1. INTRODUCTION

This statute has been created pursuant to the Education Act 1989.

2. PURPOSE AND APPLICATION

2.1. Statute Purpose

The purpose of this statute is to ensure the safe and appropriate use and parking of vehicles within Unitec premises.

2.2. Statute Application

1) Subject to any provision of this statute to the contrary, this statute shall apply to all persons driving or otherwise using or parking a motor car, truck, motorcycle or other vehicle of any description on Unitec premises.

3. OPERATIVE PROVISIONS

3.1. Vehicle Use and Safety

1) All persons to whom this statute applies must drive and park their vehicle in a safe and considerate way, and abide by the requirements of this statute. 2) No person shall drive or park on Unitec premises in a manner that contravenes any provision of the . More specifically, but without limiting the generality of the preceding provisions, no person shall; a) drive a vehicle dangerously, carelessly or inconsiderately on Unitec premises, or b) park on Unitec premises in a manner that impedes access to or egress from an area by other vehicles, or otherwise park in a manner that is not safe. 3) All persons shall at all times comply with markings and signs as may be displayed within Unitec premises. For the avoidance of doubt, any traffic markings or signs used that are the same as markings or signs used in the New Zealand Road Code shall have the same meaning on Unitec premises as they do in any other public place. 4) Drivers of vehicles shall comply at all times with directions, including directions as to driving, slowing down, stopping, parking, moving on, or removing vehicles, as may be given or notified by a member of Unitec’s Security staff. 5) The maximum on Unitec premises shall be 40 kilometres per hour. No person shall at any time drive a vehicle on Unitec premises at a speed in excess of 40 kilometres per hour. Where a speed less than 40 kilometres an hour is indicated for a particular area on Unitec premises, no person shall drive at a speed in excess of that indicated for that area. At no time shall any person drive on Unitec premises at a speed or in a manner that might prejudice the safety of other drivers or pedestrians. 6) When requested by a member of Unitec’s Security staff, drivers or vehicle owners on Unitec premises shall provide full and accurate details of his/her name and/or address to such staff member.

Vehicle Use, Safety and Parking Statute Statute Date: 15 April 2013 7) The New Zealand Road Code prohibits the use of hand-held mobile phones while driving. All drivers of Unitec vehicles must comply with these road rules. This also applies to all drivers using roads within the Mt Albert campus. 8) The New Zealand Road Code does allow for the use of hands-free mobile phones when used with an approved hands-free car kit or hands-free earpiece. It is legal to use a mobile phone to make, receive or end a call when driving if: a) the driver does not have to hold or manipulate the phone to do so (i.e. phone is completely voice activated), or b) the mobile phone is securely mounted to the vehicle and the driver manipulates the phone infrequently and briefly. 9) The New Zealand Road Code does not allow drivers to create, send, or read text messages under any circumstances. Although the New Zealand Road Code allows the use of hands-free mobile phones, the NZTA recommends that drivers minimise the potential for distraction by switching phones off while driving, or pulling over to make or receive calls. 10) Staff who specifically require a driver’s license for their job must notify their manager if their licence is suspended or removed.

3.2. Parking

1) Council may, from time to time, determine parking fees. Such fees shall take effect as prescribed in the determination. 2) The Executive Director, Finance and Infrastructure or his or her delegate, a) may issue a reserved parking permit to authorise a staff member or other person to park in car parks or parking spaces designated “reserved”, and b) shall ensure that suitable parking arrangements are made for Unitec owned vehicles that are required to be available for use as pool cars and for the vehicles of disabled persons. 3) Students, staff and visitors to Unitec may park in any designated parking area subject to the restrictions below. 4) No person shall park a vehicle in a car park or parking space designated reserved unless the vehicle displays a valid reserved parking permit. A vehicle displaying a valid reserved parking permit may be parked in parking spaces designated reserved and in other parking spaces not designated for specified use. 5) Students shall not park vehicles in car parks or parking spaces that are designated as reserved parking, staff parking or that are otherwise designated for specified use. 6) Staff shall not park vehicles in any car parks or parking spaces that are designated as reserved parking or that are otherwise designated for specified use. At all times when parking in areas designated as a staff parking facility, staff must display, in the vicinity of the front window on the left hand side above the registration label of the vehicle, a valid staff parking permit issued under the authority of the Executive Director, Finance and Infrastructure or his or her delegate. 7) Visitors shall not park in any car parks or parking spaces that are designated as reserved parking, staff parking, or that are otherwise designated for specified use other than as parking for visitors. Except where a visitor has registered his or her vehicle with the appropriate reception desk, a visitor may not park his or her vehicle in a car park designated for visitor parking for more than one hour. 8) All vehicles parking in the Pay and Display parking areas must display a valid parking voucher obtained either from the pay and display meters located within the parking areas or a pre-paid semester voucher obtained from Unitec Security located in Building 16. Vehicle Use, Safety and Parking Statute Statute Date: 15 April 2013 only exception within Pay and Display carparks are authorised vehicles parked in designated parking spaces. Staff parking permits are not valid parking vouchers within Pay and Display parking areas and staff parking in these areas without a valid parking voucher will be deemed to contravene the provisions of this statute. 9) Vehicles displaying a valid “Operation Mobility” permit may be parked in any authorised parking space on Unitec premises, except for parking spaces that are reserved or otherwise designated (other than for disability parking), and shall not be required to display a Unitec parking permit. 10) Students or staff suffering a temporary impairment to their mobility may request a temporary from the Manager, Disability Liaison. No person shall park a vehicle in a parking space designated as parking for disabled persons without displaying in the vehicle an official “Operation Mobility” label issued by the NZCCS or a temporary disabled parking permit issued by the Manager of Disability Liaison. 11) No person may park, stand or stop a vehicle: a) in any area designated “No Parking”, “No Standing”, “Keep Clear”, or “No Stopping” respectively, b) on any footpath, road kerb, garden or verge, c) on any grass area unless parking is specifically authorised in that area, d) in any area where restrictions are indicated by cross-hatching, continuous or broken yellow painted lines, e) in such a way as to impede access to emergency exits or any other access way, f) in such a way as to impede access to walkways and ramps, g) in such a way as to obstruct pedestrian crossings, footpaths and disabled persons access ways, h) in such a way as to damage grassed areas, i) in such a way as to impede access by a lawn mowing contractor to grassed areas, j) in such a way as to restrict visibility at road intersections and junctions, k) in such a way as to restrict traffic flow (e.g. by ), or l) in any other way that contravenes the New Zealand Road Code.

