettlement region, the planning housing point‟s nature is the state-owned construction land, allotted by the government, resettlement is not affected by land acquisition and relocation. The school has 20 rooms converted by schoolhouses covering an area of 13.5mu and structure of brick and wood, for the interim placement of the affected households.

Rehousing will be achieved by the Construction management office of Mobaxia Water Resource (Reservoir) Project of Cheng County. The main house has brick structure with housing area of 72 m2, and the price is expected for 1560 yuan/ m2. According to estimation, after the affected people get the housing relocation compensation (including residential housing compensation fee, relocation subsidy and incentive fee of 1,000 yuan according to the lowest grade), they can purchase new homes with an area of 72 m2 in the resettlement area, and the compensation still has balances. See details in Table 6-5. The affected person may also choose to self-build houses in the settlements. The affected people can build housing in the resettlement areas, after the affected people relocate to the resettlement region, the housing conditions can be improved, and the existing civil structure housing will be transferred into brick and concrete structure housing. The distance of the affected people‟s original settlement and the resettlement region is 5 km, the road traffic is convenient. And the distance from the county town to original settlement can be shortened to five kilometers. In the resettlement region, the water, point, road and other infrastructure will be improved than their original places.

The resettlement housing project will be started in March 2012. The construction management office of the project of three-connection and one leveling of resettlement region of Mobaxia Water Resource (Reservoir) project is established, the cost of leveling of RMB 0.2 million are under the responsibility of construction management office of Mobaxia Water Resource (Reservoir) project, and it has been listed in the budget of resettlement project.

6.5 Compensation and resettlement of non-residential housing

The non-residential housing in this project affects one industrial and mining enterprise- Mobaxia Stone Processing Plant, the demolition area is 52 m2, the affected housing for is the office and storage space of processing plant. The enterprise is a village collective enterprise, hiring six temporary workers, and the enterprise has been discontinued in the field area, and has been moved to another site for operation, scale of business has been extended, and the hired workers remain unchanged. The status of the site is shown below. After consultation with the property owner, the currency resettlement will be taken for thorough compensation of 200,000 yuan once.

6.6 Recovery of temporary land

The project temporarily covers the land with an area of 345 mu with compensation cost of 646,800 yuan (calculate by three years, including land reclamation fee), and it will be paid directly to the affected farming households. In the temporary occupation, take strict measures to protect the topsoil to avoid unrecoverable influences. When excavation is started, the topsoil (recommended thickness of 30 ~ 50cm) will have separate collection and piling up, and take the control measures for soil erosion. After construction is completed, the first is backfill the underground soil, and then topsoil will be evenly covered on the surface, the site will receive formation, in order to reduce the impact on the quality of arable land. In general, after the harvest, or before new crops, the project can be started and notice to the affected households in a timely manner, so that loss of households can be reduced.

6.7 Recovery of special facilities and ground attachments

The project affects the special facilities and power transmission facilities of 10kv and cable of 1.2km. For the recovery of special facilities, the transmission lines submerged will be recovered in the process of clearing of bottom of reservoir. The project implementation unit will allocate the compensation fee to the ownership unit involved in submerged transmission line for the rehabilitation of flooded transmission lines, and reconstruction will be mastered by the ownership unit. For the ground attachments, such as the trees and graves and others, cash compensation will be achieved for the affected people or groups.

6.8 Disadvantaged groups

In accordance with the tenet of this project, the vulnerable group means the disabled household, household enjoying five-guarantee1, female-headed household, household enjoying the minimum living guarantee22,the elderly family which lives

Throughout the resettlement, the project‟s authorities will pay special attention to the impact of projects on vulnerable groups and their placement. If the project affects the vulnerable groups in the process of implementation, in addition to living and production resettlement, the project office should also provide some assistance for the vulnerable groups, so that complete the resettlement task as soon as possible.

In the vulnerable groups, if the housing reconstruction really encounters difficult, when the households submit an application to local project office, the project office cooperating with the local government will give the compensation of different degrees depending on the specific circumstances.

In the case of the above policy still inadequate for resettlement of vulnerable groups, the implementation unit of project office will:

(1) For the families with difficult affected by the project, the major cause of poverty is the frail elderly, disease, female households, no male labor force, guaranteeing households, after the implementation of the project, these households with financial difficulties will be provided with appropriate housing subsidies;

(2) During implementation of the project, living allowance should be given as the case to help them overcome the difficulties encountered in the relocation;

(3) After the implementation of the project, the households with financial difficulties may make an application, and the local village collective provides guarantee, so that they can obtain priority to obtain loans from local credit unions;

(4) During implementation, the local village collective will help them choose the homestead and achieve organization of labor to assist in their moving and housing.

In the vulnerable groups, if the production resettlement encounters difficulties, the project office will take the following measures to help needy households for rehousing.

(1) For the affected households with working ability, they will receive livelihood training and priority jobs (such as migrant workers, workers of project construction, etc.);

(2) Apply for government subsidies.

