INTRODUCTION 1.1 Background The past twenty years have seen increased calls for greater local control over biodiversity, for the sharing of benefits derived from its use, and for a say in the way in which decisions are made about its conservation. This stems from a long history of disregard for the social issues and impacts that accompany conservation projects, as well as the inequitable way in which benefits derived from the commercialisation of biodiversity have been shared in the past. Most of the world’s biodiversity is located in the biologically rich countries of the South, yet the bulk of benefits are realised by companies and institutions in the industrialised North. If biodiversity is to be conserved, these inequities must be redressed. It is this principle that underpins the 1992 Convention on Biological Diversity (CBD), agreed at the United Nations Conference on Environment and Development. Implementing this approach requires that local custodians of biological resources and knowledge, as well as other national stakeholders, become involved in developing appropriate policies and laws to control access to genetic resources and to determine conditions for benefit-sharing. Through such participation it is believed that potential or real conflicts will be transformed into mutually beneficial relationships, trust will be built between role-players, awareness will be raised, and through co-ownership of the process of policy and law-making, implementation will be smooth and effective. Ultimately, it is assumed, the involvement of local stakeholders in the design of policies, laws and procedures, will increase their share of benefits derived from bioprospecting3 and other commercial activities. This involvement should provide an opportunity for local stakeholders to better define and negotiate the terms of a wide range of relationships, from which more equitable benefit sharing will flow. 1.2 Purpose of this Project It was on this basis that the International Institute for Environment and Development, an independent non-profit research organisation based in the United Kingdom, designed a project to investigate participation4 in the development of biodiversity policies and laws. Stated objectives were to record, analyse and share 3 Bioprospecting is the search for economically valuable genetic and biochemical resources. 4 ‘Participation’ means involvement in decision-making, as opposed to ‘consultation’, where there is no guarantee that the views gathered will actually influence decision-making. However, participation can also mean involvement in a consultation process. 6 South African case study the experiences of developing countries in securing stakeholder participation in the design of measures to control access to genetic resources and benefit-sharing (‘ABS’), so allowing for bioprospecting to contribute more effectively to the needs of poor people at local level. Through a process of learning from past experiences in consultation, it was hoped that policy and law making would improve, and that methods of best practice would emerge. The project identified four countries as case studies – Peru, the Philippines, India and South Africa – each of which have engaged stakeholders in the development of policy or law on biodiversity, ABS or traditional knowledge. In Peru, the focus was on the consultative process to develop a sui generis regime on Traditional Knowledge; in the Philippines the project centred around the development of Executive Order No. 247, which regulates access to genetic resources; in India, the focus was on the formulation of the Biodiversity Bill and community biodiversity registers. 1.3 Why South Africa? In South Africa, the focus was on the planning and consultation process conducted to develop a

However, crop genetic resources are largely public goods, so private incentives for genetic resource conservation may fall short of achieving public objectives. Within the U.S. germplasm system, certain crop collec- tions lack sufficient diversity to reduce vulnerability to pests and diseases. Many such genetic resources lie outside the United States. This report examines the role of genetic resources, genetic diversity, and efforts to value genetic resources. The report also evaluates economic and institutional fac- tors influencing the flow of genetic resources, including international agree- ments, and their significance for agricultural research and development in the United States. Claudio Chiarolla, Renaud Lapeyre, Romain Pirard (IDDRI) THE REGULATION OF BIOPROSPECTING: WHAT IS IT? AND WHY IS IT IMPORTANT? The need to protect biodiversity and to promote fairness in the use of genetic resources and associated traditional knowledge has engendered one of the most contentious debates of the 21st century between devel- oped and developing countries. This debate has fundamental implications for the way in which basic and applied research on genetic resources and biodiversity is conducted and its results are made available between and within peoples and societies. Therefore, the regulation of bioprospecting –i.e. “the search for plant and animal species from which medicinal drugs and other commercially valuable compounds can be obtained”– not only tells stories about biodiversity conservation, but also about food security, global health, intellectual property, indigenous peoples, equity, justice and human rights. NEW PERSPECTIVES: BIOPROSPECTING CONTRACTS AS MARKET- BASED INSTRUMENTS In a context of financial constraint, MBIs are seen as a potential tool to help foster biodiversity conservation. As private contracts between two (or more) parties (theoretically Coasean agreements), bioprospecting contracts could be more efficient than command-and-control regulations aimed at biodiversity conservation.     Crossing boundaries in the mind to see old ideas in a new light Bioprospecting as a conservation tool: history and 38 background PRESTON SCOTT, WFED, 1816 Jefferson Place NW, Washington, D.C. 20036; [email protected] For millennia, people around the world have studied nature as part of humanity’s never ending search for new ways to improve crops for food production, to combat disease and other maladies, and to make other discoveries that might enhance the overall quality of life on Earth. For example, more than half of the top brand-name pharmaceuticals in use in the USA in the early 1990s contained at least one major active compound derived or patterned after compounds first discovered in Nature (Grifo and Rosenthal 1997). In parts of the world where traditional healing practices remain prevalent, direct reliance on useful discoveries from nature is even more pro- nounced. Recent advances in biotechnology and related sciences have generated increased activity and interest in the search for useful biochemical compounds or other poten- tially valuable biological discoveries in Nature—a very old practice that is now some- times described by a new term: “biodiversity prospecting” or “bioprospecting.” In contrast to timber harvesting, mining, and other traditionally consumptive uses of natural resources, research-focused bioprospecting generates value from the results of scientific study involving biological samples. This value-added approach has been enhanced also by developments in intellectual property rights laws, new biorational approaches in specimen collection and drug and other product-development re- search, and evolving trade practices. Reflecting the convergence of all these developments, significant value is now at- taching to research results involving biological resources found in many special habi- tats—ranging from tropical rainforests to coral reefs to frozen tundra to national parks and other protected and unprotected areas (Marrs and Madigan 1997).

In the recent past, there have been several cases of biopiracy of traditional knowledge from India. Biopiracy in India was observed in the common plant varieties like Haldi, Basmati, Neem etc. Some cases have been highlighted with a success story, but there are also numerous stories of deprivation in the context of biopiracy. The stealing of biological resources and indigenous knowledge would affect food security, livelihood of indigenous people, and consumers’ choice. More than 70 % of our food supply is dependent on a small number of edible plant resources, mainly wheat, maize, rice, and potato, which are fundamental to food security. Patenting of these plants varieties will definitely pose threat to the consumers. In politics, biopiracy has triggered the problem of the intrusion of national sovereignty when a corporation or a government from other countries utilizes and benefits from the patent varieties of genetic resources which derived from genetic resources or traditional knowledge from another sovereign state. However, in the past few years, developing countries have become more vocal in the international arena.
