Biological Assessment Browns Ferry Nuclear Power Plant License Renewal Review Limestone County, Alabama October 2004 Docket Numbers 50-259, 50-260, and 50-296 U.S. Nuclear Regulatory Commission Rockville, Maryland Biological Assessment of the Potential Effects on Endangered or Threatened Species from the Proposed License Renewal for the Browns Ferry Nuclear Plant 1.0 Introduction The U.S. Nuclear Regulatory Commission (NRC) licenses the operation of domestic nuclear power plants in accordance with the Atomic Energy Act of 1954, as amended, and NRC implementing regulations. The Tennessee Valley Authority (TVA) operates Browns Ferry Nuclear Power Plant, Units 1, 2, and 3 (BFN) pursuant to NRC operating license (OL) numbers DPR-33, DPR-52, DPR-68, which expire on December 20, 2013, June 28, 2014, and July 2, 2016, respectively. TVA has prepared an Environmental Report (ER) (TVA 2003) in conjunction with its application for renewal of the BFN OLs, as provided for by the following NRC regulations: C Title 10 of the Code of Federal Regulations, Part 54, “Requirements for Renewal of Operating Licenses for Nuclear Power Plants,” Section 54.23, Contents of application - environmental information (10 CFR 54.23). C Title 10 of the Code of Federal Regulations, Part 51, “Environmental Protection Regulations for Domestic Licensing and Related Regulatory Functions,” Section 51.53, Postconstruction environmental reports, Subsection 51.53(c), Operating license renewal stage (10 CFR 51.53(c)). The renewed OLs would allow up to 20 additional years of plant operation beyond the current licensed operating term. No major refurbishment or replacement of important systems, structures, or components are expected during the 20-year BFN license renewal term. -

The waterway accommodates barge navigation between the Tennessee River drainage and Mobile River Basin through a series of locks, dams, canals, and dredged and diverted streams. These alterations have destroyed much riverine habitat and fragmented remaining aquatic habitats resulting in isolated freshwater mussel populations in patches of streams like the East Fork Tombigbee River, where 42 species were historically known. The first post-waterway mussel surveys in 1987 and 1988 reported 31 taxa (including 2 federally-listed species). -

SELMANTS, AND CORINNE MOROZUMI Downloaded from Nitrogen (N) pollution is increasingly recognized as a threat to biodiversity. However, our understanding of how N is affecting vulnerable species across taxa and broad spatial scales is limited. We surveyed approximately 1400 species in the continental United States listed as candidate, threatened, or endangered under the US Endangered Species Act (ESA) to assess the extent of recognized N-pollution effects on biodiversity in both terrestrial and aquatic ecosystems. We found 78 federally listed species recognized as affected by N pollution. To illustrate the complexity of tracing N impacts on listed species, we describe an interdisciplinary case study that addressed the threat of N pollution to California Bay http://bioscience.oxfordjournals.org/ Area serpentine grasslands. We demonstrate that N pollution has affected threatened species via multiple pathways and argue that existing legal and policy regulations can be applied to address the biodiversity consequences of N pollution in conjunction with scientific evidence tracing N impact pathways. NASA Stennis Space Center Environmental Resources Document 6.0 Endangered and Threatened Species 6.1 Endangered Species Act The Endangered Species Act of 1973 (16 U.S.C. 1531 et seq.) was enacted "to provide a means whereby the ecosystems upon which endangered species and threatened species depend may be conserved and to provide a program for the conservation of such endangered species and threatened species." The term endangered species applies to "any species that is in danger of extinction throughout all or a significant portion of its range." A threatened species is "any species which is likely to become an endangered species within the foreseeable future throughout all or a significant portion of its range." The Secretary of Interior in conjunction with the Secretary of Commerce makes determination of threatened and endangered species. A species may be designated either threatened or endangered because of any of the following factors: • Current or threatened destruction, modification, or curtailment of its habitat or range • Over utilization of the species for commercial, recreational, scientific, or educational purposes • Disease or predation • Inadequacy of existing regulations • Other natural or manmade factors affecting continued existence of the species Section 7 of the Endangered Species Act requires Federal agencies to ensure that any action authorized, funded, or carried out by the agency "is not likely to jeopardize the continued existence of any endangered species or threatened species or result in the destruction or adverse modification of habitat of such species." The regulations require consultations with United States Fish and Wildlife Service (USFWS) or the National Marine Fisheries Service if any listed species or their habitat may be affected by any agency activity. -

The composition and abundance of mussels are directly linked to bed sediment distributions (Neves and Widlak, 1987; Leff et al., 1990) and physical qualities of the sediments (e.g., texture, particle size) may be important in allowing the mussels to firmly burrow in the substrate (Lewis and Riebel, 1984). In addition, other aspects of substrate composition, including bulk density (mass/volume), porosity (ratio of void space to volume), sediment sorting, and the percentage of fine sediments, may also influence mussel densities (Brim Box, 1999; Brim Box and Mossa, 1999). According to Huehner (1987), water velocity may be a better predictor than substrate for determining where certain mussel species are found in streams. In general, heavy-shelled species occur in stream channels with stronger currents, while thin-shelled species occur in more backwater areas. Stream geomorphic and substrate stability is especially crucial for the maintenance of diverse, viable mussel beds (Vannote and Minshall, 1982; Hartfield, 1993; Di Maio and Corkum, 1995). -
