The Holy Prophet himself was a successful trader. In Islam, particularly the Arab countries, they refer the entity carrying out the businesses and commercials as ‘syirkah’ vis-à-vis corporation or company under Western concept. Whilst the Western distinguishes company from partnership, syirkah in Islam refer to both company and partnership. Nevertheless, the different types of these syirkah are reflected in the diversity of their categories, which comprised of al-‘inan, al-abdan, mudharabah, wujuh and mudharabah. The essential part of a syirkah is that it is contract- based, where individuals came together and entered into a contract with an agreement to distribute the profits amongst themselves. Individuals are the backbone of a syirkah in Islam. Whereas, a company in the conventional system focuses on the concept of body corporate rather than natural human being, i.e. individuals. In this modern world, the applications of the notion ‘body corporate’ are also integrated into some of Islamic institutions including those that were established in Malaysia.

    Ahmad Ibrahim Born: 15 Mei 1916, Singapura Education: Ahmad was educated in Victoria Bridge School (now Victoria School), Raffles Institution, and Raffles College (now the National University of Singapore). In 1936, he received the Queen's Scholarship (now known as the President's Scholarship) to study in St John's College, University of Cambridge. He graduated in 1939 with 1st Class Economics Tripos I and 1st Class Law Tripos II, then attained the Masters in Law in 1965. He was awarded the Honorary Degree of Doctor of Laws (LL.D) from the University of Singapore on 5 June 1965. Workspace: 1946: Appointed magistrate in Singapore. 16 Sep 1946: Admitted to the Bar in Singapore. 1947: Appointed district judge. 1948: Leaves civil service and becomes a law lecturer at Raffles College. 1949–55: In private practice and serves as municipal commissioner, also a member of the Rural Board and legislative council. 1955: Returns to civil service and appointed district judge. 1956: Made crown counsel and deputy public prosecutor. In absolute THE HONOURABLE THE terms, this is an average per year of approximately 251,000 criminal cases, 79,000 civil CHIEF JUSTICE cases, 18,000 matrimonial cases and 36,000 small claims. In these uncertain times and with our nation facing unprecedented challenges ahead, the Subordinate Courts must remain a firm anchor in the administration of justice. This is crucial for our nation’s continued stability and progress. Over the last 13 years, the Subordinate Courts have initiated fundamental judicial and administrative reforms which have enhanced public trust and confidence in the judicial system, protected public interests and ensured public access to justice. The Subordinate Courts have begun the process of institutionalising their best practices and entrenching their core values so as to ensure the sustainability of our judicial system in the long term, and to be a firm anchor in troubled and uncertain times.