12) No person may leave a vehicle parked in the same parking area or parking space for more than 48 hours continuously, without prior permission from the Executive Director, Finance and Infrastructure or his or her delegate. 13) No person may sleep overnight in a vehicle on Unitec premises. 14) All persons park their vehicles on Unitec premises at their own risk. Unitec shall not be responsible or liable for any damage or loss that may be caused to any vehicle on Unitec premises.

3.3. Contractors Vehicles

1) Subject to Section 3.3 (4) below, Contractor/Service Vehicles must be parked in accordance with the provisions outlined in Section 3.2 above and be displaying a contact name and number while on campus. 2) Service Vehicle parking and access ways are to be used as the primary places for deliveries while performing their service.

Vehicle Use, Safety and Parking Statute Statute Date: 15 April 2013 3) Contractor/Service Vehicles that need temporary access to land-locked buildings can drive on designated sidewalks and park in area with the proviso that no emergency exits are blocked, there is a pedestrian walkway/access and that a contact name and number are clearly displayed. 4) Any Contractor/Service Vehicles within a project boundary fence are not subject to the provisions outlined in Section 3.2.

3.4. Failure to Comply with this Statute

1) Subject to the provisions of this statute, any vehicle that is parked or driven in a manner that contravenes the provisions of this statute may be towed, wheel clamped or otherwise removed from the place in which it is parked at the direction of the Security Manager or a Security staff member authorised by the Security Manager. 2) Vehicles towed or removed pursuant to section 3.4 (1) will be held at such place on such conditions as prescribed in Schedule 1 to this statute. A person may recover the vehicle towed from or within Unitec premises on production of satisfactory proof of entitlement to possession and upon payment of the charges prescribed in Schedule 1 to this statute. Security shall release wheel clamped vehicles upon receipt of the fee prescribed in Schedule 1. 3) Any person who attempts, without authorisation of Security, to remove a from any vehicle shall be liable to pay to Unitec a fine equal to: a) the release fee prescribed in Schedule 1; and b) any costs resulting from damage to the wheel clamp, and if Unitec is unable to recover these amounts from that person, the driver and registered owner shall become jointly and severally liable for these payments.

4) In circumstances involving abusive or threatening behaviour by the owner or driver of the towed vehicle, the Security Manager or a Security staff member authorised by the Security Manager as the case may be, may direct that the vehicle shall be towed to a compound operated by an authorised towing company. 5) Where any person contravenes any provision of this statute or fails to make any payment imposed by this statute, the Security Manager or his or her delegate may: a) issue a , and/or b) direct that person not to drive a vehicle within Unitec premises, for a period not exceeding 12 months; and/or c) ban the vehicle driven by that person from all or any Unitec premises, for a period not exceeding 12 months; and/or d) direct any vehicle that has been so banned to be wheel clamped, towed or otherwise removed pursuant to 3.4 (1) of this statute.

6) Any person may appeal any decision made by the Security Manager or his or her delegate pursuant to this section. Any such appeal shall be made in writing to the Executive Director, Finance and Infrastructure within seven days from the date on which the person is notified of the decision of the Security Manager or his or her delegate. The decision of the Executive Director, Finance and Infrastructure in relation to the appeal shall be final.

3.5. Miscellaneous Provisions

SCHEDULE 1. TOWING AND WHEEL CLAMPING PROCEDURES AND COSTS 1) Except as otherwise provided in this statute, vehicles will be towed to the Unitec compound located behind Building 16 by the authorised towing company. 2) The charge for towing within Unitec premises is $50.00 and shall be paid through the Security office, Building 16. 3) Where the vehicle is towed to the premises of an authorised towing company, the recovery fee to be paid shall be any towing fee charged by the towing company and the Unitec $50.00 towing fee. 4) Where the vehicle is towed to the authorised towing company compound the vehicle may be recovered from that company’s premises. 5) Any complaints regarding the towing company may be directed to:
