This third instalment in the series, which began in 2015, is even more impressive than its predecessors. Our gratitude to Tim for such an in-depth analysis that draws on his experience of research, policy and practice and contributes considerably to our knowledge and understanding of the youth justice system in England and Wales. Two developments this year are so significant that they impact on our understandings of the state of the youth justice system and its wider societal context. The first is the global pandemic of the Covid-19 virus, the second is the heightened prominence of the Black Lives Matter movement in social and political discourse. As noted in the report itself (Chapters 1 and 8 in particular), many of the findings relate to the experiences of children prior to the advent of the Covid-19 pandemic. Whilst it is too early to assess the full implications for children in prison, a number of consequences are already clear. In particular, changes to regimes to accommodate social distancing have already had disturbing consequences. In two of three Young Offenders Institutions (YOIs) inspected, it was confirmed that children’s educational activities were limited to worksheets in their cells; the third establishment was able to provide just two hours face-to-face education on school days.

The Howard League welcomes the opportunity to provide evidence to the Independent Review of Criminal Legal Aid’s Call for Evidence. This submission is focused on our legal expertise which includes prison law and criminal appeal work for children and young adults. 2. The prison population is projected to increase significantly over the next five years. People in prison are extremely vulnerable to abuses of power and few can afford to pay for representation: publicly funded legal advice and representation act as essential safeguards. 3. The current rigid system of fixed and standard fees encourages unsustainable working practices at the expense of quality and practitioner wellbeing. It has led to a dramatic fall in the number of firms willing to do prison law and fresh appeal work. 4. The very low levels of legal aid funding for fresh criminal appeals further undermine fairness and trust in the criminal justice system. The recent Post Office cases illustrate that the remedial power of the Court of Appeal to correct injustice is as essential as ever. As more people receive custodial sentences, it is essential that they are supported to challenge excessive sentences and miscarriages of justice. 5. The current criminal legal aid system does not meet the needs of people in prison, victims, or the public. The Government should ensure that professionals and people in prison are working towards rehabilitation from day one by bringing sentence planning and access to Offending Behaviour Courses back into the scope of legal aid.

    Ministry of Justice Main Estimate 2021-22: Estimates Memorandum 1 Overview 1.1 Objectives At the time of publication of this document the Ministry of Justice (MoJ), like other departments, has not yet published its Outcome Delivery Plan for 2021-22. The department’s current objectives are as follows: Objectives (system outcomes): 1. Reform sentencing and probation to protect the public from harm; 2. Transform the prison estate so it is decent, safe and has the right capacity; 3. Reduce re-offending to turn people’s lives around for good; 4. Provide access to justice that best meets people’s needs today; 5. Create a modern, transparent and efficient court system; and 6. Foster a flourishing legal services sector that contributes to the economy. The highest priority for the department continues to be rising to the challenges the pandemic presents the justice system and maintaining focus on the recovery of our frontline services. MoJ’s spending is designed to support its delivery of these objectives and the detail of how we do that is provided at Section 3.1. 1.2 Spending controls Departmental spending is managed according to spending control totals, for which Parliament’s approval is sought. The spending control totals that Parliament votes are: • Resource Departmental Expenditure Limit (Resource DEL): the cost of running the department and delivering its programmes; • Capital Departmental Expenditure Limit (Capital DEL): investment in infrastructure, including net expenditure on capital assets; and • Resource Annually Managed Expenditure (Resource AME): less predictable day to day spending, which for MoJ mainly comprises impairments of assets to represent true and fair value and movements in provisions.

    CONCORDAT BETWEEN THE WELSH GOVERNMENT AND THE UK MINISTRY OF JUSTICE Introduction 1. This Concordat sets out arrangements for consultation and co-operation between the Welsh Government and the UK Ministry of Justice, covering exchanges of information (including the terms on which information is shared), justice impacts, access to services, resolution of disputes and review of relations.1 Among other things, it seeks to ensure that: the Ministry of Justice considers the interests and responsibilities of the Welsh Government when designing and implementing UK justice policy and activities likely to have an impact in Wales; the Welsh Government considers the interests and responsibilities of the Ministry of Justice when exercising devolved functions; and there is clarity and accountability, enabling productive working relationships and improved outcomes. 2. This Concordat is non-statutory and is not legally binding. It is a working document of guidance which clarifies the working relationship and provides the Welsh Government and Ministry of Justice with a set of principles by which both parties jointly agree to abide. 3. The Wales Office is responsible for oversight of the Welsh devolution settlement and ensuring UK Government policy works effectively in Wales and has a key responsibility for promoting effective working relations between the UK and Welsh Governments. 4. Transform Justice was set up in 2012 by Penelope Justice Gibbs, a former magistrate who had worked for five years to reduce child and youth imprisonment in the UK. The charity will help create a better justice system in the UK, a system which is fairer, more open, more humane and more effective. Transform Justice will enhance the system through promoting change – by generating research and evidence to show how the system works and how it could be improved, and by persuading practitioners and politicians to make those changes. Transform Justice has produced reports on unrepresented defendants, on criminal appeals against sentence, on justice reinvestment and on magistrates and diversity.
