Central Asia can be roughly described as the region to the north and the north-west nf the China Wall. The China Wall was built to koopthe namadie peoples -ineloding the Tuikic peoples- out of China. The Wall also roughly corresponded to the frontler of feıtile iand wbere agriculture could be practised. In Centtal Asia the tand was generally not suitable for qriculıure. but could sustain the animal hents of the nomads. The fmt "state" of the Turlcicpeoples was the Empiıe of the Hmıs. for which the apprOximate dates 220 BC-216 AD are given. But whether or not this formatian can be considered a state or empire in the proper sense of the word is not clear. because the Hmıs did not use the written word. Probably this fonnatian was a coofederation of tribes. raiher' than a state. The same can probobly he said for the Göktürks (552-745). though at the end of their primacy they hegan to use writing. The third important poIitical formation of the Turkic peoples was the Uygur State (745-940). By the end of the 8th century. two important developments took place among the Turkic peoples. 1) A great number of them hegan to move west, Lo Transoxania and contiguous regions and 2) they began to . adopt Islam. It seems that the proces of Islamization was a rather loog. -

No. 2, Üsküdar, Istanbul 34662, Turkey; [email protected] or [email protected] Received: 7 November 2018; Accepted: 16 January 2019; Published: 18 January 2019 Abstract: In this article, I examine religion-state relations and religious pluralism in Turkey in terms of recent changes in the religious landscape. I propose that there is a growing trend in the religious sphere that has resulted in a proliferation of religions, sects and spiritual approaches in Turkey. I argue that although the religious market model might not be applicable to the Turkish religious sphere during the republican era until the 2000s due to the restrictions applied by the state’s authoritarian secularist policies, it is compatible with today’s changing society. Different religious groups as well as spiritual movements have used the democratization process of the 2000s in Turkey as an opportunity to proselytize various faiths and understandings of Islam, with both traditional and modernist forms. In this period, new religious movements have also appeared. Thus, the Turkish religious landscape has recently become much more complicated than it was two decades earlier. I plan for this descriptive work firstly to provide an insight into the history of religious pluralism and state policies in Turkey. Secondly, I will discuss the religious policies of the republican period and, thirdly, I will evaluate recent developments such as the increasing number of approaches in the religious sphere within the scope of the religious market model. -

33 Between neo-Ottomanism and NEW PERSPECTIVES ON TURKEY Ottomania: navigating state-led and popular cultural representations of the past Murat Ergin and Yağmur Karakaya Abstract In contemporary Turkey, a growing interest in Ottoman history represents a change in both the official state discourse and popular culture. This nostalgia appropriates, reinterprets, decontextualizes, and juxtaposes formerly distinct symbols, ideas, objects, and histories in unprecedented ways. In this paper, we distinguish between state-led neo-Ottomanism and popular cultural Ottomania, focusing on the ways in which people in Turkey are interpellated by these two different yet interrelated discourses, depending on their social positions. As the boundary between highbrow and popular culture erodes, popular cultural representations come to reinterpret and rehabilitate the Ottoman past while also inventing new insecurities centering on historical “truth.” Utilizing in-depth interviews, we show that individuals juxtapose the popular television series Muhteşem Yüzyıl (The Magnificent Century) with what they deem “proper” history, in the process rendering popular culture a “false” version. We also identify four particular interpretive clusters among the consumers of Ottomania: for some, the Ottoman Empire was the epitome of tolerance, where different groups lived peacefully; for others, the imperial past represents Turkish and/or Islamic identities; and finally, critics see the empire as a burden on contemporary Turkey. Ghias Abstract Defining Shariʿa: The Politics of Islamic Judicial Review by Shoaib A. Ghias Doctor of Philosophy in Jurisprudence and Social Policy University of California, Berkeley Professor Malcolm M. Feeley, Chair Since the Islamic resurgence of the 1970s, many Muslim postcolonial countries have established and empowered constitutional courts to declare laws conflicting with shariʿa as unconstitutional. The central question explored in this dissertation is whether and to what extent constitutional doctrine developed in shariʿa review is contingent on the ruling regime or represents lasting trends in interpretations of shariʿa. Using the case of Pakistan, this dissertation contends that the long-term discursive trends in shariʿa are determined in the religio-political space and only reflected in state law through the interaction of shariʿa politics, regime politics, and judicial politics. The research is based on materials gathered during fieldwork in Pakistan and datasets of Federal Shariat Court and Supreme Court cases and judges. In particular, the dissertation offers a political-institutional framework to study shariʿa review in a British postcolonial court system through exploring the role of professional and scholar judges, the discretion of the chief justice, the system of judicial appointments and tenure, and the political structure of appeal that combine to make courts agents of the political regime. -

2- TRANSFORMATION OF THE OTTOMAN EMPIRE 2.1. Transformation of the Institutions and Laws During the nineteenth century, a fundamental cultural change took place in the Ottoman Empire, in relation to European expansion.96 Especially, in the years between 1683-1798 on the international stage, military defeats and territorial conflicts determined the era, when the imperial Ottoman state was much less successful than before. In those decades, the military balance shifted away from the Ottomans; Ottomans lost their superiority in military technology.97 The collapse of the Ottoman army following its failure to take Vienna (1683), opened a new era in Ottoman relations with Europe. Europe became aware of the weakness of the Ottoman Empire, and took to the offensive. In a century and a half of nearly continuous warfare, the Ottoman lost major territories.98 Then, there seemed some efforts to hinder the decline. The reformers who began to determine political developments after the seventeethseventeenth century, tried to restore the Golden Age of Süleyman I. (1520-1566). The Ottoman administrators first became aware of the superiority of the West after the defeats in Vienna between 1683 and 1699; the Ottoman public officials thereafter increasingly accepted Western superiority in the military field and then, in polical and social areas.99 In this chapter, this process shall be evaluated. The decline of the Ottoman Empire had begun at the end of the seventeenth century, which brought about a skepsis on the traditional system. Ottomans faced the task of deciding which problems could be solved and turned into a linear path towards a better social, political and economical situation in the eighteenth century. -

[email protected]; [email protected] +2347035467292 Abstract Mágùn and rajm Mágùn is a mean area of Nigeria. It is a means of terminating the life of a man suspected to be having ‟ W mágùn is a means of killing he who engages in rajm (stoning to death) has religious connotation particularly in the Old and New Testaments of the Bible as well as in the Tradition of Prophet Muhammad. The fact that the two modes of punishment involve termination of life underscores how serious adultery is. Attempt is therefore made in this paper to consider the two concepts and analyse the differences therein. Historical, descriptive and comparative research methods were adopted for this study. Oral interviews were conducted to elicit response from some traditionalists on issues related to mágùn; while ‟ rajm and mágùn. It was observed that there are elements of injustice in the mode of carrying out the two modes of punishment, while no consensus is reached by scholars on the application of rajm. It was then concluded that serious precaution needs to be taken in such a matter that involves lives of culprits while avenues for committing adultery are blocked as much as possible by those who wish to implement the two modes of punishment rather than carrying out the punishment. Keywords: Mágùn, rajm, adultery, scripture, Sharīcah, or Introduction Adultery (zinā or àgbèrè ) is considered one of the worst and disgraceful sins that shake the traditional and natural family set-up to its root.1 Apart from the physical, emotional, social and psychological consequences this sexual deviance and obnoxious practice constitutes to the society, some sexually transmitted diseases such as gonorrhoea, syphilis and Acquired Immuno Deficiency Syndrome (AIDS) are also attached to it. -
