    Water Safety Policy in Scotland —A Guide 2 Introduction Scotland is surrounded by coastal water – the North Sea, the Irish Sea and the Atlantic Ocean. In addition, there are also numerous bodies of inland water including rivers, burns and about 25,000 lochs. Being safe around water should therefore be a key priority. However, the management of water safety is a major concern for Scotland. Recent research has found a mixed picture of water safety in Scotland with little uniformity or consistency across the country.1 In response to this research, it was suggested that a framework for a water safety policy be made available to local authorities. The Royal Society for the Prevention of Accidents (RoSPA) has therefore created this document to assist in the management of water safety. In order to support this document, RoSPA consulted with a number of UK local authorities and organisations to discuss policy and water safety management. Each council was asked questions around their own area’s priorities, objectives and policies. Any policy specific to water safety was then examined and analysed in order to help create a framework based on current practice. It is anticipated that this framework can be localised to each local authority in Scotland which will help provide a strategic and consistent national approach which takes account of geographical areas and issues. This opportunity will also mean challenges for developers and licensing authorities in balancing the needs of a growing industry with other users of the marine environment. This Regional Locational Guidance collates information from a wide variety of sources to assist the wind, wave and tidal energy developers in situating their developments. This document will be one of a suite of supporting documents for the pilot PFOW Marine Spatial Plan. Spatial data information layers have been collected and used to illustrate the likely interactions that developers and licensing authorities will have to consider when initiating developments in the PFOW area. Fishing concerns will be one of the main considerations given the overlap of potential development areas and the highly active crab creeling industry that takes place in the PFOW. Environmental factors such as seal species will require particular attention given the sensitivity of some of these populations in this area and the uncertain effect of developments on their habitat. This Regional Locational Guidance is one of a range of tools that can be used to choose sites of maximum opportunity and minimum constraint but is not intended to be a stand-alone method of doing so.

This plan has been prepared in association with these documents. These Regulations also revoke and replace earlier legislation on port reception facilities, reinstating the existing requirements for harbour authorities and terminal operators to ensure the provision of adequate reception facilities for ships’ wastes. Adequate facilities are those that are fully used by mariners instead of discharging their ship’s waste into the sea. To achieve this, facilities should meet the needs of the harbour authority’s users and of the environment. To this end Orkney Islands Council Marine Services has attempted to remove as far as possible any disincentives towards use of such facilities. In particular the facilities provided should: • Cater for all types of waste that are usually landed at the various harbours and piers under the authority’s jurisdiction.

We have considered your request under the Environmental Information (Scotland) Regulations 2004 (‘the EIRs’). Your Request “Please provide the following information under FOI/EIR: Please see the attached spreadsheet which lists most of the salmon farms of Scotland. 1. Please could you provide information as to which farms are required by SNH to keep a log of Acoustic Deterrent Device (ADD) use and seal predation events which trigger them. 2. Please provide the log sheets for those farms for the past 5 years, giving the times when the ADDs were triggered, the number and make of the ADDs, and the evidence of seal predation. I am not interested in the names of the individuals who filled in the logs. 3. The spreadsheet shows 16 farms which are not allowed by SNH to use ADDs without an EPS licence (highlighted in yellow). Please provide correspondence between SNH and the farms and between SNH and Marine Scotland explaining why these farms require an EPS licence. 4.
