INTRODUCTION This statute has been created pursuant to the Education Act 1989. 2. PURPOSE AND APPLICATION 2.1. Statute Purpose The purpose of this statute is to ensure the safe and appropriate use and parking of vehicles within Unitec premises. 2.2. Statute Application 1) Subject to any provision of this statute to the contrary, this statute shall apply to all persons driving or otherwise using or parking a motor car, truck, motorcycle or other vehicle of any description on Unitec premises. 3. OPERATIVE PROVISIONS 3.1. Vehicle Use and Safety 1) All persons to whom this statute applies must drive and park their vehicle in a safe and considerate way, and abide by the requirements of this statute. 2) No person shall drive or park on Unitec premises in a manner that contravenes any provision of the New Zealand Road Code. More specifically, but without limiting the generality of the preceding provisions, no person shall; a) drive a vehicle dangerously, carelessly or inconsiderately on Unitec premises, or b) park on Unitec premises in a manner that impedes access to or egress from an area by other vehicles, or otherwise park in a manner that is not safe. 3) All persons shall at all times comply with traffic markings and signs as may be displayed within Unitec premises. For the avoidance of doubt, any traffic markings or signs used that are the same as markings or signs used in the New Zealand Road Code shall have the same meaning on Unitec premises as they do in any other public place. 4) Drivers of vehicles shall comply at all times with directions, including directions as to driving, slowing down, stopping, parking, moving on, or removing vehicles, as may be given or notified by a member of Unitec’s Security staff. 5) The maximum speed limit on Unitec premises shall be 40 kilometres per hour. No person shall at any time drive a vehicle on Unitec premises at a speed in excess of 40 kilometres per hour. Where a speed less than 40 kilometres an hour is indicated for a particular area on Unitec premises, no person shall drive at a speed in excess of that indicated for that area. At no time shall any person drive on Unitec premises at a speed or in a manner that might prejudice the safety of other drivers or pedestrians. 6) When requested by a member of Unitec’s Security staff, drivers or vehicle owners on Unitec premises shall provide full and accurate details of his/her name and/or address to such staff member. © Unitec Doc Owner: Director, Facilities Management Version: 3.2 Page 2 of 7 Hardcopies of this document are considered copies of the original. Vehicle Use, Safety and Parking Statute Statute Date: 15 April 2013 7) The New Zealand Road Code prohibits the use of hand-held mobile phones while driving. All drivers of Unitec vehicles must comply with these road rules. This also applies to all drivers using roads within the Mt Albert campus. 8) The New Zealand Road Code does allow for the use of hands-free mobile phones when used with an approved hands-free car kit or hands-free earpiece. It is legal to use a mobile phone to make, receive or end a call when driving if: a) the driver does not have to hold or manipulate the phone to do so (i.e. phone is completely voice activated), or b) the mobile phone is securely mounted to the vehicle and the driver manipulates the phone infrequently and briefly. 9) The New Zealand Road Code does not allow drivers to create, send, or read text messages under any circumstances. Although the New Zealand Road Code allows the use of hands-free mobile phones, the NZTA recommends that drivers minimise the potential for distraction by switching phones off while driving, or pulling over to make or receive calls. 10) Staff who specifically require a driver’s license for their job must notify their manager if their licence is suspended or removed. 3.2. Parking 1) Council may, from time to time, determine parking fees. Such fees shall take effect as prescribed in the determination. 2) The Executive Director, Finance and Infrastructure or his or her delegate, a) may issue a reserved parking permit to authorise a staff member or other person to park in car parks or parking spaces designated “reserved”, and b) shall ensure that suitable parking arrangements are made for Unitec owned vehicles that are required to be available for use as pool cars and for the vehicles of disabled persons. 3) Students, staff and visitors to Unitec may park in any designated parking area subject to the restrictions below. 4) No person shall park a vehicle in a car park or parking space designated reserved unless the vehicle displays a valid reserved parking permit. A vehicle displaying a valid reserved parking permit may be parked in parking spaces designated reserved and in other parking spaces not designated for specified use. 5) Students shall not park vehicles in car parks or parking spaces that are designated as reserved parking, staff parking or that are otherwise designated for specified use. 6) Staff shall not park vehicles in any car parks or parking spaces that are designated as reserved parking or that are otherwise designated for specified use. At all times when parking in areas designated as a staff parking facility, staff must display, in the vicinity of the front window on the left hand side above the registration label of the vehicle, a valid staff parking permit issued under the authority of the Executive Director, Finance and Infrastructure or his or her delegate. 7) Visitors shall not park in any car parks or parking spaces that are designated as reserved parking, staff parking, or that are otherwise designated for specified use other than as parking for visitors. Except where a visitor has registered his or her vehicle with the appropriate reception desk, a visitor may not park his or her vehicle in a car park designated for visitor parking for more than one hour. 8) All vehicles parking in the Pay and Display parking areas must display a valid parking voucher obtained either from the pay and display meters located within the parking areas or a pre-paid semester voucher obtained from Unitec Security located in Building 16. Vehicle Use, Safety and Parking Statute Statute Date: 15 April 2013 only exception within Pay and Display carparks are authorised vehicles parked in designated parking spaces. Staff parking permits are not valid parking vouchers within Pay and Display parking areas and staff parking in these areas without a valid parking voucher will be deemed to contravene the provisions of this statute. 9) Vehicles displaying a valid “Operation Mobility” permit may be parked in any authorised parking space on Unitec premises, except for parking spaces that are reserved or otherwise designated (other than for disability parking), and shall