(3) For the affected households without working ability, such as the households

6.9 Late support measures

In accordance with the Ordinance of Compensation for Land Acquisition and Resettlement for Migrants for Construction of Large and Medium-Sized Water Conservancy and Hydropower Project issued,the Suggestion on Improvement of Policy of Late Support for Large and Medium-Sized Reservoir Resettlement Issued by the State Council (State Issuance [2006] No. 17), and relevant provisions of notice on issuance of Interim Measures on Checking and Registration of People Supported in Later Period of Relocation for New Large and Medium-Sized Reservoir (Development and Reform, Agriculture, Economy [2007] 3718) by the National Development and Reform Commission, provide late supporting for the affected 97 people (year of design level of 2010). Late support may further promote economic and social development of the reservoir area and resettlement area, protect the migrants to restore the original production and living standard as soon as possible, promoting the sustainable development of the migration. The supporting funds are from the national special fund and the supporting standard is by 600 yuan/person.year, and the supporting life-span is 20 years. Therefore, there is a total of RMB 1.164 million for supporting.

According to Interim Measures on Checking and Registration of People Supported in Later Period of Relocation for New Large and Medium-Sized Reservoir, the people to be supported in late period should be checked by the original relocation of population (the actual placement of rural migrants) , and it will be checked and approved once per year. The relocatee will be registered with the unit of household, including the name, gender, ethnicity, identification card number, and relationship with the head of household, the reservoir name, and relocation time; relocation not only for production placement population to village register, the population for production settlement without relocation will be registered with the unit of village group, it includes the name of village group, the number of people to be supported, ethnic composition, reservoir name, and time of land acquisition.

For the population of relocation, the latter funds for direct payment for individual migrants will be directly paid for in the form of cash subsidies for living allowance; for the resettlement population can not be verified to the individuals, achieve implementation of the project supporting. The reservoir resettlement village must be the basic unit, in accordance with the principle of priority to resolving of the outstanding issues, pay close attention to preparation of plan of infrastructure and economic development of the in the reservoir area and resettlement area, specific ways will be determined by the people's governments at all levels after fully respecting their wishes and listening to the migrant villages, and achieve the preparation of practical late plan for supporting for reservoir migrants.

If it is directly issued to the individual migrants, verify to the individuals, create a file, set up accounts, and achieve full and timely payment of late supporting funds to the home; if project supporting is adopted, achieve coordinative use of funds, but the project identification must pass through the vastmost migrants, use and management of the funds must be open and transparent, and it must receive the supervision of the migrants, and it is prohibited for interception and misappropriation.

In this project, the late funds for supporting for the relocated population will be directly issued to the individuals; and the late funds only for production placement will not be verified to the individuals, so project supporting will be adopted, in accordance with policy requirements, the people‟s government of Cheng County will achieve establishment the Plan of Late Supporting, Plan for Infrastructure Construction and Economic Development of the Reservoir Area and Resettlement Area, and they will be implemented after the approval of the higher levels of government. The specific implementation plan is to be discussed and decided by the village meeting. The distribution of population under late supporting of Mobaxia Reservoir is shown in Table 6-6.

7 Organization and responsibilities

7.1 Implement and management of organizations

7.1.1 Setting of organizations The project's executing agency is the Longnan Municipal People's Government (see Figure 7-1). In order to ensure the smooth implementation of land acquisition and resettlement and achieve the desired results, Longnan Municipal People's Government has approved for establishment of the leading group of using of foreign preferential emergency loan for post-earthquake reconstruction, and set up the World Bank‟s Project Management Office. The agency is responsible for guiding preparation of migration plan and implementation of land acquisition and resettlement, and liaison with the World Bank. At the same time, the construction management office of Mobaxia Water Resource (Reservoir) Project for water supply for the urban area of Cheng County and higher administrative departments have involved in the preparation of the project's migration program, are responsible for management of land acquisition and resettlement, internal supervision and inspection, and internal monitoring.

To do a good job in the land acquisition and resettlement for Mobaxia Reservoir, after the consent of the County People's Government, set up the leadership team of land acquisition and resettlement of migrants for Mobaxia Reservoir. The leader is Li Pengjun as the county magistrate of the People's Government of Cheng County, the deputy leader contains Wu Bin as member of the standing committee of county committee and deputy county magistrate, He Ketai and Shi Bangbang as the deputy director of National People's Congress, Li Delu as the deputy county magistrate, and Zhou Yajuan as the Vice Chairman of People's Political Consultative Conference. The member is composed by leaders of all county-level administrative departments. The project-affecting town and village are equipped with 1-2 principal leaders to be responsible for assisting the resettlement. The leading group has subordinate offices in the County Water Authority with Comrade An Zhiming as the director of the Office, Wang Wenbin as the deputy director of the Office, the office staff will be drawn from the unit of member of the leading group, and they are in charge of the

7.1.2 Responsibilities of organizations Demolition for land acquisition and resettlement for Mobaxia Water Resource (Reservoir), implement the unified leadership by the county government cooperating with the county government‟s related departments, and the government of Chenyuan Town, Paosha Town and Shaba Town will take concrete implementation, the construction management office of Mobaxia Water Resource (Reservoir) Project will coordinate the supervision, organization and implementation.

