Theories abounded about the reasons for the slow and anomalous free agent market. Some saw it as simply a relatively weak group of free agents. Others viewed the 2018 free agent market as representing a more systemic shift in the business and oper- ation of baseball, particularly with the rise of data analytics. Still, others pointed to the increase in the “tanking” phenomenon in MLB as the reason for the change in free agency. While each of these theories provides some explanation for what MLB experienced during the 2018 offseason, these nar- ratives provide only an incomplete picture of the changes that MLB exper- ienced. In particular, they overlook how the competitive balance reforms contained in the latest MLB collective bargaining agreement (CBA) contrib- uted to these changes in the free agent market. In an attempt to create better competitive balance among teams, the MLB CBA may have created a context within which teams are incentivized to move away from established approaches to roster development and payroll. For this reason, they often command large sums of money prior to ever stepping on a major league baseball field, as teams annually pay large bonuses to the most talented players drafted in Major League Baseball’s (“MLB”) amateur draft. Combined, the thirty MLB teams awarded $228,009,050 in signing bonuses to 2011 draftees.1 The most talented individuals—the first-round draftees—received on average $2,653,375 per player in 2011.2 Both numbers set records for spending, as did the $8 million bonus given to the number one overall pick, Gerrit Cole.3 These sums of money are not given for performance but are given simply as an incentive to sign with the team.

She would also like to thank all of her friends and family for their continuing support and guidance. 1 “But in baseball no team can be successful unless its competitors also survive and prosper sufficiently so that the differences in the quality of play among teams is not ‘too great’.” ~ Simon Rottenberg2 Introduction Fifty years ago, in the first article of its kind,3 Simon Rottenberg identified the greatest obstacle facing Major League Baseball (MLB): each club naturally wants to win and be the best, but unlike most businesses, baseball clubs would be adversely affected if they ran their competitors out of business.4 For, it is because of the other clubs, and because of the competition on the field, that there exists any market for the product baseball produces. The thrill of the competition is what draws fans into the stands to “root, root, root for the home team,”5 as the song goes. The phrase “competitive balance” is the one most often thrown around to describe this paradoxical situation, unique to professional sports, where members of the industry must strive both to win and to maintain an even playing field with other members of the industry in order to increase their own revenue.
