    C A L I F O RN I A L A W RE V I S I O N C O M MI S S I O N S T A F F ME MO RA N DU M Study M-300 April 3, 2008 Memorandum 2008-17 Nonsubstantive Reorganization of Deadly Weapon Statutes: Titles 1-2 of New Part 6 of the Penal Code As directed by the Legislature, the Law Revision Commission is conducting a nonsubstantive study of the statutes relating to control of deadly weapons. The goal of the study is to reorganize the statutes in a manner that makes them more readily comprehensible and accessible, without changing their substantive effect. The Commission’s report is due by July 1, 2009. The Commission is in the process of preparing a tentative recommendation, which will be broadly circulated for comment. The Commission’s current plan is to create a new Part 6 of the Penal Code, which would contain most of the material on deadly weapons currently located in Title 2 of Part 4 of the Penal Code (Penal Code §§ 12000-12809). The sentencing enhancement provisions in Title 2 of Part 4 (Penal Code §§ 12021.5-12022.95) would be left in place, and Title 2 of Part 4 would be relabeled “Sentence Enhancements.” For detail on the structure of new Part 6, see Memorandum 2008-16. Attached for Commissioners and interested persons to review are the following: • A new version of the list of “Minor Clean-up Issues for Possible Future Legislative Attention.” In June 2007, the Commission decided to maintain such a list in conducting this nonsubstantive study.

HE introduction of firearms into the armies of this country goes back a T long way. In 1590 Sir John Smythe, in a book that was promptly suppressed as contrary to public policy, was lamenting that the firearm had superseded the long bow, a far superior weapon, and even complaining that the firearms of that time were inferior to those of his youth. Sir Winston Churchill has written of Crecy that the arrow hail at 250 yards produced effects never reached again by infantry missiles at such a range until the American Civil War. It was not until after Waterloo that the rifle attained as great an effective range and accuracy as the long bow; nor was it until the introduction of the breech-loading rifle a hundred years ago that it could develop as high a rate of fire. For some three hundred years, during which the cumbersome wheel lock and match lock were superseded by the flint lock and there was some development of rifled barrels and of cartridges to facilitate loading, the development of the firearm was slow. But early in the nineteenth century Alexander Forsyth's brilliant concept of the percussion cap led the way in a remarkable revolution that culminated during the latter half of the century in a breech-loading rifle with a small bore and with relatively shallow rifling to reduce the accumulation of powder fouling, a rifle firing a long bullet of high stability, capable of good accuracy and of a high rate of fire.

The same quip applies to this study, for it took me six years to conclude the story of Natal Afrikaners and the Anglo-Boer War. Numerous people and institutions assisted me during this time.     University of Pretoria etd – Wassermann, J M (2005) 29 CHAPTER 2 ADMINISTERING NATAL AFRIKANERS IN THE PERIOD LEADING UP TO THE ANGLO-BOER WAR The reaction of Natal Afrikaners at grassroots level to the ongoing diplomatic conflict taking place between Great Britain and the Transvaal-Orange Free State alliance, needs to be considered against the socio-political and economic backdrop sketched in the previous chapter. It is important to trace how, during the period immediately preceding the Anglo-Boer War, this ethnic minority related to their government, and the policies of the true blue Imperialist, Prime Minister AH Hime, and his cabinet. In this chapter the focus falls on the role, or lack thereof, of the Natal Afrikaner in defending the Colony, and on how the approximately 5 0001 men, women and children reacted to the threats Imperialism and their own government posed to the Republics with which they shared a common history, language and culture. 2.1 The restrictions of arms and ammunition and its implications for Natal Afrikaners When signs of the impending war became more evident midway through 1899, the Natal Government, as a preventative measure, deemed it necessary to exercise tighter control over the selling of firearms and ammunition. This was considered necessary so as to deal with the perceived enemy from within, namely Natal Afrikaners. The first step in implementing these measures was taken when the commandant of volunteers, Colonel W Royston, forwarded a circular to all magistrates, stating: AOwing to a delay in the receipt of the usual supply of ammunition it is advisable to issue to purchasers no more than absolutely necessary.