(1)Leadership team of Longnan City

Be responsible for leadership, organization, management and supervision pf land acquisition, demolition, relocation and resettlement, developing and implementing the supporting measures.

(2)Office of leading group of Longnan City

Chenyuan, Paosha, Shaba and other towns to do a a good job in demolition for land acquisition for and resettlement, relocation and resettlement.

(3)Responsibilities of the Construction Management Office of Mobaxia Water Resource (Reservoir) Project

① Be responsible for integration, on-site guidance, coordination and supervision, organization and implementation of land acquisition, immigration, relocation;

② Be responsible for cooperating with the County‟s Land Resources Bureau, the County Forestry Bureau and the Provincial, Municipal Land and Resources Department (Bureau), the Provincial Forestry Department (Bureau) for coordination of land acquisition, timber harvesting, division of land and confirmation of land ownership;

③ Be responsible for marking and management after measurement for land acquisition;

④ Be responsible for supervision and inspection of the allocated funds for land acquisition, resettlement and demolition;

(4)Leadership group and office of land acquisition, migrant demolition and resettlement for Mobaxia Reservoir

① Leadership Group: be responsible for leading, organization, managing and supervision of land acquisition, migrant demolition and resettlement, and formulating and implementing the supporting measures of migrant resettlement.

②Leadership Group Office: be responsible for formulating the embodiment of migrant resettlement, and coordinating actively with Chenyuan, Paoshao, Shaba town to accomplish the work in land acquisition, migrant demolition and resettlement with the management and supervision of leadership group and the guidance of superior immigration development institution.

(5) County’s related government departments and units

They are composed by the County Office of Legislative Affairs, duties of the County Land Resources Bureau, duties of the County Forestry Bureau, duties of the

County Water Authority, the County Environmental Protection Bureau, duties of the County Agriculture and Animal Husbandry Bureau, duties of the County Human Resources and Social Security Bureau, duties of the County Construction Bureau, the County Court, the County Court, the County Procuratorate, the County Public Security Bureau, the County Supervision Bureau, the County Audit Bureau, the Cheng County Power Supply Bureau, China Mobile of Cheng County, China Unicom of Cheng County, Telecom of Cheng County and other departments.

Be responsible for demolition of land for acquisition, so that resettlement is carried out smoothly.

(6) Responsibility of town government of Chenyuan, Paosha and Shaba

①Transfer business core from the department of Land and Rescources, Forestry, Water Resource, Supervision, Transportation, Construction, Public Security and so on to form the immigration office of construction and land acquisition of Mobaxia water source (reservoir) project of each village and town;

② Be responsible for the confirmation of land ownership and dealing with the dispute of land ownership;

③ Cooperate with the department of Land and Resources, Forestry and so on to complete the work of land survey, division of land, timber harvesting, and checking the compensation etc;

④Be responsible for fulfilling the land compensation, allowance of relocation, and the compensation for houses removing and other attachments on the ground;

⑤ Be responsible for the land adjustment after land acquisition, planning the house site after the house removing, and relocating in the area under administration.

⑥Be responsible for safeguarding the work of land acquisition, removal and the environment of construction in the area under administration, and severely cracking down the illegal activities on interference and sabotage of land acquisition and removal, and engineering construction in accordance with the law;

⑦ Accomplish all the work assigned by immigration leadership group of land acquisition and removal of Mobaxia water source (reservoir) project.

(7) Village (town) resettlement office

Led by the village (town) leaders, it is composed by the cadres of the land department and other units and villages, led by the. Its main duties:

① Be involved in the project investigation and assisting in the preparation of the Plan of Resettlement;

② Organize the public for participation, advocacy of resettlement policy;

③ Implementation, inspection, monitoring, and recording of all resettlement activities within the scope of the village (town);

④ Handling of migration housing relocation procedures;

⑤ Be responsible for payment and management of land compensation funds;

⑥ Monitoring of land expropriation, removal of housing and appendages, and the reconstruction and relocation of houses;

⑦ To report the situation of land acquisition, demolition and resettlement to the County Land Bureau, office of management of resettlement;

⑧ Coordinating and handling of the contradictions and problems in the work.

(8) Village committees and village groups

Its resettlement working group is composed by the main cadres of the village committee and village groups. The duties are to:

① Participate in the survey of the socio-economic and project impact;

② Organize public consultations, publicity of land acquisition and resettlement policy;

③ Select the resettlement site, allocate homestead for the relocatees;

④ Organization and implementation of agricultural and non-agricultural production and placement activities;

⑤ Be responsible for financial management and disbursement;

⑥ Reflect the views and recommendations of the migrants to the higher authorities;

⑦ Report on resettlement and implementation progress;

⑧ Provide assistance for the needy households in the demolition.

