SPEAKER SHARKEY: c Representative Lemar, you have the floor. REP. LEMAR (96th): Good evening, Mr. Speaker. Mr. Speaker, I move for acceptance of the Joint Committee's Favorable Report and passage of the bill in concurrence with the Senate. SPEAKER SHARKEY: The question is on acceptance of the Joint Committee's Favorable Report and passage of the bill in concurrence with the Senate. Will you remark, sir? c REP. LEMAR (96th): 004184 /dd 248 HOUSE OF REPRESENTATIVES May 20, 2015 c Yes, Mr. Speaker. Thank you so much. We have before us today a bill that makes numerous changes to our Department of Transportation codes and allows for several changes pertaining to bicycle operations and bikeways. We recognize across the country innovative bike designs and transit designs that accommodate multiple types of users. We think Connecticut can lead in this area. We think the types of changes that we've incorporated in the underlying bill are a dramatic step forward for our state and for transportation policy as a whole. In addition, Mr. Speaker, the Clerk is in c possession of an amendment, LCO No. 6970. I would ask the Clerk to please call the amendment and I be granted leave of the Chamber to summarize. In collaboration with some of our great colleagues on a bipartisan basis, we recognize that there are some ideas we didn't quite incorporate originally. And we had great work on Senate Amendment "A" to do two things; namely, eliminate some provisions allowing motorists to cross a road to pass a cyclist and largely encouraging DOT to consider implementing c some progressive bike standards when they're doing construction on state roads that're designated as bikeways. I ask for you to adopt the amendment. SPEAKER SHARKEY: Thank you, sir. Would you care to remark further on Senate "A?" Representative O'Dea. REP. O'DEA (125th): Thank you, Mr. Speaker. REP. MCCARTHY VAHEY (133rd): Th~nk you, Mr. Speaker. Mr. Speaker, I rise in support of this bill. As many of you know, I am a big bike fan. I rode my bike up here last night. This bill will allow us to create 21st century infrastructure that will help attract and keep young people in our state and help to keep economic development going for our municipalities. It will c 004187 /dd 251 HOUSE OF REPRESENTATIVES May 20, 2015 c provide improvements for the environment and I urge adoption of the bill. SPEAKER SHARKEY: Thank you, madam. REP. MCCARTHY VAHEY (133rd): Thank you, Mr. Speaker. SPEAKER SHARKEY: Further on the bill as amended? Representative Craig Miner. REP. MINER (66th): Thank you, Mr. Speaker. I just - I guess I rise to voice a little bit of a concern and I c understand that bicycles are becoming more and more of a common incident on roadways, which I'm not opposed to. Many of the constituents that I have ride bicycles frequently. Many of the places throughout Litchfield County, there are organized races frequently. But the problem I think that I'm hearing from some of my constituents is that it's almost as though they have equal standing. And I think, legally, they do have equal standing. But when there's a conflict, as I think this bill suggests, c that you can actually cross the center line to pass 004188 /dd 252 HOUSE OF REPRESENTATIVES May 20, 2015 c a bicycle, there is some risk. And so as we continue to do these things, I hope we recognize that just because we make it legal, we don't necessarily create a safe environment. I think the papers have told some stories in the last year or two where people have actually been killed not because they were riding a bicycle inappropriately because I think they were actually obeying the law. But the law of physics generally proves that you can be right and not survive. And so I think, as we continue to contemplate legislation like this, we should be mindful that c sending the message that it's legal isn't neces~arily the safest message we can send. So, thank you. SPEAKER SHARKEY: Thank you, sir. Would you care to remark further on the bill as amended? Representative Lavielle. REP. LAVIELLE (143rd): Thank you, Mr. Speaker. Very quickly, I rise in strong support of the bill. I think that apart from all the other reasons it's really going to c make consideration of bicycle travel an integral 004189 /dd 253 HOUSE OF REPRESENTATIVES May 20, 2015 c part of the planning of our road infrastructure in the state. And I think that in itself is a very good thing. I also just want to thank Senate Bye and Representative Lemar for their work on the amendment. Some of the considerations of how - why did you make a vehicle lane and how that should not interfere with the creation of a bicycle lane on the same road, if possible, came to us on request from the Norwalk Bike/Walk Task Force. So I really appreciate their work and cooperation on that. And I very much support the bill and I hope everyone c will join me in that. Thank you. SPEAKER SHARKEY: Thank you, madam. Further on the bill as amended? Representative Becker. REP. BECKER (19th): Thank you, Mr. Speaker. Mr. Speaker, I am very supportive of this bill, but I also wanna just draw people's attention to the fact that while you can pass a scooter, and as a scooter driver myself, I wanna make sure that people understand you can c pass a scooter when traveling at a - when the 004190 /dd 254 HOUSE OF REPRESENTATIVES May 20, 2015 c scooter's traveling at a slow speed. But it should be noted that you just should not be swinging past scooters in general, only when' they're traveling at a slow speed. And with that, I very much support this bill as well. I have one question to the proponent, please, through you. c SPEAKER SHARKEY: Please proceed, madam. REP. ZIOBRON (34th): Thank you, Mr. Speaker. I'm looking at Line 45 of the bill where it talks about a municipality in concert with others shall give consideration to implementing the minimum standard lane width. If the good representative could tell me how that will be achieved? Through you, Mr. Speaker. SPEAKER SHARKEY: Representative Lemar. c REP. LEMAR (96th): 004191 /dd 255 HOUSE OF REPRESENTATIVES May 20, 2015 c Thank you, Mr. Speaker. If you c.ould quickly reiterate that question. I was searching for the document rather than - SPEAKER SHARKEY: Representative Ziobron, could you repeat the question. REP. ZIOBRON (34th) : Of course, Mr. Speaker. To the good representative, I'm looking at Line 45 where it talks about giving consideration- shall and that's the key word for me, give consideration to implementing the minimum standard lane width. And c I'm asking how is that gonna be achieved? Through you. SPEAKER SHARKEY: Representative Lemar. REP. LEMAR (96th): Thank you, Mr. Speaker. The town will collaborate with state officials to ensure that the goals of the town are respected in consideration of developing these bike lanes and the actual lane width. Through you. And so, you know, I think about the towns I represent which, frankly, those roads probably don't even meet, especially our rural roads, don't meet some of the minimum standards that are out there today. And I'm concerned that we're gonna be putting a burden on some of our smaller towns and our planning and zoning departments to stop and meet with DOT and other folks.
