This has reference the item no xxv of the terms and conditions issued in the Environmental Clearance letter vide above reference for submission of six monthly report on the status of compliance of the stipulated EC.

We are herewith enclosing the half yearly report based on the current status of the project). Further, we are in the process of getting the Financial closure for the project and we have applied for the Consent for Establishment to APPCB on 05.09.09. The Land development works shall commence after we get the Consent for Establishment.

Krishnapatnam Power Corporation Limited. *** This has reference to the letter No. 2288/CZMA/2009, dated 12.06.2009 of Special Chief Secretary, E.F.S. &. T Dcpart.menj , Govt. of Andhra Pradesh forwarding your application seeking prior Clearance for the above project under the CRZ Notification, 1991. The proposal has been appraised as per prescribed procedure in the light of provisions under the CRZ Notification, 1991 on the basis of the mandatory documents enclosed with the application viz the Questionnaire, EIA, EMP and the! additional clarifications furnished in response to the observations of the Expert Appraiaal Committee constituted by the competent authority in its meetings held on 20th - 22"(1 July, 2009.

2. It is interalia, noted that the proposal involves the establishment of Sea water intake facilities and discharge of coolant waste water facilities including coal conveyance and transshipment facilities. It is proposed to establish 1980 MW (3X h60 MW) Coul fired Thermal Power Project at Tammenapatnam and Mornidi villages !latitude of 140 II' 05..59" N to 140 12' 28.33" N and longitude of 80004' 35.76" E to 80006' 25.87"E), Chillakur MandaI in Sri Potti Sriram u lu of Andhra Pradesh. The proposed site is situated on southern side, 3 km from . The distance to seaward boundary from the project site is 2.5 km and the Khandalcru creek IS 1.1 km. The site is situated at a distance of 150 m on the landward side of the Buckingham canal which traverses in North Sou th direction The total area envisaged for setting up of the proposed power plant is 481.40 l-£:, (1189.00 Acres). The surroundings of the project site arc undeveloped ru ral area. "

3, The desalinated water requirement of the proposed power plant will be about 14 MLD for the process and auxiliaries and 315 MLD of seawater for condenser cooling which will be supplied from the Desalination plant proposed by Mis. Krishnapatnam Water Company Private Limited (KWCPL).The sea water will be drawn from the common pipeline corridor earmarked for the proposed Desalination Plant. The intake structure is proposed near the toe of the south breakwater of Krishnapatnam Port and the intake pump house is located at latitude 140 14' 32" N and longitude 80° 07' 49" E. The intake system is located at a distance of 100 m from the shoreline with depth of H 9.60 m from CD. The total quantity of hot water discharge from the proposed power plant is 7,764 m1jhr (186 MLD).The outfall point is at a latitude 14012'14" N and longitude 80008'04" E at a depth of (-) 6.0 m CD and the total length of outfall pipeline is 4.40 km from the plant site to discharge point. The sub terrain pipeline On the land extends over 3.75 km upto land fall point and the distance between Landfall point to discharge point is 0.625 km. Land fall point is located in inter tidal zone at latitude 14()12'14" N and longitude 80007'43,08" E. The total estimated cost of the project is Rs. 9405,0 Crores.

4. The National Institute of Oceanography (NIO); Visakhapatnarn carried out the demarcation of LTL, BTL and CRZ area. As per the NIO study, the Right of Way (RoW) for the proposed pipeline corridor area between Buckingham canal and Bay of Bengal is sandy in nature and barren land with Casuarina plantations and thorny bushes and sparse wild vegetation. The coastal region comprises of fairly wide beaches with well defined foreshore and elevated backshore. The buried outfall pipeline route for thermal discharge crosses the Buckingham canal and 500 m setback line of open coast and inter tidal zone. Tile pipeline corridor including facilities for intake and outfall structures do not fan or contain in their vicinity, any environmental sensitive and important ecosystem except the Thamminapatnam Reserve Forest.