(9)Duties of design unit

①In the planning and design, accurately survey the physical indicators of occupation and demolition, environmental capacity, developable resources, assist the the government in the project area in the resettlement program, achieve preparation of relocation, compensation and investment budget and demolition and resettlement planning report, and preparation of drawings.

② During the implementation, provide the property owners with design documents, technical specification, drawings and notification in a timely manner, provide design disclosure by phases to the project offices at all levels, assist the office of migration in relocation and production resettlement, and improve and perfect planning program of resettlement according to the actual situation.

(10) External monitoring and evaluation units of migration

The Longnan City‟s Project Office will hire a qualified monitoring and evaluation agency as a migration external monitoring and evaluation unit, whose main duties are to:

① As an independent monitoring and evaluation organization, observe all aspects of resettlement planning and implementation, achieve monitoring and evaluation of the relocation, resettlement and effects of implementation, and social adaptation of migrants, report external monitoring and evaluation report to the Project Office and the World Bank.

② Provide technical advice for the Longnan City‟s Project Office in the aspect of data investigation and processing.

7.2 Personnel and facilities for migration agency

7.2.1 Staffing In order to achieve smooth resettlement, the project‟s migration authorities at all levels are equipped with dedicated staff to form up and down smooth information transmission channels. The staffing of migration authorities of this project is shown in Table 7-1.

7.2.2 Facilities configuration The project‟s migration authorities at the municipal and county (district) level all adopt the existing resources, basic office equipments, transportation equipment and communications equipment have been equipped, including the office chair, computers, printers, telephones, fax machines, transport equipments.

7.3 Training program

For smooth development of migrant resettlement, the migrants and migration worker must be trained, and related plans must be made, this plan will be organized by the World Bank Office of Longnan City.

7.3.1 Training program of migration management Create the system of staff training and human resource development for the migration authorities at all levels of Longnan City, county (district) and village (town). The training will be taken through expert lecture, technical training courses by all units, visit and study in other migration projects, and on-site training of technical and management staff, the training funds is included in the fund of project management. Training programs are shown in Table 7-2. The training includes:

7.3.2 Measures for improvement of migration agency (1) Identify the responsibilities and scope of duties of the migration organizations at all levels and strengthen supervision and management;

(2) Gradually enrich the power of the migration authorities at all levels, especially professional and technical strength, and all types of staff must possess the necessary professional standards and the quality of management and strengthen its technical equipment such as computers, monitoring equipment, vehicle, etc.;

(3) Achieve strict selection of the staff, enhance business and technical training, achieve training of the management and technical staff of the migration authorities at all levels in order to enhance the operational capacity and management level;

(4) Establish the database and strengthen the feedback of information, achieve smooth flow of information from top to bottom and from bottom to top, and major issues will be resolved by leadership team of migration and resettlement;

(5) Strengthen the reporting system, strengthen the internal monitoring, and solve the problems in due course;

(6) Establish the external monitoring and evaluation mechanism, and early warning system.

8 Budget and funding sources

8.1 Capital budget

In the process of land acquisition and migrant resettlement, the cost incurred will be included in the total budget for this project. Based on the price in February 2011, the total cost of the migration of the project is RMB 23.1462 million.

Seen from the category of influence of migration, the compensation for rural migration is RMB 12.4689 million, which takes up 53.87% of the total cost (including the compensation for permanent acquisition and temporary occupation of collective land of RMB 11.0571 million, which takes up 47.77% of the total cost; compensation for houses and appendages is RMB 1.0794million, which takes up 4.66% of the total cost; compensation for relocation is RMB 0.021 million, which takes up 0.09% of the total cost; and compensation for sporadic fruit tree and living subsidy for transitional period of demolition is RMB 0.1114 million, which takes up 0.48%); the compensation for corporate relocation and reconstruction is RMB 200,000, which takes up 0.86% of the total cost; compensation for relocation and reconstruction of professional project is RMB 120,000, which takes up 0.52% of the total cost; compensation for clearup of bottom of reservoir is RMB 380,300, which takes up 1.64% of the total cost; other expenses (including cost of survey and design, cost of monitoring and supervision for migration, cost of management of implementation, and training) are RMB 1.9091 million, which take up 8.25%; the basic reserved fund is RMB 1.8094 million, which takes up 7.82% of the total cost; relevant taxes (arable land occupation tax, cost of forest vegetation restoration and cost of farmland reclamation) are RMB 5.0945 million, which take up 22.01% of the total cost; post-supporting fund is RMB 1.164 million, which takes up 5.03% of total cost. 8.3 Source and disbursement of funds

In order to ensure that the compensation fee for land acquisition and resettlement can be fully paid to the affected people in a timely in accordance with the compensation policies and standards identified in the migration program, establish strict plan of allocation of funds for the project. The basic principles are as follows:

(1) All costs related to the resettlement will be included in the total budget of the project.

