APPROVED DECISIONS OF THE MEETING OF HERITAGE WESTERN CAPE, BUILT ENVIRONMENT AND LANDSCAPE PERMIT COMMITTEE (BELCom) Held on Wednesday, 28 September 2016 at the 1st Floor Boardroom, at the Offices of the Department of Cultural Affairs and Sport, Protea Assurance Building, Greenmarket Square, Cape Town at 09:00 6. Administrative Matters 8.1 Outcome of Appeals and Tribunals It was noted that there were five Tribunal matters and that no decisions had been made on these matters. PM 8.2 Report back on Stop Works Orders and Charges There were no new matters to report. 8.3 Formal Protection of Buildings Refused for Demolition It was noted that this matter is in the process of being addressed. 8.4 Workshop on Guidelines for Heritage Statements It was recommended that this matter be held over for the next term of the Committee 8.5 St Mary’s Church, Stellenbosch It was noted that there was no further progress to report. PM 8.6 Erf 2231, 165 Main Road, Paarl DECISION The Committee resolved that the information submitted is totally inadequate for the following reasons: A set of measured drawings must include a set of plans, sections and elevations of each building. The drawings must clearly indicate a distinction between original fabric and recent work. A set of approved local authority plans must be submitted with reference to the above. The drawings must be cross referenced to a full set of photographs of each building illustrating the nature and extent of unauthorized work. Photographs of the re-plastering of the boundary wall between erf 2231 and the Strooidak Church property must be included. The purpose of the above mentioned information is for the Committee to determine the extent of impact of the unauthorized work on heritage significance. Approved BELCom Decisions_28 September 2016 1 This information must be submitted to HWC within 30 days of the date of notice, failing which the Committee will recommend that charges be laid. WD 8.7 Farm 727 Joostenbergvlakte De Novo, Kraaifontein This matter was dealt with under item 12.5. WD 8.8 Additional BELCom Meetings It was agreed that an additional Committee meeting will be held on the 11th October 2016 in order to complete the agenda for the September meeting It was also agreed that, if necessary, an additional Committee meeting will be held on the 31st October 2016 in order to complete the agenda for the October meeting scheduled for the 26th October 2016. 8.9 Erf 5010, the Castle of Good Hope, Buitenkant Street, Cape Town This matter was dealt with under item 11.4 HB 8.10 Illegal work, Erf 46364, 24 Avenue Road, Newlands It was noted that stop works orders had been issued by HWC and the CoCT and that these had been ignored by the owner and the contractor. The Committee recommended that HWC lay charges against the owner. HB 8.11 Groot Phesantekraal Plaas Trust The Committee resolved to refuse the request for a site inspection and to reiterate the request for reasons why the permit must not be revoked. Written reasons must be submitted to HWC within 7 days of the date of notice. JW 8.12 Rhodes Statue The Committee requested that UCT be notified as a matter of urgency of its obligations to inform I&APs of the supplementary report and to make available to all parties a full set of the documentation accompanying the Section 27 application. It is intended that the matter be tabled on the 31st October 2016. HB Approved BELCom Decisions_28 September 2016 2 8.13 Conduct of Conservation Bodies The Committee recommended that HWC write to all conservation bodies explaining its position on the requirements for consultation. 10. Appointments 10.1 None MATTERS DISCUSSED 11 PROVINCIAL HERITAGE SITES: SECTION 27 PERMIT APPLICATIONS 11.1 Proposed Additions to Existing Structure on Erf 2380, 127 Main Road Paarl: MA HM/CAPE WINELANDS/DRAKENSTEIN/PAARL/ERF 2380 Case No: 16051008HB0511M DECISION The Committee is unable to condone unauthorised work. While the majority of the unauthorised work has not impacted heritage significance the Committee is of the opinion that the concrete deck has impacted the overall architectural integrity of the building The Committee recommends that a compulsory repair order be issued in terms of S45 (1) to remove the concrete deck and columns. The Committee also recommends that a discussion be held between HWC officials and the CEO regarding the laying of charges. The Committee requires the submission of revised plans including the the proposed loft interventions and the removal of the concrete decks and columns. HB 11.2 Proposed Revised Alterations for Agricultural Shed on Farm D' Olyfboom, Farm 29112, 14 Napier Street Paarl: NM HM/PAARL/FARM 29112 Case No: 16090602AS0907E This matter will be dealt with on the 11 October 2016 meeting. AS 11.3 Proposed Alteration & Additions to Erf 5357, Corner Alexander & Bird Streets, Stellenbosch: MA HM/ CAPE WINELANDS / STELLENBOSCH /ERF 5357 Case No: 16090506HB0907M DECISION The Committee resolved to conduct a site visit (SW, GJ, SH, PB and MS). HB Approved BELCom Decisions_28 September 2016 3 11.4 Erf 5010, the Castle of Good Hope, Buitenkant Street, Cape