Message by DC cum Chairman, Governing Council and Managing Committee, District Mineral Foundation Trust, Sahibganj

District Mineral Foundation (DMF) is a trust set up as a non-profit body, in those districts where development of local inhabitants, both socially and financially, can be possible through funding of mining industry.

This has been set up to work for the interest and benefit of persons and areas of mining related operations. It is funded through the royalty contributions from mining companies. It was mandated through the Mines and Minerals (Development & Regulation) Act, 1957 (Amendment in 2015). In this regard, DMF Trust, Sahibganj was registered on 20.05.2016 and is continuing to work for the developmental needs of people of areas near the mining industry.

DMF funds are treated as extra-budgetary resources for the State Plan. Efforts are made to achieve convergence with the State and the District Plans so that the activities taken up by the DMF can supplement the development and welfare activities already being carried out.

Further, the Pradhan Mantri Khanij Kshetra Kalyan Yojana (PMKKKY) will be implemented by the DMF. The overall objective of PMKKKY scheme will be (a) to implement various developmental and welfare projects/programs in mining affected areas. These projects/ programs will be complimenting the existing ongoing schemes/projects of State and Central Government; (b) to minimize/mitigate the adverse impacts, during and after mining, on the environment, health and socio-economics of people in mining districts; and (c) to ensure long term sustainable livelihoods for the affected people in mining areas.

Last but not the least, the more and more numbers of new leases of Minor as well as Major Minerals granted, it will reciprocate the funding in DMF, which will speed up the development of local inhabitants as well as the district itself.

1. Executive Summary

This report discusses the objectives, planning, schemes undertaken and the achievements by the implementation of District Mineral Foundation Trust Fund utilised in .

The District Mineral Foundation (DMF) is a trust setup as a non-profit body established in those district s affected by mining works with an objective to work for the development of the people directly or indirectly affected by mining in the region. The trust is funded through the royalty fund collected by all the mining companies in the area.

DMF funds are treated as extra-budgetary resources for the State Plan. Efforts are made to achieve convergence with the State and the District Plans so that the activities taken up by the DMF can supplement the development and welfare activities already being carried out.

2. Overview of Sahibganj District

2.1 About District

The district of Sahibganj with a predominately tribal population is a part of and forms the easterm most tip of the division. The and sub division of old Santhal Pargana district were curved out on 17 th May, 1983 to form Sahibganj district. Sahibganj is the administrative head quarter of the district and situated on the bank of river . It is bounded on the north by rhe river

Ganges and district of Katihar (), on the south by the district , on the east by Maldah and

Murshidabad districts of the state of , and on the west by and .

Sahibganj district ranks thirteenth in terms of total population in the state and thirteenth in regard to decadal population growth rate (2001-11) among the twenty-four districts. With a sex ratio of 952,it ranks fifteenth in the state. The district of Sahibganj consists of 2 subdivisions, 09 blocks and 1819 villages. The district comprises of nine blocks namely, Sahibganj, , Borio, Barhait, , Rajmahal, ,

Pathna and .As per Census 2011,the district has 1349 revenue villages and 8 towns distributed in three assembly constituencies. Census 2011 figures indicated that the percentage share of scheduled caste population to total population was 6.29 percent while that of scheduled tribes was 26.80 percent.

Based on the number of the total rural households in Census 2011 and BPL Revision Survey of 2010-11 the percentage of BPL households in rural areas is 86.03 percent.

2.2 Connectivity facilities (Road, Railways and River) in Sahibganj District:-

The area is approachable by train from Bhagalpur (Bihar) and () via West Bengal by north-south running Howrah-Bhagalpur loop of Eastern Railway. The district can be approached from all sides by a network of metaled road. The National Highway 33 passes through the district. Nearest airport is Bagdogra Airport (Siliguri), approximately at a distance of 173 km. In the bank of Ganga River Mining effected areas , established Multi Model Terminal which is used for Inland waterways.

2.3 Major industries in the district:

China Clay, Stone Crusher, Sand Stone, Silica Sand, these are major industries in Sahibganj District.

There are 158 operating stone crusher mines and 3 operative china clay and flint mines presently (August 2018), in the district. This district provides approximately 5000 employment in the Mineral based industries, such as Fly Ash Bricks, Kiln Bricks, Mineral Grinding specially soap stone & Quartz, De-Hydrated Lime etc., which involves investment of approx. Rs. 809.97 Lakh. The are the source of building and road stones. Most of the quarrying is done by the side of the loop line of the Eastern Railway. Kaolin is found near Mangal Hat in Rajmahal subdivision. Bentonite is also available in some places, used as “Multani Mitti” and has great scope of export to other parts of the state of Jharkhand.

2.6 Administrative Set — up of District - The district of Sahibganj possesses two subdivision, viz., Sahibganj and Rajmahal and over 9 C.D. Blocks and only two statutory town and six census towns. The district is in Santhal Pargana division which is in turn, under Jharkhand state (which has five divisions, e.g. North Chotanagpur, South Chotanagpur, Santhal Pargana, Palamu and Kolhan and was came out from erstwhile Bihar state on 15th November,2000). The district of Sahibganj consists of the following administrative and civic units:

The total number of villages in the district is 1813, of these 1349 are inhabited and 464 uninhabited. The district administration is headed by the Deputy Commissioner. He belongs to I.A.S. cadre. He also acts as the Collector in case of Revenue matters, as District Development Commissioner in case of District Developmental works, as District Magistrate in case of maintenance of Law and Order and General Administration, as District Election Officer in case of conduct of Election. He is assisted by a lot of officers mostly belonging to officials of Jharkhand Public Service Commission. Police Administration is looked after by the superintendent of the police (S.P.). In District, there 13 Police Station situated. He is also assisted by no. of officers like Assistant Superintendents of Police, Deputy Superintendent of Police, Inspector of Police, etc.

