Page 1 of 74 Oldham Borough Council (Chadderton Area) Consolidation Order 2003 ARRANGEMENT OF SECTIONS PART I (Waiting and Movement Control) Section 1 : Prohibition and Restriction of Waiting (Articles 1, 2 and 3) PART II (Controlled Parking Zones) Section 2 : Residents' Parking Places (Articles 4 to 15 inclusive) Section 3 : Parking Places (Specified Classes of Vehicle) (Articles 16 to 24 inclusive) Section 4 : Parking Places (Off Street) (Articles 25 to 67) Section 5 : Parking Places (On Street Pay and Display) (Articles 68 - 79) PART III (Revocations and Suspensions) Section 6 : Permanent Revocation (Article 80) Section 7 : Permanent Revocation in Whole (Article 81) GENERAL All lengths of road specified in this Order are lengths of road in the Oldham Borough. The prohibitions and restrictions imposed by this Order shall be in addition to and not in derogation of any restriction or requirement imposed by any regulations made or having effect as if made under the 1984 Act as amended aforesaid or by or under any other enactment. Any reference in this Order to any enactment shall be construed as a reference to that enactment as amended by any subsequent enactment. In this Order, where the context requires, the singular shall be interpreted as being the plural and vice versa. Definitions:- In this Order the following words and phrases (where used) have the meanings ascribed to them as follows:- (1) "1984 Act", means Road Traffic Regulation Act 1984 (1984 c.27), (2) "1991 Act", means Road Traffic Act 1991 (1991 c.40), (3) "Attended Parking Place" means a parking place where a person is provided for the purpose of receiving payment to the Council for use of a parking place. (4) "Bus" has the same meaning as in Regulation 22 of the Traffic Signs Regulations and General Directions, 1994 . Page 2 of 74 Oldham Borough Council (Chadderton Area) Consolidation Order 2003 (5) "Bus Lane", means any length of road specified in this Order and bounded by delineating road markings as prescribed under Regulation 23 of the Traffic Signs Regulations and General Directions, 1994, for use as a Bus Lane. (6) "Bus Stop Area", means any area of carriageway of a road (which is specified and intended for the waiting of buses) which is comprised within and indicated by a road marking complying with either diagram 1025.1 or 1025.3 in Schedule 6 to the Traffic Signs Regulations and General Directions, 1994. (7) "Bus Stop Clearway Hours", means the hours specified in each relevant Schedule in relation to a length of road. (8) "Car Park Attendant", means a person appointed by the council to receive payment on behalf of the Council for use of a parking place. (9) "Carriageway", means a way constituting or comprised in a highway being a way (other than a cycle track) over which the public have a right of way for the passage of vehicles . (10)"The charge", means the appropriate charge to be paid by the driver of a vehicle using the parking place in accordance with Column 7 of Schedule 5a of Part II . (11)°Council" means Oldham Borough Council. (12)"Cycle Lane", means a length of road specified in this Order as a Cycle Lane and bounded by delineating road markings as prescribed under Regulation 4 of the Traffic Signs Regulations and General Directions, 1994. (13)"Director", means the Oldham Borough Council's Executive Director Environmental Services or a person acting with equivalent authority. (14)(a) "Disabled Person's Vehicle", means a vehicle displaying a Disabled Person's Badge. (b) "Disabled Person's Badge", has the same meaning as in The Local Authorities' Traffic Orders (Exemptions for Disabled Persons) (England) Regulations 2000. (15) "Doctor Parking Permit" means a valid permit issued for use within the relevant Doctor Parking Place. (16) "Doctor Parking Place", means a parking place (Schedule 4 to Part II of this Order), which may only be used by a vehicle displaying a Doctor Parking Permit. (17) "Driver", in relation to a vehicle waiting in a parking place means:- (a) The person driving the motor vehicle at the time it was left in the parking place or (b) Where the vehicle is a pedal cycle, the person (being a user) riding, pushing by hand or otherwise in charge of the pedal cycle at the time it was left in the parking place. (18) "Dual Purpose Vehicle", has the same meaning as in Schedule 6 to the 1984 Act. (19) "Goods", includes postal packets of any description . (20) "Goods Vehicle", has the same meaning as that ascribed to it in Schedule 6 of the 1984 Act. (21) "Initial Period", is that shown in Column 3 of Schedule 5b to Part II of this order. (22) "Junction", means (in the Schedules to this Order) for measurement purposes only: The point where the prolongation of two kerb lines intersect (measurements are taken along the line of kerb for the said length of road unless otherwise stated). (23)"Lay-By", means any area of carriageway intended for the parking, waiting or loading of vehicles and lying at the side of the road bounded partly by a traffic sign of the type shown in Diagram 1010 of the Traffic Signs Regulations and General Directions, 1994, and partly by the outer edge of that carriageway on the same side of the road as that on which the sign is placed. Action: To inform Tony of the above 1 People Community and Society Police Update The Police’s current priority is ASDA and the precinct. The area is suffering from young people causing annoyance, drinking alcohol and verbally abusing passers by. Work so far has included the Youth Bus in ASDA car park, increased Police presence who have moved YP on. Chadderton Hall Park is also being given Police attention due to fights in the Park. The fights seem to be between young males from Middleton and local young males. As such, Inspector Willcocks has secured funds for staff overtime at peak times during the summer and into autumn.

    Alleygating - Chadderton Report for the Chadderton District Partnership from Community Safety Services Officer Contact: Mike Farrell Ext. 1569 Alleygating in Chadderton 1 Introduction 1.1 To date, the Crime Reduction Team in Community Safety Services have completed 367 alley gating projects, installing 1,050 gates in problem areas around Oldham. These gates are now providing protection, peace of mind and reassurance to 10,019 homes in Oldham; the total cost has been £1,207,115. 1.2 There has been evaluation of several different alleygating schemes across Oldham. The first Clarksfield project which included 35 gates covering 253 properties showed a reduction in domestic burglary of over 90%.