(2) The land compensation fee and resettlement subsidy will be fully paid before land acquisition in order to ensure that all the affected people are properly placed.

(3) In order to ensure that land acquisition, resettlement can be successfully implemented, establish financial and supervisory bodies at all levels to ensure that all funds can be well allocated in time.

In accordance with the above principles, the procedures of paying of the project's funds are as follows: the Longnan City‟s Project Office will directly allocate the tax related to land acquisition and demolition to the Land Bureau, district (county) and town departments, while the land compensation fee and resettlement subsidy will directly be deposited in the bank or credit union in accordance with the land acquisition agreement; and then the bank or credit union will directly pay it to the related village group contracting unit or individuals depending on the approval from the Longnan City‟s Project Office; and the compensation fee for demolition and crops will directly paid to the affected people; compensation fee for the infrastructure and appendages will be paid to the relevant units or individuals.

The use of the land compensation fee and resettlement fee will be determined on the basis of full consultation with the villagers, after the program of use of funds, it will be reported to the Longnan City‟s Project Office. For the land compensation fee and resettlement subsidy for direct distribution of cash, the bank or credit union will directly pay it to the related village groups or individuals depending on the approval from the Longnan City‟s Project Office; for the land compensation fee and resettlement subsidy for development of the project, the project of above RMB 0.5 million must adopt the mode of inviting bidding, and the bank or credit union will 88 Relocation plan for ADB-financed Mobaxia water source (reservior) project for urba n water supply of Cheng County, Gansu Province directly pay it to the winning unit depending on the approval from the Longnan City‟s Project Office.

9 Public participation, consultation and complaint channels

9.1 Public participation

According to national, provincial and municipal and the World Bank‟s policies and laws related to land acquisition, demolition and resettlement, in order to safeguard the legitimate rights and interests of migrants and demolition units, reduce dissatisfaction and controversy, listen to opinions and suggestions of the majority of migrants, achieve further development of the project's policy and implementation details on land acquisition and resettlement, prepare good resettlement plan, do a good job in the implementation and organization, and achieve the goal of proper resettlement of migrants, public participation is very necessary during preparation and implementation of the project.

9.1.1 Public participation during preparation of the project Since September 2010, under the guidance of the professionals of technical assistance and consultation, Luoyang Water Survey and Design Institute, Project Office of Longnan City and Cheng County has carried out a series of socio-economic survey and public consultation. And extensive public participation has also been carried out in the process of survey of physical index of the project. The main activities during preparation for the project are shown in Table 9-1. And the announcement of physical index is shown in Figure 9-1. The village group meeting is shown in Figure 9-2. And minutes of meeting with public participation are shown in Appendix 9.

9.1.2 Plan of public participation With continuous progress of the project preparation and implementation, the Design Institute of Gansu Province, migration office of Longnan City project and district (county), village and town at all levels will carry out progressive public participation. In order to ensure that the affected people can fully understand the information of the project, after the manual of resettlement information passes the review of the World Bank, it will be distributed to each affected person. Details of arrangement of public participation are shown in Table 9-2.

9.2 The complaint channels

Because resettlement will be carried out in the participation of the affected people, so huge controversy may not appear. However, in order to ensure that affected persons have a channel of complaint on land acquisition and resettlement, in the process of preparation and implementation of the plan of World Bank‟s emergency preferential loans for Longnan earthquake recovery project, establish the complaint mechanism. Complaints are divided into four stages:

 Phase I:If the migrants are dissatisfied with the resettlement plan, make oral or written complaint to the village committee or implementing agency of project demolition; if it is verbal complaint, it will be recorded in writing by the the village committee or implementing agency of project demolition. And it should be resolved within 2 weeks;

 Phase II:If the migrants are still not satisfied with the treatment decisions made in Phase one, after receipt of the decision, they can appeal to the county‟s World Bank Office and management institutions; and they should be solved within 2 weeks to;

 Phase III:If the migrants are still not satisfied with the treatment decisions made in Phase two, after receipt of the decision, under the Administrative Procedure Law of the People's Republic of China, they may appeal to the administrative organ with jurisdiction level by level for arbitration.

 Phase IV:If the migrants are still not satisfied with arbitration decision, after receiving the arbitration decision, according to the Civil Procedure Law, they may prosecute to the civil court.

The migrants may make prosecution on any problems of resettlement, including the compensation standards for resettlement. The above ways of prosecution will be noticed to the migrants through meetings and other means, so that the migrants can fully understand their own right to appeal. Meanwhile, improve the media coverage with media tools, and various migrant‟s comments and suggestions will be compiled into information items, and timely handling will be made by migration authorities at all levels. Agencies will receive free grievances and complaints of the affected

10 Implementation plan of resettlement 10.1 Principle of implementation of migration

According to the progress of project implementation plan, the project will have been implemented from December 2012 to December 2013. The resettlement schedule will have convergence with the project‟s construction scheduling, the work plan of demolition and migration will be started in June 2012 and ended in December 2012. The basic principles of the schedule are as follows:

(1) Before the project is started, there must be sufficient time for land acquisition and house demolition and resettlement.