5. The paragraph 2 (xii) of CRZ Notification permits the facilities for carrying treated effluents and waste water discharges into the sea, facilities for carrying sea water for cooling purposes. The paragraph 2 (viii) of the Notification provides for the construction of jetties, wharves, bridges and sea-links for locating the intake and outfall structures. The paragraph 3 (2) (iii) of CRZ Notification stipulates that the environmental clearance for foreshore facilities, transport of raw materials facilities for in-take of cooling water and outfall for discharge of treated waste water for Thermal Power Plants have to be obtained CRZ Clearance.

6. The Government of Andhra Pradesh has forwarded the proposal for the issue of CRZ Clearance.

7. The Expert Appraisal Committee, after due consideration of the relevant documents submitted by the project proponent and additional clarifications furnished m response to its observations, have S~~~?'\~ - 2 '\ "s

recommended for the grant of CRZ Clearance for the project. Accordingly, the Ministry hereby accord necessary CRZ Clearance under CRZ Notification, 1991 and its subsequent amendments, subject to strict compliance of the terms and conditions as follows:

8. Specific Conditions :

I. Construction phase:

[i] The temperature and salinity shall be monitored weekly.

(ti) Fish culture shall be carried ou tat disposal point and monitored regularly to check the impact on marine Iife.

(iii) De-chlorination shall be carried out before disposal of brine if necessary.

(iv) Combined impact due to discharge of RO Reject of sister company also shall be studied.

(v) The project shall be implemented in such a manner that there is no damage whatsoever to the mangroves/ other sensitive coastal ecosystems.

(vi) Consent shall be obtained from Andhra Pradesh Pollution Control Board for the disposal of effluent into sea. The effluent shall meet the standards prescribed by Andhra Pradesh Pollution Control Board before disposal.

(vii) A continuous and comprehensive post-project marine quality monitoring programme shall be taken up. This shall include monitoring of water quality, sediment quality and biological characteristics and report submitted every 6 month to Ministry's Regional Office at Bangalore.

(viii) It shall be ensured that there is no displacement of people. houses as a result of the project.

(ix) There shall be display boards at critical locations along the pipeline viz., road/rail/river crossings grving emergency instructions. This will ensure prompt information regarding location of accident during anv emergency. Emergency Information board shall contain emergency instructions in addition to contact details. Proper lighting shall be provided all along the road.

(x) There shall be no withdrawal of ground water in CRZ area, for this project. ('~~:A~i __. .. __,,_-... \ .. _,.,. 3 r , (

(xi) Arrangement for treatment of liquid effluents shall be made so as to ensure that the untreated effluents are not allowed to be discharged into the sea/marine water.

(xii) Appropriate safety devices such as masks shall be provided for use by the workers at the site and their usage by them shall be ensured.

(xiii) Necessary provisions shall be made for emergency evacuation during natural and man-made disasters like floods, cyclone, tsunami and earthquake etc.

(xiv) Provision shall be made for the housing of construction labour within the site with all necessary infrastructure and facilities such as fuel for cooking, mobile toilets, mobile STP, safe drinking water, medical health care, creche etc. The housing may be in the form of temporary structures to be removed after the completion of the project.

(xv) A First Aid Room will be provided in the project both during construction and operation of the project.

(xvi) All the topsoil excavated during construction activities should be stored for use in horticulture/landscape development within the project site.

(xvii) Soil and ground water samples will be tested to ascertain that there is no threat to ground water quality by leaching of heavy metals and other toxic contaminants.

[xviii] Any hazardous waste generated during construction phase, should be disposed off as per applicable rules and norms wah necessary approvals of the Andhra Pradesh Pollution Control Board.

(xix) The diesel generator sets to be used during construction phase should be low sulphur diesel type and should conform to Environment (Protection) Rules prescribed for air and noise emission standards.

(xx) The diesel required for operating DG sets shall be stored in underground tanks and if required, clearance from Chief Controller of Explosives shall be taken.

(xxi) Vehicles hired for bringing construction material to the site should be in good condition and should have a pollution check certificate and should conform to applicable air and noise emission standards and should be operated only during non peak hours. I./-~. i-) v~,~"~~'''~,, " \_, \.-4,/

(~- ---,,- ' ~-' -~\:~'---____ 4 (xxii) Ambient noise levels should conform to residen tial standards both during day and night. Incremental pollution loads on the ambient air and noise quality should be closely monitored during construction phase. Adequate rneasu res should be made to reduce ambient air and noise level during construction phase, so as to conform to the stipulated standards by epeB/ APPCB. '

(xxiii] Storm water control and its re-use as per C(rWB and BIS standards for various applications.

