For decades residential real estate developers and managers have worked within a given set of relationships between themselves, the municipality as service provider, the state as regulator and the investors whose primary interests they serve. That set of relationships has been based on a robust set of assumptions, so the decision-making process has become routine and institutionalised.

BUT WHAT HAPPENS IF THE CORE ASSUMPTIONS CHANGE? Let us examine some of those core assumptions so that we understand the implications of any change that might happen. Arguably the absolute foundation of any real estate development is the assumption that the municipality will provide five basic services – roads, electricity, water, sanitation and refuse removal. This means a routine decision-making process each time a new development is launched, much like a checklist.

This changed when Eskom crashed and suddenly the assumption of assurance of supply (AoS) – the guarantee of a given quantum of energy delivered to a given entity at a given time and at a given price – was found to be flawed. After initial anger and then turmoil, adaptive responses came in the form of standby generator sets. So it is the AoS assumption that is critical to the raft of municipally delivered services that enable development to occur in the first place.

Now let us apply the AoS assumption to water. Here there are two major elements to be disaggregated – potable water and waste water. Central to these are ethics, responsibility and risk. What this means is that anyone holding fiduciary responsibility, even as an unpaid trustee or director, has to make sense of this growing complexity under the persistent shadow of the threat of liability in terms of King IV for failing to act responsibly when acting on behalf of others.

Heavy stuff indeed! So where is the good news? This comes in the form of a structured intervention in which a team of professionals helps the HOA and board to transition from an initial high-risk, low-information posture to a future low- risk, high-information posture. This is done in a three-stage process designed to develop a 20-year plan, underpinned by a robust set of verifiable facts and driven by a coherent strategy, that enables long-term budgeting and forecasting to be done. This process is currently being rolled out in conjunction with ARC to all chapters across the country. It is also being made available to other specialised interest groups that have to manage real estate in one form or another, increasingly embedded in a new regulatory and institutional landscape that is changing so fast that it has not yet been formalised in policy and law.

The good news about this process is that while it de-risks the HOA and those holding fiduciary responsibilities defined by King IV, it also protects the investment value of the real estate. When you buy into a retirement community – whether it is a traditional purchase or a life right scheme - you are basically buying security. Rob Jones elaborates this as security of tenure, physical security, health security and financial security. And each of these is equally important. SECURITY OF TENURE Life right is for ever! So the most important thing to consider when buying a life right in a development is whether this really is where you want to live for the rest of your life, because it’s likely this will be your last property purchase. Buying a life right is a bit like getting married – it’s a serious commitment, and you want to know exactly who you are partnering up with.

Security of tenure is a basic construct of the life right system, and is well covered by the Housing Development Schemes for Retired Persons Act (Act 65 of 1988) (RPA). When the project was first mooted, residents were mobilised through a number of channels. A Facebook page, WhatsApp groups (one for each street), a Google+ community and, of course, the PRABOA website. There were meetings in the town hall and regular coffee get-togethers. An article in the local community (print) newspaper picked up the few people who might otherwise have fallen through the cracks, and FTTH campaigners would stop people in the street as they were strolling or jogging, or chat to them in the park while their dogs were gambolling.

Yes, Parkhurst is an open suburb in which people feel safe in the streets. It’s not uncommon for residents to walk their dogs in the park, stroll up to Fourth Avenue for a pizza or some sushi, and then saunter back home. This is largely thanks to the security initiatives started and maintained by PRABOA – and, with the advent of fibre, they are going to move forward in leaps and bounds. CCTV cameras are being installed in virtually every street, so you can do your neighbourhood watch “patrol” in the comfort of your lounge by checking out the streets online through the camera network.

FTTH, as most people now realise, will change so much in our lives. As well as the obvious advantages of super-fast internet, movie streaming, crystal-clear VOIP and in-your-face gaming, fibre allows for seamless living. As Ryan Beech, who manages the FTTH programme for PRABOA, and is currently developing the smart system that will ultimately manage the Parkhurst smart community initiative says:

This last plus has so many benefits it’s almost worth it just for that. If you use your car less, you burn less carbon, you save money, you find that it’s a good idea to stroll to the shops or to the coffee shop – thus getting some exercise, and generally taking life a little slower.

Maybe that’s the real value of speed – it lets you do things slower: more time with the kids, time to walk the dogs, time to cook a meal from scratch – and leave it in the oven at a low heat while you burn up cyberspace at the speed of light.