(2) The land acquisition and house demolition will be completed within three months before the project is began, based on the need for land acquisition and relocation and resettlement, specific starting time can be determined.

(3) In the process of resettlement, the affected people should be given the opportunity to participate in the project. Before the project is started, the scope of land requisition will be announced, do a good job in public participation and other related works.

(4) Various types of compensation will be paid to the property owners directly and completely within three months after signature of land acquisition agreement, any unit or individual will not represent them to use the property compensation, nor will the compensation be discounted for any reason.

10.2 Timetable of resettlement and implementation

According to the progress of preparation and implementation of the project, propose this general plan of progress. The specific implementation time may be adjusted due to bias of the whole progress of the project, see details in Table 10-1.

11 Arrangement of supervision, monitoring and evaluation of migration

In order to ensure the smooth implementation of the resettlement plan, achieve the target of proper placement, this project, according to the requirements of domestic policy and migration policy of the World Bank, will carry out regular monitoring and evaluation for land acquisition and resettlement activities, and the monitoring is divided into internal monitoring and external monitoring.

11.1 Supervision of migration

According to Interim Measures for Land Acquisition and Resettlement for the Water Conservancy and Hydropower Project, and comprehensive supervision of reservoir migration will be brought in the construction of water conservancy and hydropower project. Comprehensive supervision of reservoir migration has comprehensive supervision unit with corresponding qualifications, and will be jointly commissioned by the investor and provincial migration management institutions, and it will make commitment to supervision and management of whole process of relocation and resettlement, and will monitor the practices of the implementation and management unit and construction unit.

The supervisor of reservoir migration needs to carry out surveying, monitoring and periodic assessment of the project, build a dynamic information file, supervise the implementation of the annual construction plan and propose advices for the next annual plan. The scope of reservoir migration supervision includes: land compensation, compensation for physical loss; compensation for collective property; living and production placement of migrants; relocation and construction of urban and rural towns, construction of protective works, infrastructure and other projects, roads, bridges, water supply, power supply, wharfs and so on in the special restoration.

For supervision of reservoir resettlement, implement the dynamic supervision of the whole process, the supervision unit will submit semi-annual and annual reports to the owner units.

11.2 Internal monitoring

Internal monitoring will be carried out by Longnan City‟s World Bank Office,

Anhui Ganghang Construction Investment Corporation will establish the information database of land acquisition, relocation and resettlement, and use it to prepare the resettlement plan and monitoring of all migrants and demolition units, and carry out internal supervision and inspection for preparation and implementation of resettlement.

11.2.1 Program of implementation During the implementation, Longnan City‟s World Bank Office will establish the corresponding resettlement database, and in accordance with the monitoring sample, collect and record the information on the resettlement, records and progress of implementation, in order to maintain a continuous monitoring of resettlement.

11.2.2 Content of monitoring Longnan City‟s project office has prepared a detailed internal monitoring program for the project‟s land acquisition and resettlement, its monitoring includes:

11.2.3 Internal monitoring report For each half a year, all project implementation units will prepare an internal monitoring report for submitting the World Bank‟s Project Management Office. The report should be marked with the statistics of the past six months in the table, reflect the progress through actual and planned land acquisition, resettlement and use of

11.3 External independent monitoring

According to the requirements of the World Bank‟s policies, the World Bank Office of Longnan City will hire a qualified, independent and experienced migration

11.3.1 Independent monitoring agency The Longnan City World Bank‟s Project Office will hire an independent migration monitoring body to carry out external monitoring of the resettlement. The independent monitoring and evaluation unit will track the monitoring and evaluation of resettlement on a regular basis, monitor the progress, quality and funds of the resettlement, and propose advices. Tracking and monitoring of standard of living and production will be carried out, and monitoring and evaluation report will be submitted to the World Bank Office of Longnan City and the World Bank.

11.3.2 Monitoring procedures and content (1) Preparation of working outline of monitoring and assessment. (2) Development of software of information system of monitoring and evaluation of migration. ⑶ Preparation of survey outline, survey forms, and record card of the affected residents, typical industrial and mining units. ⑷ Scale of design sample of sampling survey: the demolition households of 100%; the unit affected by demolition of 20%. (5) Basic investigation The basic research for independent monitoring and evaluation for villagers under land acquisition, obtain the basic data on living standard of monitored migrants (living, production and management, and income level).

⑹ Establishment of system of monitoring and evaluation of information

Achieve establishment of system of monitoring and evaluation of information, various types of data involved in migration monitoring and evaluation will be classified for establishment of database in order to provide the computer-aided analysis, tracking and monitoring.

