(ECF No. 1.) The claim stems from a statement Rachel Maddow made 22 on The Rachel Maddow Show on MSNBC. Soon after Plaintiff filed suit, Defendants 23 filed a special motion to strike pursuant to California Code of Civil Procedure 24 § 425.16, commonly known as the Anti-Strategic Lawsuits Against Public 25 Participation (“Anti-SLAPP”) law. (“Mot.,” ECF No. 18.) The Court held oral 26 argument on the Motion on May 19, 2020. Background 2 Plaintiff Herring Networks, Inc. owns and operates One America News 3 Network (“OAN”). (“Compl.,” ECF No. 1, ¶ 1.) On July 22, 2019, reporter Kevin 4 Poulsen at The Daily Beast published a story called “Trump’s New Favorite Channel 5 Employs Kremlin-Paid Journalist.” Poulsen reported that Kristian Rouz, one of the 6 reporters at OAN, was “on the payroll of the Kremlin’s official propaganda outlet, 7 Sputnik.” (“RJN Ex. -

NEWS RELEASE XM AND AIR AMERICA RADIO ANNOUNCE LONG TERM AGREEMENT; XM TO BE OFFICIAL SATELLITE RADIO NETWORK OF AIR AMERICA 4/11/2005 Washington D.C., April 11, 2005 -- XM Satellite Radio (NASDAQ: XMSR), the nation's leading satellite radio provider with more than 3.77 million subscribers, has announced a new long-term agreement with Air America Radio, the national progressive entertainment talk radio network home to Al Franken, Randi Rhodes and Janeane Garofalo. As part of this agreement XM will be the official satellite radio network for Air America Radio. Beginning in May, XM's liberal talk channel, America Left (XM Channel 167) will be renamed Air America Radio. The channel will include an expanded line-up of Air America Radio programming, including the recently debuted "Springer on the Radio" hosted by Jerry Springer and upcoming "Rachel Maddow Show," among others. XM's Air America Radio channel also will feature popular shows currently carried on America Left, including "The Ed Shultz Show" and "The Alan Colmes Show." "XM was a natural fit to be the official satellite radio network of Air America Radio, given its large subscriber base, numerous distribution channels and demonstrated growth," said Danny Goldberg, CEO of Air America Radio. "The quality of XM's other partnerships, their Washington, D.C. location and proximity to the center of our nation's political workings, along with millions of subscribers, made our decision easy." To this point, much of the scholarly work on political entertainment news has focused on examining its effects on viewers’ political attitudes and knowledge. A rhetorical analysis reveals the actual messages they convey and the strategies they employ to discuss contemporary American politics. MADDOW SUMMARY** Defamation / Anti-SLAAP Motion The panel affirmed the district court’s judgment granting Appellees’ motion to strike Herring Network, Inc.’s defamation complaint pursuant to California’s anti-SLAPP statute, and dismissing Herring Networks, Inc.’s defamation suit with prejudice. Herring launched One American News Network (OAN) in 2013. Rachel Maddow, host of a show on MSNBC, ran a segment stating that OAN employee Kristen Rouz worked for OAN, but was “also being paid by the Russian government to produce government-funded pro-Putin propaganda for a Russian government funded propaganda outfit called Sputnik.” Herring sued Maddow and related entities for defamation. Maddow filed a motion to strike the complaint pursuant to California’s anti-SLAPP statute, which the district court granted. The panel first addressed Herring’s argument that the district court should have considered five pieces of proffered evidence outside of the pleadings in determining whether to grant Maddow’s motion to strike. -

Online Journal of Communication and Media Technologies Volume: 2 – Issue: 3 – July - 2012 Name Brand: The Rise of the Independent Reporter through Social Media Dr. Brad Schultz, University of Mississippi Dr. Mary Lou Sheffer, University of Southern Mississippi, USA Abstract A theory of branding was applied to news reporters to assess if conditions are right for them to create a personal brand, as opposed to the news brand of their outlet. Attitudinal data were collected through a purposive survey of television and newspaper reporters across the U.S. Results suggested that while reporters are not actively trying to brand themselves, the conditions are ripe for personal branding to take place. Several environmental factors would need to change before such change could occur. © Online Journal of Communication and Media Technologies 93 Online Journal of Communication and Media Technologies Volume: 2 – Issue: 3 – July - 2012 One of the hallmarks of modern society is the concept of celebrity, which has become “an omnipresent feature of contemporary society, blazing lasting impressions in the memories of all who cross its path” (Kurzman, Anderson, Key, Lee, Moloney, Silver & Van Ryn, 2007, 347). Celebrity includes the concepts of privilege and status, but goes beyond them. Sociologists argue that today, “Celebrity is status on speed. Metaphorical Violence in Political Discourse Matthew A. Turner1,*, Paul P. Email: [email protected] Metaphor is more than a literary device. It is a fundamental cognitive ability that drives the capacity to reason about state and actions in the world [1, 2]. Metaphor—which involves under- standing of abstract concepts in terms of more basic ones—permeates political discourse [3, 4]. Its ubiquity is evident in the frequent use of statements such as “It’s time to drain the swamp”, “Obama sprinted toward victory on Election Day”, and “Trump attacks Jeff Sessions over Russian probe methods”. No one is releasing water, running, or causing physical harm. How is metaphor- ical violence expressed, for instance, expressions with words such as “attack”, “slaughter”, and “hit”, and how does it influence political thought and communication? Here, we describe novel time-resolved observations and explanatory dynamical models of the use of metaphorical violence language in political discourse on U.S. cable television news in the period leading up to the two most recent presidential elections. Our results quantify the details and dynamics of the use of these metaphors, revealing how cable news shows act as reporters, promoters, expectation-setters, and ideological agents in different degrees in response to differing cultural situations. Our workhas implications for shaping political discourse and influencing political attitudes. Conceptual metaphor theory holds that metaphorical statements, such as “Costs are rising,” involve structuring one concept in terms of another; in this case, costs are conceptualized in terms of physical verticality. -

A Collection of Essays TEN YEARS OF THE CLINTON PRESIDENTIAL CENTER 2004 – 2014 AN IMPACT THAT ENDURES By Chelsea Clinton When my family left the White House, my father faced a set of questions and opportunities about how to continue the work he had long championed through elected office as a private citizen. As he has said, while President, he confronted a seemingly endless horizon of challenges on any given day. Through the Clinton Foundation and its various initiatives, by necessity and deliberate choice, he has focused on tackling those urgent challenges which can be addressed outside government and on which he, and now our whole family, can have the most significant impact. What has not changed is what has always motivated my father —will people be better off when he’s done than when he started. I am grateful he hasn’t stopped yet—and has no plans to do so. The collection of essays that follows offers a window onto the various ways in which my father has served, in and out of elected office, and in the United States and around the world. Common threads emerge, in addition to how he keeps score of his own life, including a fearlessness to take on ostensibly impossible issues, a determination to see things through until the end and a belief that every success only contains another challenge to do things better next time. Because, as my father knows all too well, all too often there is a next time. The latter half of 2014 has been momentous in our family as Marc and I welcomed our daughter Charlotte into the world and my parents (finally) became grandparents.
