AN ORDINANCE TO AMEND THE STAMP DUTY ORDINANCE, 1927.

BE IT ENACTED by the High Commissioner for Palestine with the advice of the Advisory Council thereof:—

1. This Ordinance may be cited as the Stamp Duty (Amend- Short title, ment) Ordinance, 1935, and the Stamp Duty Ordinance, 1927, No. 31 of 1927. (hereinafter referred to as the principal Ordinance) the Stamp Duty (Amendment) Ordinance, 1929, the Stamp Duty (Amend- No. 24 of 1929. ment) Ordinance, 1932, and this Ordinance, may together be No. 21 of 1932. cited as the Stamp Duty Ordinances, 1927-1935.

2. Section 26 of the principal Ordinance shall be amended:— Amendment of section 26 of the pricipcil (a) by the deletion of the words "or promissory note" Ordinance, after the words "bill of exchange", and

(b) by the deletion of the words "or note" after the words "if the bill", appearing in sub-section (2) thereof.

3. Section 29 of the principal Ordinance is hereby repealed. Repeal of section 29 of the princi­ pal Ordinance. 4. Section 30 of the principal Ordinance shall be amended Amendment of by the substitution in the place of the words "is presented for se?tl0.n 30 of the payment unstamped" appearing in sub-section (2) thereof, of Ordinance. the words "or promissory note is presented for payment unstamped or insufficiently stamped".

5. Section 36A of the principal Ordinance (as enacted in Amendment of section 8 of the Stamp Duty (Amendment) Ordinance, 1929) section 36A of shall be amended by the deletion of sub-section (1) thereof Ordinance: * and the substitution of the following sub-section in the place thereof:—

"(1) For the purposes of this Ordinance, the expression "conveyance on sale" means an assignment on sale or a bill of sale in respect of any movable property other than stocks or shares."

6. Section 49 of the principal Ordinance shall be amended:— Amendment of section 49 of the principal (a) by the insertion of the figure "(1)" after the figure Ordinance. "49", and 542 THE PALESTINE GAZETTE 27th June, 1935

(b) by the addition of the following' sub-section as sub­ section (2) thereof:—

"(2) The duty on a document chargeable with duty as a marketable security may be denoted by an adhesive stamp."

Amendment of 7. Section 68 of the principal Ordinance shall be amended:— section 68 of the principal Ordinance. (a) by the deletion of the words "but within one month" after the wrords "fourteen days" appearing in paragraph (b) thereof, and

(b) by the deletion of the words "and shall not in any other case be stamped with an impressed stamp".

Amendment of 8. Section 72 of the principal Ordinance shall be amended:— section 72 of the principal Ordinance. (a) by the insertion of the figure "(1)" after the figure "72", and

(b) by the addition of the following sub-section as sub­ section (2) thereof:—

"(2) The duty on a document chargeable with duty as stocks or shares may be denoted by an adhesive stamp."

Amendments to 9. The schedule to the principal Ordinance shall be amended

schedule to oc! ! ab follows:— principal Ordinance. (a) by the addition of the following paragraph as paragraph (4) of the Exemptions to Item 1:—

"(4) Agreement by a member of a co-operative society to comply with the rules of the society and with any marketing agreements made by the society.";

(b) by the insertion after the words "A bill" appearing in paragraph (8) of the Exemptions to Item 6 of the expression "(except a cheque)";

(e) by the addition of the following words at the end of Item 12A:—

"In any other case - 500 mils";

(d) by the addition of the following wrords at the end of paragraph (a) of Item 21:—

;"LP/1.000 mils ־ - - In any other case"

(e) by the insertion of the expression "22A" before the words "Scrip certificates, Scrip or other document" in Item 22;

by the deletion of Item 26 and the substitution therefor (־/) of the following item:—

(1) Being the only or principal security for the payment of money:—

Where any further money is added to the money already secured.

The same duty as a principal security for such further money.