11.3.4 External monitoring report The external monitoring and evaluation agency will submit the report of monitoring and evaluation to the World Bank and Longnan City Project Office for every half year, arrangement of submission is shown in Table 11-3.

A Project Description Moba gorge water resource (reservoir) construction project for the water supply of urban area of Chen county in Gansu province is the favorable and emergent loan project of the World Bank. Moba Gorge reservoir is a gorge type reservoir for water storage and it is a water supply engineering with the main objective of supplying water for city. The reservoir locates at the Nan river which is 11km away from Chen county. According to the review at the feasible stage and the approved scheme, the total reservoir storage is 17,870,000 m3, usable storage is 11,400,000 m3, the normal water level is 1092.68m, the design flood level is 1096.38m, the exceptional flood level is 1098.47m, backwater length is 3.4km, and it is a carry-over storage reservoir. The project scale is medium-scale of grade III. Permanent main building is designed according to the grade III building, permanent minor building is designed according to the grade IV building, and the temporary building is designed according to the grade V .

The hinge region project is composed by the roller compacted concrete gravity dam, right bank water delivery spillway tunnel, highway on the dam, and water pipe. The desighed daily water supply capacity is 47,500 m3, the water pipe is arranged in double-tube way, the designed water flow is 0.55m3/s, and the total water pipe is 5,040 meters long.

The total investment of this project is 264.4538 million yuan, including 20.2472 million yuan of immigration cost. From the point of immigration influence category, rural immigration fee is 12.1495 million yuan (which takes up 60.01% of the total cost) , including the 10.9042 million yuan of permanent collection of land fee, which take up 53.86% of the total cost. The compensation for housing and its appendage is 1.1129 million yuan, which takes up 5.50% of the total cost. The allowance of removal is 21,000 yuan, which takes up 0.1% of the total cost. Fruit tree compensation and living allowance fee are 11,1400 yuan, which takes up 0.55%.The enterprise removal compensation is 200,000 yuan, which takes up 0.99% of the total

cost. The special project removal and reconstruction fee is 120,000 yuan, which takes up 0.59% of the total cost. The fee of cleaning the reservoir region is 425,300 yuan, which takes up 2.1% of the total cost. Other fees (including survey design fee, immigration survey and supervising of immigration fee ,and managemt and trainning fee) are 1.8797 million yuan, which take up 9.28% of the total cost. The basic preparation fee is 1.7729 million yuan, which takes up 8.76% of the total cost. Relevant tax expense is 2. 5357 million yuan, which takes up 12.52% of the total cost. And the following support fund is 1.164 million yuan, which takes up 5.75% of the total cost.

According to the progress of the project, the preparatory work for the project will carry out from February 2009 to October 2011. And the feasibility and the approval of establishment of the project will be completed in June 2009. The preliminary design will be accomplished in April 2011. Construction design and construction bidding work will be finished in July 2011. It will begin to build in June 2012, and finish in December 2013. The construction period lasts 36 months. And it will bring into service in December 2013.

B The Influence of Immigration The influence category of Moba gorge water resource (reservoir) construction project for the water supply of urban area of Chen county in Gansu province mainly contains: (1)The influence of land acquisition/occupation losing ; (2)The influence of removing house; (3) The influence of industrial and mining enterprises removal. The permanent occupied land for the project is collective land, involving the 940.664 mu of village collective land in 3 towns, 7 villages, and 13 villager groups of Chen county in Longnan. The total collecting of rural collective land is 1017.79 mu. The permanent occupied land in reservoir inundation area is 869.96 mu,which takes up 85.48% of the total land. Permanent occupied land in the hinge region (Dam area) is 147.834 mu, which takes up 14.52%of the total permanent occupied land. The total area of house demolition for the project is 579.43m2 and the removal site is located at Mazhuang group in Niuyao village and the third group in Longmen village. There are 14 persons in 3 households has been affected. The population that is only affected by removal is 1,406 persons in 346 households. The population that not only affected by