A. 3. District Mineral Foundation Trust

3.1 Vision DMF is implemented ffor benefit of the persons/Areas effected by Mining Related operations. To regulate this modal trust did notification issue vide Jharkhand Gazette No-854 Dated 24.11.2015. DMF is a people-centric vision of natural resource governance where their right to benefit has been put at the forefront. If developed and implemented well, DMFs not only have huge potential for improving the lives and livelihoods of some of the poorest communities, they can also be a model for inclusive governance.

DMFs have been instituted to be established as a non-profit Trust in every mining district of the country under the Mines and Minerals (Development and Regulation), Amendment Act, 2015. They have a precise and legally defined objective to work for the interest and benefit of persons and areas affected by mining-related operations.

It undertakes the following activities for this purpose:

a) Receive, maintain, manage, release and utilize the funds accrued

b) Plan, identify, design and undertake suitable welfare and developmental projects, following due procedure

c) Monitor and coordinate with various executing agencies at field level for successful implementation of projects taken up

d) Ensure convergence with ongoing/existing schemes/projects of State and Central Government

e) Identify and promote innovative solutions

f) Ensure regular and swift redressal of grievances

g) Coordinate with Mining Department (GoJ)

h) Any other work entrusted

3.2 Mission

The mission of the District Mineral Foundation (DMF) Trust is to “work for the welfare and development of mining affected communities”. The vision of the District Mineral Foundation (DMF) Trust is to “alleviate the adverse impacts of mining on communities and environment, and create sustainable development opportunities for current and future generations”. The DMF Trust is responsible for: a) the implementation of various welfare and developmental projects in mining affected areas b) minimizing/mitigating the adverse impacts, during and after mining, on the environment, health and socio-economics of the people in mining areas c) ensuring long term sustainable livelihoods for the affected people in mining areas

3.3 About Pradhan Mantri KhanijKshetra Kalyan Yojana (PMKKKY)

The Pradhan Mantri Khanij Kshetra Kalyan Yojana (PMKKKY) will be implemented by the District Mineral Foundations (DMFs) of the respective districts using the funds accruing to the DMF. The overall objective of PMKKKY scheme will be (a) to implement various developmental and welfare projects/programs in mining affected areas, and these projects/ programs will be complementing the existing ongoing schemes/projects of State and Central Government; (b) to minimize/mitigate the adverse impacts, during and after mining, on the environment, health and socio-economics of people in mining districts; and (c) to ensure long-term sustainable livelihoods for the affected people in mining areas.

3.4 Objectives of Pradhan Mantri Khanij Kshetra Kalyan Yojana

 To implement various developmental and welfare projects/programs in mining affected areas that complement the existing ongoing schemes/projects of State and Central Government.  To minimize/mitigate the adverse impacts, during and after mining, on the environment, health and socio-economics of people in mining districts  To ensure long-term sustainable livelihoods for the affected people in mining areas. Care has been taken to include all aspects of living, to ensure substantial improvement in the quality of life. High priority areas like drinking water supply, health care, sanitation, education, skill development, women and child care, welfare of aged and disabled people, skill development and environment conservation will get at least 60 % share of the funds. For creating a supportive and conducive living environment, balance funds will be spent on making roads, bridges, railways, waterways projects, irrigation and alternative energy sources. This way, government is facilitating mainstreaming of the people from lower strata of society, tribals and forest-dwellers who have no wherewithal and are affected the most from mining activities.

3.5 Governance and Management of DMFT

Establishing Deed for the DMFT

MMDR Amendment 2015 requires State Governments to establish District Mineral Foundation (DMF) as per section 9B, that will be used for development of mining affected people and the areas. All DMFs shall also implement Pradhan Mantri KhanijKshetra Kalyan Yojana (PMKKKY) notified on 16 September 2015. Accordingly, Government of Jharkhand issued a notification for constitution of DMF Trust in each district of Jharkhand on 24 November 2015 along with the details of the Governing Council and Managing Committees (Gazette No. 854 dated 07 December 2015). Further, Jharkhand District Mineral Foundation (Trust) Rules, 2016 was notified on 22 March 2016 (Gazette No. 218 dated 23 Mar 2016) and they were extended for minor minerals, too, on 13 January 2017. (Gazette No 109 dated 27 Jan 2017). These rules shall be deemed to have come into force on 12th January, 2015.

Governance and Organization Structure of the DMF Trus t The DMF Trust is headed by the District Collector who acts as the Chairperson-Cum-Managing Trustee. He is supported by a Board of Trustees. Deputy Development Commissioner acts as the Member Secretary for the DMF Trust and is responsible for the executive management. Government of Mining Department, Jharkhand have constituted the Board of Trustees of District Mineral Foundation for the District of Sahibganj vide Notification No. 236 dt. 06/01/2016. The Board of Trustees for the District Mineral Foundation Trust, Sahibganj are presented in the table below. DMFT, Sahibganj established according to above act. On 20.05.2016.

5. Planning and Allocation

5.1 Annual Planning Process

DMFT practice a bottom-up planning approach to understand people's needs and include such considerations in the DMF plan. As per provisions of Jharkhand DMFT Rules 2016, selection of schemes is to be done entirely by the Gram Sabha and as per provisions of PMKKKY guidelines. The Gram Sabha in consultation with the Mukhiya /Up-mukhiya has to identify works to be carried out under priority and other priority areas. The Managing Committee does not have any overriding power on selection or approval of the schemes.