(4) Release, discharge or surrender of any such security as aforesaid, or of the benefit thereof, or of the money thereby secured:— For every LP.100 and also for every fractional part of LP.100 of the total amount or value of ־ - the money at any time secured 020

• (5) Bond given pursuant to the directions of any Ordinance or of ihe Commissioners or the Director of Customs, or any of their oificers, for or in respect of any of the duties of excise or customs, or for preventing frauds or evasions thereof, or for any other matter or thing relating thereto. Where the penalty of the bond does not exceed LP.1^0.

Exemption.

(1) Bond given by a public officer for the due execution of his duty.

(2) Bond given by or on account of a registered co-operative agricultural society or a registered co-operative credit society, or by the Treasurer or other officer thereof in accordance with the rules of the society.

(3) Bond given by any person where the estate to be ad• ministered does not exceed LP.100 in value.

(4) Bonds or deeds securing loans executed by a member of a co-operative society in favour of the co-operative society.

(5) Mortgage deeds or charges executed by members in favour of a co-operative society or by a co-operative society in favour of a bank or other financial institution or assignments of such deeds.

(6) Bond given by any person under section 20 of the Trial Upon Information Ordinance, 1924.

(7) Indemnity and guarantee bond given by a consignee of goods to the Palestine Railways where delivery of the goods is made without production of the policy in respect thereof.";

(g) by the addition of the following paragraphs as para• graphs (3) and (4) of the Exemptions to Item 31:—

"(3) Power of attorney to receive on his behalf the salary or allowances of an official of the Government of Palestine.

(4) A written authority produced by a clearing agent under section 8 of the Customs House Agents Or• dinances, 1925-1928.

(k) by the addition of the following paragraph as paragraph (16) of the Exemptions to Item 33:—

"(16) Receipt given by the recipient of relief to the Government of Palestine or to a charitable or religious institution in respect of any monies paid as charity.";

(0 by:- (i) the deletion of the words "Section 28 of the Com• panies Ordinance, 1921" and the substitution thereof of the words :— "Section 36 of the Companies Ordinance, 1929", and

(ii) the deletion of the words "Section 38 of the Com• panies Ordinance, 1921" and the substitution therefor of the words : —

"Section 62 (3) of the Companies Ordinance, 1929", and

(hi) the deletion of the words "Section 59 (l)'(c) of the Companies Ordinance, 1921" and the substitution therefor of the words :— "Section 92 (1) (c) of the Companies Ordinance, 1929", appearing in Item 34. *27th June, 1935 THE PALESTINE GAZETTE 545

(J) by the addition of the following exemption to item 37 :—

"Tickets issued for any theatrical or musical entertain• ment by any institution or society certified by the Director of Education:—

(a) to be cultural and educational, and

(b) to have as its main object a purpose other than the realization of pecuniary profit".

OBJECTS AND REASONS.

This Ordinance makes certain amendments to the Stamp Duty Ordinance, 1927, which experience has shown to be necessary.

2. Section 2 of this Ordinance amends section 26 of the principal Ordinance by deleting the words "or promissory note"/and the words "or note" appearing in sub-section (2) thereof in order to make it clear that promissory notes are chargeable with ad valorem duty.

3. Section 29 has been deleted in order to admit the stamping of a promissory note oi bill of exchange with an impressed stamp after execution and section 30 (2) has been amended so as to include promissory notes.

4. Section 36A (1) has been deleted and a new definition of "conveyance on sale" has been inserted in the place thereof, embodying substantially section

30 (1) (b}.

5. New sub-sections have been added to sections 49 and 72 of the principal Ordinance in order to enable the Treasury to issue adhesive stamps to be affixed to marketable securities and stocks and shares when such securities, stocks or shares are not in Palestine. !

6. If a receipt is issued without being stamped, it may not after thirty days be stamped at all. Section 68 (b) has therefore been amended by the deletion of the words "but within one month". This will enable receipts to be stamped at any time on payment of a penalty of LP.10. The latter part of section 68 (b) reading "and shall uot in any other case be stamped with an impressed stamp" has also been deleted.

