The Legal Canvas The Legal Canvas Summer 2012 Summer 2012 Already? In this issue of the Legal Canvas, we have chosen to cover some basics – or at least things that are basic for lawyers but may be matters of mystery for others. In the course of our practice we find that many of our clients have (happily) never been involved in litigation.That’s the good news. The bad news is that when a dispute arises, inexperience with the realities of litigation may affect the abil- ity to make good decisions. We therefore offer a primer on litigation – what it is, how it works, its risks and its benefits, and why it is so expensive. We also find that although many people in the art world owe fiduciary responsibilities to their employers, institutions, or clients, they may not understand the nature of those responsibilities or the potential consequences when they are breached. We discuss the concept of fiduciary duty and look at two cases – one that is currently pending in New York and one that was decided in London in 2010 – that illustrate the sorts of facts that may elicit claims (or findings) of fiduciary breaches. IN On other matters, we review a decision by the European Union about the THIS imposition of VAT and customs duty on works that are imported into the ISSUE EU in component parts. We also report on a federal court decision holding the California Resale Royalties Act to be unconstitutional and a proposal in DEALING IN HIddEN RISK: Congress to institute a national resale royalty scheme.     The Construction of Brancusi’s Primitivism Amelia Miholca, Phoenix Within the discourse of modern sculpture, Brancusi is constructed as a primitive with either an affinity towards African art, or a familiar connection with Romanian folk art. For art historians, the source of Brancusi’s primitivism and his abstractness in his work is derived either from African art or from Romanian folk art, not both. This dichotomy of Brancusi’s primitivism is exemplified in the Brancusian studies of Sidney Geist and Edith Balas. More specifically, Geist and Balas set in motion how Brancusi is conceived within the discourse of twentieth century primitivism. Therefore, it is imperative to analyze their arguments surrounding the source of Brancusi’s primi- tivism, along with the viewpoints of other art historians who either contradict Balas and Geist or follow their lines of argument. William Rubin includes Brancusi in his “Primitivism” in 20th Century Art dis- cussion of avant-garde’s affinity to tribal art. Robert Goldwater exa- mines the reason for Brancusi’s interest in primitive art. Anna Chave studies Brancusi and his work from a postmodern perspective, re- constructing his identity in relation to the Other. Along a similar postmodern perspective, Friedrich Teja Bach argues for the impor- tance of the pedestal in Brancusi’s art. Eric Shanes notes Brancusi’s prejudice understanding of the primitive and argues against Brancusi being identified as a primitive. In this paper, I will also examine Bran- cusi within the context of other modern artists who were active in the development of modern sculpture and who were interested in primtive art.

This is due to his innovative use of materials, such as wood and marble, and his reduction and precision of form. Brancusi developed his abstraction with “primitive” sources of art in mind. This thesis examines how and to what extent primitivism played a central role in Brancusi’s sculptures and his construction as a primitive artist. Romanian folk art and African art were the two main sources of influence on Brancusi’s primitivism. Brancusi identified himself with the Romanian peasantry and its folk culture. Romanian folk culture embraces woodcarving and folk literary fables—both of which Brancusi incorporated in his sculptures. In my opinion, Brancusi’s wood pedestals, such as the Endless Column, are based on wood funerary, decorative, and architectural motifs from Romanian villages. Brancusi was exposed to African art through his relationship with the New York avant-garde. The art dealers Alfred Stieglitz, Marius de Zayas, and Joseph Brummer exhibited Brancusi’s sculptures in their galleries, in addition to exhibiting African art. Meanwhile, Brancusi’s main patron John Quinn also collected African art. His interaction with the New York avant-garde led him to incorporate formal features of African sculpture, such as the oval forms of African masks, into his abstract sculptures.

    What Makes Modern Art Modern? _________________________________________________________________________________________________________________________ NTENSE, CRITICAL, BREAKING WITH TRADITION, AND AVANT-GARDE— these are words and phrases sometimes used to describe modern art. “Modern” is a chronological and stylistic designation that Iusually refers to art made from the beginning of the twentieth century until after World War II, although some scholars date modern art from the late nineteenth century to the 1960s or beyond. Traditionally, the history of modern art is organized around a series of intellectual, philosophical, and aesthetic developments that informed artworks created at the time.     Cultural Diplomacy and Brancusi’s Reception in the Digital Age in Romania Nicolae Stanciu "Dunărea de Jos (Lower Danube)” University of Galati Abstract: The internet and media resources have opened new opportunities for digital cultural diplomacy and management of culture. Theoretically an ideal choice for cultural diplomacy, Constantin Brancusi’s reputation as a representative for government agency has suffered a crisis of reception. A Romanian-born and French-adopted sculptor, Brancusi has become a symbol of folklore and mythology but also a great, internationally recognized sculptor. This has been due to the existence of preferred or fixed models of desigining projects instead of involving teams of different backgrounds and incorporating cultural concepts in the political discourse. Approaching the topic with concepts of cultural diplomacy, media anthropology, heritage and online discourse, this case study deals with media events of cultural diplomacy broadcasted online in present day Romania. It emphasizes the potential that lies in cultural management and the important role of team spirit in designing public cultural policies and implementing projects.
