www.nriaeb5.net Introduction to EB-5 Immigration Visa

The EB-5 Program is an investment based immigration program designed to allow foreign investors who invest in the and create jobs for American workers to gain permanent residence (a “green card”) in the United States.

An EB-5 visa applicant who invests $900,000 to $1,800,000 depending on the project (plus an administration fee along with separate legal fees and USCIS fees) in a targeted employment area can attain their permanent residency green card for themselves, their spouse, and their children under 21. Qualifying “investments” must result in the creation of 10 full-time jobs for U.S. workers. Some of the most popular immigration investment programs in the United States are located in the Metro area, San Francisco, Philadelphia and Southern .

Currently How EB-5 Investment Works

INVEST CREATE RECEIVE $900K to $1.8M 10 Jobs Green Card In a qualified11 project +=Create 10 jobs in Obtain U.S. permanent (plus Admin fees, 2 years through resident status or Attorney fees, your investment in a “green card” and USCIS fees) NRIA Real Estate

The most secure type of investment an EB-5 visa applicant can invest in is a real estate development that is “certified” by an economist to create 10 U.S. jobs per investment. All NRIA projects are economist certified to meet this job creation requirement.

When the investor’s initial application is approved, the investor can stay in the U.S. and apply for conditional residence. The conditional residence lasts two years. After two years, the investor can apply to have the conditions removed and have the conditional residency made permanent, but only if the investment has resulted in the creation of a minimum of 10 jobs, as required, which NRIA projects do.

If you are investing in one of NRIA’s projects, here is a summary of the EB-5 process and what EB-5 investors need to have to get an EB-5 Visa: • You need a minimum of $900,000 available to invest plus administration fees ($50,000), attorney fees and USCIS fees in U.S. currency verified available to invest. You may secure your spot with $200,000 down and a promissory note against Real Estate. • The investor must verify the investment and prove that the investment capital came from a lawful source. • Discounts may be available when you speak with us directly to discuss your case. • There is a waiting period to receive your I-526 approval and 2 year conditional green card. This varies by your country of origin. Your 2 year green card is then followed through with a 10 year permanent card during which time you are eligible to become a US citizen. Also, if you are here on an H1B, you may renew and stay during your wait. Your recommended EB-5 attorney will customize this timeline and process with you once all required documentation is reviewed. • It is required that you pass a standard government background check for criminal, political or financial activities.

What EB-5 investors need to do to invest in our EB-5 projects for EB-5 Visas:

• Set-up an initial consultation with NRIA EB-5 to discuss your case. • Submit your financial overview information to NRIA EB-5 to determine your EB-5 qualifications. • Contact and schedule a conference call with your recommended EB-5 attorney. • Hire your EB-5 immigration attorney and submit actual documents. • Request and read your EB-5 project documents. Ask us any necessary questions. • Sign the EB-5 project subscription documents. • Transfer the $900,000 to $1,800,000 plus required fees into an escrow account where the funds are held safely by a third party. • Prepare a source of funds report. • File your I-526 petition through your recommended immigration attorney.

Planning Your EB-5 Investment EB-5 investment offerings vary. What’s great about NRIA EB-5 projects are that they are small to medium sized residential real estate development projects statically located in U.S. to sell out quickly. They are in super high demand markets like Northern NJ, New York, Philadelphia PA, and Palm Beach County, Florida, and they are not the 1 Billion dollar high risk projects. NRIA’s EB-5 consultants will evaluate your situation and present the best EB-5 investment location for your safe project investment. www.nriaeb5.net NRIA NATIONAL REALTY INVESTMENT ADVISORS 9 © National Realty Investment Advisors EB-5 Visa Program EB-5 Program Frequent Questions

What is the EB-5 Visa Program? The EB-5 Visa program is sometimes called the “Golden Visa” and was created by the United States Congress in 1990 to help stimulate the U.S. economy while also providing a unique opportunity for foreign investors to obtain a permanent residency “Green Card” in the United States.

What does the Foreign Investor need to do? In order to qualify for the EB-5 visa, a foreign investor needs to invest $900,000 to $1,800,000 (depending on the project) plus administrative, attorney and USCIS fees in a targeted employment area; known as a “Regional Center”. The Regional Center that NRIA is working with is the NYC Transportation Regional Center which is focused on one of the most desirable locations in the world: The New York City Metropolitan Area. We also however, have prime opportunities in Palm Beach County, Florida and Philadelphia from time to time.

Is that it? All I need to do is invest at least $900,000? In addition to investing a minimum of $900,000 (plus administrative, attorney and USCIS fees) in a Targeted Employment Area (TEA), the investment must also create at least 10 jobs over 2 years in that Regional Center. All NRIA projects are economist certified as job creators.

And is it only the investor who gets a Green Card? Once the investment and application process are completed, the investor should be approved. The investor, their spouse and any of their children under 21 years of age are all eligible for a permanent residency Green Card.

If I'm on a H1B Visa and want to apply for an EB-5 Visa, does the $900,000 to $1,800,000 have to come from an overseas account? No, as long as money is in a USA Verifiable account you can utilize those funds.

Do I need to be an Accredited Investor? If your primary residency is not in the United States, you do not have to have accredited investor status. If your primary residence is in the United States, then you do have to be an accredited investor. For US persons, an Accredited Investor must generally meet the following criteria: A. Net worth, or joint net worth with that person's spouse, exceeding $1,000,000– excluding the primary residence. B An individual with income exceeding $200,000 in each of the two most recent years or a joint income together with their spouse exceeding $300,000 in each of those years with likelihood of continuance. (US based persons please see: www.sec.gov/fast-answers/answers-accredhtm.html for a full definition of the term “accredited investor” and seek your NRIA advisors assistance in understanding your compliance requirements)

How long does this process usually take? Typically, from the time you first apply for your EB-5 Visa through NRIA’s EB-5 Visa program, it can take up to 2-3 yearsto receive your conditional Green Card. However, time frames do vary by country of origin. Our recommended EB-5 Attorney can counsel you on the price situation for your country and circumstances.

What happens after 2 years? Is it complicated? Typically, after you receive your conditional green card it could take another 1-3 years before all restrictions and conditions are removed from your Conditional Green Card status. Although this process might seem complicated, the NRIA EB-5 program helps make the process as smooth as possible for you from start to finish, also your referred attorney will follow through on all vital aspect of your EB-5 application from the beginning to completion.

What are the advantages of an EB-5 Visa versus other paths to permanent residency? There are many advantages to an EB-5 Visa over other visas. For example: There are no specific educational or technical requirements necessary; you have the freedom to work and live anywhere in the U.S. you wish; you need not prove every 3 years you are the only person who can perform a special job – as with the H1B visa; it’s easy to apply; and you get your initial $900,000 to $1,800,000 investment back plus interest after 5 years.

Are there any fees? Yes, the Administration Fee is $50,000 that is assessed by various service providers in addition to the immigration attorney fees and USCIS fees. Discounts may be available if you speak with us directly to discuss your case.

Do I need to hire an attorney? Yes, NRIA EB-5 consultants will help you every step of the way and will also recommend to you excellent legal representation through one of the East Coast’s leading legal authorities on the EB-5 process.

What happens if I am not accepted? If your I-526 petition is not approved after we have accepted you, for any reason, NRIA EB-5 will refund your $900,000 to $1,800,000 capital investment and $50,000 Administration fees.

Why would I choose NRIA? NRIA is one of the East Coast’s leading midsized developers.