land acquisition but also by removal are 83 persons in 18 households. The area of non-residence houses in project removal is 52 m2, mainly in the quarry of Moba gorge. Meanwhile, the temporary occupied land involves 10 groups of 3 villages in 1 town of Chen county in Longnan. The area of temporary occupied land is 345 mu in total, and the total populations that are affected in short term are 377 persons in 78 households. In the period of occupying land temporarily, the annual compensation standard of plow land is two times of the average production value per mu in the past three year before land acqusition, which is 1,580. After the expiration of the occupying, the land can be restored by construction organization or village group or affected person. The period of land occupied for project is 3 years, and the compensation period is 4 years. The compensation fee for the tempoary occupied plow land is that: Paosha town is 7,820 yuan/mu, Shaba town and Shenyuan town is 4,988 yuan/mu; The compensation fee for the tempoary occupied woodland is that: Paosha town is 2,580 yuan/mu, Shaba town and Shenyuan town is 1,872yuan/mu;The compensation standard for land re-cultivation is that dryland is 1500yuan/mu, bushwood is 1,000 yuan/mu. In order to reduce the impact of land acquisition on the young crop, the project is arraged after the harvest, or before seeding. The compensation standard of residence removal for this project is based on the principle of full replacement price and the actual situation of Chen county, and it is in acccordance with the The Land Administration Law of the People's Republic of China, Implementing Regulations of The Land Administration Law, and the relevant laws and regulations of Gansu province and each project county. It is based on the cost of brick house and civil structure house in project to analyze and forecast, see the appendix 8. According to the calculated result, the compensation standard of removing the civil structure house is 1,200yuan/m2 , which is more than 9 71.25 yuan/ m2 of its replacement price( The structure replacement price is 307.25 yuan/ m2). The affected relocated households can obtain relocation subsidies and early removal fee besides the the compensation for house removal.  The Standard of Non-residential House Removal There is only one non-residential house of industrial and mining enterprise that has been affected. It is a quarry in Moba Gorge. And it is a collective enterprise of Niuyao village which is built for the reservoir of Chen county. According to the compensation policy for non-residential house in Chen county, the removed house of industrial and mining enterprise will be compensated and resettled through negotiating with industrial and mining enterprise on the principle of market replacement price.

D Immigration Orangization

In order to guarantee the smooth implementation of the land acquisition and immigrant resettlement, and achieve the expected effect, the people's government of Longnan approves to establish the leading group for taking advantages of foreign preferential emergency loan program to reconstruct after earthquake. And it consists of managment office for World Bank project. This organization is responsible for directing the formation of immigration plan and the implementation of land acquisition and demolition, and contacting with World Bank. Meanwhile, project construction management office of urban water supply using the water resources of Moba gorge( reservoir) in Chen county and its higher competent authorities take part in the formation of immigration plan, and have responsibiliy of the managing land acquisition and demolition, monitoting and inspection internally, and monitoring internally.

In order to complete all parts of work in land acquisition and demolition and immigrants resettlement of Moba gorge reservoir, the people's gvernment of Chen county approves to establish the leading group for land acquisition and demolition and immigrants resettlement of Moba gorge reservoir. The headman of the leading group is Li Pengju, who is the head of Chen county. And the vice director of the group is Wu Bin, who is the member of county party committee and deputy magistrate, He Keqiang, who is vice-director of people's congress, Li Lude, who is deputy magistrate , Shi Bangbang, who is deputy magistrate, and Zhou Yajuan, who is vice-chairman of the CPPCC. The team members are the leaders of the administrative department of the government at the county level.

There are 1 to 2 leaders to take in charge of immigrants resettlement in affected villages and towns. And the leading group is composed of a office which located at county Water Authority. The director of the office is An Zhiming,and the vice director is Wang Wenbin. The members of the office come from leading group member unit. They are in charge of the detailed work about land acquisition and demolition and immigrants resettlement of Moba gorge reservoir. In addition to that, the organizations that participating the project are the affected village committees and villager groups, design units, and external monitoring unit

E Complaint Appeal

For the immigration resettlement work is carried out through the participation of the affected person, there will not appear great argument. However, in order to guarantee that there is a channel where the affected person can lodge an appeal about the all aspects in land acqusition and immigration resettlement, appeal system has been built in the process of formation and implementation immigration resettlement plan of World Bank emergent preferential loan program about reconstruct Longnan after earthquake . It can be divided into four stage:

 Stage One: If the immigrants do not satisfied with the immigration resettlement plan, they can appeal to the village committee or the organization of implementation demolition in oral or written form.If it is oral complaint, village committee or organzation of implementation demolition shall deal with it and record it in writing. The village committee or organzation of implementation demolition should solve it in 2 weeks;

 Stage Two:If the immigrants do not satisfied with the decision, they can appeal to the World Bank project office or administration in county after receving the decision; World Bank project office or administration in county should make decision in 2 weeks;

 Stage Three:If the immigrants still do not satisfied with the decision, according to the Administrative Procedure Law of the People's Republic of China, they can appeal to the administrative organs that have jurisdiction step by step after receving the decision; and to to have arbitration.

 Stage Four:If the immigrants still do not satisfied with the decision, according to the Civil Procedure Law, they can sue in civilian courts after receving the decision.

Immigrants can bring the accusation about any aspects of immigration resettelment, like the compensation standard , etc. The immigrants can be informed about the above complaints way through meeting and others ways. The immigrants can fully understand their own rights of appeal. Meanwhile, it shall propagandize the related immigration issue by using of media the and sort views and suggestions about the immigration into information provision. Immigration organizations at all levels should deal with the problem immediately. All organizations will accept the complaint and

appeal of the affected person for free, and the reasonble expenses will be at the cost of contingency of immigration.
