Laptevа* Siberian Federal University 79 Svobodny, Krasnoyarsk, 660041, Russia Received 07.09.2017, received in revised form 07.11.2017, accepted 14.11.2017 The article presents a study of variants of possible future for Siberia and Russian Far East up until 2050. The authors consider the global trends that are likely to determine the situation of Russia and the Siberian macro-region in the long term. It is shown that the demand for natural resources of Siberia and Russian Far East will be determined by the economic development of Asian countries, the processes of urbanization and the growth of urban “middle class”. When determining possible scenarios, the authors use a method of conceptual scenario planning that was developed under the framework of foresight technology. Three groups of scenario factors became the basis for determining scenarios: external constant conditions, external variable factors, internal variable factors. Combinations of scenario factors set the field for the possible variants of the future of Siberia and Russian East. The article describes four key scenarios: “Broad international cooperation”, “Exclusive partnership”, “Optimization of the country”, “Retention of territory”. For each of them the authors provide “the image of the future” (including the main features of international cooperation, economic and social development), as well as the quantitative estimation of population and GDP dynamics: • “Broad international cooperation” – the population of Russia will increase by 15.7 % from 146.5 million in 2015 to 169.5 million in 2050; Russia’s GDP will grow by 3.4 times – from 3.8 trillion dollars (PPP) in 2015 to 12.8 trillion dollars in 2050.

Penova and Valery A.Safonova aSaint Petersburg State University, Saint-Petersburg, RUSSIA ABSTRACT The article contains a comparative analysis of constitutional and other legislative provisions that ensure a trade union’s right to define its own administrative structure in European states. The aim of the study is to reveal the management’s problems of European trade unions, declarative and empirical mass-character legislative provisions, which allow to structure trade unions by themselves. The result is that the state should not set forth an exhaustive list of various types of trade unions. The article also examines the authority of trade union associations to define the requirements imposed on their members’ charters. These requirements are argued to comply with the principle of the freedom of association. Moreover, the work reveals that many European legislative provisions are declarated but rarely realized in sphere of inner management. The novelty of the research is the comparative analytic review, basing on the modern local and collective European laws.     LAW OF UKRAINE WHILE PART OF THE RUSSIAN EMPIRE V. HONCHARENKO Doctor of Legal Sciences, Professor, Member of the National Academy of Legal Sciences of Ukraine, Head of Chair of History of State and Law of Ukraine and Foreign Countries (National University «Yaroslav Mudryi Law Academy of Ukraine») uring the 1780–1790s, the constant offensive of Russian Tsarism against the statehood of the Ukrainian people ended with the final elimination of the DHetmanate, destruction of the Zaporozhian Host, and the introduction into Left Bank Ukraine of a provincial administrative-territorial structure and thereby a new judicial system connected with the new administrative structure for this ter- ritory. During the first half of the nineteenth century, the elimination of Ukrainian national law by Russian imperial power was completed — the Russian legal system was introduced into operation. Among the major sources of Russian law which gradually extended their operation to the territory of Ukraine were, especially, the Digest of Laws of the Russian Empire, which entered into force in Ukraine in 1835 with regard to regulating relations of a State and administrative character. During the 1840s and in 1842 the operation of the Digest of Laws was extended to civil and criminal law on the Left Bank and Right Bank of Ukraine accordingly. From 1846 the basic source of criminal law in Ukraine became the «Statute on Criminal and Reform Punishments», confirmed by Tsar Nicholas I on 15 August 1845 and introduced into operation in the Empire from 1 May 1846. The Statute not without reason is consid- ered to be a code.1 The principal source of criminal procedure law in Ukraine became Volume XV, Book Two, of the Digest of Laws of the Russian Empire, which, in the view of Tertyshnyk, became the first code of criminal procedure of Russia.2 In the second half of the nineteenth century the Imperial system of law func- tioned on the territory of Ukraine which was part of the Russian Empire, tak- ing its beginning during the codification work effectuated under the direction of M.

Introduction First of all, the fundamental principles of regulation of sustainable development are established at the international level. They were formulated at the United Nations Conference on Environment and Development in 1992 in Rio de Janeiro (Brazil), reflected in the adopted Declaration on Environment and Development. They were further discussed at subsequent international conferences of the United Nations in 2012 and 2016. It is noteworthy that the Declaration does not contain a definition of sustainable development. But based on the goal of establishing a new, equitable global partnership by creating new levels of cooperation between states and key sectors of society, the Declaration establishes such broad principles of sustainable development, which can be perceived not only in the context of environmental protection. The Declaration establishes the need to eradicate poverty, eliminate unviable models of production and consumption, deepen scientific understanding, create an open international economic system, maintain original cultures of the traditional population, prevent wars, etc.

Please do not cite* Russian Constitutional Court and ECtHR: The ‘Right to Object’ as a Tool for Constructive Dialogue, not a Revolution Maria Smirnova1 Introduction On 14 July 2015 the Russian Constitutional Court (RCC) passed a very alarming ruling No. 21-P (the ‘Supremacy of the Constitution’ Ruling) whereby all lower courts shall stop the proceedings on any case submitted for their consideration and refer to the RCC in order to review the constitutionality of legislation in which the European Court of Human Rights (ECtHR) has found flaws. Should the RCC come to a conclusion that the Strasbourg decision is incompatible with the Constitution, it is not to be implemented. Later in 2015 a Federal Constitutional Law was adopted solidifying the right of the RCC to rule, essentially, on the constitutionality of a Strasbourg judgment (No. 7-FKZ of 14 December 2015). On 31 March 2016 this federal law was used for the first time when the Ministry of Justice requested the RCC to assess the constitutionality of ECtHR judgment on prisoners’ voting, Anchugov and Gladkov.2 If not a sign of a change in the general political attitude towards the implementation of decisions of the Strasbourg Court, this ruling at least brought forward the debate about international obligations and state sovereignty. The RCC reasoned that: ‘the participation of the Russian Federation in any international treaty does not mean giving up national sovereignty. Neither the ECHR, nor the legal positions of the ECtHR based on it, can cancel the priority of the Constitution.