(xxiv) Regular supervision of the above and other measures for monitoring should be in place all through the construction phase, so as to avoid disturbance to the surroundings.

II. Operation Phase

(i) Noise should be controlled to ensure that it does not exceed the prescribed standards. During night time the noise levels measured at the boundary of the building shall be restricted to the permissible levels to comply with the prevalent regulations.

(ii) The green belt of the adequate width and density preferably with local species along the periphery of the plot shall be raised so as to provide protection against particulates and noise.

(iii) The ground water level and its quality should be monitored regularly.

(iv) The mangroves, if any, on the site should not be disturbed in any way.

(v) The environmental safeguards contained in the ErA Report should be implemented in letter and spirit.

(vi) A separate Environment Management Cell with suitably qualified staff to carry out various environment related functions shall be set up under the charge of a Senior Executive who will report directly to the Chief Executive of the Company.

(vii) The funds earmarked for environment protection measures shall be maintained in a separate account and there shall be no diversion of these funds for any other purpose. A year-wise expenditure on environmental safeguards shall be reported to this Ministry's Regional Office at Bangalore

5 (viii) In case of deviation or alteration in the project including the implementing agency, a fresh reference shall be made to this Ministry for modification in the clearance conditions or imposition of new one for ensuring environmental protection. The project proponents shall be responsible for implementing the suggested safeguard measures,

9. General Conditions :

(i) Adequate provision for infrastructure facilities including water supply, fuel and sanitation must be ensured for construction workers during the construction phase of the project to avoid any damage to the environment. (il) Appropriate measures must be taken while undertaking digging activities to avoid any likelydegradation of water quality.

(iii) Borrow sites for each quarry sites for road construction material and dump sites must be identified keeping in viewthe following:

(a) Noexcavation or dumping on private property is carried out without written consent of the owner.

(b) No excavation or dumping shall be allowed on wetlands, forest areas or other ecologically valuable or sensitive locations.

(e) Excavation work shall be done in close consultation with the Soil Conservation and Watershed Development Agencies working in the area, and

(d) Construction spoils including bituminous material and other hazardous materials must not be allowed to contaminate water courses and the dump sites for such materials must be secured so that they shall not leach into the ground water.

(iv) The construction material shall be obtained only from approved quarries. In case new quarries are to be opened, specific approvals from the competent authority shall be obtained in this regard.

(v) Adequate precautions shall be taken during transportation of the construction material so that it does not affect the environment adversely.

(vi) Borrow pits and other scars created during the road ~~y'construction shall be properly levelledand treated. 6 · ..l

(vii) Adequate financial provision must be made in the project to implement the aforesaid safeguards.

(viii) The project proponent will set up separate environmental management cell for effective implementation of the stipulated environmental safeguards under the supervision of a Senior Executive.

(LX) Full support shall be extended to the officers of this Ministry I Regional Office at Bangalore by the project proponent during inspection of the project for monitoring purposes by furnishing full details and action plan including action taken reports in respect of mitigation measures and other environmental protection activities.

(x) Ministry of Environment & Forests or any other competent authority may stipulate any additional conditions or modify the existing ones, if necessary in the interest of environment and the same shall be complied with.

(xi) The Ministry reserves the right to revoke this clearance if any of the conditions stipulated are not complied with the satisfaction of the Ministry.

[xii] In the event of a change in project profile or change in the implementation agency, a fresh reference shall be made to the Ministry of Environment and Forests.

(xiii] The project proponents shall inform the Regional Office as well as the Ministry, the date of financial closure and final approval of the project by the concerned authorities and the date of start of land development work.

(xiv) Safety provision such as bus bays, service roads intersection improvement etc., will be carried out by the project proponent. The project proponent shall provide adequate facilities as per IRe normsyguidelines.

