IND S16 Terms of Reference for selection of appropriate agency for carrying out the training of Prosecutors on Anti Human Trafficking (AHT).

1. Aim: As part of the Anti Human Trafficking Project of UNODC, it has been decided to organize the training programmes for the prosecutors of Maharashtra. UNODC is looking for an agency to undertake the training programmes of prosecutors for a period of six months, the first training starting on 28-29 October at and the last training during the fourth Saturday / Sunday of April 2007 2. The participants: The Director of Prosecution (DP) of Maharashtra will select the prosecutors who will be attending each session. They will be directed by the DP to attend the training programme at the concerned venue The mandate is to see that, as far as possible, maximum number of prosecutors of Maharashtra is trained in this project at the earliest on AHT. 3. Organizing Agency: UNODC is looking for appropriate agency that can carry out the task of organizing the Training in Maharashtra. The job demands the following activities. a. Training calendar and participants: The training programmes will be held at the divisional/ regional/ range head quarters like , , , Amravati, Mumbai etc and will be decided in consultation with the DP Maharashtra. The training calendar is being prepared by the DP Maharashtra. The first session is to be held on 28- 29 October in Mumbai. In all these training programmes the participants will include the prosecutors who are working in the districts in the region / range. b. Venue: The agency will have to locate an appropriate venue at the concerned place of workshop. This should have a conference hall to accommodate 30-35 persons and accommodation (twin sharing), for 26 participants. (Out of the 30 participants in each workshop approximately 4 will be local participants and 26 will be out station participants. The accommodation mentioned above is only for the out station participants. Besides this the agency may be required to arrange 1-2 rooms for the resource persons who come from outside. The venue of the workshop and the place of accommodation to be arranged by the agency should be suitable and comfortable, but should also be within reasonable limits and not exorbitant. Preference be given to institutional location especially government buildings. If they are not available, reasonable and appropriate hotel can be considered. The organizing agency will have to locate the venue and make all arrangements for the conference there itself. If the venue is different from the place of accommodation, adequate transportation be arranged. c. Training arrangements: all arrangements like LCD projector, screen, and white board with markers; mike, other training aids etc must be arranged by the selected agency. d. Food arrangements The agency should make reasonable arrangement for the food of the participants. This includes working lunch as well as tea and snacks to be served in the forenoon and afternoon, on both days. The inaugural and valedictory function can have high tea along with VIPs, if any. e. Date. Training will be conducted in separate batches consisting of 30 prosecutors per batch during the weekends of second week and fourth week (because the prosecutors are free from court work only during these periods). The training calendar will be provided by the DP Maharashtra. The first course is scheduled to be held at Mumbai 28-29 October and the last one to be held by fourth Saturday/ Sunday of April 2007. f. Training materials: The agency should make arrangements for the purchase of the law books and provide them to the participants. They should also provide xerox copies of the important judgments (numbering 7-10) on AHT. The list of books (bare acts) and the court rulings to be provided to the participants is attached for reference. The materials to be supplied to the participants should include case studies, other relevant literatures, writing pads and pen. Carry bags (not more than Rs.350 per bag) should also be supplied by the agency. The resource materials, other than the law books, may preferably be supplied in a bound volume so that it is easy to handle. g. Local Resource persons. The organizing agency will have to arrange local resource persons for handling all subjects as per the course curriculum attached. They can be paid honorarium of Rs.1000/- per session (minimum of one hour). These persons should be known experts on the subjects concerned and should be decided in advance and in consultation with the Project Coordinator UNODC. Persons who have attended the TOT are the appropriate prosecutors who can address the topics on prosecution. The resource persons should be given advance notice and requested to come prepared to make the sessions interactive. They must give a copy of their presentation (soft and /or hard copy) to all the participants. They should be specifically told that their task is to empower the prosecutors with knowledge, skills and attitude. Therefore their presentation should be empowering and positive. h. Travel costs and Daily Allowance for the trainees (participating prosecutors): It has been decided, on the request of the DP, that the prosecutors attending the training programmes will be reimbursed the actual cost of their travel from the place of posting to the venue of training and the return cost on the same route, by the mode of transport, as per their entitlement from the Govt of Maharashtra.

i. Documentation; The agency will have to make qualitative documentation in hard copy and present to UNODC within a week of each training. It should also have an album of photographs of important events (total of 15 snaps per training sessions would be adequate). On the day of training the agency should communicate to the Project Coordinator, UNODC the no. of participants and a brief note on the events of the day.

j. All original bills along with the statement of expenditure should be forwarded to UNODC for settling the bills. There should be a report covering all the events in detail. The reporter should be briefed in advance to record the events approximately. Care should be taken to follow the protocols regarding money matters, for example for every expenditure above Rs. 5000, quotations should be invited and lowest quotations should be honored.

4. Transfer of Funds: Once selected, the organizing agency will be required to sign a contract and thereby commit oneself to the job required as above. On receipt of the signed contract, the agency will be extended 50 % of money as advance , 35 % will be paid after the completion of 60% of the training and rest will be paid upon submission of final training report and expenditure statements and other details. 5. Certificates: All the participants will be issued with a certificate of participation on their completion of the training course for both days. The certificate will be issued by the UNODC and will be jointly signed by the DP and the UNODC official. The Agency need to procure them from the UNODC and get them distributed on time.
