Background Facts and Proceedings Nath, who is sixty-nine years old, was a part-time employee of Shopko. The events appeared to have taken place during the transition stage after Pamida Stores Operating Co., L.L.C. had been sold to Shopko Stores Operating Co., L.L.C. No request was made to separate the liability of the two parties, and both will be referred to as Shopko.