7. The amendments to the schedule provide for the extension of exemptions to co-operative societies and Clearing House Agents, etc., and for specific duties in cases in which no duty was stated; an addition has also been made to the schedule to provide for thev extension of exemption from stamp duty to tickets issued for theatrical or musical entertainments by certain societies and institutions.

AN ORDINANCE TO AMEND THE FIREARMS ORDINANCE, 1922.

BE IT ENACTED by the High Commissioner for Palestine, with the advice of the Advisory Council thereof: —

Short Title. l. This Ordinance may be cited as the Firearms (Amendment) Ordinance, 1935, and the Firearms Ordinance, 1922, (hereinafter referred to as the principal Ordinance), the Firearms (Amend• ment) Ordinance, 1926, the Firearms (Amendment) •Ordinance, 1933, and this Ordinal ce may together be cited as the Firearms Ordinances, 1922-1935.

Insertion of new 2. The principal Ordinance shall be amended by the insertion,,

section in the after section 20 thereof, of the following section which shall BrKnce. be numbered section 20A:—

"20A.—(1) Notwithstanding anything in this Ordinance contained, a smooth bore shot gun may be imported or exported through parcel post at the Post Offices of Haifa, J alia, Jerusalem and Tel Aviv respectively, provided that the consignee or consignor produces to the officer in charge of the parcel post a valid licence in respect of such shot gun.

(2) Where a shot gun is exported under the provisions of sub-section (1) hereof, the licence issued in respect of such gun shall be retained by the officer in charge of the parcel post and forwarded by him to the officer issuing such licence for cancellation:

Provided that if a shot gun is exported for temporary purposes only the consignor shall so inform the officer in charge of the parcel post and the licence in respect thereof shall not be so cancelled. Should such shot gun be reimported during the validity of the licence the production of the latter to the officer in charge of the parcel post shall be sufficient to secure the delivery of the firearm.

OBJECTS AND REASONS.

This Ordinance inserts a new section in the principal Ordinance, whereunder it will be possible to import or export from Palestine through the parcel post smooth bore shot guns in respect ot which valid licences are held.

AN ORDINANCE FURTHER TO AMEND THE PORTS ORDINANCE, 1926.

BE IT ENACTED by the High Commissioner for Palestine with the advice of the Advisory Council thereof :— 1. This Ordinance may be cited as the Ports (Amendment) Short title. Ordinance, 1935.

2. In this Ordinance, the term "principal Ordinance" shall Interpretation, mean the Ports Ordinance, 1926.

3. Section 8 of the principal Ordinance shall be amended by Amendment of the substitution in the place of sub-section (2) thereof of the se?TL0.N J OF THE following sub-section, that is to say :— Ordinance.

Executive Council may make־The High Commissioner-in (2)" rules :—

(a) regulating, prohibiting or restricting the issue by the Officer in charge of the Port of any licence under sub-section (1) hereof and the transfer or renewal of any such licence and the conditions subject to which any such licence may be issued, transferred or renewed, and

(b) providing for the marking of any vessel licensed under sub-section (1)| hereof with the number of passengers and weight and quantity of goods which such vessel is licensed to carry."

4. Section 13 of the principal Ordinance shall be deleted and Substitution of the following section shall be substituted in the place thereof:— new section in place of section 13 of the principal 13. Provided that if any prosecution tounded upon the facts as a result of which the Director has suspended any licence hereunder is subsequently brought against such person and such prosecu­ tion fails:—

(a) no action shall lie against the Govern­ ment of Palestine and no civil or criminal liability shall be incurred by the Director in respect of such suspension, but (b) if the acquittal be prior to the date of the determination of the period of suspen­ sion, such period shall determine forthwith upon acquittal". 27th June, 1935 THE PALESTINE GAZETTE 540
