    ALYSON MILLER Examining hoax memoirs by James Frey (2003), Dave Pelzer (1995), and Kathy O'Beirne (2006), this paper illustrates how anxieties about the inability of representation to provide a direct access to truth are mitigated via an emotional connection with the text. While the degree of faking varies, each scandal reveals concerns about authenticity and the need to find—or feel—something that can be accepted as unquestionably 'true'. The mimicking performed by a fake unsettles the boundaries between fact and fiction to reveal a public investment in an undisturbed effect of the real, a willingness to accept a blurring of 'truth' in the interests of the sensational experience of literature. THE PORIOGRAPHY OF TR.uMA: FAKflG IDEiTITY IM 'MISERY MEMOIRS' In the contemporary literary market, the immense popularity of a genre termed the 'misery memoir' explicitly demonstrates a public infatuation with confessions of trauma. Described by Frank Furedi as the "pornography of emotional hurt" ("An Emotional Striptease"), these memoirs focus on the outpourings of authors who have endured childhoods of horrific abuse, describing in agonising detail histories of domestic violence, incest, poverty, institutional cruelty, drug addiction, and sexual abuse.     A Million Little Pieces In 2003, publisher Doubleday released James Frey’s book A Million Little Pieces, marketing it as a memoir about Frey’s struggles with alcohol and drug addiction. In 2005, the book was selected for Oprah’s Book Club, in part for the inspiring and supposedly true story of Frey’s overcoming addiction. The publicity from The Oprah Winfrey Show sparked strong sales for the book, which topped bestseller lists in the following weeks. On January 8, 2006, investigative website The Smoking Gun published an exposé describing numerous exaggerations and fabrications in Frey’s account of his life story as written, creating controversy regarding the truthfulness of the book as a “memoir.” When Frey first appeared on The Oprah Winfrey Show in 2005, he emphasized his honesty: “If I was going to write a book that was true, and I was going to write a book that was honest, then I was going to have to write about myself in very negative ways.” As he did so, he expanded on falsehoods that appeared in the book. Frey and his publisher, Nan Talese, were unable to effectively refute The Smoking Gun allegations. When Winfrey invited Frey back on her show, she harangued him for lying, saying that she felt “duped” and that Frey had “betrayed millions of readers.” Talese described Winfrey’s rebuke of Frey as “mean and self-serving,” while critics of Frey saw him as opportunistic. Frey defended the right of authors and memoirists to draw upon their memories, not only upon documented facts: “I wanted the stories in the book to ebb and flow, to have dramatic arcs, to have the tension that all great stories require.” Authors and literary critics have echoed this sentiment, noting that memoirs are not necessarily the same genre as biographies or autobiographies.

INTRODUCTION Truthiness is “the quality of adhering to concepts one wishes or believes to be true, rather than the facts.”1 Comedian Stephen Colbert introduced the term on October 17, 2005, during the inaugural episode of The Colbert Report, itself a blurring of news and satire. As the inception of truthiness coincided with the scandal surrounding James Frey’s so-called memoir, A Million Little Pieces,2 the term has previously been applied to the issues addressed herein.3 In this Note, I explore the legal and literary impact of James Frey’s A Million Little Pieces, analyzing memoir through the lens of truthiness. First, I sketch a brief literary history of autobiography and memoir, from the genre’s first examples through its most recent developments. Second, I consider the role of the law in literary realms, examining lawsuits involving autobiographies and/or memoirs.
