North Chadderton Secondary School, Chadderton Hall Road, Chadderton Delegated Decision Proposed Waiting Restrictions, Bus Stop Clearways and School Keep Clears (No Stopping) - North Chadderton Secondary School, Chadderton Hall Road, Chadderton Report of: Deputy Chief Executive – People and Place Officer contact: Darryll Elwood – Technical Admin Traffic Ext. 1946 30 September 2020 Reason for Decision The purpose of this report is to consider the proposal to implement measures on Chadderton Hall Road, Chadderton, comprising waiting restrictions, bus stop clearways and school keep clears, associated with the North Chadderton Secondary School. Recommendation It is recommended that measures comprising of waiting restrictions, bus stop clearways and school keep clears (no stopping) be introduced on Chadderton Hall Road, Chadderton, in accordance with the schedules at the end of this report. Delegated Decision Proposed Waiting Restrictions, Bus Stop Clearways and School Keep Clears (No Stopping) - North Chadderton Secondary School, Chadderton Hall Road, Chadderton 1 Background 1.1 The Building Schools for the Future programme in Oldham includes the North Chadderton Secondary School site in Chadderton. 1.2 A review of parking issues associated with the college has been undertaken following the opening of the site in September 2012. The review has involved discussions with local residents and Ward Councillors. 1.3 Chadderton Hall Road (B6195) is a main distributor road connecting the A627M roundabout and Oldham Road/Middleton Road, serving North Chadderton Secondary School, St Matthew’s Primary and Infant Schools as well as a wider residential area and is also a bus route. 1.4 Along the frontage of the schools there is a need to ensure that obstructive parking does not occur as this poses significant risk to local school children attempting to cross the road, by protecting the existing bus stop lay-bys, school access points and preventing parking. All these measures will ensure that traffic movement along Chadderton Hall Road will remain unobstructed. 1.5 It will also be necessary to introduce waiting restrictions on Chadderton Park Road, at its junction with Chadderton Hall Road, to ensure traffic is not obstructed when turning in or out at this junction. 2 Current Position 2.1 Waiting restrictions exist along Chadderton Hall Road in the shape of single and double yellow lines, together with a school keep clear Order. The Secondary School has recently undergone work as part of the Building Schools for the Future programme that has created new access points as well as bus stop relocations for the school itself. This in turn has brought about a need to slightly amend the existing waiting restrictions, introduce a range of new School Keep Clear Orders and ensure that bus lay-bys do not become obstructed by introducing Bus Stop Clearway Orders. 3 Options/Alternatives 3.1 Option 1: To approve the recommendation. 3.2 Option 2: Not to approve the recommendation. 4 Preferred Option 4.1 The preferred option to approve is Option 1. Page 2 of 12 g:\common\dec_rec\3208 03.03.20 TM3/825 5 Justification 5.1 The amendments to the existing waiting restrictions, as well as the introduction of school keep clear and bus stop clearway Orders will ensure that obstructive parking does not take place on Chadderton Hall Road along the frontage of the schools, throughout the normal working school day. 6 Consultations 6.1 GMP View - The Chief Constable has been consulted and has no comment on this proposal. 6.2 TfGM View - The Director General has been consulted and thank you for consulting Transport for Greater Manchester with your proposals. On behalf of Bus Services I fully support the introduction of the bus clearways in order to protect the existing bus services which serve the area. If issues with parked vehicles obstructing the bus stop clearways becomes problematic after the full introduction of these measures I would like to request the support of civil parking enforcement to protect these measures as required. 6.3 GM Fire Service View - The County Fire Officer has been consulted and has no comment on this proposal. 6.4 NW Ambulance Service View - The County Ambulance Officer has been consulted and has no comment on this proposal. 7 Comments of Chadderton North Ward Councillors 7.1 The Ward Councillors have been consulted and Councillor B Brownridge has commented: I have no objections to the principle but would question how it is to be enforced. There is already a major problem with people parking on the verges and footways totally ignoring the risk they are causing to pedestrians – particularly the children going to St Matthew’s and I am concerned that without the ability to police this effectively the current problems will be exacerbated. 8 Response to Councillors Comments 8.1 With regards to enforcement, there is always an issue when enforcing waiting restrictions, as this is done by an Officer on foot, the difficulty arises at school times when the driver is sat in the vehicle and if an Officer approaches the driver drives off. 8.2 With regards to the Bus Stop Clearways and the School Keep Clear Markings these, albeit on a rota basis, are enforced by the Councils camera car. Including rota based enforcement, the location can be added to the hotspot list and additional enforcement can be undertaken if required. Page 3 of 12 g:\common\dec_rec\3208 03.03.20 TM3/825 9 Financial Implications 9.1 The cost of introducing the Order is shown below:- £ Advertisement of Order 1,200 Road Markings 2,322 Traffic Signs 2,074 TOTAL 5,596 9.2 The above costs will be capitalised and charged as follows: • The advertising and traffic signage costs totalling £3,274 will be funded from the transport Capital Programme. • Road Marking costs of £2,322 will be charged against the Incentive Fund 2017/18. 9.3 Annual maintenance costs estimated at £500 per annum in March 2020 will be met from the Highways Operations revenue budget. If there are pressures in this area as the financial year progresses, the Directorate will have to manage its resources to ensure that there is no adverse overall variance at the financial year end. (Nigel Howard) 10 Legal Services Comments 10.1 The Council must be satisfied that it is expedient to make the Traffic Regulation Orders in order to avoid danger to persons or other traffic using the road or any other road or for preventing the likelihood of any such danger arising, or for preventing damage to the road or to any building on or near the road, or for facilitating the passage on the road or any other road of any class of traffic, including pedestrians, or for preventing the use of the road by vehicular traffic of a kind which, or its use by vehicular traffic in a manner which, is unsuitable having regard to the existing character of the road or adjoining property or for preserving or improving the amenities of the area through which the road runs. 10.2 In addition to the above, under section 122 of the Road Traffic Regulation Act 1984, it shall be the duty of the Council so to exercise the functions conferred on them by the Act as to secure the expeditious, convenient and safe movement of vehicular and other traffic (including pedestrians) and the provision of suitable and adequate parking facilities on and off the highway. Regard must also be had to the desirability of securing and maintaining reasonable access to premises, the effect on the amenities of any locality affected and the importance of regulating and restricting the use of roads by heavy commercial vehicles so as to preserve or improve the amenities of the areas through which the roads run, the strategy produced under section 80 Environmental Protection Act 1990 (the national air quality strategy), the importance of facilitating the passage of public service vehicles and of securing Page 4 of 12 g:\common\dec_rec\3208 03.03.20 TM3/825 the safety and convenience of persons using or desiring to use such vehicles and any other matters appearing to the Council to be relevant. 10.3 In relation to the proposed bus stop clearways, it is possible to introduce a bus stop clearway without the need for a Traffic Regulation Order. The Council has introduced an approvals procedure for dealing with bus stop clearways which to a large extent mirrors the procedure to be followed when making Traffic Regulation Orders. It is recommended that the approval procedure be followed. The area is suffering from young people causing annoyance, drinking alcohol and verbally abusing passers by. Work so far has included the Youth Bus in ASDA car park, increased Police presence who have moved YP on. Chadderton Hall Park is also being given Police attention due to fights in the Park. The fights seem to be between young males from Middleton and local young males. As such, Inspector Willcocks has secured funds for staff overtime at peak times during the summer and into autumn.
