DRAFT | CPSA 2017 Please don’t cite without permission Competing Diversities: Representing “Canada” on the Supreme Court in 2016 Erin Crandall | Acadia University Robert Schertzer | University of Toronto The Supreme Court oF Canada’s (SCC) inFluence on politics and public policy – from deciding human rights cases to adjudicating Federal-provincial disputes – has long placed it in the spotlight oF political actors and watchers alike. Seeing the Court as activist or restrained, as siding with the Federal government or as balanced in its Federalism case law, as anti-democratic or the guardian oF the constitution, are all hallmarks oF the debate about its place in Canadian politics. Underpinning these debates is an often-critical focus on the justices’ themselves, the process by which they are selected, and the virtually unFettered power Prime Ministers have had in appointing individuals to the bench. In August 2016, Prime Minister Justin Trudeau clearly established his position within this debate by announcing a new way to choose SCC justices. Along with promoting more transparency and accountability in the process, the key elements oF Trudeau’s proposed reForms were to ensure that all future justices were functionally bilingual and that they represent the diversity of Canada (see Trudeau 2016b). In line with these new objectives, one oF the First things Trudeau highlighted in his announcement was a willingness to break with the convention of regional representation on the bench and move toward an open application process. With the upcoming retirement of Nova Scotia Justice Thomas Cromwell in September 2016, questions immediately emerged as to whether the government would deviate from the tradition of having one of the nine justices on the SCC come from Atlantic Canada. -

Many – though by no means all – Canadians had grown to believe reading comic books was directly linked with a perceived increase in rates of juvenile criminal behaviour. Led primarily by PTA activists and other civic organizations, the campaign was motivated by a desire to protect the nation’s young people from potential corrupting influences that might lead them to delinquency and deviancy and resulted in amendments to the Criminal Code passed by Parliament in 1949. Available from: http://ssrn.com/abstract=2511239 Abstract Most of the recent appointees to the Supreme Court of Canada have participated in a new Canadian judicial nomination process initiated by the current Conservative government. As originally formulated in early policy platforms, the process was intended to mimic features of US Senate judicial confirmation hearings and so would highlight the distinction (popular in US political discourse) between ‘applying’ and ‘making’ law. This led to widespread fears that any new public process would politicize judicial appointments and functions at the Supreme Court. The process turned out to be much more tepid than anticipated and so raises questions about what Canadians may have learned as a consequence of this new nomination process. This paper undertakes a qualitative analysis of reporting of four nomination processes from a select number of Canadian newspapers. The main object is to determine the degree to which readers might have been alerted to the distinction between law and politics or, put another way, between judicial activism and restraint. It turns out that this framing was not dominant in the coverage and that, instead, distinctive Canadian political preoccupations, like language politics, got channeled through this new political opportunity structure. -
Party Competition in Alberta, Saskatchewan and Manitoba

May 29, 2009 Abstract Similar in so many ways, questions persist as to why Canada’s three Prairie Provinces have developed such distinct patterns of party competition. Right-wing dynasties thrive in Alberta; Saskatchewan’s natural governing party is avowedly social democratic; while party politics in Manitoba remains relatively balanced between the forces of the right and left. This paper supplements conventional solutions to this “prairie paradox” - grounded in political culture and settlement patterns - with an ideational analysis of campaign narratives. This examination reveals that each system is focused around a unique provincial “code.” In Alberta, Social Credit and Progressive Conservative leaders have emphasized “freedom” over “security,” whereas New Democrats in Saskatchewan have stressed precisely the opposite. Successful politicians in Manitoba have steered a middling course, underscoring the importance of “moderation” in their campaign rhetoric. Cultivated by, and constraining, prominent leaders over time, these dominant discourses help explain the persistent differences between the three worlds of party competition in the region. Introduction Considering their many commonalities, the three Prairie Provinces ought to feature similar patterns of party competition. Manitoba, Saskatchewan, and Alberta are each separated by essentially artificial boundaries, their borders based on arbitrary longitudinal lines, rather than topographic or ethnic divisions (Elton, 1970). All three are associated with a common iconic landscape: one with vast stretches of prairie, bounded only by mountains to the West and the Canadian Shield to the East. -

THE SUPREME COURT OF CANADA AND THE JUDICIAL ROLE: AN HISTORICAL INSTITUTIONALIST ACCOUNT by EMMETT MACFARLANE A thesis submitted to the Department of Political Studies in conformity with the requirements for the degree of Doctor of Philosophy Queen’s University Kingston, Ontario, Canada November, 2009 Copyright © Emmett Macfarlane, 2009 i Abstract This dissertation describes and analyzes the work of the Supreme Court of Canada, emphasizing its internal environment and processes, while situating the institution in its broader governmental and societal context. In addition, it offers an assessment of the behavioural and rational choice models of judicial decision making, which tend to portray judges as primarily motivated by their ideologically-based policy preferences. The dissertation adopts a historical institutionalist approach to demonstrate that judicial decision making is far more complex than is depicted by the dominant approaches within the political science literature. Drawing extensively on 28 research interviews with current and former justices, former law clerks and other staff members, the analysis traces the development of the Court into a full-fledged policy-making institution, particularly under the Charter of Rights and Freedoms. This analysis presents new empirical evidence regarding not only the various stages of the Court’s decision-making process but the justices’ views on a host of considerations ranging from questions of collegiality (how the justices should work together) to their involvement in controversial and complex social policy matters and their relationship with the other branches of government. These insights are important because they increase our understanding of how the Court operates as one of the country’s more important policy-making institutions. -

Following a brief historical introduction to the jurisdiction of the state in question, the various reports examine the composition, internal organization, functioning, jurisdiction of the various highest courts, as well as the right of access to its courtroom, its procedural rules, and the effects and the execution of its judgments. The present study examines Canada’s highest court, the Supreme Court. While all judicial courts may rule on constitutional matters, the Supreme Court of Canada enjoys a privileged status in the Canadian legal landscape. As the ultimate arbiter of the Constitution, it has the final word with respect to constitutional interpretation, notably in constitutional matters. It thus plays a central role in Canada’s federal democracy.