(xv) Andhra Pradesh Pollution Control Board shall display a copy of the clearance letter at the Regional Office, District Industries Center and Collector's Office/Tehsildar's office for 30 days.

10. These stipulations would be enforced among others under the provisions of Water (Prevention and Control of Pollution) Act 1974, the Air (Prevention and Control of Pollution) Act 1981, the Environment (Protection) Act, 1986, the Public Liability (Insurance) Act, 1991 and EIA Notification 2006, including the amendments an.d rules made thereafter.

11. All other statutory clearances such as the approvals for storage of diesel from Chief Controller of Explosives, Fire Department, Civil Aviation Department, Forest Conservation Act, 1980 and Wildlife (Protection) Act, 1972 etc. shall be obtained, as applicable by project proponents from the respective competent authorities.

12. The project proponent shall advertise in at least two local Newspapers widely circulated in the region, one of which shall be in the vernacular language informing that the project has been accorded Environmental Clearance and copies of clearance letters are available with the Andhra Pradesh Pollution Control Soard and may also be seen on the website of the Ministry of Environment and Forests at http://www.envfor.nic.in. The advertisement should be made within 10 days from the date of receipt of the Clearance letter and a copy of the same should be forwarded to the Regional office of this Ministry at Bangalore ..

13. Environmental clearance is subject to final order of the Horr'ble Supreme Court of India in the matter of Goa Foundation Vs. Union of India in Writ Petition (Civil) No.460 of 2004 as may be applicable to this project.

14. Any appeal against this Environmental Clearance shall lie with the National Environment Appellate Authority, if preferred, within a period of 30 days as prescribed under Section 11 of the National Environment Appellate Act, 1997. .

15. A copy of the clearance letter shall be sent by the proponent t() concerned Panchayat, ZIlla Parisad/ Municipal Corporation, Urban Local Body and the Local NC}O, if any, from whom suggestionsl representations, if any, were received while processing the proposal. The clearance letter shall also be put on the website of the company by the proponent.

16. The proponent shall upload the status of compliance of the stipulated EC conditions, including results of monitored data on their website and shall update the same periodically. It shall simultaneously be sent to the Regional Office of MoEF, the respective Zonal Office 01 CPCB and the SPCB. The criteria pollutant levels namely; SPM, RSPM, S02. NOx (ambient levels as well as stack emissions] or critical sectoral parameters, indicated for the project shall be monitored and displayed at a convenient location near the main gate of the company in the pu blic domain.

17. The project proponent shall also submit six monthly reports on the status of compliance of the stipulated EC conditions including results of monitored data (both in hard copies as well as bye-mail) to the respective Regional Office of MoEF', the respective Zonal Office of epCB and the SPCS.

18. Reference: Your Lr.No.KPTM/PJ/03/RWHdt. 8.10.2009 Sir, With refernce to the letter cited above, the undersgined along with Sri G. Sudahrshan, Scientist-D have visited the proposed proejct area at the above siad villages on 23.11.2009 and studied the condition at the site to assess the recommenations mentioned in the reprot prepared by Mis. Global Consultants, Hyderabad, which was submitted by the project authorites on faesibilityof rainwater harvesting.

Considering the hydrogeological conditions, topography, thickness of the phreatic aquifer, the rain water harvesting technology suggested in the report to collect the rain water in two storage ponds within the premises and to utilize the collectedrain water for green belt developmnt, dust sprinklers, washing purposes etc. is found to be appropriate. The phreatic aquifer is restricted to 6 to 7 m bgl and the depth to water levels are shallow (1 to 2 m bgl). There is no necessity of ground water recharge as of now as the water levels are very shallow and there as there is no proposI for withdrawal of ground water in the plant area. The fresh water aquifer is thin and highly permeable and is located in a fragile enviornment. Any proposal of withdrawal in future needs careful planning and it should be taken up in consultation with CGWB.

The stiupulation made in the Environemntal Clearance Lr.No.J- 13011/1/2009-IAII(f) Ministry of Environemnt and Forests are to be striclty followed in order to protect the ground water resources including the monitoring of ground water levels and quality of ground water by establishing 5 piezometer wells in the premises, so as to ensure that the ground water quality is not adverselyaffected due to the project.