Town: MA DECISION The Committee requested that the method statement and drawings prepared by Gabriel Fagan Architects be circulated for a decision by e-mail and that a site inspection be undertaken to review all completed work. The Committee recommended that the CEO of the Castle Control Board and HWC meet to discuss the preparation of a Conservation Management Plan and Heritage Agreement in order to assist with on-going management of the site. HB 12 STRUCTURES OLDER THAN 60 YEARS: SECTION 34 PERMIT FOR TOTAL DEMOLITION 12.1 Proposed Total Demolition to Erf 34073, 5 Boeschoten Road, Athlone: MA HM/CAPE METROPOLITAN/ATHLONE/ERF 34073 Case No: 16082901JW0806E DECISION The Committee noted that the building is identified in the CoCT ISIS grading system as not conservation worthy. The Committee agreed that the building is not conservation worthy and resolved to approve the total demolition. The building is not a good example of the typology and is also isolated from the grouping of wood and iron structures in Athlone. JW 12.2 Proposed Total Demolition to Erf 207 69 Long Street, Piketberg: MA HM/BERGRIVER/PIKETBERG/ERF 207 Case No: 15080502JW0806E DECISION The Committee noted that there is a dispute between the applicant and the objectors whether the requirements of the High Court Order have been met. The Committee resolved to defer making a decision on the application until the dispute has been resolved. JW 12.3 Proposed Total Demolition, Erf 1487 - 15 Davenport Road, Vredehoek: MA HM/ CAPE TOWN METROPOLITAN/ VREDEHOEK / ERF 1487 Case No: 16031526WD0810E DECISION The Committee resolved not to approve the sketch proposals due to concerns with the scale and form of the proposed building and the impact that it will have on the surrounding heritage context consisting predominantly of two storey buildings. Approved BELCom Decisions_28 September 2016 4 Revised proposals must be submitted which must be accompanied by an accurate indication of the scale of the building in relation to existing street levels and surrounding buildings Revised proposals must be accompanied by an indication of the roof form and how this relates to the surrounding roof scape, as well as the indication of street interface and materials. The Committee is of the opinion that an accurate model would assist in assessing the appropriate response of the scale and form of the new building in relation to its heritage context. WD 12.4 Proposed Total Demolition - Erf 1186 - 19 A Cumming Street: Wellington: MA HM/ CAPE WINELANDS/ DRAKENSTEIN/ WELLINGTON/ ERF 1186 Case No: 16072701WD0810E DECISION The Committee decided that the building is not worthy of formal protection. While it contains some good period elements, these do not contribute to significance to a degree that would warrant inclusion of the building in HWC’s heritage register. The Committee resolved to approve the total demolition. WD 12.5 Total Demolition - Portion 10 Of Farm 727 Joostenbergvlakte De Novo – Kraaifontein: MA HM/ CAPE TOWN METROPOLITAN/ KRAAFONTEIN/ PORTION 10 OF FARM 727 JOOSTENBERGVLAKTE DE NOVO Case No: 130918TG24M DECISION The Committee resolved to request a public participation process including making available the current heritage statement to I&APs for comment. The outcome of this consultation process must be incorporated into an updated heritage statement. The up dated heritage statement must expand and clarify social historical issues with particular emphasis on social historical issues raised during the consultation process. Given the urgency of the matter, the parties present agreed to submit the outstanding documentation including I&AP comment for consideration at the additional BELCom meeting to be held on 11th October 2016. WD 12.6 Proposed Total Demolition of two structures on Erven 1788 and 1799, 12 and 14 Constantia Road, Tamboerskloof: MA HM/TAMBOERSKLOOF/ERVEN 1788 AND 1799 Case No: 16060110GT0810E Approved BELCom Decisions_28 September 2016 5 DECISION The Committee is of the opinion that the buildings are located within a significant streetscape. The buildings have been altered and their contribution to the streetscape character lies in their scale and architectural form, set-back and boundary treatment. They do not retain sufficient heritage significance to warrant placement on the heritage register. The Committee supports the demolition in principal on condition that the redevelopment of the properties is sympathetic to the streetscape character. A permit for demolition will not be issued until Heritage Western Cape has approved a set of heritage related design indicators and subsequent design. AS 13 STRUCTURES OLDER THAN 60 YEARS: SECTION 34 PERMIT FOR PARTIAL DEMOLITION/ALTERATIONS 13.1 Proposed Partial Demolition & New Building on Erf 149274, Ptn Erf 148549, "Old Breakwater Jail", 9 Portswood Road, Green Point: MA HM/CAPE METROPOLITAN/GREEN POINT/ERF 149274, PTN ERF 148549 Case No: 16070802HB0714E DECISION The Committee resolved to approve the proposals subject to the further resolution of the visual simplification of the upper floor as indicated on the south elevation drawings.
