    1 The Cultural Paradigms of British Imperialism in the Militarisation of Scotland and North America, c.1745-1775. Nicola Martin Date of Submission: 24th September 2018 This thesis is submitted in fulfilment of the requirements for the degree of Doctor of Philosophy Faculty of Arts and Humanities University of Stirling 2 3 Abstract This dissertation examines militarisation in Scotland and North America from the Jacobite Uprising of 1745-46 to the outbreak of the American Revolutionary War in 1775. Employing a biographical, case study approach, it investigates the cultural paradigms guiding the actions and understandings of British Army officers as they waged war, pacified hostile peoples, and attempted to assimilate ‘other’ population groups within the British Empire. In doing so, it demonstrates the impact of the Jacobite Uprising on British imperialism in North America and the role of militarisation in affecting the imperial attitudes of military officers during a transformative period of imperial expansion, areas underexplored in the current historiography. It argues that militarisation caused several paradigm shifts that fundamentally altered how officers viewed imperial populations and implemented empire in geographical fringes. Changes in attitude led to the development of a markedly different understanding of imperial loyalty and identity. Civilising savages became less important as officers moved away from the assimilation of ‘other’ populations towards their accommodation within the empire. Concurrently, the status of colonial settlers as Britons was contested due to their perceived disloyalty during and after the French and Indian War. ‘Othering’ colonial settlers, officers questioned the sustainability of an ‘empire of negotiation’ and began advocating for imperial reform, including closer regulation of the thirteen colonies.

Introduction The Common Law Program at Université René Descartes in Paris introduces students trained in the civil law to common law doctrine and legal method through a series of English-language mini-courses offered every other week by visiting faculty from common law countries throughout the world. Beginning in the 2001–02 academic year through Fall, 2007, I had the honor and pleasure of teaching the opening course in this program.1 My pedagogic goals in this course included: • Introduce the students to fundamental elements of common law legal method in order to better prepare them for all the common law courses; • Use the issue of reciprocal inducement, within the common law doctrine of consideration, as both a vehicle for developing facility with legal method and as an exercise in comparative law; and • Expose students to both traditional and innovative American teaching techniques, as a further means of providing students with a comparative experience. To meet these goals, I led the students in a number of interactive exercises, some of them set in non-legal contexts so that the students focused all their attention on the legal method those exercises illustrated. Whether set in legal or non-legal contexts, these exercises required students to recognize and accept uncertainty in legal disputes, appreciate the role of stare decisis, and develop opposing arguments from facts and precedent. This study argues that a series of events of violent antislavery and southern perceptions of northern support for them caused white southerners to rethink the value of the Union and their place in it. John Brown’s raid at Harpers Ferry, Virginia, and northern expressions of personal support for Brown brought the Union into question in white southern eyes. White southerners were shocked when Republican governors in northern states acted to protect members of John Brown’s organization from prosecution in Virginia. Southern states invested large sums of money in their militia forces, and explored laws to control potentially dangerous populations such as northern travelling salesmen, whites “tampering” with slaves, and free African-Americans. Many Republicans endorsed a book by Hinton Rowan Helper which southerners believed encouraged antislavery violence and a Senate committee investigated whether an antislavery conspiracy had existed before Harpers Ferry. In the summer of 1860, a series of unexplained fires in Texas exacerbated white southern fear. As the presidential election approached in 1860, white southerners hoped for northern voters to repudiate the Republicans. When northern voters did not, white southerners generally rejected the Union.
