With some sadness, I also include the obituaries of four well-known Muslim scholars. The first article is my own, entitled ‘Peace in the Islamic Tradition: One Vision, Multiple Pathways’. A comprehensive overview of how peace, jihad and conflict resolution are understood by the Islamic tradition, I conclude that: 1) Islam’s core principles emphasise peace and Muslims must return to them while considering broader objectives and eschewing literalism; 2) Muslim countries must prioritise good governance, social justice and the rule of law as the bedrocks of peace; 3) peaceful interpretations of jihad must rise to the fore; and 4) major international actors must consider how their actions impact upon the peace and security of weaker Muslim countries. Our second article, entitled ‘Towards Authentic Behaviour Management Models for Islamic Schools – A Framework Synthesising Research’, is by Dylan Chown and Omaira Alam, both of Razi Education. Concerned with the effectiveness and Islamic authenticity of the Behaviour Management Models (BMMs) currently being employed in Islamic schools, the authors suggest a seven-point framework for the assessment and improvement of these BMMs. This framework includes: consideration of an effective Islamic pedagogy within the context of an Islamic worldview; an emphasis on Islamic etiquette (adab); a teacher-modelled, student-directed approach set within a ‘whole community’ perspective; character education; and an interventionist approach capable of fostering transformative experiences in students. For our third article, K. M. Zakir Hossain Shalin, of the International Islamic University Malaysia (IIUM), presents us with ‘Juristic Views on Ribā, Gharar and Qimār in Life Insurance’. Zakir’s thought-provoking discussion engages with a longstanding debate amongst Islamic scholars: does conventional life insurance include the prohibited practices of usury (ribā), risk/speculation (gharar) and gambling (qimār)? Although Zakir concludes that it does not, to make this clearer to the scholarly community at large he recommends that: 1) life insurance be explicitly redefined as ‘securing financial assistance’, not ‘financial gain’; 2) restrictions be placed on the investment of insurance premiums so that insurance operators do not engage in prohibited activities; 3) surplus premiums be repaid to premium holders; and 4) bilateral life insurance contracts be discontinued in order to redefine insurance operators as managers of the insurance process. ICR 7.2 Produced and distributed by IAIS Malaysia 154 ISLAM AND CIVILISATIONAL RENEWAL Our fourth article, ‘The Maqasid of Zakah and Awqaf and their Roles in Inclusive Finance,’ is by IAIS Research Fellow, Tawfique al-Mubarak. In it, Tawfique examines the nature and effectiveness of inclusive finance – that is, financial assistance rendered to ‘unbankable’ members of the public who are usually denied access to more standard finance. Tawfique argues that current inclusive finance programmes have failed to alleviate widespread hardship because they deal in interest; he proposes rectifying this by incorporating the interest-free principles of compulsory alms (zakah) and perpetual charity (awqaf) into the process. While not necessarily at odds, these dual commitments nonetheless provide legal and symbolic resources for activists to advance contending visions for their states and societies. Using the case study of Malaysia, Constituting Religion examines how these legal arrangements enable litigation and feed the construction of a “rights-versus-rites binary” in law, politics, and the popular imagination. By drawing on extensive primary source material and tracing controversial cases from the court of law to the court of public opinion, this study theorizes the “judicialization of religion” and examines the radiating effects of courts on popular legal and religious consciousness. The book docu- ments how legal institutions catalyze ideological struggles that stand to redefine the nation and its politics. The Holy Prophet himself was a successful trader. In Islam, particularly the Arab countries, they refer the entity carrying out the businesses and commercials as ‘syirkah’ vis-à-vis corporation or company under Western concept. Whilst the Western distinguishes company from partnership, syirkah in Islam refer to both company and partnership. Nevertheless, the different types of these syirkah are reflected in the diversity of their categories, which comprised of al-‘inan, al-abdan, mudharabah, wujuh and mudharabah. The essential part of a syirkah is that it is contract- based, where individuals came together and entered into a contract with an agreement to distribute the profits amongst themselves. Individuals are the backbone of a syirkah in Islam. Whereas, a company in the conventional system focuses on the concept of body corporate rather than natural human being, i.e. individuals. In this modern world, the applications of the notion ‘body corporate’ are also integrated into some of Islamic institutions including those that were established in Malaysia.

    Ahmad Ibrahim Born: 15 Mei 1916, Singapura Education: Ahmad was educated in Victoria Bridge School (now Victoria School), Raffles Institution, and Raffles College (now the National University of Singapore). In 1936, he received the Queen's Scholarship (now known as the President's Scholarship) to study in St John's College, University of Cambridge. He graduated in 1939 with 1st Class Economics Tripos I and 1st Class Law Tripos II, then attained the Masters in Law in 1965. He was awarded the Honorary Degree of Doctor of Laws (LL.D) from the University of Singapore on 5 June 1965. Workspace: 1946: Appointed magistrate in Singapore. 16 Sep 1946: Admitted to the Bar in Singapore. 1947: Appointed district judge. 1948: Leaves civil service and becomes a law lecturer at Raffles College. 1949–55: In private practice and serves as municipal commissioner, also a member of the Rural Board and legislative council. 1955: Returns to civil service and appointed district judge. 1956: Made crown counsel and deputy public prosecutor. May 1957: Promoted to senior crown counsel. 1959–1965: Singapore’s first state advocate general. 1965–1967: The Republic of Singapore’s first attorney-general. 1966: Parliament passes the Administration of Muslim Law Bill drafted by Ahmad. In absolute THE HONOURABLE THE terms, this is an average per year of approximately 251,000 criminal cases, 79,000 civil CHIEF JUSTICE cases, 18,000 matrimonial cases and 36,000 small claims. In these uncertain times and with our nation facing unprecedented challenges ahead, the Subordinate Courts must remain a firm anchor in the administration of justice. This is crucial for our nation’s continued stability and progress. Over the last 13 years, the Subordinate Courts have initiated fundamental judicial and administrative reforms which have enhanced public trust and confidence in the judicial system, protected public interests and ensured public access to justice. The Subordinate Courts have begun the process of institutionalising their best practices and entrenching their core values so as to ensure the sustainability of our judicial system in the long term, and to be a firm anchor in troubled and uncertain times. The Subordinate Courts must continue to be a first class judiciary, no matter how the external environment changes. Our judges and officers must continue to be of the highest calibre. We must continue to strive towards individual and organisational excellence.
